Understandably, construction of thc water treatment plant has had priority for the past several years. It is finished now and thc time has come to consider again a long-range plan and time schedule for the use and restoration of the Montgomery-Butler House. The City of Iowa City has already acknowledged that it is an important site by cleaning it and "mothballing" it several years ago at a cost $50,000 plus. Thc City of Iowa City also hired Marlys Svcndsen to do a feasibility study (The Montgomery-Butler House Feasibility Report of September 2001). I feel that it is very important that the Iowa City Historic Preservation Commission finish the attempt to have it listed on the National Historic Register. I had heard that there were just a few more details for Mr. Richard Carlson to return to Des Moines before the listing was official. I hope that has been done. Why? Grants to help with various steps of a restoration will be easier to get with a National Historic Register listing. Various local historic preservation groups such as the Friends of Historic Preservation and the five local Quester groups will be more likely to help and, hopefully, so will other local, state and national groups. The Montgomery-Butler House is an original example of the earliest type of stone dwelling built in the Iowa City-Coraivillc settlement. It was built in approximately 1854- 55 by two of Iowa City's earliest settlers, Martin M. Montgomery and his wife, the widow Elizabeth Galbreath Butler Montgomery. Elizabeth was the wife first of Walter Butler, who was famous for building Butler's Capitol Building where the first Iowa Legislature met before Old Capitol was built. Elizabeth Butler, in her own right, was written up in the Johnson County history books as being one of the outstanding females, wife and mother, in this area during the pioneer settling years. She died in the Montgomery-Butler House in 1888. Thc house was owned by various members of the Butler family - Maude Butler being the last in 1968. Thc site is historically important because the earliest map showed a ford crossing of the Iowa River and later a ferry crossing owned by Martin Montgomery. Montgomery also operated a steam saw mill on the property. There is still a remnant of a pre-Civil War road with its very deep ruts going down to the river. All these facts together point to a very important Iowa City area development site - surely enough to qualify as an historic tourist attraction and educational opportunity for future generations. For all these reasons, I am asking that the Iowa City Historic Preservation Commission move the Montgomery-Butler House Project up on their priority list for future development before you take on any other new projects. As you know the City now requires a Criminal History check from the State of Iowa DCI as well as the signature of the County Attorney for license renewals. It is my understanding that these are not required by the State ABD. This year we received our license renewal forms in the mail on the afternoon of Monday October 28, only 15 days before the deadline for submission to be on the Council agenda. We immediately sent the request for the Criminal History report from the Iowa DCI. This report is required before we can obtain signatures of the County Attorney and Iowa City Police. We received the report in the mail on Saturday November §th. Since Monday November ! 1 was a holiday, this left only 4 hours to obtain the necessary signatures to submit the renewal application on time. We accomplished this task with the kind assistance of Andy ChappeI1 of the County Attorney's Office. That's cutting it rather close. The City Clerk informs me that the renewal packet is mailed out as soon as it is received from the State ABD. Since the City imposes additional requirements on applicants that require more time to execute, it would be helpful if the City Council would formally request ABD to send the renewal forms to the City Clerk at an earlier date. This would allow the licensee a more reasonable period of time to comply with the additional requirements imposed by the City for license renewals. Thank you for your consideration of this dilemma. I am currently the program director for the university's chapter of the Society of Professional Journalists (SPJ). One of SPJ's projects includes putting together a panel for Legal and Ethical Issues in Communication (a required class for journalism majors). The panel is made up of three journalists and three non-journalists. A moderator will read approximately three scenarios that involve specific conflicts in the area of ethics, and panelists are asked to answer questions about the scenarios. I am writing this letter to ask if one council member would be interested in participating on the panel. The panel will meet Tuesday, December 3 from 10:55-12:10 p.m. in Lecture Room Two of Van Allen Hall. It is a great opportunity to share and hear various viewpoints as to why and how something should be done. I call two considerations to your attention, in addition to those emphasized by others: 1) Surely, traffic lights and, probably, street 'ffidening will become necessary at the corner of South Grand and Melrose Avenue. The comer is already a traffic pattern nightmare and will become more so with closure of Grand Avenue Court to local traffic (Doug True, who must never venture over this way, should take note). Who will pay for this, Iowa City or UI? 2) Long-range plans of UI for reasonable traffic flow on the West Side is murky, to say the least. Entry and exit to the UIHC Emergency Room and loading dock, field house, Pharmacy building, Medical Laboratories building, Bowen Basic Science building, Law Building, UI day care centers, the new Athletes Education Building - not to mention football and basketball crowds, and patients forlornly