The installation shall consist of
(Detailed Description)
1 — 40' pole 30' North of pavement edge
3 anchors — one 11 — one 13 — one 15 on North of above pole
and will be located as shown on the detailed plat attached hereto.
AGREEMENT&: The utility company, corporation, applicant, permittee, or licensee, (hereinafter referred to as the Permittee)
agrees that the following stipulations shall govern under this permit.
1. The location, construction and maintenance of the utility installation covered by this application shall be in accordance with the current
Iowa Department of Transportation Utility Accommodation Policy.
2. The installation shall meet the requirements of local municipal, county, state, and federal laws, franchise rules, and regulations, regular
tions and directives or the Iowa State Commerce Commission, Utilities Division. the Iowa State Department of Health, all odes and regulations
of the Iowa Department of Transportation, and any other laws or regulations applicable.
S. The Permittee shall be fully responsible fur any future adjustments of its facilities within the established highway right of way caused
by highway construction or maintenance operations.
j A. The Iowa Department of Transportation shall give the Permittee at least 48 hours written notice of any proposed construction or maintenance
iq work, on either existing or newly acquired right -or -way, that is likely to conflict with the installation belonging to the Permitteo, in order that
-.. lire Permittee may arrange to Protect its facilities.'
S. The State of Iowa and the Iowa Department of Transportatinn assume no responsibility for damages to the Permittee's property occasioned
by any construction or maintenance operations on said highway.
i 0. The Permittee shall take all reasonable precaution during the construction and maintenance of said installation to protect and safeguard the
lives and property of the traveling Public and adjacent property owners.
` I 7. The Permittee agrees to give the Iowa Department of Transportation fonyeight hours' notice of its intention to start construction on the
highway right -or -way. Said notice shall be made in writing to the Engineer whose name is shown below.
i8. The Permittee agrees to at all times give the Iowa Department of Transportation timely notice of intention to perform routine maintenance
within the right -or -way. Said notice shall be to the Engineer whose name is shown below.
D. The Permittee, and its contractors, shall carry on the construction or repair of the accommodated utility with serious regard to the safety of
the public. Traffic pmwetion shall be in accordance with Part V1 of the current Iowa Department of Transportation Manual on Uniform
Traffic Contra] Devices for Streets and Highways.

Highway Division personnel may supervise flagging operations where considered necessary by the Engineer. The original placement or

10. Operations In the construction and maintenance of said utility installation shall be carried on in such a manner as to cause minimum of
interference to or distraction of traffic on said highway.
11. The I'ermittee shall be respunsible for any damage that may result to said highway because of the construction operation, or maintenance
of said utility, and shall reimburse the State of Iowa or the Iowa Department of Transportation any expenditure that the State of Iowa or the
Iowa Department of Transportation may have to make on said highway because of said Pennittee's utility having been constructed, operated, ,
and maintained thereon.
12. The Permittee shall indemnify and save harmless the State of Iowa• and the Iowa Department of Transportation from any and all causes of
action, suits at law or in equity, or losses, damages, claims, or demands, and from any and all liability and expense of whatsoever nature for,
o:, account of, or due to the acts Of onimissions of said Pennittee's officers, members, agents, representatives, contractors, employees or
assigns arising out or or in connection with its !or their) use or occupancy of the public highway under this permit.
13. Non-compliance with any of the terms of the Iowa Department of Transportation policy, permit, or agreement, may be considered cause for
sbut-down of utility construction operations nr withholding of relocation reimbursement until compliance is assured, or revocation or the permit.
The cost of any work caused to be perfornmd by the State in removal of non -complying construction will be assessed against the Permittee.
14. A copy of the approved permit shall be available on the job site at all times for examination by Department of Transportation officials.

