This program would be operated jointly by the City, the Chamber of Commerce, and participating private sector businesses. The idea behind the program is to provide forgivable loans of up to $5,000 to assist Iowa City small businesses in clean-up and hiring of electrical and plumbing inspectors in order to get their business reopened. There are an estimated 100 small businesses in Iowa City who have been impacted in some way by the recent flood event. We would like to assist these businesses in getting back on their feet and reopening. Many of these businesses are small enough and have suffered losses such that the expense for clean-up and hiring licensed inspectors is a considerable financial burden. Our proposed program is intended to assist these businesses in getting cleaned up and reopened. My recommendation is that we dedicate $75,000 from funding currently budgeted and allocated for economic development activities to establish a Small Business Flood Assistance Program. Staff and I will work with the Chamber to secure an additional dollar for dollar match from private businesses to create a fund of $150,000. My staff would create criteria for considering funding requests, and a review committee of City, Chamber, and Corporate representatives would oversee the award of grants up to $5,000 for flood related clean-up expenses. We believe we can assist up to 50 businesses with the program as proposed. Expectations for receiving the funds would require an applicant to reopen their business within six to twelve months and remain open for at least 18 months following. In the interest of getting funds out to small business owners as quickly as possible to facilitate clean-up, I would recommend that a member of the Council Economic Development Committee be your representative on the oversight committee along with staff from the Department of Planning and Community Development. It is our understanding that clean-up costs for business owners is not a reimbursable expense from FEMA and though modest, this funding would go a long way in assisting small business owners. I look forward to discussing this with you further at our June 30 work session. I am out of town June 26-27, so feel free to contact Jeff Davidson if you have questions. cc: Jeff Davidson Wendy Ford Nancy Quelhorst ppdad m/memismallb usiness6-24.doc r ~~-~~~~ CITY OF IOWA CITY IP3 .~~®~~-~ MEMORANDUM Date: June 25, 2008 To: City Council From: Michael Lombardo, City Manager Jeff Davidson, Director of Planning and Community Development Re: Availability of buyout funds through the Hazard Mitigation Grant Program We have received notice that the State of Iowa will receive FEMA funding under the Hazard Mitigation Grant Program (HMGP) as part of the most recent Presidential Disaster Declaration. The State's priority for this funding is the acquisition of flood prone properties. This memorandum is to provide you with the best information we have about this program at this time. It is important that we all be on the same page in giving out information to persons impacted by the flood in terms of what they may expect from this program. The FEMA funds will go to the State Homeland Security and Emergency Management Division. They will oversee the granting of funds for buyout of flood prone property. Individuals are not eligible applicants; for municipalities the local government entity would be the applicant. Following are some key points of the program: The acquisition of flood prone properties is the State's priority. The greater the risk of inundation, the higher the priority for acquisition. It is reasonable to assume that properties with a higher probability of flooding in the 100-year flood plain would be higher priority than less vulnerable properties in the 500-year flood plain. The State has indicated that properties not funded would be set aside for future funding consideration should funds become available based on the perceived risk criteria. All sales must involve willing sellers. Acquisition projects are strictly voluntary and homeowners are never forced to sell their property. Purchase price for properties must be at their pre-flood fair market value. The decision to buy flood-damaged property is made by the local government and the property owners, not the state or federal government. Costs must be shared on a 75% federal/25% state or local basis. The State has indicated that they intend to provide 10% of total project costs which would leave a 15% local match. The State's commitment has not been confirmed. Acquired property must revert to natural flood plain or be maintained as open space. Future disaster payments would be prohibited at purchased sites. The State has provided a typical timeline for HMGP grants. It appears that under the best possible circumstances the buyout process would take at least one year to complete. If you wish to consider interest in this program we will need to discuss the funding provisions in order to commit to the required local match. We would then put a resolution on the City Council agenda to submit a formal Notice of Interest to the State. June 25, 2008 Page 2 One other complicating factor is the necessity of having an approved Hazard Mitigation Plan filed with the State. This is a requirement to be eligible for the HMGP buyout program. There are currently no entities in Johnson County who have approved Hazard Mitigation Plans, and there are many entities throughout the State which do not have plans completed. We are currently evaluating the most expedient way to get our plan completed. We do not expect any problems getting our plan completed prior to any funds being granted because of the long timeline for this buyout program. Let's plan on discussing this matter at your June 30 special work session. It is important in your various conversations that you not imply the City's commitment to the HMGP buyout program until we have discussed the impacts thoroughly. As We, in Iowa City, urge you to authorize 100 percent federal funding beginning June 11, 2008 and continuing for no less than 60 days for emergency protective measures and debris removal (categories A and B) under the FEMA Public Assistance program. As you heard when you visited our community, the City supported flood response efforts throughout