AGREEMENTS': The utility company, corporation, applicant, permittee, or licensee, (hereinafter referred to as the Permittee)
agrees that the following stipulations shall govern under this permit.
L The location, construclIon and maintenance of the utility Installation covered by this application shall be in accordance with the current
[ Iowa State Highway Commission Utility Accommodation Polley.
C 2. The installation shall meet the requirements of local municipal, county, state, and federal laws, franchise rules, and regulations, regula-
tions and dlrectives of the Iowa State Commerce Commission, Utilities Division, the Iowa State Department of Health, all rules and
regula-tions of the Iowa State Highway Commission, and any other laws or regulations applicable.
( 8. The Permittee shall be fully responsible for any future adjustments of its facilities within the established highway right of way caused
by highway construction or maintenance operations.
[ 4. The Iowa Stale Highway Commission shall give the Permittee at least 48 hours written notice of any proposed construction or maintenance
work, on either existing or newly acquired right-ofway, that is likely to conflict with the installation belonging to the Penalties, in order that
the Permittee may arrange to protect its facilities.
S. The Stale of Iowa and the Iowa State Highway Commission assume no responsibility for damages to the Permittee's property occasioned by
any construction or maintenance operations on said highway.
6. The Perniltee shall lake all reasonable precaution during the construction and maintenance of said installation to protect and safeguard
the lives and property of the traveling public and adjacent property owners.
r 7. The Permittee agrees to give the State Highway Commission forty-eight hours' notice of its intention to start construction on the highway
right-of-way. Said notice shall be made in writing to the Engineer whose name is shown below.
8. The Penalties agrees to at all times give the Iowa Stale Highway Commission timely notice of intention to perform routine maintenance
within the right-of-way. Said notice shall be to the Engineer whose name is shown below.
9. The Permittee, and its contractors, shalt carry on the construction or repair of the accommodated utility with serious regard to the safety
of the public. Traffic protection shall be in accordance with Part VI of the current Iowa Stale Highway Commission Manual on Uniform
Traffic Controls.
Highway Commission personnel may supervise flagging operations where considered necessary by the Engineer. The original place-
ment of signs and removal on completion of the work shall be accomplished by the (Permittee) (Highway Commission).

I' 10. Operations In the construction and malnten t of said utility Installation shall be carried i such a manner as to cause a minimum
of interference to or dlstractimi of traffic on said highway.
` 11. The Permittee shall be responsible for any damage that may result to said highway because of the construction operation, or maintenance
of said utility, and shall reimburse the State of Iowa or the Iowa Slate Highway Commission for any expenditure that the State of Iowa or the
Iowa State Highway Commission may have to make on said highway because of said Pernittee's utility having been constructed, operated,
and maintained thereon.
12. The Permittee shall indemnify and save harmless the State of Iowa and the Iowa State Highway Commission from any and all causes of
action, suits at law or in equity, or losses, damages, claims, or demands, and from any and all liability and expense of whatsoever nature for,
ion account of, or due to the acts or omissions of said Permittee's officers, members, agents, representatives, contractors, employees or
assigns arising out of or in connection with Its (or their) use or occupancy of the public highway under this permit.

y 13. Non-compliance with any of the terms of the Highway Commission policy, permit, or agreement, may be considered cause for shut -do"

14. A copy of the approved permit shall be available on the job site at all times for examination by Highway officials.

1. The location, construction and maintenance of the utility installation covered by this application shall be in accordance with the current '
Iowa Department or Transportation Utility Accommodation Policy.
2. The installation shall meet the requirements of local municipal, county, state, and federal laws, franchise rules, and regulations, regular
ties,-- and directives of the Iowa Slate Commerce Commission, Utilities Division, the Iowa State Department of Health, all rules and regulations
of the Iowa Department of Transportation, and any other lawsor regulations applicable.
3. The Permittee shall be rally responsible for any future adjustments of its facilities within the established highway right of way caused
by highway construction or maintenance operations. ,