S I am writing you concerning an aspect of the comprehensive plan about
which the Planning and Zoning Commission is about to have hearings and concerning
the implementation of which your body will later have discussions. While the
y concept of the plan is a good one, I would like to point out one potential
problem area in the plan as it apparently exists now in tentative form. A
F letter is being sent to the Commission, I should add, making the same points.
`@ However, I think you need this information as well.
I Aly concern is for the small, rather closed neighborhood created by North
Summit and Dewey Streets. This neighborhood is, today, a rather nicely
1 balanced one with a bit of the same character it had at an earlier time in the
1 city's history. It includes mostly single family dwellings with a sprinkling
fof duplexes and one area of multiple family units. However, as I have had the
tentative comprehensive plan explained to me, the east side of the 1000 block
of North Summit would allow for more multiple family units. This higher level
i of density is, I think, a mistake.
The geography of the neighborhood is somewhat unique in that it is bounded
on the east by the cemeteries and on the west by a ravine. Therefore, the only
access is from Brown Street on the south and Highway 1 on the north. Even with
the current levels of traffic these intersections can be a bit problematical,
especially at rush hours and in the winter. No doubt activity on the highway
has increased with the addition of a shopping center just beyond the North
Dodge -North Summit -Prairie du Chien corner. The flow of traffic at this in-
tersection is also complicated by the number of vehicles turning onto Prairie
du Chien Road. It would only complicate matters further if a larger amount of
traffic was seeking to turn south at the same intersection. One might also
i note that, unlike the Prairie du Chien side of that intersection, the placement
of the Hilltop Tap greatly limits visibility on the North Summit side of the
street.
At the south end of the neighborhood the situntion is even more constrained.
Again the embankments limit visibility for all but the foremost car heading
west on Brown Street as one leaves the neighborhood. Those entering face a
1 narrow, brick street with a number of houses having short setbacks, many up on
an embankment, and no off-street parking. In addition, there are three very
tight 900 turns in the space of a block and a half. At the present time it is
often necessary to stop and yield to an on -coming vehicle in the 800 block of
Dewey Street. This could be prevented by eliminating on -street parking altogether,
but such a prohibition would leave several older residences entirely without a
place to park.

To sum up, then, it is my impresstion that our streets are already carrying
as much, if not more, traffic than they were designed to handle and that little
can be done to alter them without: 1) removing houses, 2)disturbing the cemetery,
or 3) further truncating the front yeards of homes which already have setbacks
shorter than the 25 feet now required.
If you agree that the present balanced character of the neighborhood should
be preserved and that a potential problem could exist if higher density were
permitted, there is one thing which can be done. That is to prevent a substan-
tially heavier traffic pattern from developing. Since there is little travel
on these streets by non-residents, this simply means maintaining the area as a
low density neighborhood. I, therefore, request that you seriously scrutnize
proposals for this neighborhood which might permit other than the lowest density
development for any portions of Dewey and/or North Summit Streets.

The City Council is in receipt of your letter dated June 29, 1980,
concerning the area in the vicinity of North Summit Street. The Planning
and Zoning Commission will be taking your comments into consideration in
its review of the new proposed Zoning Ordinance and map for Iowa City.
The Comprehensive Plan for Iowa City was adopted in 1978 and the new
proposed Zoning Ordinance will implement portions of the Plan. The
Comprehensive Plan Map illustrates a land use pattern of from 8-16 dwelling
units per acre of residential development for the area you describe.
Consequently, the Plan limits the choice of zones which could be
established for the area. For this particular density range an RS -8 Zone
is proposed, permitting 8 dwelling units per acre of single family
dwellings, townhouses and duplexes, and an RM -12 Zone which would permit a
maximum of 14 units per acre of single family dwellings, townhouses,
triplexes and fourplexes. Consideration of any other zones would require
an amendment to the Comprehensive Plan.
The area is presently zoned R2 which permits single and two-family
dwellings at a density of up to 14 dwelling units per acre. The RM -12 Zone,
which is proposed for the area, is, therefore, consistent with the existing
zoning. Whether an RS -8 Zone or more restrictive zone is more appropriate
for the area depends upon whether there would be created an abundance of
nonconforming lots and buildings in the area. These conditions will be
taken under consideration in review of your comments.

