AGREEMENTS': The utility company, corporation, applicant, permittee, or licensee, (hereinafter referred to as the Permittee)
agrees that the following stipulations shall govern under this permit.
1, The location, construction and maintenance of the utility Installation covered by this application shall be in accordance with the current
Iowa State Highway Commission Utility Accommodation Policy.
2. The Installation shall meet the requirements of local municipal, county, slate, and federal laws, franchise rules, and regulations, regula-
tions and directives or the Iowa Stale Commerce Commission, Utilities Division, the Iowa State Department of health, all rules and regula-
tions of the Iowa State Highway Commission, and any other laws or regulations applicable.
3. The Permittee shall be fully responsible for any future adjustments of Its racnities within the established highway right of way caused
by highway construction or maintenance operations.
4. The Iowa Stale Highway Commission shall give the Permittee at least 45 hours written notice or any proposed construction or maintenance
work, on either existing or newly acquired right -noway, that Is likely to conflict with the installation belonging to the Permittee, In order that
the Petmiltee may arrange to protect Its facilities.
5. The State of Iowa and the Iowa Stale Highway Commission assume no responsibility for damages to the Permittee's property occasioned by
any construction or maintenance operations on said highway.
G. The Permlilee shall lake all reasonable precaution during the construction and maintenance of Bald Installation to protect and safeguard
the lives and properly of the traveling public and adjacent property owners.
7. The Permittee agrees to give the Slate Highway Commission forty-eight.hours' notice of its Intention to start construction on the highway
right-of-way. Said notice shall be made In writing to the Engineer whose name Is shown below.
8. The Permittee agrees to at all limes give the Iowa Stale Highway Commission timely notice of Intention to perform routine maintenance
within the right-of-way. Said notice shall be to the Engineer whose name is shown below.
9. The Permltlee, and Its contractors, shall carry on the construction or repair of the accommodated utility with serious regard to the safety
of the public. Traffic protection shall be In accordance with Pan VI of the current Iowa State IUghway Commission Manual on Unlronn
Traffic Controls.
Highway Commission personnel may supervise nagging operations where considered necessary by the Engineer. The original pLce-

assigns arising out of or In connection with its (or their) use or occupancy of the public highway under this permit.

13. Non-compliance with any of the terms of the Highway Commission policy, permit, or agreement, may be considered cause for shut -down
of operations or withholding or relocation reimbursement until compliance is assured, or revocation of the permit. The cost of any work caused
to be performed by the State in removal of non -complying construction will be assessed against the Permittee.
14. A copy or the approved permit shall be available on the Job site at all times for examination by Highway officials.

Members of the Iowa City City Councils
As you may remember, we were prepared to proceed with construction
of the Lucas Building last fall when the mortgage market suffered severe
disarray and many permanent mortgage investors, including ours, stopped
making mortgage loans. In the view of our lender it was unfortunate that
our loan application had been in :heir office for three weeks without action,
but they now were out of the market for mortgage loans and, therefore, our
application would not be processed. This occurred about October 6. Events
during the months immediately following the early October collapse of the
e mortgage market conditions. We requested

In February after interest rates had plateaued and there was some
feeling among mortgage people that rates would be easing, we rebid the
project. Before all the bids were back interest rates started their
move to even higher levels. Clearly this was not the time tb..be borrowing.
We waited, watched the market, spoke to several mortgage lenders, and
explored some unconventional sources. The only feasible alternative in
the short run appeared to be a tax exempt mortgage. We were aware of the

