NOTICE OF PUBLIC HEARING
Notice is hereby given that a public hearing will
be held by the City Council of Iowa City, Iowa, at
7:00 p.m. on the 13th day of May, 2008, in Emma
J. Harvat Hall, 410 E. Washington Street, Iowa
City, Iowa, or if said meeting is cancelled, at the
next meeting of the City Council thereafter as
posted by the City Clerk; at which hearing the
Council will consider:
1. An ordinance changing the zoning
from Community Commercial (CC-2)
zone to Intensive Commercial (CI-1)
zone for 11.7 acres of property located
on Ruppert Road west of Old Highway
218.
2. An ordinance changing the zoning
from Community Commercial (CC-2)
zone to Neighborhood Public (P-1)
zone for 8.95 acres of property located ~__

3. An ordinance vacating an alley located
south of 829 Kirkwood Avenue.

BACKGROUND INFORMATION:
Aviation Commerce Park North was subdivided in 2000 and was zoned P/CI-1, Public/Intensive
Commercial, at that time. In 2005, Wal-Mart had an interest in purchasing a large tract of land
within Aviation Commerce Park. At that time, the entire subdivision was rezoned to CC-2,
Community Commercial. To do this, the Comprehensive Plan was amended to change the
designation on the land use map in the South Central District Plan from Intensive Commercial to
Community Commercial. Also, the text of the plan was changed to refer to the more general term
"commercial" rather than the more specific Intensive Commercial or Community Commercial. The
rezoning was approved, but the sale of land to Wal-Mart did not take place.
In 2007, approximately 12 acres of land in the eastern part of Aviation Commerce Park North was
rezoned from CC-2 to CI-1. The application for this rezoning resulted from offers made for the
purchase of land for uses that would require a CI-1 zone. This rezoning was approved and
resulted in lots 1, 5, 6, and 7 being rezoned back to CI-1. At the time of the rezoning, an
additional amendment was made to the South Central District Plan. The language of this
amendment said that retail uses could be possible in Aviation Commerce Park North, but would
only be appropriate if visibility and access to the site were improved. Without such improvements,
the amendment says that commercial uses not requiring high visibility would be appropriate.
The rezoning in 2005 resulted in the entire development being zoned CC-2, including outlots B
and C. The zoning for these outlots has not changed since that time.
Currently, an application is being considered by the City Council requesting that lots 2, 3, and 4
and outlots 2A, 3A, and 4A be rezoned from CC-2 to CI-1. If approved, nearly all property
surrounding lots 8 through 17 will be zoned CI-1 or P-1.
ANALYSIS:
Land Use and Zoning
Lots 8 through 17 are currently zoned CC-2, Community Commercial. This zone is primarily
intended for retail goods and service operations that require high visibility. As the Aviation
Commerce Park North is currently designed, visibility is lower than what would be desirable for
most businesses that would be appropriate for a CC-2 zone. It is unlikely that smaller retail
businesses would find this location desirable.
The CI-1, Intensive Commercial, zone allows for businesses that do not rely on high visibility.
These businesses include uses characterized by outdoor storage and display of merchandise, or
sales and repair of large equipment.
Outlots B and C are currently zoned CC-2 and are owned by the City. These outlots are
undevelopable due to their very narrow width. Also, outlot C's primary use as a drainage ditch
makes it undevelopable. Since these undevelopable outlots are publicly owned, a P-1 zone is
appropriate.

Compatibility with Comprehensive Plan and Neighborhood
After amendments were made to the comprehensive plan in 2005 and 2007, the most recent
version states that either Community Commercial, CC-2, or Intensive Commercial, CI-1, would be
appropriate. No amendment to the comprehensive plan would be necessary to rezone lots 8
through 17 from CC-2 to CI-1.
The uses surrounding this property are all commercial in nature. Existing development to the
north is zoned CI-1. Undeveloped land to the east is also zoned CI-1. To the south, land will be
zoned CI-1 if a pending application is approved by City Council. Land to the west is zoned CC-2;
however, this land feels separated from lots 8 through 17 due to the layout of streets and buildings
in the area. Therefore the proposed CI-1 zoning is compatible with the surrounding properties.
STAFF RECOMMENDATION:
Staff recommends item REZ08-00004, a request for a rezoning from Community Commercial
(CC-2) zone to Intensive Commercial (CI-1) zone (approximately 11.7 acres) and Neighborhood
Public (P-1) zone (approximately 8.95 acres) for property located on Ruppert Road west of Old
Highway 218, be approved.

ESTIMATED COST FOR EAST SIDE RECYCLING CENTER PROJECT IN THE CITY OF IOWA
CITY, IOWA
TO ALL TAXPAYERS OF THE CITY OF IOWA CITY, IOWA, AND TO OTHER INTERESTED PERSONS:
Public notice is hereby given that the City Council of the City of Iowa City, Iowa, will conduct a public
hearing on plans, specifications, form of contract and estimated cost for the construction of the East Side
Recycling Center Project in said City at 7:00 p.m. on the 13~h day of May, 2008, said meeting to be held in the
Emma J. Harvat Hall in City Hall in said City, or if said meeting is cancelled, at the next meeting of the City
Council thereafter as posted by the City Clerk.
Said plans, specifications, form of contract and estimated cost are now on file in the office of the City Clerk
in City Hall in Iowa City, Iowa, and may be inspected by any interested persons.
Any interested persons may appear at said meeting of the City Council for the purpose of making
objections to and comments concerning said plans, specifications, contract or the cost of making said
improvement.
This notice is given by order of the City Council of the City of Iowa City, Iowa and as provided bylaw.

PUBLIC HEARING NOTICE
The City Council will hold a public hearing on Iowa City's FY09 Annual Action Plan on May 13,
2008, at 7:00 p.m., City Hall, Emma Harvat Hall, 410 East Washington Street, Iowa City, IA. The Action
Plan is a sub-part of Iowa City's 2006-2010 Consolidated Plan (a.k.a. CITY STEPS).
The City of Iowa City has available a draft FY09 Annual Action Plan for the use of Community
Development Block Grant (CDBG) and HOME Investment Partnership Program (HOME) funds. Approval
of the Action Plan will also be considered by the City Council on May 13, 2008.
The Annual Action Plan describes the federally funded activities to be undertaken by the City and
its recipients during the 2009 fiscal year (July 1, 2008 to June 30, 2009). Copies of the draft FY09 Annual
Action Plan are available to the public at the Iowa City Public Library, 123 S. Linn Street, the Department
of Planning and Community Development, 410 E. Washington Street, and at www.icgov.org/actionplan. A
thirty (30) day public comment period began on April 11, 2008.