not hesitate to contact the Planning and Zoning Commission or City Council.

our firm has been retained by the principals of Plaza Towers
Associates (Plaza Towers), an Iowa joint venture, regarding its
bid for the proposed purchase of urban renewal parcel 64-1 lo-
cated in Iowa City, Iowa. We understand that the City Council
conditionally accepted a bid from College Plaza Development Com-
pany and High Country Corporation (College Plaza), rather than
that of our client, by a resolution dated May 13, 1980.
The prospectus issued by the City of Iowa City in connection
with the proposed sale of urban renewal parcel 64-1 clearly sets
forth the bidding rules and procedures to be followed by all of
the bidders and the City of Iowa City. We have commenced an ex-
haustive investigation of the background facts and have completed
a thorough review of the pertinent documents provided to us by
our client. We find the record replete with examples of these
rules and procedures being violated by College Plaza, and these
violations being repeatedly ignored by the City. Based upon the
foregoing, it is our opinion that the City Council's action in
accepting the College Plaza bid is illegal and void due to cer-
tain improprieties which we will not detail in this letter, and
material deficiencies in the procedures which were followed, some
of which we set forth in detail below, to wit:
Violation No. 1 - No Commitment from a Department Store
The prospectus provides on page 17 that:
"The City recognizes that to attain maximum economic
viability in the project, a redeveloper may desire to

construct additional facilities to mutually support
other private investment. Accordingly, the City will
permit the redeveloper to bid on the parcels as follows:
1) The redeveloper may bid on the parcel solely for con-
struction of a high quality hotel to be designed in
accordance with existing site constraints, up to
10,000 gross square feet of ancillary retail may be
included.
2) The redeveloper may propose to develop a hotel and
supportive commercial space not to exceed 90,000
gross square feet, provided that a quality, nondis-
count department store of from 50,000 to 5,000
gross square feet shall be included in the 90,000
gross square feet total.
The City shall objectively evaluate all proposals on
their merits without unduly penalizing any redeveloper
for submitting either proposal. A redeveloper inter-
ested only in developing a hotel, therefore, can success-
fully bid and achieve designation. However, the public
interest would be served by development of commercial
facilities in addition to the proposed hotel and the al-
ternative bidding process allows a redeveloper who has
secured sufficient commitments to submit such a redevel-
22ment bid.
The following criteria illustrate the City's concern for
minimum levels of support development which could be
` constructed in this project that would meet public
!! policy objectives:
j The City requires that from 50,000 to 75,000 of the
90,000 gross square feet be occupied by a major depart-
ment store, with the remaining square footage to be
i occupied by retail establishments occupying ground floor
space in the hotel and specialty retail establishments
I developed outside the hotel".

The City Council should have rejected the College Plaza bid
for the reason that it did not have a commitment from a depart-
ment store. College Plaza could have bid on the parcel solely
for construction of a hotel with up to 10,000 gross square feet
of ancillary retail space, but the alternative of proposing to
develop a hotel with a major department store was not available
under the applicable bidding rules without a major department

store commitment. The record conclusively shows that Plaza
Towers did have a commitment from Armstrong's and College Plaza
had no such commitment. The failure of the Council to reject the
College Plaza bid due to the lack of a commitment from a depart-
ment store was in direct violation of the provisions of the
prospectus.

