Dear City Council Members:
We are writing in behalf of the student council at South East Jr. High
to urge you to keep the crossing guard at the corner of First Avenue
and Bradford Drive. Many students from our student body use the
crossing guard and even though we're twelve to fifteen years old, we
aren't as safety conscious as we should be and we can tend to be spacy.
Just last year, there was a student hit while riding his bicycle on
his way to school.
Without the crossing guard, the students' safety could be jeopardized
because the times the students cross there are during the rush hour.
There are many cars who speed (not seeing the 25 mph signs after the
35 mph signs by Wendy's) and there is more congestion because four
lanes compact into two lanes. A petition was presented by students
to Round Table.
We strugly urge you to retain our school crossing guard for the safety
of the students. Thank you.

Street lights, and the Elderly Services Agency, we thank the
City Council for responding so promptly to our concerns, and
for approving the City Manager's recommendations.

the fine actions they take on behalf of the community. We

Re: Regency Gardens, Parts I-IV
Dear Mayor Balmer:
I represent Rolin Investments who is the developer of Regency Gardens, Parte I-IV.
The City Council Agenda for Tuesday, April 21, 1981, scheduled the setting of a
public hearing to consider the final Planned Area Development Plan of Regency Gardens,
Parte I-IV, for May 19, 1981.
The purpose of this letter is to request the City Council to consider holding the
public hearing on May 19 and having the first reading of the Ordinance approving
this Development Plan. I would further request that the second and third readings
of the Development Plan be done on Tuesday, June 2, 1981, which would permit the
Development to commence construction in early June.
My request is based upon two factors. First, because the City Council meets every
other week having a separate public hearing and three readings of the Ordinance
would result in this Development not obtaining approval until the middle of the
summer which could prevent construction this year. Second, and more importantly,
I had met with members of the planning staff in March in attempting to schedule a
plan of action which would permit the Development to be approved by the City Council
on Tuesday, May 19, or Tuesday, June 2. You may recall that on Tuesday, April 7,
the City Council established a public hearing for this Development Plan for Tuesday,
April 21. However, after the public hearing was established it was discovered that
the notice requirements could not be satisfied and thus the public hearing had to be
rescheduled. If the developer had known earlier that there was going to be this
problem we could have set the public hearing for May 5 at the latest, or could have
expedited our work back in March and had the public hearing on April 21. In any
event it is clear that the public hearing cannot be held until May 19 and I would
request the City Council considering the first reading of this Ordinance at that
meeting with the final two readings on June 2.

I would also like to clarify the Minutes of the Planning G Zoning meeting which
may have been forwarded to the City Council. While Ressncy Gardena, Parts I-IV,
is located adjacent to the Weetwinds Subdivision there is very little similarity
between the two projects. The developer of Regency Gardens is Paul Olin. Further,
there are no common areas nor will there be a Momsownsrs Association as part of
the Regency Gardens Development Plan. Regency Gardena, Parts I-IV, is a single
family residential project using the ":aro-lot line concept". I trust that the
comments regarding the Wastwinde Condominiums will not adversely affect my client's
project.
I would appreciate one of the staff or you contacting•a regarding the prospect of
obtaining approval on June 2 assuming there are no objections to the Development
Plan.

Re: Yield Sign at Davenport Street/Van Buren Street
As directed by Section 23-16 of the Municipal Code, this is to advise
you of the following action:
ACTION:
Pursuant to Section 23-160 of the Municipal Code the City Traffic
Engineer will direct the installation of yield signs on Davenport
Street at its intersection with Van Buren Street. This action will
be taken on or shortly after May 15, 1981.
COMMENT:
This action is being taken after a review of the accident experience
at this location. While the accident experience is not sufficient to
warrant the installation of stop signs at this intersection it is of
such number ovar the past five years that the installation of yield
signs is called for. The Traffic Engineering Division will continue
to monitor conditions at this intersection.

