In considering this matter, it became apparent that there had been no com-
pliance with the provisions of Chapter 409 of the Cade of Iowa or with the
provisions of the Johnson County Zoning ordinance which was enacted in
October, 1960. At that particular time municipalities were granted power
to approve subdivisions within one mile of the City limits.
In any event, no approval was obtained by Mr. Hershberger and we are now
confronted with a situation where houses have been built and the title may
be jeopardized by failure to comply with the appropriate provisions of
Chapter 409 and the Johnson County Zoning Ordinance. This problem is not
unique with the Hershberger Subdivision as there are several other sub-
divisions within the jurisdiction of Iowa City for which approval has never
been granted. The question arises as to the way these matters should be
treated. Ilithin the corporate limits of the City there is a statute which
legalizes old plats but this is not true for the area immediately adjacent
to or outside the municipal corporate limits.
In view of the expiration of more than 19 years since this plat was recorded
and the fact that houses have been built and financing obtained on the assump-
tion that title is merchantable, it would seem to me that the City of Iowa
City should adopt some policy acknowledging the situation as it exists and
at least indicating that no prosecution will occur or any attempt be made
to vacate the plat for failure to comply with the provisions of Chapter 409,
Code of Iowa.

In 1961 a plat entitled 11Hershberger Subdivision,, was filed in Book 5,

43, Records of the Recorder of Johnson County, Iowa. This involves the

Property immediately adjacent to and north of the City limits of Iowa City,
Iowa.
In considering this matter, it became apparent that there had been no com-

Thank you for your letter of September 8, 1980, and your telephone
calls concerning the street lighting program on the north side.
While the City desires to have safe streets it also does not wish to
damage trees. For that reason the City is experimenting with lights
at several locations. Lights have been or shortly will be installed
at the following locations.
318 North Linn, 12 foot arm over street
Between 314/320 Fairchild St., 6 foot arm over sidewalk
Between 511/515 Ronalds St., 12 foot arm over street
Between 420/424 Davenport, 6 foot arm over sidewalk
Again, I can assure you it is the intent of the City and CLASS, the
group working to provide safe streets, to minimize any damage. If
you have additional thoughts concerning this matter please feel free

To: The Members of the Iowa City Council
I am writing to you because of the deep concerns we have relative to the
North Side lighting project. We write as permanent, long-term residents of the
North Side having lived in our home for 23 years. We were attracted to the
neighborhood and house for many reasons but the large trees in the area and
in front of our property were one of the maJor considerations. In fact
without the trees we would not have bought the property. In the early years,
before the city took over trees in the parking, we spent a lot of time and money
having the beautiful maples which shade our property fed, thinned, and pruned.

A detailed analysis of the Rapes, Assaults, etc. which did take place in this
North Side area shows that in very few instances could the foliage on the trees
have been a contributing factor. litany took place during the winter, at the
backs of houses, in houses, or in well-lighted areas. We are troubled about
tree pruning in the whole area because the trees add so much to the attractiveness
of our neighborhood and our summer comfort. It is much cooler and quieter
when the streets, side-walks, and houses are shaded as is very ably pointed
out in the City's ublication, Iowa City Tree Planting Plan. We are even more
concerned because we have found that in the past the pruning contractors,
even when hired to trim the trees to code, tend to prune much highor than the
9 feet over the side::al k and 13 feet over the street which the code stipulates.
They often measure up the trunk of the tree for the 9 feet when an arching
branch nay be 8 feet up the trunk but well over 9 feet at the sidewalk. There
is also a tendency to "eye ball" the height and remove branches that would not
a
need to go. Naturally, we are most worried about the trees immediately in
$'$
front of our house since we depend on the lower limbs to screen us from the
street and other houses. `ife've measured and the trees do meet the code.
Removing those lower limbs cannot be part of a one-year experiment because once
sawed off they are gone forever and can never grow back even if the project is
discontinued.
Let me assure you that we do want our neighborhood (in fact, the whole city)
to be as safe as possible. And we do appreciate the concerns of those people
who walk in the area as we do. Certainly* an awareness program is an excellent

idea. But we honestly do not believe, from an analysis of the Police Reports
and our own and our neighbors observations, that destroying the trees and

flooding the area with light is warranted or would make the area sof er.

My notes include the nature, location, and time of each incident which took
mace in the North Side (bounded by Market, Clinton, Brown, and Governor)
during 1979 and 1980 and I would be happy to tall, with any of you or with any

1 was man who went to door saying he was being
beaten by another man [whom he might have
known]; and only 1 involved some -one being
grabbed and this was south of Market in the
100 block of North Gilbert, not a heavily
shaded area and not in area bounded by
Market. This assault took place in Dec.