Plaza Towers disclosed its business relationship with Arm-
strong's to the City long before the bid prospectus was issued.
Although the nature of the relationship with Armstrong's (docu-
mented by the letter of intent of September 24, 1979) was known
to the City and the other bidders, these facts were apparently
ignored, and subsequent discussions by the City and the other
bidders with Armstrong's have interfered with the final negotia-
tions between Armstrong's and Plaza Towers, and with the prepar-
ation of the proposal of Plaza Towers and, thereby, seriously
impaired the effect of the Plaza Towers bid.
Violation No. 3 - Retail Space in Excess of the Maximum Allowed
The College Plaza proposal was also defective because the
proposed retail space, including the department store for which
there was no commitment, was more than 100,000 square feet, ex-
ceeding the maximum permitted of 90,000 square feet by more than
10,000 square feet. This excess was not clearly discernable from
the original College Plaza bid filed on April 8, 1980. But, in
response to the City's questions on April 15, 1980, College Plaza
confirmed that its bid proposed 100,500 square feet of retail
space. At a meeting with the City staff on April 17, 1980, col-
lege Plaza was asked to reduce the retail area to conform to the
maximum allowed by the prospectus. They should not have been
allowed to change their bid in this significant matter. In any
event, however, they did not choose to take advantage of the
opportunity to conform the bid to the prospectus. Instead, Col-
lege Plaza chose to retain 30,000 square feet of small retail
shops and unilaterally deducted 15,000 square feet from the mini-
mum 75,000 square feet required by Armstrong's. This gave the
College Plaza proposal the appearance of being in compliance with
the prospectus if one were to ignore the fact that Armstrong's
required a minimum of 75,000 square feet. It was known to Col-
lege Plaza and the City that Armstrong's minimum requirement for
retail space was 75,000 square feet. Armstrong's indicated un-
equivocally in the fall of 1979 that they had to have at least

75,000 square feet of retail space and this requirement remains
unchanged. On May 1, by letter, and as late as May 12, at the
Council work session, College Plaza proposed to assign only 8,000
square feet of the 15,000 square feet of excess small shops re-
tail space to Armstrong's, leaving an excess of 7,000 square feet
of small retail shops.
Also, the original plans submitted by College Plaza and all
revisions of such plans, show a swimming pool on the third floor
(Pool surface at that floor level) of the building, directly
above the department store, but there is no space deducted from
the departent store on the second floor for the pool. This would
have to cane out of the second floor department store space and
would further reduce the square footage available for the depart-
ment store.

The controlling fact is that College Plaza will have to pro-
vide 75,000 square feet of retail space for Armstrong's and, as
of May 12, 1980, College Plaza refused to accept this reality.
At no time during the period from April 8, 1980, when the bid was
afiled, and May 13, 1980, when the conditional bid approval was
given by the Council, did the College Plaza proposal conform to
the maxium retail space limitations as set out in the prospectus.
Its bid, therefore, should have been rejected by the Council as
not conforming to the provisions of the prospectus.

The staff report of April 25, 1980 states that:
"The review of the competing proposals based on the cri-
teria set forth in the prospectus resulted in the iden-
tification of relative strengths and weaknesses in both
proposals. Neither proposal was demonstrably superior
in all respects. On a criterion by criterion basis,
many of the staff conclusions were mixed, favoring one
proposal based on one criterion and the other proposal
based on another criterion."
"Following a full discussion of all the available infor-
mation, the staff review team was asked to comment on
Which offer was considered superior considering all
factors. The staff consensus clearly was in favor of
Plaza Towers Associates."

It is apparent from the contents of the above report that the
staff reviewed all material as submitted to the City including
unsolicited material from College Plaza and still found a clear
superiority in favor of the Plaza Towers bid. In the staff
report of May 8, 1980, on page 13, it is stated that,
"The staff memorandum of April 25, set forth clearly the
staff recommendation based on all materials received as
of that date. This memorandum has carefully set forth
the staff conclusions regarding all materials submitted
since April 25."
"On the basis of a full review of all submitted materials,
the staff still recommends the designation of Plaza Towers
Associates as the preferred developer of Block 64, sub-
ject to the conditions contained in the previous recom-
mendation."
It is clear that the staff reviewed all materials received by the
City both before April 22 and after that date, even though the
City should not have accepted, considered or evaluated any infor-
mation or materials received after April 22, 1980.