seeking access to UIHC - depend at present on an open Grand Avenue or Melrose Avenue. Closure of Grand Avenue (as reported in the newspapers but otherwise ignored) without new street or highway construction is hard to figure. Just what is planned and when, and at whose expense? Closure of Grand Avenue Court seems simply to accommodate the hasty move of beginning construction on the athletes building. What's next? The Iowa City Council needs more information on "ultimate" West Side traffic flow patterns and assurance from the UI that their plans - if they presently exist - will work for all affected. Past street closures have often led to congestion and poor alternative traffic routes, and therefore give little confidence in the foresight of University "planners." My concern is that now that extension is open, a similar situation inevitably will occur (as it did, anecdotally, this morning). As more development takes place and people become used to this very convenient route, it will become more dangerous for those of us on foot (which I believe will increase as those people who work in the area will enjoy the healthy benefits, as will families in the area). The Council is sometimes criticized for actions it takes, but this should not be a tough decision. Safety was a major reason proponents of the extension pushed for it. Clearly it is a public safety issue. Although not entirely completed (muddy and lack of street access to date), they are a welcome addition to the neighborhood. As an active family of four, the Sycamore sidewalk system means we can walk/jog with little fear of traffic accidents as my wife and I are generally able to find time to exemise in the pre-dawn and/or dusk hours. As our kids get older, I anticipate them to visit friends in neighboring developments without adult supervision on the road or being driven to their destination. When cycling with our children, my son (5) 'wrecked' this fall trying to transition from cement road in our subdivision to the oiled gravel of S. Sycamore Straet~thera is often loose gravel and a hump where they meet. The sidewalk may alleviate this hazard although an asphalt/cement road is the real solution. Keep up the progress. It would appear that this is an important part of the local economy (including a thriving underground economy). Bars will serve practically anyone, including eighteen year olds like my son. There are "parties" that charge a fee for all the beer you can drink. I personally observed a friend's fifteen year old (who looks fifteen) served a beer at a prominent sports bar. Teenagers (including high school students) flock to Iowa City to drink. Why isn't the drinking age law enforced in this town? Why aren't these establishments held accountable. If the police would investigate thisissue properly (beyond the token effort now performed), I am not sure that any drinking establishments would not be found in violation. Sending our son into this type of "anything goes concerning drinking" environment is very disturbing. I am not naive and realize the some underage drinking goes on everywhere. We even live in a university town, Fayetteville, AR, but what goes on in Iowa City is beyond any reason. But what really disturbs me is all the money being made those who prey on the underage students. What is being done now is not enough. I believe that many of the well- publicized problems that the University of Iowa is experiencing are due to the total disregard of alcohol consumption laws. If this is not the right forum to address this issue, please direct me to where I should go. As the manager of Saratoga Springs Limited Partnership, the Housing Fellowship serves as the property manager for 16 townhouses in the Walden Ridge Homeowners Association. Essentially this means that the Association maintains/repairs the exterior of the units and Saratoga Springs maintains/repairs the interiors. I have enclosed a chronology of events as recalled by the staff of the Housing Fellowship. Five Saratoga Springs units received flood damage to the unfinished basements. Four of the units required basement reconstruction (i.e. replacement of walls, furnaces, water heaters and electrical service). The Daniel's unit at 2519 required basement repair (i.e. removal of damaged drywall, disinfecting, new vinyl in basement bath and carpet replacement on the last few steps of basement stairs). Upon receiving notice of the flood damage, staff immediately contacted the City's Rental Inspector, the Insurer, Moore Construction and Riverside Maintenance. The Rental Inspector deemed all five units uninhabitable on August 23. The Inspector informed staff of what repairs needed to be completed so the units would be habitable. The Daniel's unit required removal of sections of drywall, vinyl and carpet, cleaning and disinfecting. Moore Construction and Riverside Maintenance began the clean up on August 23. The Housing Fellowship worked with the Red Cross and the tenants to arrange lodging for the weekend. We offered to end all five leases immediately if families chose to relocate. Ms. Daniel indicated that she might look for other options. On Monday, August 26, the Daniel's unit was not habitable, so Saratoga Springs paid for them to continue their motel stay. Between the 23ra and 27th of August, damaged drywall, vinyl and carpet were removed, windows boarded up and sump pumps checked. On Tuesday, August 27, the Daniel's unit was deemed habitable by the Rental Inspector, as damaged components had been removed, professionally cleaned and disinfected and the family returned to their home. During this week, Ms. Daniel indicated an interest in moving. The staff at the Housing Fellowship, after consulting the Iowa City Public Housing Authority (PHA), informed Ms. Daniel that PHA did have three bedroom vacancies. It is our understanding that