The 1980-81 school year is well into the fall term. As the new
chairperson for the Safety Committee of the District Parent
Organization, I would like to thank the Iowa City Council and the
Iowa City School board for co-operating to continue the school
crossing guard program at its present staff for this year. It
is my understanding that there is sufficient money available for
the 1980-81 school year from the appropriations of the city and
that of the Iowa City school district to adequately cover the
budgetary needs for the existing twelve crossing guards now
operating in the Iowa City school district.
My recent conversations with Mr. Jim Brachtel, city traffic
engineer, and Mr. Don Akin, supervisor of the crossing guard
program, indicated that the 12 crossing guards can be maintained
at their present locations for the complete school year. The
District Safety Committee received notice from police chief Harvey
Miller that the crossing guard was removed from the rail crossing
at Greenwood Drive as there is no longer any rail service on the
track.
The District Safety Committee will continue to co-operate with the
city and the school district to help develop further recommendations,
if necessary, or to help resolve any problems regarding the school
crossing guard program to assure that it can be operated within the
allotted budget. Thank you again for meeting the budget needs for
tXie school crossing guard program for 1980-81. The parents of the
Iowa City community are very appreciative for your provisions
regarding the safety of their children while traveling to and
from school.

(Lenoch & Cilek, Inc. Project)
Our client, Lenoch & Cilek, Inc., desires the assistance of
Iowa City, Iowa, through the issuance of the City's Industrial
Development Revenue Bonds in an amount not to exceed $100,000.00.
These bonds would be acquired either by Iowa State Bank & Trust
Company, Iowa City, Iowa, or a sophisticated local private investor,
with the proceeds then being loaned to Lenoch & Cilek, Inc. Lenoch
& Cilek, Inc. will use the loan for acquisition of certain fixtures,
machinery, equipment and miscellaneous appointments, and the instal-
lation of those items into the new Lenoch & Cilek, Inc. store to be
located in the location presently occupied by J. C. Penney Company
at the corner of Dubuque and College Streets in Urban Renewal Project
area R-14.
The payment of principal and interest on these bonds, if issued
by the City, will be fully guaranteed by all shareholders of Lenoch
& Cilek, Inc. Additionally, as you know, the bonds will not consti-
tute an indebtedness of the City within the meaning of any constitu-
tional or statutory provision and shall never constitute nor give
rise to a pecuniary liability of the City or a charge against its
general credit or taxing powers. The purchasers of the bonds, as a
condition of the issuance thereof, will also agree to reimburse the
City for all costs incurred by the City in connection with the issu-
ance of the bonds.
The parties involved will be happy to meet with the City's Bond
Council or appropriate City Officials regarding the manner in which
this proposal should be pursued, including the development of the
general terms of the proposed financing and the presentation of a

Re: Parking on Sunset Street
As directed by Section 23-16 of the Municipal Code of Iowa City, this memo
is to advise you of the following action:
ACTION
Pursuant to Section 23-234 of the Municipal Code of Iowa City, the City
Traffic Engineer will direct that signs, prohibiting parking at all times,
be removed from both sides of Sunset Boulevard from Benton Street south to
the south loop intersection of Arbury Drive with Sunset Boulevard. This
action will be taken on or shortly after 17 October 1980.
COMMENT
The existing parking prohibition was installed at the time that Sunset
Boulevard had a dirt median. The dirt median has now been replaced with
PCC paving. There now is enough cross-sectional width to allow for two
travelled lanes plus two parking lanes.

City Traffic Engineer will direct that parking be prohibited on the north
side of Court Street from the center line of Clark Street extended
easterly 80 feet. Signs will be installed on or shortly after 17 October
1980.
COMMENT
This action is being taken to ensure greater visibility of pedestrians
using the crosswalk for westerly -bound traffic on Court Street.

RE: Septic Sewer System of the Jack Young Property
The old Elks Country Club (i.e., the Jack I. Young property)
has two "large" septic tanks which are under the jurisdiction
of the Johnson County Health Department. The capacity of the
septic tanks is not known.
However, the Johnson County Department of Health has informed
me that the subject property does not have sufficient area to
provide adequate septic service to the density that would be
allowed according to the proposed rezoning. There would have
to be at least nine acres for a septic field large enough to
accommodate 18 dwelling units. Before the City would issue a
building permit, the applicant would have to obtain a county
sewer permit. The question regarding the adequacy of septic
service is separate and apart from the zoning question being
presented to you.

