a. Hold a public hearing to consider the vacation of right-of-
way along the original alignment of Foster Road and St.
Ann's Drive between Buresh Avenue and Prairie du Chien Road.
Comment: The Planning and Zoning Commission, at a regular
meeting held March 5, 1981, recommended by a 5-0 vote that
the right-of-way along the original alignment of Foster Road
be reduced from 66 to 55 feet and that the City retain a
uniform 40 foot right-of-way along St. Ann's Drive. This
recommendation is consistent with the staff's recommendation
presented in a staff report dated March 5, 1981, which was
attached to the Council agenda of March 24, 1981.

b. Consider a recommendation of the Planning and Zoning Commission
to rezone a two -acre tract from R3 located on the west side
of Emerald Street between Melrose Avenue and West Benton
Street. Z-8102.
Comment: The Planning and Zoning Commission, at a regular
meeting held April 16, 1981, recommended by a 7-0 vote to
approve the subject rezoning. The Commission also recommended
by unanimous vote that the City enter into an agreement and
protective covenant whereby the applicant recognizes the
intent of the City to rezone the entire tract to a more
restrictive zoning category in its forthcoming revised
zoning ordinance and agrees not to expand the use of the
property beyond 158 units in existence upon the date of the
rezoning.
A copy of this agreement and protective covenant is included
in the Council packet for your information. This document
has been reviewed and found to be in acceptable form by the
Legal Department. These recommendations are not totally
consistent with the staff's recommendation presented in a
staff report dated March 24, 1981, which is attached to the
Council's agenda.
Action:
c. Consider setting a public hearing for June 2, 1981, to
consider rezoning a two acre tract of land from R3 to R3A
located on the west side of Emerald Street between Melrose
Avenue and West Benton Street. Z-8102.

to approve the preliminary and final plat and planned area
development of Regency Gardens. S-8104.
Comment: The Planning and Zoning Commission, at a regular
meeting held April 16, 1981, recommended by a 7-0 vote to
approve the preliminary and final plat and planned area
development of Regency Gardens located west of Mark IV
Apartments and south of Westwinds development subject to the
following: 1) the signatures of the utility companies being
provided; 2) the legal papers being revised; 3) the easement
line shown on Lot 6 being denoted; 4) the driveways being
located 18 feet apart at the curb line or the street beinq
posted No Parking; 5) the drainage course for the stormwater
management being shown on the preliminary plans; and 6) the
PAD ordinance meeting all ordinances at the time the PAD is
adopted by City Council.
This recommendation is consistent with the staff's recommenda-
tion presented in a staff report dated April 2, 1981, which
i s.attached to the Council's agenda. A public hearing is
scheduled to be held on the planned area development on May
19, 1981. A letter from the developer's attorney, Tom
Cilek, is included in the correspondence on the Consent
Calendar requesting that the Council give the first considera-
tion to the ordinance approving this development at the time
of the public hearing.

e. Consider a recommendation of the Planning and Zoning Commission
to amend Section 8.10.20D.2 and 8.10.20E.2 of the Code of
Ordinances of Iowa City (Planned Area Development Ordinance).
Comment: The Planning and Zoning Commission, at a regular
meeting held April 16, 1981, recommended by a 7-1 vote to
amend Sections 8.10.20D.2 and 8.10.20E.2 of the Planned Area
Development Ordinance to permit the calculation of density
by dwelling units, rather than population, and on the basis
of the least restrictive use within a Planned Area Development.
For example, under the R3 zone classification, the flexibility
provided by the subject amendment would allow approval of a
PAD with a density range between 3,000 square feet per unit
to 5,000 square feet per unit depending upon the character
of the development. This recommendation is consistent with
the staff's recommendation. A public hearing is scheduled
on this item for May 19, 1981. A copy of the ordinance is
included in the Council packet.

f. Consider a recommendation of the Planning and Zoning Commission
that the recommendations of the Melrose Corridor Committee
be approved.
Comment: The Planning and Zoning Commission, at a regular
meeting held April 16, 1981, recommended by a 7-0 vote to
approve the following recommendations of the Melrose Corridor
Committee.
The Committee finds, based on information presented to us
including traffic counts and films, and our ensuing discus-
sions, that there does not appear to be unacceptable traffic
congestion in the Melrose Corridor at this time. Therefore,
the Committee makes the following recommendations.
1. That the implementation of the Melrose traffic circle
not be considered as a future option to solve traffic
problems in the area.
2. That the currently planned widening of the South
Ryington/Grand Avenue intersection to two lanes would
appear to he an adequate improvement to meet the
current traffic needs.

