AGREEMENTS: The utility company, corporation, applicant, permlltee, or licensee, (hereinafter referred to as the Permittee)
agrees that the following stipulations shall govern under this permit.
1. The location, construction and maintenance of the utility Installation covered by this application shall be In accordance with the current
Iowa State Highway Commissloo Utility Accommodation Policy.
- 2. The Installation shall meet the requirements of local municipal, county, state, and federal laws, franchise miss, and regulations, tegula-
lions and directives of the Iowa Stale Commerce Commissloo, Utllltlea Dlvlslon, the Iowa Stale Department of Health, W rules and tegula-
dons of the lova Stale Highway Couuulaslon, and any other laws or regulations applicable.
3. The Permittee shall be fully responsible for any future adjustments of its ficilltles within the established highway right of way caused
by highway construction or maintenance operations.
4. The Iowa Slate Highway Comml salon shall glue the permlltee ■l least 68 hours written notice of any proposed construction or maintenance 1
work, on either existing or newly acquired rlght-oj.way, that Is likely to connict with the Installation belonging to The Permltlee, In order that
the Permittee may arrange to protect its facilities.
S. The State of Iowa and the Iowa Slate Highway Commissiop assume no fesponslbl:ily for damages to the Permltlee's properly occuloned by
any construction or maintenance operations on said highway. _
6. The Permltlee shall take all reasonable precaution during the construction and maintenance of laid lnsWlallon to protrcl and safeguard
the lives and properly of the traveling public and adjacent property owners.

Re: Parking on Madison Street
As directed by Section 23-16 of the Municipal Code of Iowa City, this
is to advise you of the following action:
ACTION
Pursuant to Section 23-234 of the Municipal Code of Iowa City, the
City Traffic Engineer has directed that signs be erected on both the
east and west side of Madison Street from the intersection of Madison
Street/Prentiss Street north to the intersection of Madison
Street/Davenport Street R.O.W. These signs are being erected as
portions of the newly constructed Madison Street are open to general
traffic. We have anticipated that this length of Madison Street will
be completely opened to vehicular traffic during the second week of
December, 1980.
COMMENT
This action is being taken in conjunction with the reopening so that
the newly paved facility .does not present confusing parking
situations to the public. This total parking prohibition is at
variance with some previous parking conditions on Madison Street. In
most instances where variance occurs, it is due principally to a
change in the width of the new Madison Street over the old Madison
Street. It is felt that the new configuration and parking conditions
will better serve vehicular traffic access to the abutting land uses.

As directed by Section 23-16 of the Municipal Code of Iowa City, this
is to advise you of the following action:
ACTION:
Pursuant to Section 23-234 of the Municipal Code of Iowa City, Iowa,
the City Traffic Engineer will direct that signs be erected on both
sides of Sturgis Corner Drive from its intersection with Highway 6
northwesterly to its intersection with Riverside Drive. This action
will be taken on or shortly after 29 December 1980.

Re: Loading Zones in the 100 and 200 Block of South Clinton
Street
As directed by Section 23-16 of the Municipal Code of Iowa City,
Iowa, this is to advise you of the following action:
ACTION:
Pursuant to Section 23-289 of the Municipal Code of Iowa City, the
City Traffic Engineer will direct that signs be installed in the new
loading zone bays in the 100 and 200 blacks of South Clinton Street
as follows: 3 loading zone bays on the east side of these two blocks
Of South Clinton Street will be designated "no parking - commercial
vehicle loading zone" with a maximum occupation time of 30 minutes.
The three loading zone bays on the west side of Clinton Street will
be designated by sign as "no parking - loading zones - with a maximum
occupation time of 15 minutes - driver must be in vehicle". These
loading zone designations will be fully implemented on or shortly
after 29 December 1980.
COMMENT:
These loading zone designations are consistent with the conceptual
planning which was done at the inception of the Clinton Street
project. By the end of December, 1980, the bulk of contractual work
will be completed in the Old Capitol Mall. It is felt that these
loading zone bays will better serve those shoppers who are attempting
to pick up large size parcel purchases which are inconvenient to
carry to their parked car. The stipulation requiring the driver to
be in the car is being suggested to discourage short-term parking for
the purposes of "run-in shopping". The east side commercial vehicle
loading zone designation is being retained to provide service
vehicle access to those stores fronting on Clinton Street.