Neighborhood
There are two houses and garages on South Dubuque Street which have been
acquired under the Small Cities Program, which can be moved to other
locations and rehabilitated. A third house that has been acquired, cannot
be moved, but has salvage value.
Bid packets have been assembled,requiring minimum bids of $2,500 for the
sale of the houses to be relocated, and a minimum bid of $500 for the sale
of the house for salvage. Several persons have indicated an interest in
bidding on these properties. After this public hearing these persons will
receive bid packets, and we will also advertise for bids.

This Agreement to Sell is made this day of

hereinafter called BUYER.
WHEREAS, the City of Iowa City, Iowa, is authorized and empowered by
state law to enter into agreements for the disposal of property owned by
the City of Iowa City, Iowa, and
WHEREAS, Resolution No. authorized the sale of certain property

of Iowa City, City Engineer of the City of Iowa City and the local
Zoning Administrator or to a location approved by the appropriate
governmental authority outside the city limits of Iowa City, within
sixty (60) days of the date of this agreement.
5. FORCED DELAY IN PERFORMANCE. Neither the SELLER nor the BUYER, nor
any successor in interest, shall be considered in breach, or default
of, its obligations with respect to the preparation of the property
for removal or demolition, or the commencement and completion of
removal or demolition, in the event of enforced delay in performance
of such obligations due to unforeseeable causes beyond its control
and without its fault or negligence. The time for the performance of
the obligations shall be extended for the period of the enforced
delay, as determined by the SELLER, if the party seeking the expenses
shall request it in writing of the other party within ten (10) days
after the beginning of the enforced delay.
6. REMEDIES.
In General. Except as otherwise provided in this Agreement, in the
event of any default in or breach of the Agreement or any of its
terms or conditions, by either party hereto, or any successor to such
party, such party (or successor) shall, upon written notice from the
other, proceed immediately to cure or remedy such default or breach,
and, in any event, within sixty (60) days after receipt of such
notice. In case such action is not taken or not diligently pursued,
or the default or breach shall not be cured or remedied within a
reasonable time, the agreed party may institute such proceedings as
may be necessary or desirable in its opinion to cure or remedy such
default or breach, including, but not limited, proceedings to compel
specific performance by the party in default or breach of its
obligations.
7. That the SELLER shall supply to the BUYER a list of deficiencies
concerning certain improvements that can be made by BUYER which shall
be remedied by BUYER within six (6) months of the date of this
agreement.
8. That BUYER shall secure a license prior to moving said property
pursuant to Ordinance No. 2469 (Chapter 8, Article V of the Municipal
Code of the City of Iowa City) and shall move said property according
to the sections and provisions of said Ordinance. This Agreement is
specifically subject to BUYER obtaining a moving permit and
complying with the provisions stated in Ordinance No. 2469 which by
this reference is made a part of this Agreement.
9. BUYER shall, prior to moving said property, remove all rubbish and
trash within said property and shall haul the trash and rubbish to
the municipal sanitary landfill at his/her own expense. BUYER agrees
to comply with standards and practices for protection of job site,
trenching, movement of heavy equipment and other similar standards
for demolition as set forth in the Uniform Building Code.
10. BUYER shall, after the completion of the removal or the demolition of
said property, fill the basement level with the adjoining ground
using clean, compacted fill dirt.

