ZIMT OF IOWA CITY I wish to hereby reply to the city rxu:rcil's recent statements to the press, to the city attorney's statements to me and the press and to all officials of the city government. A group of citizens recently filed a " Citizen's Complaint" of possible conflict of interest. concerning Larry Lynch, City Councilor, The complaint mas made in writing, in good faith, and at the suggestion of the city council itself at a city counc57 meeting. It was d.one with the understanding that the city attorney, John Hayek, would fully investigate the complaint , a._ .:^ pledged to do at that city council meeting. To my knowledCe there was no form or legal procedure, except lawsuit, for citizens to file such an action, A lawsuit action would have shown lack of good faith on our part and could have quite possibly been at odds with the intent of the complaint. Those people who signed the complaint did so in good faith, within their rights as citizens, seeking some honest and straightforward answers to some honest questions. j The City's reply, I feel,am^ ="mewhat lacking in respect for the public, especially in light of I-Ir.Hayek`5 public pledge, it seems inappropriate to call a letter to a reporter a full investigation and is somewhat disrespectful'. to all the people who signed the complaint. Considering there was no form In the city clerk's cffice for filing such u complaint, or any set procedure, or any precedent to my knowledge, it is not surprising that Mr. Shantz, the state's Solicitor General, should find our complaint "unclear', Flr. Shantz may find matters "unclear" legally but we felt the circumstances acre clear enough to justfy our asking some relevant questions. The people do not always have access to documents that have a bearing on how they are being goverened. In December of 1979, shortly after the last city council election, the Iowa City Federation of Labor,AFL-CIO, sent a letter to the Iowa City Council concerning the Freeway 518 issues. In that letter we stated "Like most residents of Iowa City and Johnson County we are anxious to see Freeway 518 built as soon as possible." With the worsening of the recession our need for jobs to feed our families is even more pressing . If any city councilors thought it was ever our intent to delay construction of Freeway 518, they have very short memories . And, I might add, our letter was written 12 years before the advent of TV lights andcablevision at the city council meetings and 'before any complaints were presented orally or in writinz. These facts make Mr. Lynch's claim he wasn't sure what we were referrin to quite ludicrous. Equally absurd is the insinuation by some city councilors that complaints have been made because TV cameras are present in the city council chambers, The city council is now treading on thin ice In attempting to regulate what matters may be brought up for public discussion at their meetings. Despite serious attempts by the New Right to erode it , roro ^.'ill enjoy the protections of the First Amendment to the U.S. Constitution. Who on the city council will decide what is a "personal attack' or a relevant matter? Will Mayor Balmer consider any attack on the city government a "persona]. attack" on him? Whatgriddlines will he follow before banging the gavel down? Will TV paranoia effect what is a relevant matter in the council members' minds? The First Amendment may indeed be in trouble here, Ther are many worthwhile projects tiv,t citizens, and workers and tho city n council can work on together as a team. Hopefully the people of Iowa City will not forget that the city council nerves at their pleasure and is supposed LL.Lu Jr^ m 0O & soon�kD be lrasrpossible. This action will be taken prior to the opening of the City's new public library. COMMENT: This action is being taken to provide for a short-term free loading zone for patrons of the City's new public -library. It will provide for short duration parking while library -patrons pick up or return items placed on reserve. This action will be taken on or shortly after June 24, 1981. COMMENTARY: This action is being taken after the Traffic Engineering Division has conducted the counting program at this installation. The volumes and characteristics of this intersection require that some form of right of way control be installed at the intersection be installed at the intersection.