A meeting was held with Messrs. Hayek and Scholten at which we out-
lined a proposal to obtain tax exempt financing through the auspices of
Iowa City. Basically our proposal was that, after North Bay Construction
had obtained a certificate of completion for the project,and its contract
with the City was completed, North Bay would sell the building. At that
time a tax exempt mortgage in the name of the buyer would be effected.
This proposal also received a negative response from the legal staff. We
disagreed with that conclusion from a legal viewpoint and raised the
possibility of a declaratory judgement to resolve the disagreement. The
legal staff was not supportive of such an approach apparently because of
the possible time involved. During the course of discussion with the legal
staff, the possibility of another qualified government body financing the
project with tax exempt financing was raised and Mr. Hayek stated that he
had no problems with that approach since Iowa City would not be the issuer
of the tax exempt financing.
We subsequently approached University Heights to see if they would have
any interest in sponsoring a tax exempt financing for our building. They
indicated willingness to undertake such an effort, subject to certain condi-
tions which Include:
a) That Iowa City's City Council would have no objection to University
Heights role in the project's financing.

b) That Iowa City would provide the necessary resolutions to enable
University Heights to do the financing.
c) That the required public hearings raise no problems.
d) That, in fact, there is no risk of loss to the issuer, Specifically
that the financing will. not adversely affect their own bond rating,
bonding capacity and, in case of default, would not be payable by
them or otherwise adversely affect their status.

e) That they have the legal authority to issue tax exempt mortgages
on another community's Urban Renewal project,
After receiving a positive response from University Heights, we con-
tacted Banco Mortgage with whom we have been working for over two years
on this project. They have submitted a tax exempt loan application on
terms satisfactory to us to a permanent lender for approval.
We have also proceeded to work toward satisfaying the conditions
indicated by University Heights as necessary for the financing to proceed.
In the process it has been ascertained that there may be a legal problem
with University Heights sponsoring tax exempt financing on another com-
munity's Urban Renewal project, In view of this new information we reviewed
our situation as to how we should proceed. After consultation with our
legal counsel we are of the opinion that the City's legal staff may be in
error with respect to Iowa City sponsoring tax exempt financing for our
project along the lines indicated earlier in this report. We believe our
proposal to be legally distinquishable from the earlier case involving
the hotel proposal.
While we have the highest respect for the City's legal counsel - in
fact, Hr. Hayek represents us in private legal matters - we never -the -less
feel that a third opinion from a mutually acceptable legal expert of high
repute would be the most acceptable way to resolve our differences in
legal opinions. We would be willing to incur the cost of obtaining the
third opinion. However, before proceeding it needs to be recognised that
unless the City Council is willing to effect a tax exempt financing for
this project, in the event of a favorable ruling by a third party legal
expert, it would not be productive to seek an opinion.
We therefore request that the City Council agree to obtaining a third
party legal opinion and then, if it is favorable to our position, that they

would look with favor on entertaining our request for tax exempt financing
as authorized under the present Iowa City Code. Conversely, if the third
party legal opinion would be supportive of the City's legal staff position,
we see no alternative at the present time to our requesting the immadiate
rebidding of this project to permit tax exempt financing.

of the City Attorney that the City does not have the legal authority
to offer you the use of industrial revenue bond financing for the
redevelopment of the above parcel since this benefit was not
available to all prospective bidders at the time of the initial
offering. You have made the request that the City Council seek an
outside legal opinion as to the legal necessity of rebidding this
urban renewal project in order to allow the use of industrial revenue
bond financing,
In accordance with the discussion at the Informal Fleeting on June 2,
1980, the City Council wishes to advise you that no outside legal
opinion will be requested on this matter. It continues to be the
City's position that a rebidding of this project will be necessary
prior to any City approval of industrial revenue bond financing.
Therefore, the City requests that you respond promptly to this letter
and indicate what your intention is with respect to the existing
contract for redevelopment of Parcel 82-1B. Thank you very much for
your cooperation.

RE: Proposed Human Relations Staff Changes
Dear Mayor & City Council:
The City Relations Committee of The Chamber of Commerce has
reviewed the memorandums of the City Manager and the Human Relations
Commission dated May 8, 1980 and May 15, 1980. The Committee began
to look at this problem a few weeks ago. It is the concensus of the
committee that the Council should approve the City Manager's recommendations.
By placing the analyst under the direction of the assistant City Manager
we believe that the work can be done more efficiently and effectively.
We also believe the position of Human Relations Director should be
reclassified to a division head level.
The Committee feels it is extremely important that all staff personnel j
of the City be responsible to the City Manager.