11. In addition to the above -stated consideration, BUYER shall deposit
with the Building Inspector of the City of Iowa City, Iowa, a
.performance bond of five thousand dollars ($5,000) per structure to
be moved.
12. That upon a showing by BUYER to the SELLER that the terms, covenants
and conditions stated herein are complied with and upon SELLER'S
approval of BUYER'S performance, SELLER shall refund to BUYER
BUYER'S performance bond, after deducting a sum sufficient to pay for
any and all costs, damages and expenses incurred by the SELLER by
reason of removal of said property.
13. Failure of performance by BUYER of any of the terms, covenants and
conditions of this Agreement shall constitute a breach of contract
and SELLER, in addition to any and all of the legal and equitable
remedies which it may have, in its option, may proceed to cancel this
contract and forfeit BUYER'S performance bond together with all
monies paid to SELLER as compensation for the use of said property,
and/or as liquidated damages for breach of contract.
14. BUYER shall secure from the local government authority having
jurisdiction a certificate of occupancy prior to occupying or
holding out said property for occupancy.
15. This Agreement shall be binding upon the heirs, executors, admini-
strators, assigns, and successors of the parties hereto, and no
provisions, terms, or obligations herein contained shall be
affected, modified, altered or changed in any respect whatsoever
without an expressed written agreement between the parties involved
to do so. Further, any and all heirs, executors, administrators,
assigns, and successors shall be bound by the terms and conditions of
this agreement and accept the responsibility for full performance of
these conditions.
16. CONFLICT OF INTEREST: SELLER'S REPRESENTATIVES NOT INDIVIDUALLY
LIABLE. No member, official, or employee of SELLER shall have any
personal interest, direct or indirect, in this Agreement, nor shall
any member, official, or employee participate in any decision
relating to this agreement which affect his/her personal interests
or the interests of any corporation, partnership, or association in
which she/he is, directly or indirectly, interested. No member,
official, or employee of the SELLER shall be personally liable to the
BUYER or any successor in interest, in the event of any default or
breach by the SELLER or for any amount which may become due to the
BUYER or successor or on any obligation under the terms of this
Agreement.
17. RESTRICTIONS ON USE. BUYER agrees to abide by Section 18-32 Housing
Discrimination of the City of Iowa City Code in the use or occupancy
of the property or any improvements located or to be erected thereon.
18. ACCIDENT PREVENTION. The BUYER shall exercise proper precaution at
all times for the protection of persons and property including any
barricading, flagmen and/or fencing required to protect the public,
which protections shall be provided at BUYER'S expense, and shall be
responsible for all injury or damages to persons or property, either
on or off-site, which occur as a result of his/her prosecution of the

work. The State's revisions of all applicable laws and building and
construction codes shall be observed and the BUYER shall take or
cause to be taken such additional safety and health measures as the
City of Iowa City may determine to be reasonably necessary.
19. The BUYER shall indemnify and save harmless the City of Iowa City
from liability for any injury or damages to persons or property
resulting from the prosecution of work under this contract.
20. INSURANCE. (See Sec. 8-63 of the Iowa City Code)
The BUYER shall file with the Building Inspector a liability
insurance policy issued by an insurance company authorized to do
business in the state, protecting the BUYER and the City and its
officials, providing for coverage of fifty thousand dollars
($50,000.00) for any property damage, one hundred thousand dollars
($100,000.00) for injuries to any one person, and three hundred
thousand dollars ($300,000.00) for injuries to all persons in any one
accident, which policy may be a blanket insurance policy covering all
house moving for which the applicant has obtained a permit. Such
policy shall inure to the benefit of the City and the City shall be
named insured therein for the use and benefit of any person intended
to be protected therby and shall be conditioned on the payment of any
damage to public or private property and the payment for any damages
or losses resulting from any malfeasance, misfeasance, nonfeasance
or negligence in connection with any of the activities or conditions
upon which the permit applied for is granted.
21. Storage of salvage materials and equipment on the project site will
be permitted only for the duration of this contract, and the storage
shall at no time interfere with the activities of the City of Iowa
City or other parties.
22. The properties are sold "as is," without warranty as to condition,
suitability for relocation in city limits, liability, etc.
23. Parties agrees this Agreement shall be binding on their respective
successors in interest; but in no event shall this Agreement be
assigned without written consent of CITY.

Re: Resolution Establishing Just Compensation for Parcels 10 and 13
(Owned by Johnnie Anderson and Wilfrieda Hieronymus)
In accordance with real property acquisition regulations of the
Department of Housing and Urban Development, this resolution will
formally establish just compensation for parcels 10 and 13 at $68,000 and
$39,000 respectively. This figure is in line with the appraisal and
review appraisals carried out on the properties. Parcel #10 is located at
512 South Linn Street and parcel #13 is located at 725 South Linn Street.
Both are adjacent to Ralston Creek.
