Resolutions. (1) Consider resolution accepting storm sewer in the storm - water management basin (Villa Park Extended) for MacBride _141,3 Addition, Part III. Comment: See attached Engineer's report. g. Setting Public Hearings. (1) Consider resolution setting public hearing on July 14, 1981, on plans, specifications, form of contract, and �6 estimate of cost for the construction of the Scott Boulevard Paving Improvement Project - Phase II, directing the City Clerk to publish notice of said hearing, and directing City Engineer to place said plans, etc., on file for public inspection. Comment: This project extends from Muscatine Avenue north to Court Street and through Court Street west to existing Scott Boulevard, and includes thirty-one foot wide paving, an eight foot wide sidewalk/bikeway on the west side and related storm sewer work. Estimated project costs are $457,900. (2) Consider a motion to set a public hearing on July 14, 1981, on an ordinance amending Sections 1205(a) and 3305(b) of the 1979 edition of the Uniform Building Code as edited by the International Conference of Building Officials. Comment: The purpose of this ordinance is to amend the 1979 edition of the Uniform Building Code to regulate minimum window size in residential buildings for light and ventilation and to clarify language for required minimum width of stairways. Recently, the Council adopted a previous amendment to Section 1205(a) to reduce the required ten percent window area to eight percent; however, there was an error in the drafting of that ordinance which read one-eighth of the floor area instead of eight percent which in fact increased the requirement from ten percent to 12k percent. Section 3305(b) is being amended to clarify the language on what the required minimum width of a stairway is. The Board of Appeals has received two appeals in the past six months on interpretation of how you measure the width of a stairway. It is the interpretation of the Building Inspection Division and the International Conference of Building Officials that the mininim width of a stairway be measured as the clear tread width. This amendment reflects that interpretation by inserting language that the minimum width of a stair is in fact the clear tread width. Both of these amendments have been reviewed by the Board of Appeals and it is their recommendation that Council adopt these amendments. A copy of this ordinance is enclosed in the packet. h. Consider a motion setting a public hearing July 28, 1981, to consider an amendment to the Zoning Ordinance of the Code of Ordinances of Iowa City, Iowa, excepting a balcony/deck from yard regulations. Comment: The Planning and Zoning Commission, at a regular meeting held June 18, 1981, recommended by a 6-0 vote to approve the subject amendment. This recommendation is consistent with the staff's recommendation. Approval of this ordinance would provide a definition for balcony/deck in the Zoning Ordinance and except the balcony/deck from the required yard regulations. Since decks have become increasingly popular and since they do not obstruct the flow of air or light to a significant degree, the staff recommends the amendment to allow the construction of decks within the required rear yard. Shaffer to the Riverfront Commission as a representative of Coralville to fill the vacancy created by the resignation of Richard G. Baker. This term will expire December 1, 1981. On Friday, June 26, 1981 the union made the following offer to the City of Iowa City and we wish to make it public now. Terms of settlement on major issues: A. One year contract B. $5o annual cleaning allowance C. $50 annual shoe allowance D. 6% across the board raise The cost above the fact finders report is between 3-4,000 dollars for the life of the contract. As an example of the misunderstanding an article in todays Press Citizen assistant City Manager Dale Helling stated that the "city was not adamant about a two year contract and feels that the fact finders recommendations are a good basis for settlemeht. It is the police union that wants to settle far beyond thak. The city does not feel that is is necessary or fair" I checked the citys payments to negotiator Steven Rynecki and as of March 25th, 1981 he had recieved $28,h65.86. His services for April, May and June have not been paid . The cityp while praising the "fairness" of the factfinders report and alleging the poldce union wants to settle FAR beyond that takes no interest in the cost of negotieti.nns to the taxpayer. Neither does it account for the continuation of these costs b y city appeals. The leCislature has provided us with a method whereby contrast disputes can be settled. Police and fire personnel are prohibited by good conscience and law from striking. In place of this option is arbitration. This years negotiations were alleged to have exceeded the statutory time limits. The city went to arbitration with the fire union after granting an extention of time limits but appealed to PERB to avoid doing the dame with the police. PERB found that the delay was their fault and the city is obligated to go arbitration. The council must now decide whether to appeal that decision to district court. I have just made public the terms under which they . could settle the contract so we have a good idea what that will cost. How much will another