ANALYSIS
The applicant desires -to rezone this tract from R3 to R3A, in order to add one
unit to the development (see attached site plan). At the time that the
apartment complex was initially constructed, the R3 zoning did not allow the
completion of the final unit. Therefore, while the last building actually
contains six apartment units, one apartment was not finished in order to meet
the density requirements of the R3 zone (3,000 square, feet per unit). As Mr.
Barker indicates in the attached letter, he has discussed this matter with the
Commission before. At that time, the Commission indicated that they had no
problem making this property conforming and with the adoption of the new zoning
ordinance would consider zoning it RM20.
As_was.stated, the portion of. the apartment complex which the _applicant wishes,
to rezone is currently zoned R3. The remaining portion of the complex, as can be
seen on the location map, is currently zoned R3A. The applicant proposes two

alternatives: (1) rezone that portion of the apartment complex necessary to
make the whole area R3A; or (2) rezone only that portion of the property at the
north end that includes the unfinished unit. The staff would recommend against
the latter of these options, as it appears that the question of spot zoning
ld-b 'i i ant Therefore the only available option would be the first one.

The Comprehensive Plan recommends a density in this location of 8-16 dwelling
units per acre. For the property owned by the applicant, this designation
appears to be inconsistent with the actual density of about 20 dwelling units
per acre. More realistically then, the proper designation for this area should
'— --probably be 16=24' dwelling' units- per -acre and the proper zoning-RM20,-upon the -
adoption of the new zoning ordinance. This density would allow the use of the
final unit. However, this indicates a problem with the current Zoning
Ordinance. While the proper'density may be 16 to 24 dwelling units per acre the
next zone which would allow the additional unit is R3A, which allows 43 dwelling
units per acre. The problem is that there is no zone available to implement the
recommendations of the Comprehensive Plan., This problem points out the need for
a new zoning ordinance, designed to carry out those recommendations. Therefore,
while the staff would agree that the Comprehensive Plan should be amended to
indicate the actual density of this area, the staff could not advocate an
amendment to any higher density (e.g., 25 OU +).

increasing the density of the Emerald Court apartments by anymore than the one
additional unit is very low, even if the property is rezoned R3A. Tearing down
the existing units to replace them with larger units is not feasible in today's
market. Also, it should be noted that while the applicant would find the use of
the additional unit advantageous, he certainly has adequate use of his property
now.
STAFF RECOMMENDATION
The staff would recommend that the Comprehensive Plan be amended to indicate the
existing density of 16 to 24 dwelling units per acre. However, the staff could
riot advocate an a6endment'to any higher density, and would therefore recommend
against the requested rezoning.

Dear Mr. Boothroys
Last sumer we were in the process of requesting a change in j
the zoning of the Emerald Court Apartments so that we could
complete one three bedroom apirtment. The outside construction "
is complete with only some interior work remaining. The apart-
ment was not oomplsted at the time of construction because of
the density requirements for 13 zoning density requirements.
During one of -the discussions with the.Planning and Zoning
Commission, the consensus appeared to be to wait until the -
now proposed. zoning plan was adopted and, based on what appeared
would be the recommendation to the City Council, the new zoning
would permit the apartment to be completed, i3
. -. --•- •- Since it -appears now that the.new zoning regulations will not be
adopted in the immediate future, we wish to proceed with a re=
' quest to change the zohing of the north portion of our property
to the same zoning classification as the south portion, namely

Apartments located on Emerald Street in Iowa City. We
have renamed them Emerald Court Apartments. The buildings
were constructed to accomodate a total of 158 apartments.

