Many students from our student body use the crossing guard and even though we're twelve to fifteen years old, we aren't as safety conscious as we should be and we can tend to be spacy. Just last year, there was a student hit while riding his bicycle on his way to school. Without the crossing guard, the students' safety could be jeopardized because the times the students cross there are during the rush hour. There are many cars who speed (not seeing the 25 mph signs after the 35 mph signs by Wendy's) and there is more congestion because four lanes compact into two lanes. A petition was presented by students to Round Table. We strugly urge you to retain our school crossing guard for the safety of the students. Thank you. The City Council Agenda for Tuesday, April 21, 1981, scheduled the setting of a public hearing to consider the final Planned Area Development Plan of Regency Gardens, Parte I-IV, for May 19, 1981. The purpose of this letter is to request the City Council to consider holding the public hearing on May 19 and having the first reading of the Ordinance approving this Development Plan. I would further request that the second and third readings of the Development Plan be done on Tuesday, June 2, 1981, which would permit the Development to commence construction in early June. My request is based upon two factors. First, because the City Council meets every other week having a separate public hearing and three readings of the Ordinance would result in this Development not obtaining approval until the middle of the summer which could prevent construction this year. Second, and more importantly, I had met with members of the planning staff in March in attempting to schedule a plan of action which would permit the Development to be approved by the City Council on Tuesday, May 19, or Tuesday, June 2. You may recall that on Tuesday, April 7, the City Council established a public hearing for this Development Plan for Tuesday, April 21. However, after the public hearing was established it was discovered that the notice requirements could not be satisfied and thus the public hearing had to be rescheduled. If the developer had known earlier that there was going to be this problem we could have set the public hearing for May 5 at the latest, or could have expedited our work back in March and had the public hearing on April 21. While Ressncy Gardena, Parts I-IV, is located adjacent to the Weetwinds Subdivision there is very little similarity between the two projects. The developer of Regency Gardens is Paul Olin. Further, there are no common areas nor will there be a Momsownsrs Association as part of the Regency Gardens Development Plan. Regency Gardena, Parts I-IV, is a single family residential project using the ":aro-lot line concept". I trust that the comments regarding the Wastwinde Condominiums will not adversely affect my client's project. I would appreciate one of the staff or you contacting•a regarding the prospect of obtaining approval on June 2 assuming there are no objections to the Development Plan. Approximately 2 acres. Size: Existing land use and zoning: Multifamily housing and R3. Surrounding land uses and zoning: Earth - fire stationamily (University singleHeights). South - duplex and R2. West - multi -family and RIB. Comprehensive Plan: 8-16 dwelling units per acre. 45 -day lieii'tation period: 4/29/81 Physical characteristics: Topography is gently sloping to steep. ANALYSIS The applicant desires -to rezone this tract from R3 to R3A, in order to add one unit to the development (see attached site plan). At the time that the apartment complex was initially constructed, the R3 zoning did not allow the completion of the final unit. Therefore, while the last building actually contains six apartment units, one apartment was not finished in order to meet the density requirements of the R3 zone (3,000 square, feet per unit). As Mr. Barker indicates in the attached letter, he has discussed this matter with the Commission before. At that time, the Commission indicated that they had no problem making this property conforming and with the adoption of the new zoning ordinance would consider zoning it RM20. As_was.stated, the portion of. the apartment complex which the _applicant wishes, to rezone is currently zoned R3. The remaining portion of the complex, as can be seen on the location map, is currently zoned R3A. The staff would recommend against the latter of these options, as it appears that the question of spot zoning ld-b 'i i ant Therefore the only available option would be the first one. wou a mm n , The Comprehensive Plan recommends a density in this location of 8-16 dwelling units per acre. For the property owned by the applicant, this designation appears to be inconsistent with the actual density of about 20 dwelling units per acre. More realistically then, the proper designation for this area should '— --probably be 16=24' dwelling' units- per -acre and the proper zoning-RM20,-upon the - adoption of the new zoning ordinance. This density would allow the use of the final unit. However, this indicates a problem with the current Zoning Ordinance. While the proper'density may be 16 to 24 dwelling units per acre the next zone which would allow the additional unit is R3A, which allows 43 dwelling units per acre. The problem is that there is no zone available to implement the recommendations of the Comprehensive Plan., This problem points out the need for a new zoning ordinance, designed to carry out those recommendations. Therefore, while the staff would agree that the Comprehensive Plan should be amended to indicate the actual density of this area, the staff could not advocate an amendment to any higher density (e.g., 25 OU +). "--It­should`be pbintid-66t-id al Vfairness."that the likelihood of the applicant increasing the density of the Emerald Court apartments by anymore than the one additional unit is very low, even if the property is rezoned R3A. Tearing down the existing units to replace them with larger units is not feasible in today's market. Also, it should be noted that while the applicant would find the use of the additional unit advantageous, he certainly has adequate use of his property now. STAFF RECOMMENDATION The staff would recommend that the Comprehensive Plan be amended to indicate the existing density of 16 to 24 dwelling units per acre. At the present time three curb cuts have been completed - two at Iowa Avenue and Linn and one on the northwest corner of Dubuque and Iowa Avenue. Three more are in the process of being completed, and the remainder should be finished by July 1. The only location mentioned on your petition which will not be completed at this time will be the one at the alley next to the Brown Bottle. There is some concern on the part of the staff that water will seep into the basement of the building where the Brown Bottle is located if this curb is lowered. The final decision on this matter will be taken up during the next calendar year as part of the scheduled reconstruction of the alley.