The City Relations Committee of The Chamber of Commerce has reviewed
the matter of the cost of underground wiring connection costs to buildings
in the Urban Renewal area. We recommend that the Council establish a
policy that Urban Renewal funds or block grants, if available, be used to
pay these connection costs. It seems unfair to require the owner or tenant
in the CB district to bear these costs. Also the City should work with
the Utility Company to insure that the utilities costs are borne by the
Utility Company and not the City and that the work is done at the lowest
costs.

ACTION:
Pursuant to Section 23-234 of the Municipal Code of Iowa City, the City
Traffic Engineer will direct that signs be installed on the east side of
Benton Court so as to prohibit parking at all times from the intersection
of Benton Court and Benton Street north to the north terminus of Benton
Court. This action will be taken on or shortly after 4 June 1980.
COMMENT:
This action is being taken after the completion of a postcard survey which
obtained the opinion of the residents directly affected by this
prohibition. This action is in keeping with the consensus of the affected
property owners.

ANALYSIS
Chariton Storage Company and Hy -Vee Food Stores, Inc. requests the vacation of a
public alley located directly south and adjacent to the rear building wall of
the Hy -Vee Food Store located on Kirkwood Avenue (see location map). Petitions
were previously submitted by the Chariton Storage Company in 1972 and 1973 for
vacation of this alley. In both cases, after opposition was expressed by the
adjoining property owner, the petition was withdrawn. The applicants now own
all of the property served by this alley and request it be vacated and disposed
to them for their use. Vacation of the alley would provide for the logical
connection of the parcels of property currently owned on the north and the south
that is now separated by the alley.
Engineering has reviewed the request and finds no reason to object. The City
has no interest in maintaining any easements over the subject alley.
RECOMMENDATION
The staff recommends that the entire alley be vacated..

extension of First Avenue.
The topography is gently sloping to
moderately steep (2-18 percent).
The subject addition provides for the extension of First Avenue north of
Rochester Avenue over the north branch of Ralston Creek to the north boundary of
the development. As proposed, First Avenue can continue north of this addition
following any of three possible street alignments (see attached map). It is not
imperative with the consideration of this development for the City to commit to
any of the aforementioned alternatives. But, future development of the property
to the north will require a decision by the City regarding the First Avenue
alignment. The staff finds the alignment of First Avenue as proposed within
this subdivision to be acceptable.
Sanitary sewer service is not presently available to this development.
Availability of sewer service is contingent upon extension of the trunk sewer
from its present location (i.e., in the vicinity of Hickory Hill Park -Seventh
Avenue) and cooperation of the intervening property owner. The applicant with
his proposal has not fully addressed how sewer service will be provided to the
subject development. As designed, the majority of lots within this subdivision
could not accommodate septic systems. Unless the applicant is willing to extend
sanitary sewer service to the subject development, the City should not approve
the preliminary plat at this time.
The design of the subject plat is also based upon the premise that the Hickory
Hill stormwater storage facility will be constructed and that additional storage
facilities will not be required upstream from said facility, According to the
Engineering Division, stormwater detention for this subdivision will not be
required if the north branch dam project becomes a reality. However, if the
final plat is submitted prior to construction of the stormwater storage
facility, the necessary design notes and construction plans for stormwater
detention will have to be submitted and necessary easements provided before
final plat approval.
RECOMMENDATION
Due to the unavailability of sanitary sewer service to the development, it is
the staff's recommendation that the preliminary plat be denied unless action is
taken for the extension of a sanitary sewer to the subject property.
DEFICIENCIES AND DISCREPANCIES
1. A signature block should be provided for the City Clerk's signature.
2. The legal description of the boundary of the tract is very difficult to
follow and should be clarified by providing points of beginning, lengths
and bearings.

