NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, that a special, temporary reduction in transit fares be established for a one -day period on May 14, 1980. The reason these applications were not submitted in proper form was that the building inspector refused to sign the form approving the building due to an on -premises painted wall sign located on the south side of the building. It is my client's intention to challenge the validity and application of this Code Section when prosecuted by the City. The reason I would like this on the City Council agenda for next week is to have the council either approve or reject this application based on the signed ordinance violation, as a matter of administrative procedure. If rejected, then we would plan to approach the Iowa Liquor Commission for renewal of these licenses. To do that we would need the rejection of this application as it now stands. While my client is convinced that this statute is of dubious validity and is also unconstitutional, if ordered by the Court to remove the sign, my client will do so.