Evaluation
Under the terms of the prospectus, the only proposals to be
subjected to the evaluation criteria were the proposals submitted
to the City with all supporting documents in sealed envelopes or
other containers marked 'Offer to Purchase Property for Redevelop-
ment" before 12:00 noon on April 8, 1980. In addition to the pro-
posals and other documents contained in the sealed bids, additional
information requested by the City and received prior to April 22,
1980 would also be subjected to the evaluation criteria. This is
clearly set out on page 21 of the prospectus in Section V,
Procedures.
"Upon receipt of the written proposals, the City staff
and consultants will review and evaluate all proposals.
The City Council, will, after recommendations from the
staff and consultants, select the winning proposal. The
announcement of selected developer will be made by City
Council by April 22, 1980."

material, including the criticisms of the Plaza
Towers proposal and the arguments made therein, was
a blatant violation of the rules prescribed by the
prospectus. It was not part of the review process
for bidders to criticize the staff recommendations
or to evaluate the other proposals.

unsolicited report attempting to usurp the function

moted by the company for sale and were for sale during the
bidding process. One should further note that of the three

This failure to disclose this very important information is
dangerous to the City when one realizes that the City and the
redeveloper ultimately are close partners in the development and
must deal at all times in good faith in order not to jeopardize
the financial position of the City. Obviously, this pending sale
of property also is indicative of an ownership philosophy by High
Country Corporation of developing properties and selling them as
the opportunity presents itself hoping to retain the management.
This, of course, is in direct contrast to Plaza Towers' proven
record of continuing ownership by local people thereby assuring
an ongoing desire by the ownership for a high standard of
operation.
Violation No. 8 - Transformation of Unacceptable Bid
A careful review of the proceedings in this matter since the
filing of the bids on April 8, 1980 shows that College Plaza was
not prepared to file their bid on April 8, 1980. This is consis-
tent with their efforts to have the bid date postponed. What has
transpired since that time has been a concerted effort on their
part to transform an unacceptable bid, when submitted, to one
which could be compared on equal terms, in some aspects at least,
with the Plaza Towers bid. College Plaza was allowed to keep
changing their bid in an apparent effort to make it more like the
preferable bid of Plaza Towers. While the prescribed rules do
permit the City to negotiate with the redevelopers concerning the
terms and conditions of their proposals, agreed changes cannot
materially affect the conditions stated in the prospectus. The
negotiations between the City and College Plaza, however, that
occurred after April 22, 1980, were in violation of these provi-
sions and did materially affect the conditions stated in the
prospectus, all to the detriment of Plaza Towers.
We are satisfied that the foregoing represent fatal deficien-
cies in the procedures which were followed in conditionally ac-
cepting the College Plaza bid proposal. The action of the City
Council was and is therefore, illegal and void, and will not be
permitted to stand without challenge.
The Plaza Towers bid proposal is the only one which has sat-
isfied all requirements of the City's prospectus, and it should
be accepted. On behalf of Plaza Towers, therefore, we formally
request that the City Council immediately reconsider their prior

ANALYSIS
The applicant proposes to finish off sufficient space within an existing
29 -unit apartment building for one additional apartment unit. By
expanding the total number of units within the building to 30, the owner
is required to submit and obtain approval of a Large Scale Residential
Development plan (see Chapter 27-52, Code of Ordinances, City of Iowa
City). The only visible improvement to the site will be three additional
parking spaces, which comply with the Tree Regulations.
There are a number of existing utilites located within the subject
development. Although the City presently has easements over the water and
sewer lines, these easements do not restrict construction of buildings
over them; therefore, dedication of new easements should be required.
RECOMMENDATION
Staff recommends the 'preliminary and final Large Scale Residential
Development Plan be deferred. Upon revision of the deficiencies and
discrepancies noted below, the staff recommends the subject development
plan be approved.
DEFICIENCIES AND DISCREPANCIES
I. Signature block for the utility companies should be provided.
2. The City has on file an application entitled Court View Terrace,
therefore, the applicant should change the title of his Large Scale
Residential Development Plan.
3. The width of the proposed easement to be granted to the City should
be clearly dimensioned on the plan.
4. A note should be provided on the plan indicating that all of the
property west of the 29 -unit apartment building is an existing City
sewer easement.
5. The width of the existing drive should be shown.
6. The right-of-way width of Myrtle Avenue and the pavement width of
Myrtle should be dimensioned on the plan.
7. A delta angle should be provided for the south boundary line.
8. The legal papers are not in order and should be revised.