3. The acreage of the proposed subdivision should be provided on the plat.
4. The watermain along First Avenue should be extended to the north property
line. The size of proposed and existing watermains should be shown.
5. A cross-section for the proposed streets should be corrected to show
roadway location, the type of curb and gutter, and paving and sidewalks to
be installed. Paving thickness for First Avenue should be shown to be
eight inches.
6. All streets within the proposed subdivision should be named.
7. A note should be provided on the plat indicating that part of the
subdivision is a replat of Lot 2 Moreland Subdivision.

Re: Request that 207 Myrtle Avenue be permitted to change
from a 29 unit to a 30 unit building without filing a
LSRD plan.
The building at 207 Myrtle Avenue has 10 units on
each of 3 floors, except that one of these 30 units is
not finished off.
According to a strict interpretation of Section 27 of
the Iowa City Ordinance a LSRD permit is required in order
to do this.
A review of the LSRD Ordinance shows that it requires:
(1) A topographical map
(2) Location of utilities
(3) Grades of proposed streets
(4) Location of proposed building
(5) Location of proposed trees.
(6) Location of proposed sewers and water lines.
(7) Accurate survey
It seems that the intent is to plan a development where
new buildings are to be put up.
In the present instance no new building is to be con-
structed. Most if not all of the information entailed in
an LSRD plan is irrelevant in the present case. Furthermore,
considerable effort and expense are necessary to complete
a preliminary and final LSRD plan.
Section 27-59 states, "If . it can be shown that
strict compliance . . . would result in extraordinary hard-
ship to the owner because of . . . excess costs, or other
such nonself-inflicted conditions . . . the commisssion may
vary, modify or waiver the general requirements
And also, "The council may also modify, vary or waive the
general requirements on its own motion for good reason
shown, even if the commission refused to do so."
At present I have filed a preliminary plat, which if
you agree with the above, I will withdraw until further
development of new buildings is planned. It is not conven-
ient for me to include all future development and present
additions of one unit in an LSRD at the present time
because my future plans are not settled at this time.

I was born in Wafcross, Georgia, I attended and graduated from
Center High School of that city, From Nov 24, 1964 - Nov, 22, 1967
I served in the U.S. Army, attaining the rank of Sergeant g-5 in
two ,ears. While in the Army I served ae a postal supervisor and
an administrative team leader. For 13 months I served with the
25th Infantry Division In Vietnam, I am the holder of the Purple
Heart, Combat Infantryman Badge, NDSM, VCX, and the VCM. At this
Lime, Senator Sam Nunn of Georgia is attempting to obtain for me
the Bronze Star & Good Conduct Medals (these medals were rejected
by me upon my release from the military due to my opposition to
the war in Vietnam). D.D. Form 214 will be provided upon request.
I have been employed as a communications technician for the
Atlanta Georgia and !dashington D.0 Folios Departments. (Names of
supervisors will be provided upon request.)
Hobbies include reading, the theatre, and traveling
At this point in my life I am not interested in making a lot
of money, I merely went to do somethln6 worthwhile that will benefit
a lot of people.

ADVISORY BOARD/COMMISSION APPLICATION FORM
Individuals serving on Boards/Commissions play an important role in advising the Council
matters of interest to our community and its future. Applicants must reside in Iowa City.
' The City Council announces advisory board vacancies 60 days prior to the date the
appointment will be made. This 60 -day period provides for a 30 -day advertising period and a 30 -
day training period for new members. The training period allows new members to become familiar
with the responsibilities and duties of the advisory board before becoming a full voting
member.
After a vacancy has been announced and the 30 -day advertising period has expired, the
Council reviews all applications during the informal work session. The appointment is
announced at the next formal Council meeting. Appointees serve as unpaid volunteers.
All applications must be submitted to the City Clerk no later than one week prior to the
announced appointment date.
