O3- ~/ (1) CONSIDER A RESOLUTION SETTING A PUBLIC HEARING FOR DECEMBER 10 TO AMEND THE SECTION 8 ADMINISTRATIVE PLAN FOR IOWA CITY HOUSING AUTHORITY SECTION 8 PROGRAM. Comment: The Section 8 Administrative Plan is being amended to include various program updates including preference for Section 8 assistance and mandatory family composition change. The Administrative Plan is a HUD required administrative document which is used in the operations of the Section 8 program. e. Resolutions. ~ol - 3~10 (1) CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO A'I-FEST A MEMORANDUM OF UNDERSTANDING BETWEEN THE IOWA DEPARTMENT OF TRANSPORTATION, THE CITY OF IOWA CITY AND THE UNIVERSITY OF IOWA. Comment: This Memorandum of Understanding outlines the maintenance responsibilities for the three pedestrian bridges located in the City of Iowa City over US Highway 6. The bridges were constructed at various times and currently a clear understanding does not exist as to which entity is responsible for the bridges. November 19, 2002 City of Iowa City Parle 3 o~--%q~ (5) CONSIDER A RESOLUTION AUTHORIZING ACQUISITION OF FOUR DUPLEX LOTS LEGALLY DESCRIBED AS LOTS 10, 11, 12, AND 13, LONGFELLOW MANOR SUBDIVISION, UNDER THE AFFORDABLE DREAM HOME OPPORTUNITY PROGRAM. Comment: The Iowa City Housing Authority (ICHA), under its Affordable Dream Home Oppodunity Program (ADHOP) and in partnership with the Great Iowa City Housing Fellowship, propose to construct universally designed, affordable duplex homes for homeownership. This resolution authorizes the purchase of four lots in the Longfellow Manor Subdivision. The lot prices have been reduced by the use of CDBG funds to make them more affordable. f. Correspondence. PLANNING AND ZONING MATTERS. a. Consider a motion setting a public hearing for December 10 on an ordinance rezoning 10.15 acres form Medium Density Multifamily (RM- 20) to Sensitive Areas Overlay and Planned Housing Development Overlay (RM-20/OSA/OPDH) for property located Northwest of Highway 1 and Ruppert Road. Comment: The proposed rezoning will allow for the development of a 198- unit apartment complex with clubhouse. The Planning and Zoning Commission is scheduled to vote on this application at their November 21 meeting. The Council is being asked to schedule the public hearing at this time due to the limited meeting schedule in December. b. Consider a motion setting a public hearing for December 10 on an ordinance changing the zoning designation from Low Density Single Family Residential (RS-5) to Sensitive Areas Overlay (RS-5/OSA) for 5.6 acres of property located at 1520 N. Dubuque Road. (REZ02-,OI~.019) Comment: At its November 7 meeting, by a vote ot~7':-0-, the Planrfir~g and Zoning Commission recommended approval of the rezoning. Staff recommended approval in a report dated October 17. This rezoning will allow the construction of three single-family dwellings on property containing critical slopes. Action: c. Consider a motion setting a public hearing for December 10 on an ordinance vacating Lafayette Street, located west of Capitol Street. Comment: At its N 7 meeting by a vote of 7-0, the Planning and Zoning Commission recommended approval of the vacation of this right-of- way, Staff recommended approval in a staff report dated November 7. Approval will allow the adjacent property owner, ~ty Carto_n~n to purchase this property from the City. Action: d. Consider a motion setting a public hearing for December 10 on an ordinance vacating the east-to-west alley in Block 27 of the Original Town Plat, located between Market and Bloomington Street west of Dodge Street. (VAC02-00007) Comment: At its November 7 meeting by a vote of 7-0, the Planning and Zoning Commission recommended approval of the vacation of this right-of- way. Staff recommended approval in a staff report dated November 7. Approval will allow M~ercy Hospital to purchase this property from the City. Public hearing on an ordinance amending Title 14, Chapter 6, Article K, the Sensitive Areas Ordinance, regarding requirements for Sensitive Areas Overlay Rezonings and Sensitive Areas Site Plans. Comment: At its October 17 meeting, by a vote of 5-0 (Shannon, Hansen absent), the Planning and Zoning Commission recommended approval of the proposed amendments to the Sensitive Areas Ordinance. The amendments will generally require approval of the Sensitive Areas Site Plan by staff unless an applicant seeks modification of a Sensitive Areas Buffer or seeks modification of other zoning requirements. Staff recommended approval in a memorandum dated September 5, 2002. Action: ~__.~.~ f. Consider an ordinance amending Title 14 Entitled 'Unified Development Code,' Chapter 6, Entitled 'Zoning,' A~icle U, entitled 'Administration and Enforcement,' Section 7 Entitled 'Violations and Penalties' to Increase the Municipal Infraction Civil Fines for Violating the Zoning Code. (Second Consideration) Comment: At its October 3 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of amendments to the Zoning Code to provide that a penalty of $250 be assessed against the properly owner/tenanFlandlord for the first offense, $500 for the second violation and $750 for the third violation of the Zoning Code. This ordinance enacts one of the recommendations of the Neighborhood Housing Relations Task Force. Staff previously requested expedited consideration. Action: ~~/~ g. Consider an ordinance to vacate the no~hern two feet of Benton Street beginning 60 feet east of Gilbe~ Street and ending at Maiden Lane. (VAC02-0005) (Pass and Adopt) Comment: At its October 3 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval of this request subject to the applicant maintaining the two feet of