ANALYSIS
The subject application is for approval of a preliminary and final Large Scale
Residential Development (LSRD) plan of Phase II, Part 1. The Arbor Hill LSRD is
a 66 unit 10.10 acre project. Phase I1, Part 1 will contain 18 rental units on
3.8 acres of land. Phase I of the development has been completed with 12 units
and an additional eight units are projected to be built on that parcel sometime
in the future. All of the units proposed for construction will be rental with
the possibility of condominium conversion sometime in the future.
The Arbor Hill tract totaling 14.2 acres has undergone a series of proposals and
revisions dating from 1971. More recently a Staff Report dated December 6,
1979, was submitted for Phase II of Arbor Hill. At that time it was decided that
a preliminary and final LSRD would be needed for the tract. A preliminary PAD
plan for the tract had previously been submitted and approved in 1971.
The only changes in the LSRD from the approved PAD are:
1. Traffic circulation has been altered so that two buildings which previously
had entered onto Green Mountain Drive now access onto a private drive which
feeds Washington Street. This improvement in traffic circulation places
traffic onto Washington Street which was designed to handle the additional
load.
2. Four of the units have been changed in style from row units into more
condensed box -shaped units. This design is viewed as more energy
efficient.
3. The PAD shows a system of walkways facilitating pedestrian movement within
and through the project. The LSRD should have sidewalks included in the
plan as well as an additional sidewalk connecting the north end of the cul-
de-sac with Green Mountain Drive.
A drive connecting the 8 -unit building in the Phase II, Part 1 development and
the proposed future development of an 8 -unit building in the Phase I development
is shown on the final LSRD plan but not on the preliminary LSRD plan. This drive
should be consistent on both maps.
Stormwater management will also not be required by the City since the developer
did not alter the project significantly from the approved PAD plan.
As previously mentioned part of the overall project design relating to
pedestrian flow in and through the proposed project area, easements and the
construction of a sidewalk trail should be considered especially in the northern
part of the development. The inclusion of this trail would facilitate in
pedestrian movement to and from Lemme Elementary School. Sidewalks or walkways
should also be provided between the garages and the apartment buildings they
serve.

RECOMMENDATION
The staff recommends that the LSRD plan be deferred. Upon revision of the plan
correcting the deficiencies and discrepancies noted below and the incorporation
of the concerns mentioned above, it is recommended that the LSRD plan of Phase
II, Part 1 be approved.

ANALYSIS
The Waters Estate includes 100 acres of land in East Lucas Township that is
immediately outside
of the existing Iowa City limits. The owner, Wayne Waters,
has a farmhouse on the
northern third of this land that is rented to another
family. He is
requesting voluntary annexation to the City of Iowa City in order
to receive City water
service; the existing well on his property is no longer
usable and estimates indicate
a new one would be costly. According to the
Engineering Division, there is adequate water supply and hook-up
available on
the north side of Highway 6 in front of the farmhouse. The fee for water hookup,
according to Mr. Cleo Kron, the Water Superintendent, would be $504.00.
In the past, it has been Iowa City's policy not to provide services to property
outside the City limits
yet within the County. Mr. Waters is requesting
voluntary annexation to receive City
water service only. It is doubtful that
any development will occur on his land in the
near future that would require
provision of additional services. The test for provision

of services is
unnecessary since this is an application for voluntary annexation.
The future designated land use for this area includes 8 to 16 dwelling units
a