Dear John,
Although the new zoning ordinance is not complete, I
must resign from the commission. My re -appointment to the
commisel0n was based on my staying on the commi3sion until
the adoption of the ordinance which was.Viewed as a reasonably
short time. As we all know, the time has been greatly ext-
ended. We should have reviewed all of the ordinance by Jan.
1, 1981 and it is an of this date that I wish to resign.
I will be taking on new duties with the Iowa City Cham-
ber of Commerce which will be very demanding on my time after
the first of the year. I am also going to have to be out of
town 6 weeks next year for a job I have taken with the National
luggage Dealers Association. It would be unfair to the other
members of the commission for me to miss so many meetings.
If my position is not filled by Jan. 1, 19810 I will
continue to serve as I am able until a new aupointment Is made.

TO THE FOLLOWING COMMISSION:
HUMAN RIGHTS COMMISSION
Three vacancies - Three-year terms
January 1, 1981 - January 1, 1984
The duties of the members of the Human Rights Com-
mission are to provide for the general welfare of
the citizens of Iowa City by studying the relation-
ships of people of various races, colors, creeds,
religions, nationalities, sexes and ancestries liv-
ing within the community. To provide procedures
for the operation of said Commission to eliminate
prejudice, intolerance, bigotry and discrimination
in the City of Iowa City, Iowa, by declaring dis-
criminatory practices in the areas of public accom-
modations, employment and the leasing, sale, finan-
cing or showing of real property to be against
public policy and to provide procedures for the in-
vestigation of complaints and conciliation and to
provide for enforcement.
Iowa City appointed members of boards and commis-
sions must be qualified voters of the City of Iowa
City.*
The appointments to the Commission will be made at
the December 16, 1980, meeting of the City Council
at 7:30 P.M. in the Council Chambers. The actual
terms will begin January 1, 1981. This will allow
an opportunity for the appointees to attend meet-
ings of the Human Rights Commission to become
familiar with the duties of the Commission before
accepting full responsibility. Persons interested
in being considered for these positions should con-
tact the City Clerk, Civic Center, 410 East Wash-
ington. Application forms are available from the
Clerk's office upon request.

Individuals serving on Boards/Commissions play an important role in advising the Council
natters of interest to our community and its future. Applicants must reside in Iowa City.
The City Council announces advisory board vacancies 60 days prior to the date the
appointment will be made. This 60 -day period provides for a 30 -day advertising period and a 30 -
day training period for new members. The training period allows new members to become familiar
with the responsibilities and duties of the advisory board before becoming a full voting
member.
After a vacancy has been announced and the 30 -day advertising period has expired, the
Council reviews all applications during the informal work session. The appointment is
announced at the next formal Council meeting. Appointees serve as unpaid volunteers. j
All applications must be submitted to the City Clerk no later than one week prior to the j
announced appointment date.

11. Yuman Rights advocacy including employment, housing, credit,
and public accomodations discrimination has always been an important
part of my law practise. I have appeared numerous times in the
State and Federal Courts and in front of many administrative agencies
litigating civil rights issues.
This experience has required a working knowledge of State,
Federal and municipal civil rights law. Also, my work, experience has
required that I develop an ability to analyze fact situations
in light of the applicable laws. In the course of this work I have
developed a strong interest in the field of advocacy of human rights.

The Iowa City Human Rights Commission appreciates this opportunity to
provide the City Council with our perceptions of current membership needs.
As you review applications and make the appointments, we ask you to
consider the following Commission observations:
1) Hispanic representation. As you know, Hispanic peoples represent
the largest growing minority in the country. Presently, over five
percent of Iowa's population is of Latin origin. Therefore, we
request that an affirmative effort be made to compensate for our
current deficiency.
2) _Blue collar representation. The Commission has traditionally
attracted more professional persons. So that we can address employ-
ment situations other than professional more effectively, we ask you
to appoint a blue collar worker.
3) Prior Complaint Resolution and/or Conciliation. With Mori
Costantino s leaving, we will be left with a relatively
inexperienced Commission in this area. Any candidate who has had any
experience or exposure to this, in any setting, should be strongly
considered.
4) Leqal training. Although we have able staff counsel assigned to the
Commission, we believe that the Commission could be enhanced with a
lawyer with both legal and community perspective.
In the past we have recommended specific candidates for your
consideration. Rather than restrict the selection process in such a way,
this year we are informing you of our weaker areas. The Commission is
always aware of its charge to remain fully representative of the Iowa City
community. We hope you will be mindful of our suggestions toward this aim
as you make the appointments.