vatted right-of-way as landscaped area and subject to utility easements if necessa~. Staff recommended approval in a repo~ dated October 3. Approval of this request will allow the prope~y owner to reconfigure and expand a parking area to accommodate a restaurant at 320 E. Benton Street. Applicant previously requested expedited consideration. Action: November 19, 2002 City of Iowa City Parle 6 h. Consider a resolution approving final plat of Whispering Meadows Part 3, Iowa City, Iowa. (SUB02-00019) Comment: This resubdivision of lots 139-156 of Whispering Meadows Pad Two is an 18-1ot, 26.14-acre subdivision located south and west of Whispering Meadow Drive. At it November 7 meeting by a vote of 7-0, the Planning and Zoning Commission recommended approval of this subdivision subject to staff approval of legal papers and construction drawings prior to City construction drawings prior to City Council consideration of the final plat. Consider a resolution approving the extraterratorial preliminary plat of Kennedy Subdivision, Johnson County, Iowa. (SUB02-00020) Comment: The proposed Kennedy Subdivision is located outside Iowa City's limits in Fringe Area C. It is a 4-lot, 40.2-acre residential subdivision located southwest of the intersection of Dane Road SW and Osage Street SW. At it November 7 meeting by a vote of 7-0, the Planning and Zoning Commission recommended approval of this subdivision. Staff recommended approval in a report dated November 7. Action: L/'~cc~ct-~¢~'//~_.../~ ITEM 7. CONVEYANCE OF APPROXIMATELY 200 SQUARE FEET OF BENTON STREET RIGHT-OF-WAY TO KATHLEEN A. STEVE. Comment: The City Council is considering pass and adoption of an ordinance vacating approximately 200.63 square feet of Benton Street right-of-way. The adjacent property owner, Kathleen Steve, has made an offer to acquire the property, subject to easements for existing utilities and the condition that it be maintained as a grass area, in exchange for approximately 228 square feet of her property adjacent to Maiden Lane. The Public Works Department wishes to acquire said 228 square foot piece in connection with the Maiden Lane right-of- way. This resolution authorizes conveyance of the above property, subject to easements for existing utilities and the condition that it be maintained as a grass area, in exchange for approximately 228 square feet of Ms. Steve's property adjacent to Maiden Lane. a. CONSIDER AN ORDINANCE AMENDING TITLE 14, CHAPTER 8, ENTITLED "AIRPORT ZONING" BY REPEALING THE EXISTING CHAPTER IN ITS ENTIRETY AND REPLACING SAME WITH A CHAPTER REGULATING AND RESTRICTING THE USE AND HEIGHT OF STRUCTURES AND OBJECTS OF NATURAL GROWTH IN THE VICINITY OF THE IOWA CITY MUNICIPAL AIRPORT BY CREATING APPROPRIATE ZONES AND ESTABLISHING BOUNDARIES THEREOF: DEFINING CERTAIN TERMS USED HEREIN: REFERRING TO THE IOWA CITY MUNICIPAL AIRPORT ZONING MAP, AS AMENDED, WHICH MAP IS ADOPTED BY THIS ORDINANCE: ESTABLISHING AN AIRPORT ZONING COMMISSION: ESTABLISHING AN AIRPORT ZONING BOARD OF ADJUSTMENT: PROVIDING FOR ENFORCEMENT: AND IMPOSING PENALTIES. (SECOND CONSIDERATION) Comment: At its September 9, 2002 meeting, the Iowa City Airpod Zoning Commission recommended approval of this ordinance. The ordinance updates the language of the Airport Zoning Code and provides zoning protection for the projects anticipated by the Airport Master Plan. After the ordinance is approved by the City Council, it will be forwarded to the Johnson County Board of Supervisors for approval. The ordinance has been reviewed by the Airport Commission, and the Airport Commission recommends approval. ITEM 9. CONSIDER A RESOLUTION AUTHORIZING THE HISTORIC PRESERVATION COMMISSION TO FILE AN APPLICATION FOR A CERTIFIED LOCAL GOVERNMENT (CLG) GRANT TO OBTAIN FUNDS FOR THE PURPOSE OF PREPARING FOUR NATIONAL REGISTER OF HISTORIC PLACES NOMINATIONS FOR THE PROPOSED NORTH LINN STREET, NORTH GILBERT STREET, EAST JEFFERSON STREET AND EAST RONALDS STREET HISTORIC DISTRICTS, LOCATED IN THE NORTHSlDE NEIGHBORHOOD. Comment: In a report dated August 16, 2000 architectural historian Marlys Svendsen of Svendsen Tyler, Inc. recommended the nomination of these three proposed historic districts to the NRHP. The Iowa City Historic Preservation Commission is also requesting in this grant that the consultant further evaluate the Northside Neighborhood to determine if additional properties could be included in these districts and/or designated as a conservation district. In order to receive federal funding through the Certified Local Government program, the Iowa City Historic Preservation Commission is requesting approval of this grant and allocation of the required matching funds. CONSIDER A L A G FOR REVOLT SKATEBOARD SHOP FROM IOWA CITY'S COMMUNITY DEVELOPMENT BLOCK GRANT - ECONOMIC DEVELOPMENT FUND AND AUTHORIZING THE CITY MANAGER TO SUBMIT ALL NECESSARY DOCUMENTATION TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. Comment: At their November 6, 2002 meeting, the Council Economic Development Committee recommended that Revolt Skateboard Shop be allocated a one-year grant in the amount of $12,500 for job creation. CONSIDER A RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE BROADBAND TELECOMMUNICATIONS DIVISION BY ADDING ONE TIME SPECIAL PROJECTS ASSISTANT - CABLE TV, AND AMENDING THE AFSCME PAY PLAN BY ADDING THE POSITION OF SPECIAL PROJECTS ASSISTANT - CABLE TV. Comment: This position was tentatively approved in the FY03 Budget. Council wished to wait until the beginning of FY03 to ensure adequate funding was available. Wages and benefits for this position will exceed those of the current 17-hour per week temporary position by approximately $7,300 for the remainder of FY03.