acre of residential development. Since the property owner has no intentions of
developing the
property, it should now be zoned RIA, the most restrictive
residential zone, and AG under the City's new
proposed zoning ordinance until
such time as all services are extended to the

property. According to the
Comprehensive Plan Map, the Waters Estate 1s shown to be
within the limits of
projected urban development. It is assumed that the land will remain in
an
agricultural use until such time as that extension of a trunk line sewer from
the
new sewage treatment plant. Since, by implication of the Comprehensive
Plan, the
area should be annexed to accommodate the future expansion of growth,
voluntary annexation now would

preempt future involuntary annexation.
RECOMMENDATIONS
Staff recommends that the land be annexed to the City of Iowa City. Once

The Board of Supervisors wishes to formally register its opposition
to the annexation and rezoning of the Water's property in East Lucas
Township. We feel there are a number of reasons which make this -
annexation inappropriate, including the urbanization of 100 acres
of prime agricultural land, the availability of large amounts of
undeveloped land presently inside Iowa City, the leap -frog pattern
of annexation that this action could begin, and the apparently
excessive amount of .Land involved for one residence to tap onto
city water.
Without minimizing the previously mentioned concerns, there are
two primary considerations the Board wishes you to take into account
before acting on this matter. The first is the nearly completed work
of the fringe Study Committee. The second is the corresponding annex-
ation study under preparation by your planning staff. We would urge
you, at the very least, to defer your action until the recommendations
of these studies have been completed and reviewed.
We recognize the owner's interest and needs which prompt this request.
However, it is the feeling of this Board that municipal water Supply
can be furnished to the property without such extensive measures. A
smaller area of ].and would certainly accomplish what is needed and
would also be supporter] by the Board of Supervisors.

ISSUANCE OF $2,570,000 GENERAL
OBLIGATION BONDS

WHEREAS, pursuant to notice published as required by
law, this Council has held a public meeting and hearing
upon the proposal to institute proceedings for the issuance
of $2,570,000 General Obligation Bonds for the essential
corporate purpose of paying costs of the construction of
street improvements, sanitary sewers and wastewater treatment
facilities including the
River Corridor Trunk Sewer,
Wastewater Treatment Facility, Sanitary Sewer Evaluation

Study, Scott Boulevard - Phase I and South Gilbert Street
Projects, and has considered the extent of objections received
from residents or property owners as to said proposed issuance
of bonds;
and, accordingly the following action is now
considered to be in the best interests of the City and
residents thereof:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF IOWA CITY, IOWA:

RESOLUTION ACCEPTING WORK
WHEREAS, on April 1, 1900, Iowa City, Iowa, entered into
contract with Weber taros. of Mechanicsville, Iowa, for the
construction of the 1980 Melrose Avenue Sanitary Sewer
Extension Assessment Project, within the City, as therein
described; and
WHEREAS, said contractor has fully completed the construc—
tion of said improvements, known as the 1980 Melrose Avenue
Sanitary Sewer Extension Assessment Project, in accordance
with the terms and conditions of said contract and plan.; and
specifications, as shown by the certificate of the Engineer

NOW, THEREVORE, BE IT RESOLVED BY THE COUNCIL Or IFL' CITY
IOWA CITY, IOWA:
That said report of the Engineer be and the same is hereby
approved and adopted and said improvements are hereby approved
and accepted as having been fully completed in accordance with
the said plans, specifications and contract, and the total
project cost of the improvements under said contract is hereby
determiner] to be a 16,581.20 as shown in said report of the

BE IT RESOLVED, that the Engineer is hereby instructed to
prepare a final plat and schedule showing the separate lots or
parcels of ground subject to assessment for the cost of the
1980 Melrose Avenue Sanitary Sewer Extension Assessment
Project, together with the names of the owners thereof, so far
as practicabLe, and the amount assessable by Law against each
lot or parcel of ground so assessable, and against any railway
or street railway legally assessable thureEor, and $13682_70
of the whole amount of the cost of said improvements shall be
assessed against the benefited properties, but not in excess
of the amounts so assessed in the preliminary plat and sche-
dule for the improvement, and filed in the office of the
Clerk.