appeal cost? In whose interest is it to appeal? If it is the intent of the council to promote efficient government and protect the taxpayers dollars, lets settle the contract. We ask what is right, and what will eventually happen, the right to submit r unreconcillable ussues to a neubral, disinterested third party for binding arbitration. We ask the council not to appeal the PMB decision. We ask that public bargaining to began as soon as possible to attemt to a•:oid arbitration. lie ask that the public support our right to a contract and the right to have arbitration if no agreement can be reached in a reasonalhle time. The city has either negotiated, arbitrated or granted raises to all other city employees whhich have exceeded our aekings. We ask the public to support our request for fair treatment. Item No. 10 - CONSIDER MOTION SETTING A PUBLIC HEARING FOR JULY 28, 1981, FOR PUBLIC INPUT REGARDING THE PROPOSAL TO PARTICIPATE IN THE SECTION 8 MODERATE REHABILITATION PROGRAM PURSUANT TO THE HOUSING ACT OF 1937. Comment: Chapter 403A of the State Code requires the PHA hold a public hearing before undertaking any low cost housing project. Comment: A brief description of the program was provided in the Council packet. The application and supporting documentation is for 30 units - twenty two-bedroom units and ten three-bedroom units and should be submitted as soon as practical. Comment: The Uniform Act provides a maximum of $15,000 as a replacement housing payment to aid homeowners displaced by City projects. Josephine Graham is being displaced by the Small Cities/Lower Ralston Creek Neighborhood project, and the $15,000 replacement housing payment added to the appraised value of her property, will not be sufficient for her to purchase decent, safe and sanitary replacement housing under current market conditions. It is therefore necessary to trigger Section 206 (Last Resort Housing) of the Uniform Act to provide the additional replacement housing payment ent needed for relocation. Comment: This resolution authorizes the fourth renewal of Iowa City's contract with Johnson County for SEATS elderly and handicapped transportation service. A memorandum regarding this agreement is attached to the agenda. Comment: The County has reviewed the contract prepared by the City and accepted it with the following changes: Action: I. Duration and termination clauses combined and increased to 120 days notice of termination by either party. 2. Compensation - Refund to the County due to termination deleted. 3. Budget procedure - New paragraph IV. a. City transmits budget to County by January 15. b. County transmits resolution of commitment by February 15 ' to fund 20 percent or a specific amount. C. Iowa City adopts final budget by March 15 obligating Johnson County to 20 percent for the amount specified by the County whichever is the lesser amount. d. Amendments to the budget do not increase the obligation of the County unless mutually agreed upon. e. Comment: This resolution authorizes the City to award a contract to Motorola in the amount of $55,086 for the purchase and installation of a bus radio system. FOR THE PURCHASE OF TEN (10) BUS SHELTERS FOR THE IOWA CITY 7-Z TRANSIT SYSTEM. Comment: This resolution authorizes the City to award a contract to Columbia. Equipment in the amount of $15,980 for the purchase of bus shelters. A subsequent contract will be awarded for shelter installation. A Federal transit grant will pay 80% of the project costs. Comment: This resolution authorizes the City, acting as lead agency on behalf of the University of Iowa, to award a contract in the amount of $30,898.63 to Ward Bus Body Sales.. The Federal govern- ment will pay 80% of the cost of this new "Bionic Bus"; the University will pay the remaining 20%. Comment: This resolution authorizes the City, acting as lead agency on behalf of itself, the City of Coralville, and the University of Iowa, to award a contract in the amount of $934,492, to Neoplan- USA for six (6) transit coaches - two (2) each for Iowa City, the City of Coralville, and the University of Iowa. The contract also provides for an option for one additional coach for Iowa City if funding permits. Abs Comment: Implementation of the League's workers' compensation insurance program and proper completion of paperwork necessary to file the program with the Insurance Commissioner's office requires that a separate association be formed by a group of cities specifically for workers' compensation purposes. Therefore, the board of trustees of the insurance program is asking the city councils of the cities that have representatives on the board to adopt the resolution necessary to form the insurance association. Action: Under the proposed resolution, Iowa City joins other Iowa cities in the formation of a workers' compensation association. Partici- pation in the formation of this association does not commit the City to participate in its program, pay any premiums, or make any other contribution. Cities desiring to participate in the workers' compensation insurance program will become association members by a separate and different resolution. Joining in the formation of this association only makes this insurance program available to League member cities wishing to participate; it creates no obli- gation or liability on the part of Iowa City.