4. The Iowa Department of Transportation shall give the Pemdttee at least 48 hours written notice of any proposed construction at maintenaaei
work, on either existing or newly acquired right. -of -way, that is likely to conflict with the installation belonging to the Permittee, In order that
the Permittee may arrange to protect its facilities.
6. The State of Iowa and the Iowa Department or Transportation assume no responsibility for damages to the Permittee's property occasioned
by any construction or maintenance operations on said highway.
6. The Pem,iuee Shall take all reasonable precaution during the construction and maintenance of said installation to protect and safeguard the
lives and property of the traveling public and adjacent property owners.
7. The Penuittee agrees to give the Iowa Department of Transportation forty-eight hours' notice of Its intention to start construction nn the
highway right -or -way. Said notice shall he made in writing to the Engineer whose name is shown below.
S. The Permittee agrees to at all times give the Iowa Department of Transportation timely notice of intention to perform routine maintenance
within the right-of-way. Said notice shall be to the Engineer whose name Is shown below.
9. Thu Permittee, and its contradicts, shall carry on the construction or repair of the accommodated utility with serious regard to the safety of
the public. Traffic protection shall be in accordance with Part VI of the current Iowa Department of Transportation Manual on Uniform
Traffic Control Dovicos for Streets and Highways.

of said utility, and shall reimburse the State of Iowa or the Iowa Department of Transportation any expenditure that the State of Iowa or the
Iowa Department of Transportation may have to make on said highwaybocause of said PennitteCe utility having been constructed, operated,
and maintained thereon.
12. The Permiuee shall indemnify and save harmless the State of Iowa, and the Iowa Department of Transportation from any and all causes of
action, suits at law or in equity, or losses, damages, claims, or demands, and from any and all liability and expense of whatsoever nature for,
on account of, or due to the acts or onunissions of said Permiuee's officers, members, agents, representatives, contractors, omPioyees ar
assigns arising out of or in connection with its (or their) use or occupancy of the public highway under this permit.
1:3. Non-compliance with any of the terms of the Iowa Department of Transportation policy, permit, or agreement, may be considered cause for
shutdown of utility construction operations or withholding of relocation reimbursement until compliance is assured, or revocation of the permit.
The cost of any work caused to he performed by the State in removal of non complying construction will be assessed against the Permittee.

When the new Senior Center opens,Johnson County residents age 55
and older will have a nice building in which to play. But i" we should
all decide that we want to play on the same day. only about twoof us
out of each 100 persons will be able to get in the building,
and in
some cases plans for sharing will need to be devised.
In the case of congregate meals, priority was established by federal
law when the Older American Act of 1965, as amended, we adopted by Con-
gress. Congregate meals is public welfare, and each welfare project
must state the conditions under which persons are eligible. You are
all familiar with the way in which the meals program is being advertised
and so I will not repeat.
While the meals were being served in churches and in a privately
owned building, the Council had no authority to say anything with regard
to the way in which the project was being operated or advertised. But
now that the provider has asked for space in they Cgfiter, so that congre-

In the June 20 issue of the Press -Citizen, in the article on congre-
gate meals, this statement appeared: "The City Council Monday agreed in 1
part to Grizel's suggestion. It decided to draft a memo to the Johnson
County Supervisors to recommend a priority be established when the need
arises." lou may have been misquoted, I don't know, but I will comment
in case this is something you might be considering.
Why should you recommend that the Supervisors, or anyone else,

Instead of recommending that the Supervisors "establish" something
that has already been established, and which no one but Congress could
change, I suggest that you recommend that the Supervisors correct the
things that need corredtion, and that they can easily correct. Those

No. 1. Correct the notice regarding congregate meals that appears
each Saturday in the Iowa City Press -Citizen, which item, since June 26,
1980, has indicated that the meals program is being operated on an open
door or blanket eligibility basis. As I understand one of the statements