Duties: In appropriate cases and subject to appro-
priate conditions and safeguards, make special ex-
ceptions to the terms of the ordinances in harmony
with general purpose and intent and in accordance
with general or specific rules therein contained
and provide that any property owner aggrieved by
the action of the Council in the adoption of such
regulations and restrictions may petition the said
Board of Adjustment directly to modify regulations
and restrictions as applied to such property owners.
It can only act pursuant to the zoning ordinance.
It has no power to act upon any ordinances other
than the zoning ordinance. It cannot grant a vari-
ance unless specific statutory authority provides
for granting a variance. Variances granted under
Iowa Code, Chapter 414.2(3) and Iowa City Munici-
pal Code 8.10.28H 1(d) may only be granted in the
case of "unnecessary hardship." The hardship must
be substantial, serious, real, and of compelling
force, as distinguished from reasons of convenience,
maximization of profit or caprice.

sions must be qualified voters of the City of Iowa
City.
This appointment will be made at the December 16,
1980, meeting of the City Council at 7:30 P.M. in

There are three past or present activities which qualify
me for this position. First, I use the facilities. Two, I
have experience in operating parks and recreational facilities.
Specifically, I worked, for one year, at a park in Virginia, and
during college I worked at a Y. M. C. A. summer camp. Together,
these have allowed me to see recreational facilities from both
ends, 1. e. as an employee and as a user. Three, my training
as a scientist will help me make logical decisions.
My knowledge of this board is based on three source,. Most
of this information was gathered several years ago when I pre-
viously sought appointment to this commission. One, I have
discussed tho commission with board members; two, conservations
with city workers, in this area, including Dennie Showalter; and
three, I.follow press coverage of the city's activities in this
area.

After serving four years on the Iowa City Parks and Recreation Commission, I
feel that I am very well qualified to be re -appointed to a 4 year term starting
January 1, 1981. During this 4 year period, I have learned, the inner workings
of the Commission, and how to deal with the staff and other commission members.
I believe that during my term on the Commission we have made great strides
in the area of Parks and Recreation. New programs have been started, new
shelters have been built, etc. Also I have appeared before the Council to
present our budget requests, and other areas where you requested Commission
input on certain matters (sale of Elm Grove Park)
For the past 4 years I have been a part of this Commission, and would like
to continue this service for another 4 years. I hope the Council will agree

RE: Areawide Housing Opportunity Plan (AHOP)
1. AHOP - A Plan to implement activities developed by an Area Planning Organi-
zation and participating jurisdictions, approved by HUD, which specifically
addresses areawide housing assistance needs and goals. The AHOP program ob-
jective is to encourage, facilitate and provide a broader geographical choice
of housing opportunities for lower income households (with particular atten-
tion to families and large families), outside areas and jurisdictions con-
taining undue concentrations of low income or minority households. An AHOP
is a cooperative effort between the Area Planning Organization and Partici-
pating Jurisdictions within the Plan Area for the development and Implemen-
tation of a coordinated areawide strategy for the distribution of housing
assistance in such a manner as to promote the objective outlined above. The
Plan will serve as a comprehensive and consistent guide for the geographic
distribution of housing assistance within the Plan Area. After approval by
HUD, it will serve as a basis for the distribution of all contract authority
allocated by HUD within the approved plan area.
2. An approved plan must contain -
a. Assessment of need.
b. Goals and procedures for distributing allocations. This yields a Fair
Share Allocation.
c. Outreach requirements.
d. Identification of barriers.
e. Implementation activities to overcome barriers.
f. Evidence of Agreement. This serves to indicate the participating juris-
diction's commitment and acceptance of their jurisdictionlo share of the
established goals and their willingness to undertake activities that are
tied to plan implementation. To be approved by HUD the plan must con-
tain letters of agreement from SO percent of the localities representing
at least 7S percent of the population of the Plan Area.
3. East Central Iowa Council of Governments (ECICOG) is proposing the develop-
ment of an AHOP. Attached is a Draft Study Design for preparing an AHOP.
Jim Elza, Director of ECICOG has requested the Iowa City City Council ap-
prove the attached Study Design and provide a letter of intent to sign an
Agreement upon receipt of a completed and acceptable plan.
4. This subject has been discussed with the Housing Commission and their recom-
mendations to the Council are:
a. That the City Council of Iowa City approve the Study Design with the
following stipulations:
1. Credit be given 'to those localities that are providing low
income housing in the final "Fair Share" calculations.

