HomeMy WebLinkAbout1980-12-15 OrdinanceORDINANCE NO. 80-3015 AN ORDINANCE AMENDING SECTION 8-59 OF THE CODE OF ORDINANCES TO ALLOW THE WAIVER OF SIZE LIMITATIONS FOR BUILDINGS TO BE MOVED UPON CITY STREETS. SECTION I. PURPOSE. The purpose of this ordinance is to allow the Building Official, with the concurrence of the City Forester and the Parking System Supervisor, to waive the size limitations for buildings to be moved upon City streets. SECTION II. AMENDMENT. Section 8-59 of the Code of Ordinances is amended to read as follows: No building shall be moved upon or through the streets of the city which exceeds thirty-four (34) feet, including overhang in width or which exceeds thirty (30) feet loaded height. (- Said size limitations may be waived by the Building Official, with the concurrence of the City Forester and the Parking System Supervisor, if in their opinion the oversized building may be safely moved on the proposed route, without danger to property or public improvements.') No building shall be moved upon or through the streets of the city to a lot in the city if the value of such building before moving is less than forty (40) percent of the value of a new building of the same type. No building shall be moved in or through the streets of the city to a lot in the city if such building is in such deteriorated condition that, in the opinion of the building inspector, it is unsafe and a hazard. No building shall be moved on any route which in the opinion of the building inspector endangers other buildings or property. SECTIONIII. REPEALER. All ordinances and parts of ordinances in conflict with the provision of this ordinance are hereby repealed. SECTION IV. SEVERABILITY. If any section, provision or part of the Ordinance shall be adjudged to be invalid or unconstitutional, such ajudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconsti- tutional. SECTION V. EFFECTIVE DATE. This Ordinance shall be n effect after is nal passage, approval and publication as required by law. Date published 12/15/80 r� i ;tJ i j . t City of Iowa City MEMORANDUM DATE: December 12, 1980 TO: City Council FROM: Cit er RE: Mo Ing Ordinance In preparing final plans for the move of the former University of Iowa Credit Union building from its present location to a new location on Washington Street, it was discovered that the size limitations in the existing ordinance would prohibit such a move. While the size limitations generally are necessary because of the distances which houses usually are moved, in this case the size limitation is not sensible as the width of the street is adequate to accommodate the move. Because the move is scheduled for Tuesday morning, we have included with the informal meeting on Monday a special Council meeting which proposes an ordinance establishing a waiver procedure for the size limitations. j This change will permit the move of the Credit Union office. As it will take six Council members to approve the ordinance, it is important that ; all members be present Monday afternoon.