2. Correct the printed informational folder on congregate mealh that
is being circulated which reads, "Any person 60 years of age or older
and their spouses (regardless of age) may participate." (See inclosed
copy of this folder.) Here too. the pre -fix of the words "Subject to
priorities" would appear to be the proper correction.
No. 3. Instruct all those who are paid to give information and outreach
regarding services available for the elderly (including the director of
the Elderly Services Agency and 60 PLUS) to give correct information as to
those persons who have priority, under the Older American Act of 1965 as
amended, in the serving of congfegate meals.
I No. 4• And what reply should Bette Meisel and Lori Benz give in
answer to'the question, "Under present law, what individuals in Johnson
County are to have priority in the serving of congregate meals?" And what
should they write about this in the Senior Center Post.? Everyone should
have the same answer to this -question -- the Mayor, the City Manager, and
the heads of all the organizations working with and for the elderly of
Johnson County. The Associate Commissioner for Program Development, Dept.
of Health and Services, Washington, D C. has written in a letter dated
December 19, 1980, "The age eligibility and emphasis on those with greatest
economic or social need are fecuirements of the Older American Act, as
amended. Our County Attorney have said practically the same thing in some- �.
what different words.
I am inclosing a copy of the January 16, 1976 legal opinion of our
County Attorneys for your review, and for the information of members of
the Senior Center Commission who may not have seen a copy. Those legal
opinions are so well written that neither one has ever been challenged by
any attorney. A copy of the October 7, 1980 legal opinion was filed with
you on March 10, 1981.
The people of Iowa City and Johnson County will always be grateful
that the two different groups of Supervisors requested the legal opinions
of the County Attorneys, but we continue to be puzzled as to why they
stopped there (apparently). We are grateful to the Attorneys too, for
their well written opinions.
In Johnson County there are more than 7,000 persons age 60 or older,
anA a large uncounted number of younger spouses. We are told that the
present contract is for about 200 congregate meals each day.
As I talked with each of you individually, I got the impression that
some of you would like to permit all of the people who are now participating
to continue to participate,providing that all who apply can be served This
could be done easily and neatly and stay within the law at the same time.
The following is how this could be done.
Some of the people are nov iermitted to have standing reservations,
while some have been reuired to phone in a reservation for each meal.
Those in charge could give advance notice that on August 1, 1981 the only
persons who would be 1ermitted to havea-astanding, reservation would be those
entitled to priority. The number of meals over and above the number needed
to take care of those entitled to priority could be made available to other
60 ,year olds on a day to day reservation.
Please send a copy of this letter to the Senior Center Commission.

I have received your letter dated April 16, 1981: I agree that the addition
of the phrase "priority will be given to those persons with the greatest eco-
nomic or social need" will not in any way change the basis upon which the
congregate meals are provided.
In 45 CFR Part 1321.109, the regulations state, "All service providers under
this part must follow priorities set by the area agency for serving older
persons such as location of services and specialization in the types of ser-
vices most needed by these groups to meet this requirement. Service provi-
ders may not use a means test." It seems clear to me that since tib r�-
tions prohibit the use ot a means test we will never be in the position to
determine on an individual basis those persons with the greatest economic or
social need. We will, however, continue to give priority to those people in
greatest economic and social need by locating our congregate meal sites in
places that are accessible to them and we will continue to subcontract with
the Johnson County Board of Supervisors who administer programs for those
people with greatest economic and social need.
If and when space becomes a problem for serving congregate meals the deter-
mination as to who will be served will be made on the basis of the order in
which reservations were received and not based on any form of means
I will be speaking with Bob Welsh about this matter to see if the Board of
Supervisors will be willing to modify the newspaper notice for congregate
meals.

YCur opinion request to us followed your receipt of a letter
fr I.Ms. Della A. Grizel questioning whether any qualifications
existed for individuals to be served meals.
"Sub -Chapter VII of Title 42 of the U.S. Code is the
statutory basis for the Congregate Meals Program for the Elderly
administered here in Johnson County and elsewhere. In inacting
this law, Congress found that there was a need "to assist in
.-ee:ing the nutritional and social needs of millions of persons
aged 60 -or older." 42 USC 3045(a) This statute further
provides that,
"Many elderly persons do not eat adequately because
(1) they cannot afford to do so; (2) they lack the
skills to select and prepare nourishing and well
balanced meals; (3) they have limited mobility which
may impair their capacity to shop and cook for them-
selves; and (4) they have feelings of rejection and
loneliness which obliterate the incentive necessary
to prepare and cat a meal alone."
It should be noted here that the foregoing statutory language
is identical to the language quoted by his. Grizel in her letter
although her citation referred to the public law form instead
of the now codified form.
A subsequent section of this same statute, Section 3045e(a)(2)
provides that funds under this program are to be disbursed to
recipients of grants or contracts who agree "to provide such
nutrition project for individuals aged 60 or over who meet the