WHEREAS, a portion of the above-described property is presently zoned,
pursuant to the Iowa City Zoning Ordinance, R3 and the other portion is

WHEREAS, when the Emerald Court Apartments were initially constructed on
the above-described tract, the density requirements of the R3 zone did not
allow the completion of the final apartment unit; and
WHEREAS, the Applicant has requested that the portion of the tract
currently zoned R3 be amended to R3A to permit completion of the remaining
unfinished apartment; and
WHEREAS, the Iowa City Planning and Zoning Commission has carefully
reviewed the zoning of the tract in question, and in its proposed revised
zoning ordinance initially has recommended that the entire parcel be zoned
RM20, so as all the units would be conforming; and
WHEREAS, the review and implementation of the proposed zoning ordinance
revisions have been delayed and undoubtedly will not be completed for many
months; and
WHEREAS, the Applicant -is. -snot interested in expanding the use or density
of the tract beyond the completion of one additional apartment unit.

THE CITY AND APPLICANT THEREFORE AGREE AND COVENANT AS FOLLOWS:
1. Upon the City Council's determination, after due consideration, that
the portion of the above-described real estate presently zoned R3 is
to be rezoned to R3A, the Applicant recognizes the intent of the City
to rezone the entire tract to a more restrictive zoning category in
its forthcoming revised zoning ordinance.
2. The Applicant waives their right to object, as established in Section
414.5 of the Code of Iowa, to the rezoning of the above-described
real property to RM20, or any other similar zone which may be adopted
by the City, providing that the current use of the tract, including
the additional unit to be completed, remains a conforming use; and
releases the City, its officers and agents, from any and all
liability, claim or loss which arises from said rezoning.
3. The Applicant further covenants that during the effective period of
this Agreement they will not expand the density or the use of the
property beyond 158 units in existence upon the date of rezoning.
4. If the City does not rezone the real property described above within
four years from the date of execution of this Agreement, all rights
and responsibilities established in this Agreement shall terminate.
5. This Agreement shall be binding upon the heirs, assigns and
successors of the parties, and shall be a covenant running with the
above described real property.

Physical characteristics: Topography is gently to
moderately sloping (2-10%).
ANALYSIS
Seventeen attached single family and townhouse units are proposed by the
subject application. The typical lot size is 3,220 square feet or
dimensionally 28' x 115'. The overall density of the development is 4,578
square feet per unit or approximately 9h units per acre. Common open
areas are planned around each residential cluster. The development will
. •.. also -be -able -to take advantage --of -adjacent open spaces and recreational-••
t facilities as provided on the West High School property. An access
r' easement to the school property is proposed in a later development phase.

!' Provisions of the Planned Area Development Ordinance allow for variances

In the instant situation, because each unit is proposed on its own lot
thereby classifying them as single family uses, the overall density of the

than one unit was provided per lot (i.e. multi family uses) the maximum
density •of••3,000•square feet -per •unit would prevail because within the R3
zone duplexes and multi -family uses are permitted at a density of 3,000
square feet per unit. The amenity of each unit having a private yard area
for individual use is a very positive aspect to this development concept.
The Planned Area Development Ordinance should be flexible enough to
encourage this type of development. Therefore, staff recommends amending

Section•8t10.20.D.2 and'E.2 of the Planned Area Development provisions of"'
the Zoning Ordinance such that, depending upon the character of the
t development, the net dwelling unit density may be computed in terms of the
density requirements of the least restrictive use within the zone in which
the PAD is proposed.

Regarding the'neccssary legal papers to be submitted for review prior td`
action being taken upon the subject application. Legal provision should
F. be made for permanent access easements for the maintenance of the exterior

Chapter 31, Streets, Sidewalks, and Public Places of the Code of
Ordinances. Specifically, the plan is in violation of Section 31-60 which
governs proximity of driveways to corners and property lines and states

