Re: Change in By-laws At the request of the City Manager, the Board of Appeals conducted a meeting on February 26, 1981 to review the current by-laws and incorporate in the by-laws a time period for which a member can serve. It is my understanding that any by-law changes by any board or commission must be reviewed by the Rules Committee. This memorandum is to indicate to you that after the Board's review the by-laws stayed intact, however, an additional item no. 16 was added to place a maximum length•of term of five years for any Board member to serve. The Board alsofeltthat they should establish a termination period, so, they indicated that terms should expire on alternating years and because of the numerous vacancies we have had in the past three or four years, the Board also decided to incorporate no limit as the number of appointees in any one given year. I would appreciate the committee members acting upon this by-law change at their next regularly scheduled meeting so we can incorporate this new by- law should there be need to appoint someone in the near future. If you should need any additional information concerning the by-law changes or have any comment concerning the existing by-laws, please do not hesitate to contact me. The Board of Appeals shall meet at the call of the chairperson, or when requested by the building official. 2. The chairperson of the Board of Appeals shall be elected by a majority of the entire regular membership at the first meeting of each calendar year, to serve for a term of one calendar year. A vice -chairperson shall be elected in the same manner at the same time for a term of one j calendar year. 3. The chairperson of the Board of Appeals shall preside at all meetings, shall conduct all hearings, and exercise and perform such other powers and duties as may be from time to time assigned to him or her by the Board of Appeals or prescribed by the bylaws. In presiding at meetings and hearings, the chairperson shall rule on procedure and on order of presentation. 4. A quorum ofdthe Board of Appeals shall be any three (3) members. 5. The Board shall be the judge of the qualifications of persons appearing as expert witnesses and shall be empowered to refuse to receive the testimony of any purported expert not so qualified. 6. In the absence or the disability of the chairperson, the vice - chairperson shall perform all the duties of the chairperson and when so acting shall have all the powers of, and be subject to all the restrictions upon, the chairperson. 7. In the absence of both the chairperson and the vice -chairperson of the Board of Appeals, a chairperson pro tempore shall be elected from among those regular members present by a majority vote of all the board present. $. Should any member have knowledge of any facts which may constitute a conflict of interest in his consideration of any appeal, he/she shall forthwith notify the building official and the chairperson, of said fact. 9. The building official shall be the secretary of the Board, and shall keep, or cause to be kept, minutes of the proceedings'of the Board of Appeals and shall prepare an agenda for each meeting which shall be furnished members prior to the actual hour of the meeting. The secretary shall, in addition, be custodian of the records of the Board of Appeals and shall, upon the filing of an appeal, furnish each regular member with a copy of the letter of appeal. 10. Appeals from decisions of the building official shall be in writing, shall be directed to a specific decision of the building official and consideration of said appeal by the Board of Appeals shall be limited to the said specific decision. ��+ j MICROFILMED BY 'JORM MICRO_ LAB 'CEDAR RAPIDS -DES MOINES 11. Appeals will be heard at meetings called pursuant to law by the presiding officer or by a majority of the members of the Board. Hearings sha11 be scheduled within thirty (30) days of the receipt of a written appeal,.unless both the appellant and the chairperson agree to a continuance. 12. The decision of the Board of Appeals on an appeal shall be final. 13. Decisions rendered by the Board shall be in writing and shall state the reason or reasons for the decision. 14. The Board of Appeals shall not hold executive sessions, unless authorized by law. 15. These bylaws may be amended by a vote of four of the regular members of the Board of Appeals, subject to the approval of the Council. 16. The length of term for a board member shall be five (5) years, one (1) term expiring every year with no maximum of appointments in any one (1) year. Revised March 19, 1981 j MICROFILMED BY 'JORM MICRO_ LAB CEDAR RAPIDS•DES MOINES 4wa ■ City of Iowa City f MEMORANDUM Date: March 24, 1981 To: Honorable Mayor and City Council From: James Brachtel, Traffic Enginee� Re: Parking Prohibition on Seventh Avenue at Jackson Street As directed by Section 23-16 of the Municipal Code of Iowa City this is to advise you of the following action: ACTION: Pursuant to Section 23-234 of the Municipal Code of Iowa City the City Traffic Engineer will direct that signs be repositioned on the west side of Seventh Avenue so that the existing No Parking Here to Corner zone which extends from the intersection of Jackson Street with Seventh Avenue north from Jackson Street 50 feet will be expanded so that the No Parking Here to Corner zone will be 140 feet long. This action will take place on or shortly after April 9, 1981. COMMENT: This action is being taken at the request of the Iowa City transit system. It is felt that the extension of the No Parking Here to Corner zone as shown on the accompanying drawing will facilitate the maneuvering of Iowa City transit coaches at this intersection. ACTION: Pursuant to Section 23-289 of the Municipal Code the City Traffic Engineer will authorize the removal of parking meters I195, I197, I199, I201 and I203.',Further, the City Traffic Engineer will direct that these meters be replaced by signs creating a commercial vehicle loading zone with a maximum time period of 30 minutes. Further, signs will be erected requiring parallel standing. This action will take place on or shortly after April 16, 1981.