The Committee wishes to make clear that such spouses
eligibility is not conditioned on age or upon meeting
the conditions set forth in the statement of purpose
and findings. (Emphasis .added.) 1972 US Code
Congressional and Administrative News 2086, 2093.
Federal regulations, as in many instances, are issued for
purposes of implementing the statute described above. A review
of those regulations discloses that they incorporate precisely
the same language as was in the statute in defining eligible
individuals and clearly require meeting one of the four
specifications in addition to being aged 60 or over. See 45
C.F.R. 909.3(x).
It is, in view or all OF the above, our opinion that
administration of the congregate meals program in Johnson County,
to whatever extent it is or has been operated on an open door
or blanket eligibility policy is in violation of the foderal
statute which established the program and the regulations which
have implemented it. Ile, do recognize that the for speci.Ficatioins
are very broad in nature and extremely difficult to measure or
judge. That is par tic:nlarly true of the fourth speciFicatioY

and as broad as the specifications are stated, we find no
authority for adopting a policy which assumes that every single
individual aged 60 or over moots one of the four specifications.
It is our opinion that some procedure is required l)rhich reviews
and determines eligibility pursuant to the four specifications.
It should be added that, in our opinion, the procedures adopted
for this determination need not be complex or administratively
burdensome. Tn fact,
the implementing regulthe statute, its legislative history and.
ations make it clear repeatedly that it
is the intention of this program to avoid significant administra-
tive costs and, consistent with that approach, a complex
administrative procedure for identifying eligible persons should
be avoided. While it is certainly not our place to determine
how to administer this necessary procedure, a relatively simple
corm could be utilized whereon an individual desiring to
utilize the congregate meals program could simply state their
name, their age, and check one or more of the four statutory
s=ecifications indicating that they apply to themselves as one
xishing to participate in the program. .In view of the broad
specification categories, it would be our view that an individual's
declaration that they are within one of the categories would
su-M ce.
We want to clarify one other point of discussion that was
raised in requesting the opinion. It is the participants'
decision as to whether she or he is able to pay for a meal.
Each individual must determine her/his own ability to contribute
toward the cost of a meal. Schedules of suggested fees can be
adopted but these schedules cannot be used as a means test to
determine eligibility. See 45 CPR 909.44(b) and (c).

We have approximately 150 elderly residents in Oaknoll, many of whom
use the city buses frequently. It would be very helpful to them if they
did not have to wait for the bus in bad weather without shelter.

Dear Mr. Ambrisco:
Thank you for your letter of June 22, 1981, in which you requested
that two sites in the vicinity of Oaknoll be considered for the
installation of bus shelters.
The City of Iowa City is in the process of acquiring ten bus
shelters, which will be installed along Iowa City Transit routes
throughout the City. These shelters will need to be parceled out
among about 450 stops along 14 different routes. Obviously, the
competition for these shelters will be intense, and many deserving
locations will not receive them.
We have not yet determined at which stops shelters will be located,
but based on our preliminary information it appears that the
'intersection of Oaknoll Drive and West Benton Street would be a very
i likely candidate. Not only would Oaknoll residents be well served,
but the residents of Seville Apartments and other complexes in the
area would benefit as well. The intersection of Oakcrest Street and
George Street, however, is not quite as an attractive location, and I
am less optimistic that a shelter could be placed there.
In any event, your interest in Iowa City Transit is greatly
appreciated. I sincerely hope that we will be able to place at least
one of our shelters at a location that will serve the Oaknoll
Retirement Residence.

ACTION:
Pursuant to Section 23-143 of the Municipal Code of Iowa City the Traffic
Engineer will direct that signs be installed so as to make the alley
bounded by Ronald Street/Governor Street/Church Street/Lucas Street a
one-way westbound alley. This action will take place on or shortly after
July 6, 1981.
COMMENT:
This action is being taken at the request of one of the affected property
owners. The Traffic Engineering Division conducted a postcard survey of
the abutting property owners. Of the 13 affected property owners four
residents chose not to respond to the postcard survey. Of the nine
responding residents five residents favored the proposed change and four
did not favor a one-way alley. Traffic Engineering is taking this action
based upon the simple majority decision of the responding residents.