that driveways in no case can be located closer than three feet to the
property line. Only those units, within the proposed development, shown
to have common drives are in compliance with this chapter. Although the
Planned Area Development provisions do provide flexibility in varying
certain -provisions- of the Zoning Ordinance and requirements. of the
subdivision code, they do not provide the authority to waive the
requirements of Chapter 31.
RECOMMENDATION
-
The, staff^recommends•-that -the preliminary and final subdivision•plat.and ..
planned area development plan of Regency Gardens be deferred. Upon
revision of the plat and plan correcting the deficiencies and
discrepancies noted below and the incorporation of the concerns mentioned
above, it is the staff's recommendation that the preliminary and final
plat and planned area development plan be approved.
DEFICIENCIES AND DISCREPANCIES
1. A schedule of completion should be provided.
2. Legal instruments should be provided governing the maintenance of
---common-open•ereas including restrictive covenants. -
3. A permanent 10 foot maintenance easement should be provided on each
lot for access to common walls when located upon lot lines.
4. The plan should be revised so that driveways are located 3 feet from
lot lines.
5. The plan should be brought into compliance with the Stormwater
Management Ordinance.
6. Private common open areas should be clearly denoted on the plan.
7. The proposed overall population (unit) density should be indicated
on the plan.

Dear Ms. Hegg:
At its regular meeting of May 5, 1981, the City Council received and
placed on file your petition concerning curb cuts which you presented
to Councilmember Clemens Erdahl.
At the present time three curb cuts have been completed - two at Iowa
Avenue and Linn and one on the northwest corner of Dubuque and Iowa Avenue.
Three more are in the process of being completed, and the remainder should
be finished by July 1. The only location mentioned on your petition which
will not be completed at this time will be the one at the alley next to
the Brown Bottle. There is some concern on the part of the staff that
water will seep into the basement of the building where the Brown Bottle
is located if this curb is lowered. The final decision on this matter
will be taken up during the next calendar year as part of the scheduled
reconstruction of the alley.
You and the other signers of the petition may be assured that the City will
cooperate whenever possible to correct the problems of accessibility.

5. The State of Iowa and the Iowa Department of Transportation assume no rospunsibility for damages to the Permittee'sproperty occasioned
by any construction or maintenance operations on said highway.
6. The Permittee shall take all reasonable precaution during the construction and maintenance of said Installation to protect and safeguard the
lives and property or the traveling public and adjacent property owners.

7. The Perndttee agrees to give the Iowa Department of Transportatloo forty-eigbt hours' notice of its intention to start construction on the
highway right-of-way. Sald notice shall be made in writing to the Engineer whose name is shown below.
8. The Permittee agrees to at all times give the Iowa Department of Transportation timely notice of Intention to perform routine maintenance
within the right•of-way. Said notice shall be to the Engineer whose name to shown below.
• 8. The Permittee, and Its contractors, shall carry on the construction or repair of the accommodated utility with nerious regard to the safety of
the public. Traffic protection shall be in accordance with Part VI of the current Iowa Department of Transportation Manual on Uniform
Trafric Control Devices for Streets and Highways.

10. Operations in the construction and maintenance of said utility install anion ihall be carried on in such a manner as to cause minimum of
Interference to or distraction of traffic on said highway.
11. The Permittee shall be responsible for my damage tha: may result to said highway because of the construction operation, or maintenance
of said utility, and shall reimburse the State of Iowa or the Iowa Department of Transportation any expenditure that the State of Iowa or the
Iowa Department of Transportation may have to make on said highway because of said Pennittee's utility having been constructed, operated,
and maintained thereon.
12. The Permittee shall indemnify and save harmless the State of Iowa, and the Iowa Department of Transportation from any and all causes of
action, suits at law or In equity, or losses, damages, claims, or demands, and from any and all liability and expense of whatsoever nature for,
on account of, at due to the acts or ommissions of said Permittee'- officers, members, agents, representatives, contractors, employees or
assigns arising out of or in connection with its (or. their) use or occupancy of the public highway under this permit. -
13. Non-compliance with any of the terms of the Iowa Department of Transportation policy, permit, or agreement, may be considered cause for
sbut•down of utility construction operations or withholding of relocation reimbursement until compliance is assured, or revocation of the permit.
The cost of any work caused to be performed by the State in removal of noncomplying construction will be assessed against the Permittee. •
14. A copy of the approved permit shall be available on the Job site at all times for examination by Department of Transportation officials.