In the last few weeks I have received i.ngairies from several property Owners
rz " concerning the new proposed zoning ordinance for Iowa City.

The proposed use map indicates that there are several properties which have
Previously been commercially zoned and are now being considered as being

limited for residential uses only.
According to several clients of mine who find themselves in an area where the
zoning is to be changed, substantial improvements have been made upon the
property in reliance upon the existing zoning. Under the Circumstances, it is
my opinion that any such rezoning of those properties would be the proper
subject of (1) a claim that the new proposed zoning would be arbitrary, un-
reasonable and invalid, or (2) that the proposed regulation is confiscatory
in nature and that a claim should be filed against the City for the difference
in value of the property under the previous zone as opposed to the value under
the new zone. Under this approach, the property owner would not attempt
necessarily to invalidate the zoning but would simply be claiming damages for
the additional restrictions.
The purpose of this letter is to ask that you carefully consider any rezoning
which would make any existing use a nonconformity where money or effort has
been spent and reliance placed upon the existing zoning. In addition, I
believe some study should be made concerning the economic impact of the proposed
zoning upon the City in general from a utility and tax standpoints. In other
words, sane responsible fiscal analysis should be made before any new zoning
is enacted.
I wanted you to have this information for whatever value, if any, it might have
to you in your deliberations. I am sure that other law firms have received

I have received your request for A-95 clearance regarding
the combined Step II -Step III application for funds to imple-
ment the Iowa City, Iowa Facility Plan for wastewater collection
and treatment facilities
ECICOG's policy is to review Step Il and III applications
when a significant change has been made from activities and costs
proposed in the facility plan. While I note that total project
costs have increased by over $2 million, it is my understanding
that these are due to inflation, based on a conversation with
your office.
Since no significant changes from the Facility Plan have been
made, our agency will not review the project further. This letter
should serve to satisfy the requirements of the A-95 process.

RE: Archaeological Survey, Iowa City, Iowa. Southeast Trunk Sewer,
Bear Mr. Schmadeke:
The following is a preliminary accounting of the findings and recommendations
of the Phase I Cultural Resource Survey of the proposed route of the city of
Iowa City Southeast 'Trunk Sewer.
The proposed route of the Southeast Trunk Sewer was notlrecisely defined at
the time of this survey. Therefore, a corridor approximately 500 feet (150 m)
wide was requested to be surveyed. The centerline of this corridor was
loosely defined, however, which necessitated in places surveying a wider
corridor to insure the proposed route was adequately inspected. The corri—
dor was systematically inspected by pedestrian surface inspection.
Three archaeological sites were designated as a result of this survey (see
enclosed figure
13JII335 This site lies in the center of the proposed route in Section 25
and would be directly impacted by construction activities as presently
planned. Artifacts recovered are: 1 utilized percussion flake. White
fossiliferous chert. 1 percussion flake. Black and grey material.
This site is located in a recently cultivated bean field which made artifact
recovery quite difficult. The paucity of recovered cultural materials re-
flects this plus the fact that the survey strategy was not to maximize
artifact recovery but to locate potential areas where undisturbed cultural
maierials may exist.

route_ in Section 25. It is located outside the corridor and should not be
impacted by construction activities as presently planned.
Artifacts recovered are:
1 side notched projectile point, broken tip. Grey and black material.
0.5cm a 1.6cm x 2.1 cm.
1 retouched flake fragment. Idhite chert.
1 flake fragment. Reddish material
1 piece angular quartzite (flake fragment?)
White to clear quartz.
Clearance of this project from a cultural resource perspective is not recom-
mended at this time. 13JH335 will be directly impacted by construction of
the Southeast Trunk Sewer as presently planned. I recommend Phase II testing
of this site to determine its size, state of preservation, cultural affilia-
tion(s), etc., and to determine its status for nomination to the National
Register.
Any changes in the route of this project which result in any construction
activities outside the 500 foot (150m) corridor as indicated on your project
map will necessitate notification of this office and inspection of that area
before construction activates commence.
No survey technique is completely adequate to locate all the sites in an
area, given and cover, time and other factors such as deeply buried sites.
Therefore, should any site appear during ensuing construction, the Office
of the State Archaeologist (OSA) must be contacted immediately.
Artifact analysis, archival research, etc, are now being completed and the
Phase I Contract Completion Report will soon follow. I will be happy to
answer any questions you have regarding this survey.

submitted by a broader range of bidders. If you decide to take advantage

in cooperation with EPA, may establish a goal for MBE participation or

to result in an acceptable level of 148E participation. Section V C(3)

important is Section V B(3) which indicates the information that is to
be included in solicitation documents.