BE IT FURTHER RESOLVED, that the said schedule of

assessments and accompanying plat, be and the same are hereby
approved and adopted; and that there be, and is hereby

assessed and Levied, as a special tax against and upon each of
the lots, parts of Lots and parcels of land, and the owner or
sj
owners thereof liable to assessment for the cost of said

improvements, the respective sums expressed in figures set
opposite to each of the same on account of the cost of the
construction of the said improvements. Provided, further,
that the amounts shown in said final schedule of assessments

as deficiencies are found to be proper and are levied con-
ditionally against the respective properties benefited by the
improvements as shown in the schedule, subject to the provi-
sions of Section 384.63, Code of Iowa. Said assessments
against said lots and parcels of land are hereby declared to
be in proportion to the special benefits conferred upon said

property by said improvements, and not in excess thereof, and
riot in excess of 25% of the value of the same.

BE IT FURTHER RESOLVED, that said assessments of $50.00 or
more shall be payable in ten equal annual installments and
shalt hear interest at the maximum rate permitted by law per
annum from the date of the acceptance of the improvements; the
first installment of each assessment, or total amount thereof,
if it be less than $50.00, with interest on the whole
assessment from date of acceptance of the work by the Council,
shall become due and payable on July 1, 1981; succeeding
annual installments, with interest on the whole unpaid amount,
-
shall respectively become due on July lst annually thereafter,
and shall be paid at the same time and in the same manner as
the September semiannual payment of ordinary taxes. Said
assessments shall be payable at the office of the City Clerk,
in full or in part and without interest within thirty days
after the date of the certification of the plat and schedule
of assessments to the County Auditor of Johnson County, Iowa.

directed to certify said final plat and scheduLe to the County
Auditor of .7ohnson County, Iowa, and to publish notice of said
certification once each week for two consecutive weeks in the
Press -Citizen, a newspaper printed wholly in the English
language, published in Iowa City, Iowa, and of general cir-
culation in Iowa City, Iowa, the first publication of said
notice to be made within fifteen days from the date of the
filing of sairi schedule with the County Auditor, the Clerk
shall also send by certified mail to all property owners whose
property is subject to assessment a copfsaid notice,
mailing to be on or before the date ofthesecondpublication
of the notice, all as provided and directed by Code Section
384.60, Code of Iowa.
BE IT FURTHER RESOLVED, that the Clerk is directed to cer-
tify the deficiencies for lots specially benefited by the
improvements, as shown in the final schedule of assessments,
to the County Auditor for recording in the Special Assessment
Deficiencies Book and to the city official charged with
responsibility for the issuance of building permits. Said
deficiencies are conditionally assessed to the respective pro-
perties under Code Section 384.63 for the amortization period
specified by ordinance.
The Clerk is authorized and directed to ascertain the
amount of assessments remaining unpaid after the thirty day
period against which improvement bonds may be issued and to
proceed on behalf of the City with the sale of said bonds, to
select a date for the sale thereof, to cause to be prepared
such notice and sale information as may appear appropriate, to
publish and distribute the same on behalf of the City and this
Council and otherwise to take all action necessary to permit
the sale of said bonds on a basis favorable to the City and
acceptable to the Council.

SANITARY SEWER EXTENSION ASSESSMENT PROJECT, FOR WHICH
DEFICIENCIES EXIST AGAINST LATS SUBJECT TO SPECIAL ASSESSMENT"
and caused the same to be read in full. Council Member
Vevera moved that the requirement that ordinances be
considered and voted on for passage at two Council meetings
prior to the meeting at which it is to be finally passed, be
suspended and that said Ordinance be now finally passed.
Council Member Neuhauser seconded the motion and
after due consideration thereof by said Council, the Mayor put
the question on the adoption of said motion and the roll being
called, the following named Council Members voted:
