Comment: This project would involve the construction of a
968 sq. ft. building at Mercer Park. This building would
provided concession area, restrooms, garage, and storage.
The Engineer's estimate is $33,800.
Consider setting a public hearing on July 15, 1980, on an
annexation moratorium agreement between Iowa City and
Hills.
Comment: An agreement with the City of Hills concerning
the annexation of railroad right-of-way was first presented
to the City Council on April 1 and was deferred from that
meeting and also from the meeting of April 22, 1980. The
original agreement provided that Hills would deannex the
railroad if it did not issue industrial revenue bonds
before January 1, 1981. This provision is replaced with
the following language:
"4. That should Iowa City find it to he in the public
interest to annex any part of the railroad property
described hereinabove, located within three (3) miles
of the present corporate limits of Iowa City, then
Hills shall join with Iowa City in petitioning the
City Development Board of the State of Iowa for a
boundary adjustment to sever such portion of the
railroad property from Hills and annex it to Iowa
City, provided the motive for annexation is not solely
to increase revenues to Iowa City."
The legal staff has approved this agreement.

of the resubdivision of Braverman Center Parts 1 and 2. S-8002.
Comment: The Planning b Zoning Commission, at a regular meeting
held June 5, 1980, recommended by a 6-0 vote approval of the
subject plat located west of Keokuk Street and north of Southgate
Avenue waiving the requirement that all lot lines intersect with
streets at angles between 80° and 100" and subject to completion
of the legal papers, signing of the plat, and correction of the
plat showing the pavement width as being 36 feet back -of -curb to
back -of -curb in lieu of 45 feet back -of -curb to hack -of -curb.
This recommendation is consistent with the staff's recommendation
presented in a staff report dated June 5, 1980, which was
attached to the Council agenda of June 17, 1980. The 60 -day
limitation period has been waived. This item is now ready for

Comment: The Planning R Zoning Commission, at a regular meeting
held April 3, 1980, recommended by a 6-0 vote approval of the
subject plat located northwest of Shive-Hattery 8 Associates
contingent upon 1) the signatures of the utility companies and
a registered land surveyor being provided, 2) the legal papers
being revised, and 3) the street cross section being corrected
to indicate 31 feet back -of -curb to back -of -curb concrete
paving. This recommendation is consistent with the staff's
recommendation presented in a staff report dated March 20, 1980,
which was attached to the Council agenda of April 15, 1980. The
60 -day limitation period has been waived. The contingencies
listed above have been resolved and this item is now ready for
Council's consideration.

Action:
d. Consider a resolution approving one-year extension of time for
submission of the final plat of Village Green Part 10 (Derby
Court, Leeds Court, and Sunderland Court).
Comment: The approval of a preliminary plat is effective for a
period of 18 months unless, upon written request of the subdivider,
the City Council grants an extension of that time. The applicant
has requested an extension of time in a letter which is attached
to the agenda.
e. Consider an ordinance vacating an alley running east and west in
Block 2 of Cook, Sargent and Downey's Addition (west of Gilbert
Street and south of Kirkwood Avenue). V-8002 (first consideration)
Comment: The Planning A Zoning Commission, at a regular meeting
held May 22, 1980, recommended by a 5-0 vote approval of the
subject vacation. This recommendation is consistent with the
staff's recommendation presented in a staff report dated May 1,

ESTIMATE FOR THE LOWER CITY PARK BIKE TRAIL - FY81.
Comment: This project would involve the placing of an 8 foot wide, 4 inch
thick asphaltic bikeway along the road and over the existing gravel
bikeway in Lower City Park. The Engineer's Estimate is 534,000.
This bike trail is a part of the River Corridor Project funded with
CDBG funds.

Comment: As part of the LSNRD plan approved by the Council on June 28, 1977,
ACT agreed to install sidewalks along Dubuque The agreement
also provided that the City has a lien against the property if they
are not installed within one year. The City is not interested in
requiring this installation at this time. This agreement would
subordinate the sidewalk lien to the mortgage on the new office
buildinEthereby enabling ACT to obtain the mortgage.

Item No. 13 - CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN A LEASE WITH
JOHNSON COUNTY AGRICULTURAL ASSOCIATION FOR RENTAL OF STORAGE SPACE
�S3 FOR EQUIPMENT AT THE JOHNSON COUNTY FAIRGROUNDS.
Comment: For the past five years Public Works has leased the swine barn at the
Johnson County Fairgrounds to store equipment, particularly during
the winter months. The lease provides for 7,500 square feet and the
lease runs from September 1, 1980 through June 30, 1981 at $350 per
month, for a total of $3,500. A memorandum from the Purchasing Agent
was furnished in the information packet of June 20 which explains
that the Agricultural Association will rent its buildings only on a
ten-month basis. This item was deferred from the Council meeting of
June 17, 1980.1/)Public Works recommends approval of this resolution.

Item No. 14 - RESOLUTION APPROVING CAPITAL IMPROVEMENTS PROGRAM FOR THE CITY OF
�S �z IOWA CITY, IOWA, FOR THE FISCAL YEARS 1981 THROUGH 1985.
Comment: The City Finance Committee of the State of Iowa recommends that
Capital Improvements Programs be formally approved. Although this is
not mandated by law, the Finance Department recommends that the
Council take formal action to approve the CIP for FY1981-1985 as an
expression of the Council's legislative intent for future protects
and planning for the City of Iowa City. A summary of the CIP, which
was informally approved by the Council in December, 1979, is attached
to the Resolution. This item was deferred from the Council meeting
of June 17, 1980.

Item No. 15 - RESOLUTION AUTHORIZING APPROVAL OF SEVENTH AMENDMENT TO ENGINEERING
SERVICES AGREEMENT WITH VEENSTRA A KIMM FOR DESIGN AND PREPARATION OF
ash- SPECIFICATIONS FOR NEW WATER POLLUTION CONTROL PLANT AND OUTFALL
SEWER.
Comment: These changes are in response to Environmental Protection Agency's
(EPA) request regarding Minority Business Enterprise participation
requirements to be increased from 5% to 7% (actual participation 9%)
and provisional overhead rates irrespective of EPA auditing.