showings were arranged and Ms. Daniel did not show up for the showings. It is true that the Daniel's have called on several occasions to request the repairs be expedited. The Housing Fellowship responded to each and every request. However, on several occasions the contractor and sub-contractors have been denied access to the unit by the Daniel's. It has been reported to the Housing Fellowship that the Daniel's informed the Contractor that it was inconvenient for them to have workers in their unit before 10:00 a.m. Further, the Daniel's denied access to Americlean to remove equipment used to dry the basement. In regard to the storm water management system, the partners of Saratoga Springs requested a special meeting of the Walden Ridge Homeowners Association on September 13. The meeting was held on October 16, 2002 (the covenants and restrictions require a lengthy notice to Association members). The Homeowners Association adopted a motion to hire a Civil Engineering firm to study the storm water management system and correct any drainage problems. I know that the building inspector has recommended some remedial steps to prevent leakage into 2519 Clearwater, and the Association intends to complete these tasks within the week. The Board of Trustees and the staff of the Housing Fellowship very much regret that the Daniel's are not happy with the way that the reconstruction/repairs have been handled. The situation has been frustrating for all of those involved and everyone wants this situation to be resolved as soon as possible especially the tenants. Moore Construction has assured us that all repairs will be completed by November 18. I assure you that we have made every attempt to provide all five families with safe and decent housing. If the Daniel's wanted more room, they would need to pay for it August 27, 2002 ·Americlean extracted water, cleaned, deod6rized and disinfected carpet and flOor, installed 2 turbo dryers and commercial dehumidifier for the next three days · City Rental Inspector declared unit habitable. Daniel's returned to their home August 29, 2002 · Daniel's refused Americlean access to unit to remove equipment. Americlean informed GICHF office of an additional 24-hour charge for the equipment if not removed. P. Hinzman asked Daniel's to allow Americlean access to remove equipment and to avoid additional charges From August 29 to present - Moore Construction has been coordinating the repairs to the five damaged units. Tenants at 2563 and 2567 returned to their homes on October 18. Family at 2555 returned home on November 5. August was supposed to be one of the most important months and or time of our life. August 3rd, 2002, we wed. August 13th is my birthday. Then came August 23rd, the day of the flood, which mined our honeymoon, many household items and our entire basement. Now we realize that this occurrence, the flood, was unexpected. I use the word unexpected very lightly, because we've always complained about water every time there's a hard rain. The water would fill up in the hole in the basement where the window is and also the drain. Also, water would seep in along the walls or perimeter of the basement causing mildew which had risen up along the walls at least 3 to 4 feet off the ground. This has been a major concern involving our housing situation and the way my family and I have been treated through out this whole ordeal. We have been patient. We have been respectfhl. We have tried several times to communicate with our landlord, which is Saratoga Spring, Greater Iowa City Housing Fellowship. We have verbally expressed concerns and damages. Their response was, "Wanda, thank you for being patient but the other apartment had worse flood damage therefore their apartment is a priority." Five families were displaced including mine. We'd like to thank the Red Cross for being the only organization that provided help, food, shelter, etc.., for the weekend. During those days clean up had not started. Mud was everywhere. Mildew was concentrated, spores, bacteria--it was a disaster. In our opinion the flood could have been prevented if the builder had constructed a water barrier. So therefore we have poor construction, poor drainage, and poor listening skills. As a result we have several items destroyed, damaged such as albums, winter clothing, furniture, chairs, shelves, a whole drum set, rugs, a toilet not in use, a shower not in use, we have no window at all, no drywall, small uninvited critters. Weeks have gone by with no courtesy call from the landlord, no inspector, no worker, no landlord visits. No nothing. Now we're getting angry and disappointed! This is really affecting our family mentally, emotionally, and physically. Meanwhile our children are asking questions and we have to try to go about our daily routines. We have had to use Clorox bleach daily to sanitize, to cut down on mildew. Weeks go by. We had to talk to someone. Because we know we have every right to know what's going on or the progress that is being made. We call our Section 8 worker. We explained to her how we felt and what's going on and she acted as if she understands my disappointment and us wanting some answers. By the way she is fully aware of when this happened and our concerns. Now we are desperate. We need some help so that is why we called her thinking maybe she can get some answers. The landlords told her the same thing they told us. We feel helpless, ignored, disrespected. We can't believe how insensitive our landlord has become toward us. After all she has communicated with others every other day. She still has not made an attempt to call or talk to us as a tenant. We deserve to have adequate, safe, fair housing. We have rights! We understand that Iowa City has fair equal sources that can help someone like us. We have to know the sources and use them!