This action is being taken to ensure that the senior citizens using

I checked the citys payments to negotiator Steven Rynecki and as of March
25th, 1981 he had recieved $28,465.86. His services for April, May and
June have not been paid .
The city* while praising the "fairness" of the factfindcrs report and
alleging the polmce union wants to settle FAR beyond that takes no interest
in the cost of negotiations to the taxpayer. Neither does it account for
the continuation of these costs b y city appeals.
The leCislature has provided us with a method whereby contrazt disputes can
be settled. Police and fire personnel are prohibited by good conscience and
law from striking. In place of this option is arbitration. This years
negotiations were alleged to have exceeded the statutory time limits.
The city went to arbitration with the fire union after granting an extention
of time limits but appealed to PERB to avoid doing the dame with the police.
PERB found that the delay was their fault and the city is obligated to go
arbitration. The council must now decide whether to appeal that decision
to district court. I have just made public the terms under which they
could settle the contract so we have a good idea what that will cost -
How much will another appeal cost? In whose interest is it to appeal?
If it is the intent of the council to promote efficient government and
protect the taxpayers dollars, lets settle the contract.
We ask what is right, and what will eventually happen, the right to submit L
unreconcillable ussues to a neutral, disinterested third party for
binding arbitration. We ask the council not to appeal the PERB decision.
We ask that public bargaining tn began as soon as possible to attemt to
a•:oid arbitration. We ask that the public support our right to a contract
and the right to have arbitration if no agreement can be reached in a
reasonalEie time. The city has either negotiated, arbitrated or granted
raises to all other city employees whhich have exceeded our aekings.

There are three past or present activities which qualify
me for this position. Firat, I use the facilities. Two, I
huvo r,xpr�rlence in operating parks and recreational facilities.
Specificallv, I worked, for one year, at a park in Virginia, and
during college I worked at a Y. M. 0. A. summer camp. Together,
these have allowed me to see recreational facilities from both
ends, 1. e. as an employee and as a user. Three, my training
as a scientist will help me make logical decisions.
My knowledge of this board is based on three sources. Most
of this information was gathered several years ago when I pre-
viously sought appointment to this commission. One, I have
discussed the commission with board members; two, conservations
with city workers, in this area, including Dennis Showalter; and
three, I.follow press coverage of the city's activities in this
area.
I want to contribute something to this city and its citizens.
I believe that this is the best way for me to do that because of
my knowledge and interests. As today's economy forces both
the city and its citizens to become more fiscally conservative,
the important question for the 80's is: How can the city meet
an increase in demand on a limited budget? And I am sure that
there will be an increased demand ---people will be looking closer
to home for recreational activities.

Re: Assisted Housing Programs
A. Public Housing
The Housing Authority submitted, on July 17, 1979, an application for
20 units Public Housing, New Construction, Turnkey. A Program
Reservation was made by HUD on September 11, 1979, i.e., sixteen two-
bedroom units and four three-bedroom units, Contract Authority of
$66,240, Loan Authority of $922,950 and Budget Authority of
$2,649,600.
The lack of site approval by both the Authority and HUD makes
completion of this project highly improbable. To preserve those
dollars committed to Iowa City, it is recommended that a letter be
forwarded to HUD requesting the program be changed from New
Construction to Acquisition of Existing Units. If approved by HUD,
the Housing Authority will enter into an Annual Contributions
Contract with HUD, similar to the Turnkey ACC, and proceed to
purchase existing units that are on the market. HUD must approve
each unit as to price and location.
This can be implemented by a simple motion during your formal
meeting. A resolution is not required.
B. Section 8 Moderate Rehabilitation
HUD has invited the Authority to submit an application for an
unspecified number of units in the Section 8 Moderate Rehabilitation
Program. A brief explanation of the program follows. Assume an
application for 30 units was submitted and approved for twenty two-
bedroom and ten three-bedroom units, ACC amount $136,000 per year.
The Authority advertises the availability of the program and
solicits proposals from property owners. Each proposal is evaluated
and specific units selected. Tenants (if occupied) are interviewed
to determine eligibility for rental assistance. No unit may be
occupied by ineligible tenants. No relocation is provided for in
this program. A work write-up and cost estimate is prepared by the
Authority. If the owner agrees as to the initial estimate and
required work, he obtains assurance of rehabilitation financing (if
required). A contract rent is established, i.e., the maximum rent
that will be approved after completion of rehabilitation. Firm
commitments are received from contractors that will perform the
rehabilitation and a start -finish date is established. The owner and
the Authority sign an Agreement to Enter into a Housing Assistance

Payments Contract upon completion of the rehabilitation and
acceptance by the Authority. The PHA inspects during contract
performance and upon completion the HAP contract is signed. This
contract will place the rental assistance with the unit rather than
with the tenant and will cover a 15 year period. After completion
and occupancy, the administrative actions are the same as for the
Section 8 Existing Housing Program.
Please note that in the event the quest to obtain the above programs
is successful, additional staff will be required for implementation.
The number and specific duties have not been determined however,
salaries and related costs will be borne by the Assisted Housing
programs and will not be a direct cost to the City's general budget.
The specifics will be developed after HUD approval of the programs
and during program budget preparation.
