Comment: The owners of the property located at 2685 Indigo Court received assistance through the City of Iowa City's HOME Investment Partnership Funds. As a condition of use of HOME funds, the owners had to sign a Resale Agreement to ensure that it would be sold to an income eligible family. CONSIDER A RESOLUTION ACCEPTING CIVIL PENALTY AND WAIVER OF RIGHT TO HEARING FROM JOHN'S GROCERY, INC. Comment: This Resolution accepts a waiver of right to hearing and payment of a $1500 civil penalty, as set out in Iowa Code section 453A.22(2), by John's Grocery, Inc., 401 East Market Street. Section 453A.22(2) provides that, after a hearing, a $300.00 civil penalty will be assessed to a retail cigarette permit holder when and if that permit holder's employee violates Iowa Code section 453A.2(1) by selling or providing tobacco to a minor. The civil penalty for the second time the permit holder's employee violates Section 453A.2(1) within atwo-year period is either $1500.00 or a thirty (30) day retail cigarette permit suspension, at the option of the permittee. This is the second time within atwo-year period that an employee of John's Grocery, Inc. has violated Section 453A.2(1). By signing the appropriate waiver and paying the $1500 civil penalty, John's Grocery, Inc., waives its statutory right to have a hearing on whether the civil penalty should be assessed. f) Correspondence. 1. (Item "b" will proceed as outlined in the City Attorney's memo of 2/28/07 entitled "Rezonings, Due Process and Ex parte communications.") a) TO AMENDING THE COMPREHENSIVE PLAN TO INCLUDE THE UPDATED HISTORIC PRESERVATION PLAN Comment: At its November 7 meeting, by a vote of a vote of 7-0 (Trimble absent), the Historic Preservation Commission recommended approval of the Historic Preservation Plan. At its January 17 meeting by a vote of 4-1 (Brooks and Smith absent, Eastham voting no), the Planning and Zoning Commission recommended approval of an amendment to the Comprehensive Plan to include the Historic Preservation Plan, which contains policies and recommendations for the identification, preservation and regulation of historic landmarks, properties and neighborhoods. The plan was included in the Council's February 7 information packet 1. PUBLIC HEARING Action: a 2. ~ CON IDERR A/R S Action: See.. e X~~ e~ ~ U~a~~ b) CONSIDER AN ORDINANCE CONDITIONALLY REZONING APPROXIMATELY 4.40 ACRES OF LAND AT 2815 ROHRET ROAD FROM LOW-DENSITY SINGLE FAMILY RESIDENTIAL (RS-5) TO COMMERCIAL OFFICE (CO-1) (REZ07-00016) (DEFERRED FROM 1129 - SECOND CONSIDERATION ) Comment: At its January 2, 2008, meeting, by a vote of 6-0 (Shannon absent), The Planning and Zoning Commission recommended approval of this rezoning subject to conditions to ensure that the property develops in a manner that is compatible with the surrounding residential neighborhood. Staff recommended approval in a report dated December 20. Approval will allow this property to be developed with office space in accordance with the concept site plan submitted. TO DISCUSS THE PROPOSED OPERATING BUDGET FOR THE FISCAL YEAR JULY 1, 2008 THROUGH JUNE 30, 2009, THE PROPOSED THREE-YEAR FINANCIAL PLAN, AND ALSO THE MULTI-YEAR CAPITAL IMPROVEMENTS PROGRAM THROUGH FISCAL YEAR 2012. Comment: Public Hearing to discuss the FY2009 Proposed Operating Budget, the three-year Financial Plan for FY2009 - FY2011 and the multi-year Capital Improvements Program (CIP) through fiscal year 2012. Detailed information on the budget became available for public inspection on February 8, 2008. Resolutions to adopt the Annual Operating Budget, three-year Financial Plan and multi-year Capital Improvement Program are scheduled for March 4, 2008. Correspondence included in Council packet. Comment: This hearing is the time designated for the Council to consider whether to adopt a Resolution assessing the $300.00 civil penalty authorized by Iowa Code section 453A.22(2) against Delimart #2, 1920 Lower Muscatine Road. Section 453A.22(2) provides that, after a hearing, a $300.00 civil penalty will be assessed to a retail cigarette permit holder when and if that permit holder's employee violates Iowa Code section 453A.2(1) by selling or providing tobacco to a minor. As a part of the hearing, the Council will be provided with information establishing an employee of permit holder Delimart #2's violated Iowa Code section 453A.2(1). The permit holder's representative will then have the opportunity to provide the Council with information s/he deems appropriate. The Council will then decide whether to assess the requested civil penalty and, if it decides to do so, will adopt an appropriate Resolution. Comment: At its December 7, 2007 meeting, the Public Art Advisory Committee recommended by a 6-0 vote to select artwork by BJ Katz of Meltdown Glass for installation in the Robert A Lee Recreation Center Pool Room. The contract amount is not to exceed $65,050. The installation lighting for the artwork will be the responsibility of the City. . Action: February 19, 2008 City of Iowa City ITEM 10. CONSIDER A RESOLUTION AUTHORIZING THE THE INTERNATIONAL COUNCIL OF LOCAL ~ ' ~ (ICLEI) AND PARTICIPATE IN ITS "CITIES CAMPAIGN. Page 9 CITY OF IOWA CITY TO JOIN ENVIRONMENTAL INITIATIVES FOR CLIMATE PROTECTION" Comment: The International Council for Local Environmental Initiatives, or ICLEI, is an international association of local governments that have made a commitment to sustainable development. Their basic premise is that locally designed initiatives can provide an effective and cost-efficient way to achieve local, national, and global sustainability objectives. ICLEI works with about 700 governmental bodies around the world through performance-based, results-oriented campaigns and programs. Through membership, Iowa City can utilize technical consulting, training and information services to target and achieve our local sustainability objectives. The annual membership fee is $1,200. CONSIDE A RESOLUTION APPROVING A LEASE AND~TEMPORARY CONSTRUCTION EASEMENT WITH MERSCHMAN SEEDS, INC. AND o ~'-5p REGENNITTER FARMS, INC. TO LEASE AND CONSTRUCT AN ACCESS WAY FROM MORMON TREK BLVD. TO THE NORTH/SOUTH RUNWAY. Comment: The Airport Commission leases some of the airport land for agricultural purposes to Regennitter Farms, Inc. ("farmer"). The farmer would like to contract with Merschman Seeds, Inc. to permit Merschman to plant test plots in the area between the north/south runway (which is closed) and Mormon Trek Blvd. In order to facilitate the planting and viewing of the test plots, Merschman would like to construct and lease an access way from Mormon Trek to the runway at Merschman's cost. Although the proposed access way is located primarily on airport property, it also is partially located on City property. Merschman has obtained a curb cut permit from the City for this purpose. Because Merschman will be constructing and maintaining the access way and because the City/Airport will own the improvements at the end of the lease, Merschman will not pay any rent. At its meeting on December 13, the Airport Commission agreed in principle to enter into atwo-year lease with Merschman and will consider this lease and the temporary construction easement at its meeting on February 14. Also on the Commission's agenda will be an agreement for Merschman to install a security gate at its cost. Action: February 19, 2008 City of Iowa City Page 10 ITEM 12. CONSIDER A RESOLUTION APPROVING SETTLEMENT OF PENDING LITIGATION. Comment: This Resolution will confirm and ratify a proposed settlement of pending ~S~rJ`~' , f litigation which is scheduled for discussion during the executive session scheduled for Tuesday, February 19, 2008.