the opportunity for direct input in developing barriers
and activities to be taken to overcome those barriers.
b. That the Council of the City of Iowa City approve the attached letter
of intent and the Mayor sign same.
5. Identification of barriers to increasing access of low-income households
to housing in non -concentrated areas and barriers to increasing the pro-
vision of this assisted housing are essential elements of the A.H.O.P.
It will serve as a basis for stating problems and developing strategies
to remove or overcome the problems. Examples only: -
Barrier to increasing access to housing - Lack of property owner participa-
tion in the Section 8 Existing Program. Strategy - Provide all rental pro-
perty owners in the area with information concerning the program, stressing
the positive factors.
Barrier to increasing the provision of assisted housing - Scarcity of suit-
able and acceptable multi -family building sites. Strategy - Identify suit-
able and acceptable sites and modify restrictive zoning practices such as
lot size or density restrictions. Develop program for land write-down or
other preconstruction costs utilizing-CDBG entitlement funds.
Because of the importance and relevancy, it is felt that'the city Housing
and Planning staff must be provided the opportunity for input during the
development of this part of the plan.
6. Impact on the City of Iowa City. ECICOG must produce a plan acceptable to
Iowa City before an actual letter of agreement is signed. Once this has
occurred and HUD has approved the plan, the impact on the city will be
negligible. The change in classification of the city from Non -Metro to an
SMSA will have some effect on HUD allocation plans. Extent unknown at this
time. With an approved A.H.O.P., designation as a separate allocation area
is possible. At this point in time there are no known negative factors.
7. The staff concurs with the recommendations of the Housing.Commission.

PART II GOALS AND PROCEDURES FOR DISTRIBUTING HOUSING ASSISTANCE
The Housing Opportunity Plan (HOP) differs from the Housing Assistance
Plan (HAP) in goal setting and distribution procedures. In the HAP
goals are proportional to needs, but in the HOP goals include a variety
of factors beyond a simple proportional relationship to need.
This difference between HAP and HOP is basically derived from differences
in the program objectives. Where the HAP is concerned with providing
housing by type and tenure in accordance with need; the HOP is directed
at promoting housing opportunities outside concentrated areas which consider
the unique character of each plan area.
Flexibility is allowed in developing the allocation procedure, but, by
regulation seven areas must be taken into consideration. These areas
are:
(1) current and projected housing,
(2) current and projected changes in population and its distribution
(3) an assessment of families expected to reside based on employment
and spatial deconcentration,
(q) present locations of assisted housing,
(5) rehabilitation resources and housing vacancies,
(6) jurisdictional capacity to accommodate assisted housing, and
(7) policies concerning community development, economic development,
land use, transportation and environment.
Each of these and other factors must be weighed as to its relative
significance in establishing allocation goals. The allocation goals must,
at a minimum, be percentage goals; but numerical goals are more useful
and are preferred.
Allocation Methodology
Step 1: Calculate data for five factors used to determine fair share:
(1) share of households, 1980
2) share of expected household growth, 1990
3) share of jobs, 1980
(4) share of expected job, growth, 1990
5) share of Section 8 eligible households, 1975
Step 2: Determine relative share scores of these indicators compared to
regional total for each jurisdiction.
Step 3. Add the five scores for each jurisdiction and divide by five.
Result is the community's percentene share of subsidized housing.

Step 4. Multiply percentage share times the sum of existing units. and
future need for units. The result is the jurisdiction's fair
share of housing units.
Step 5. Subtract existing units from the fair share of units for each
jurisdiction. The result is past unmet subsidy need as well
as future need for subsidized housing.
Step 6. Translate the jurisdiction's fair share number to a percentage
by dividing by the number of households expected to need
assistance over the next 10 years.
Step 7. Derive 3 year and 10 year goals by multiplying the fair share
percentage times the expected funding level of subsidized housing
This methodology provides for the fair share allocation of units by
jurisdiction but does not consider the capacity of a jurisdiction to
accommodate subsidized housing. Ranking of jurisdictions by (1) capacity
and (2) limiting factors accomplishes this objective and fulfills the last
three criteria requirements.
Step 1. Calculate data for factors used to determine priority ranking.

(3 degree of urbanization, 1980

Step 2. Rank order jurisdictions and assign scores based on relative
position within•each of the four factors.
Step 3. Divide sum of scores for each jurisdiction to determine rank order
coefficient.
Step 4. Consider limiting factors in each jurisdiction which may cause
deficiencies in capacity.
(1) water supply
(2) sewer service
3) transportation
4) other
Step 5. Prioritize jurisdiction in accordance with rank order coefficients
and limiting factors.
The prioritization of a jurisdiction's ability to accommodate subsidized
housing makes a statement about which jurisdictions have the greatest or least
ability to successfully support a project. It does not in itself determine
which jurisdiction should receive housing first, etc.