3. That further improvements need to be considered to
accommodate pedestrian traffic on Melrose Court and
across Melrose Avenue at Melrose Court and to specifi-
cally reconsider our previous recommendations con-
cerning these issues.
4. That if in the future increased traffic demands on the
Melrose Corridor would necessitate a major new traffic
facility, then the Committee would recommend that the
Melrose Diagonal without median should be included
among the options considered to remedy the traffic
congestion. This should be considered an acceptable
option only at such time as there are no longer private
properties fronting on Grand Avenue Court.

g. Resolution releasing agreement to dedicate right-of-way for
the extension of West Benton Street.
Comment: The City and Robert Bartelt and George and Beatrice
Petsel entered into an agreement in December 1967 in which
the property owners agreed to dedicate 40 feet of right-of-
way for the construction of Benton Street west of Moran
Trek Boulevard if and when the City decided to extend the
street. The current property. owners have requested that the
City release them from this obligation so they can complete
their planning for the development of the real estate in
question. The Planning and Zoning Commission at their
regular meeting, April 2, 1981, made a unanimous finding
that the property owners should be released from the agreement

EXTENSION OF THE BOUNDARIES OF THE LOWER RALSTON CREEK REDEVELOP-
MENT PLAN.
Comment: The Lower Ralston Creek Neighborhood Redevelopment Plan was
adopted by the Iowa City City Council on September 18, 1979, to
permit the rehabilitation and redevelopment of the Lower Ralston
Creek area, pursuant to Chapter 403 of the Iowa Code. ,The
extension of the project boundaries is necessary in order to
carry out creek improvements immediately south of the originally
designated project area. The additional improvements are needed
to effectively contain flood waters throughout the entire re-

Item No. 21 - CONSIDER MOTION AUTHORIZING DIRECTOR OF PUBLIC WORKS TO SIGN
APPLICATION FOR USE OF HIGHWAY RIGHT-OF-WAY FOR UTILITIES ACCOM-
MODATION.
Comment: This work consists of the installation of a 12 -inch ductile iron
water main on the north side of Highway 1 from Ashley Drive to
Willow Creek Drive. With this water main extension, Barker's
First Addition, a subdivision in the City of Iowa City, Iowa,
will then have potable water and fire protection. A copy of the
application is attached to the agenda.

IN THE EQUIPMENT SERVICE DIVISION AND ONE PERMANENT FULL-TIME

Comment: EQUIPMENT SERVICE DIVISION
The newly appointed Equipment Service Superintendent has recommended
a reorganization of job duties in the Parts/Rebuild section of
the Equipment Service Division which would affect the classification
of the now vacant Senior Mechanic position and that of the incumbent
Maintenance Worker II.
Supervisory responsibility for Parts/Rebuild will be assumed by
the Shop Supervisor rather than requiring a Senior Mechanic. The
position will then be filled as a Mechanic I, who will perform
general line mechanic work on City vehicles. These changes will,
however, create additional responsibilities in the area of parts
inventory for the Maintenance Worker II position, necessitating a
reclassification to Maintenance Worker III.
PARKS DIVISION
The employee in the position for which reclassification is being
recommended currently performs the following duties normally
performed by a position classified as Senior Maintenance Worker:
skilled building construction, rough and finish carpentry and
remodeling, interior and exterior painting, cement work; acts as
a lead worker of a crew involved in building construction or
grounds maintenance.
Projects that have been completed by the employee currently in
this position include work in Parks Department buildings, in the
Rec Center, Animal Shelter, Bus Barn, Civic Center and complete
construction of the new Accounting Division location, for which a
great savings in construction costs can be estimated.
These reclassifications will result in no additional costs in
FY81, and a cost savings of $200 in FY82_

Item No. 25 - CONSIDER RESOLUTION ESTABLISHING FEES FOR CERTIFICATES OF STRUCTURE
COMPLIANCE AND RENTAL PERMITS AS PART OF THE IOWA CITY HOUSING
CODE.
Comment: The resolution establishing fees for Certificates of Structure
Compliance and Rental Permits is being proposed in accordance
with the provisions of the new Iowa City Housing Code. The fee
schedule has been drafted using the figures which have been
suggested by the Iowa City Apartment Association. This fee
schedule, once implemented, will satisfy the $50,000 goal on fee
collections as outlined by the City Council. In addition, fees
would be collected in conJunction with the required inspections
rather than on an annual basis. The Housing Commission has
reviewed this schedule and recommended its approval, as has the
staff. This item was deferred from the agenda of April 21, 1981.

Comment: These proposed amendments are to establish a minimum ceiling
height in all commercial buildings and to establish minimum
window requirements, handrail requirements and footing require-
ments for residential buildings. The Building Code currently
does not establish minimum ceiling heights for any rooms in
commercial structures. It is our feeling that a minimum ceiling
height of seven feet needs to be established. Window require-
ments are being proposed to reduce the current 10 percent window
requirement to 8 percent, establish a minimum footing size of
which is ecurrent

These amendments have been reviewed and approved by the Board of
Appeals and the Board recommends that the Council adopt these
amendments. A copy of the proposed ordinance was attached to the

Comment: Adoption of this Ordinance is necessary to comply with the
requirements of EPA and to receive federal funding for our sewer
main and wastewater treatment plant projects.
EPA has required additions to Sections 5 and 6 of Article III.
At the end of Section 5 add: "The source of these transfers
shall not be from the operation and maintenance fund." At the
end of Section 6 add: "Operation and maintenance funds may not
be used for Capital Improvement Protect."