PART IV IDENTIFICATION OF BARRIERS
The identification of barriers serves as a problem statement for defining
the kinds of activities which should be included in the AHOP implementation
program. Each barrier identified should be followed up with a strategy in the
implementation program designed to remove or modify the barrier. The two
types of barriers are: (1) barriers to increasin access of low income and
minority households to nonconcentrated areas, and 2 , barriers to increasing
the provision of assisted housing in nonconcentrated areas. The regula-
tions do not require a separate identification of these barriers, however,
a separate identification of barriers which inhibit access of low income
households to nonconcentrated areas is strongly recommended.
Barriers must be identified in specific terms that lend themselves to the
development of specific implementation activities.
Barriers must also be within the immediate capability of an APO or local
governmental bodies to readily resolve.
Barriers which might be considered are listed below. Barriers to
increasing access .to housing are listed separately from barriers to
increasing the provision of assisted housing.
Barriers to Increasing Access to Housing
1. Residence preferences should be identified as a barrier in all
AHOP applications, unless Housing Authorities withl�� the plan
area have eliminated these preferences.
2. Limited knowledge of fair housing laws within the area, and no
established program for responding to fair housing complaints
and inquiries:
3. Lack of advance knowledge to low income households living in
concentrated areas of the availability of housing in non -
concentrated areas.
4. Lack of local administrative capability or time devoted to
conducting housing outreach activities.
5. Lack of property owner participation in the Section 8 Existing
Program.
6. Lack of housing counseling organizations to provide low income
and minority persons with housing information and related services.
7. Lack of knowledge about affirmative marketing and non-discrimination
management practices by real estate firms, developers, PHAs,
housing counselors, relocation aides, property managers and
I non-profit organizations.

PART V IMPLEMENTATION ACTIVITIES TO ADDRESS BARRIERS
Implementation program consists of various strategies designed to
remove or modify identified barriers. These strategies include:
(1) outreach activities directed at barriers identified in the AHOP
as restrainingaccess to housing, and (2), activities directed at
identified barriers to increase the provision of assisted housing
in nonconcentrated areas.
Implementation programs must address the barriers specifically and
clearly identify the separate responsibilities of the APO and par-
ticipating jurisdictions in the execution of activities.
Outreach Activities to Increase Access
A viable strategy of outreach activities to ensure access of low income
households to housing in nonconcentrated areas is a key AHOP element.
There are a number of activities which can be used to expand lower-
income knowledge of and access to housing opportunities in non -
concentrated areas and jurisdictions. These activities include:
1. Eliminating residency preferences for Section 8 and other
assisted housing programs. This is a most effective way of
increasing housing choice, especially since the Section 8
existing program has proved to be an acceptable form of housing
assistance for many jurisdictions.
2. Providing advance notice to low-income and minority residents
of the availability of units in nonconcentrated areas. This has.
proved to be an effective way of promoting access, since the
availability of assisted housing is scarce and developments become
filled by local residents often without the need of any sort of
advertising.
Activities to Increase the Provision of Housing
These are housing related activities tied to the delivery of housing
assistance resources while furthering the achievement of regional hous-
ing goals. The provision of family and large family housing should be
included as an activity in the implementation program unless it is clear
that this is not a housing issue within a plan area.
Other activities which may be considered are:
I. Modifying restrictive zoning practicies, including lot size require-
ments, building area standards, and density restrictions.

PART VI EVIDENCE OF AGREEMENT
The Evidence of Agreement serves to indicate the degree of local
political commitment by participating jurisdictions to the AHOP
program. The Agreement consists of two elements: (1) the agree-
ment on the percentage housing goals established for the juris-
diction, and (2) the agreement on the implementation activities
outlined in the AHOP plan;
The Evidence of Agreement should indicate acceptance of their
jurisdiction's share of the housing goals established by the AHOP
plan and a willingness to undertake activities which are tied to
plan implementation.
A letter of agreement is the usual form of Evidence of Agreement
used by jurisdictions, but other forms of agreement are acceptable.
Failure to identify specific implementation activities which will
be undertaken'1by a jurisdiction in support of the AHOP program is
the most frequent problem.