the community-not only for public infrastructure, but for private residential and commercial properties as well. Full FEMA reimbursement will ensure that citizens in community already affected by the flood will not have to bear the additional costs of response and recovery efforts. Our community will be pursuing Hazard Mitigation funding through FEMA. Many residents in the affected areas have asked about buyout programs and I am certain we will explore these, as well as other options, to support rebuilding and recovery in our community in a sustainable manner. Amail-back survey of households in this area was conducted. The response rate to this survey was 75% in favor (9 in favor, 3 opposed) of the proposed traffic calming project. This is above the 60% majority required by the City's adopted Traffic Calming Program. Sixteen postcards were not returned. After a public comment period, final approval will be considered at the July 15, 2008 City Council meeting (please contact the City Clerk's office prior to the meeting to verify the date/time). If approved, the speed humps will be installed near the locations shown on the attached diagram. Exact locations of the speed humps will be determined by the Project Engineer. If the City Council approves the project, the speed humps will be constructed this summer (weather permitting). Approximately one year after installation, we will complete afollow-up traffic study and neighborhood survey. This will determine if the speed humps have been effective and if the neighborhood wishes to keep them in place. The Iowa Green Communities Criteria establishes minimum performance-based green building design and construction standards for all upcoming applications for financial assistance from the Iowa Department of Economic Development's Housing Fund, Community Development Block Grant Program Community Facilities and Services Fund, and Main Street Iowa Challenge Grant program. This meeting will take place Monday, July 7th at 9:00 am, at the Shueyville United Methodist Church (www.shueyvillechurch.org) located at 1195 Steeple Lane NE in Shueyville. This site is centrally located and will accommodate more attendees than ECICOG's office in Cedar Rapids. Staff from Iowa Homeland Security & Emergency Management Division (HSEMD) will provide information regarding FEMA funding that the State of Iowa will receive under the Hazard Mitigation Grant Program (HMGP) as part of Presidential Disaster declaration FEMA-1763-DR. HSEMD's goal for the meeting is to educate City and County leadership about the availability to acquire flooded property under the Hazard Mitigation Grant Program (HMGP), and how to proceed with a HMGP Acquisition program. Again, we stress that this informational meeting is for staff and decision makers only, not for homeowners at this early stage. As a reminder, a FEMA approved Local Hazard Mitigation Plan is an eligibility requirement for all HMGP projects. However, if a community has destroyed homes and is engaged in the planning process now, there could still be an opportunity for them to be awarded HMGP funds. There is a planning waiver that the State and FEMA Region VII could approve that would give a community one year after the HGMP project grant award to have their plan approved. We hope further clarification on this requirement will be provided at the meeting, and would encourage you to attend, regardless. Update on Website: Nelson reminded the Commission to update their biographies and submit events to the calendar. Youth Empowerment Grant: There were no new applications for the Youth Empowerment Grant. Nelson clarified that a member of the Commission could in fact apply for a grant. A new press release was planned, as well as Facebook ads. Weeks agreed to make a facebook ad for West, Green agreed to make ads for City and Regina, and Malatek agreed to make an ad for the Kirkwood network. Summer of the Arts Update: Weeks stated that he and Segar would meet to plan activities and submit the plan and estimated costs to Karr ahead of the June 7th date. Nelson and Green said that they would each find volunteers for the event. Nelson suggested that pictures be taken to be posted on the website. Make uq of 2008 Subcommittees: There were no changes to the subcommittees. Review of Present Bvlaws: Weeks suggested that the requirement for making a quorum be changed to a majority of filled positions, rather than counting the vacancies as well. Wilburn pointed out that such a change could allow a minority of the Commission to disproportionately affect votes, as well as allowing Commission members to skip meetings by anticipating a quorum being there. A plan to reserve spots on the Commission for specific schools was discussed. Nelson suggested a combination scheme with some positions reserved for schools and others open or at large. City Clerk Karr will provide the Commission with an electronic copy of the by-laws and Commission members agreed to review (with an emphasis on membership) submit their changes for discussion at the next meeting. Wilburn reminded the Commission that amending the by-laws required atwo-thirds majority vote. Wilburn also spoke about a youth conference and said he would alert the Commission when he had more information. Malatek noted that she attended a similar conference during the creation of the YAC. Public Discussion: None Announcements/Invitations: The Neighborhood Centers of Johnson County thanked the Commission for helping with their Road Race. Nelson and Karr suggested that a member of the Commission be at the welcoming party for the new city manager. Wilburn announced that the downtown concert series was starting for the summer. PUBLIC DISCUSSION OF ANY ITEM NOT ON THE AGENDA Carney shared a cigarette machine art package example with the committee. He told the committee the small packages of art can be dispensed from old cigarette machines and serve as "art to go". Carney said the packets might work to raise money and awareness for public art. Klingaman wondered if purchasers of the packets would know what they are getting. Carney thought the cigarette machines could be made to allow for that. The committee agreed this is a good idea and it should be further explored for next month. CONSIDERATION OF THE MINUTES OF THE MAY 15. 2008 MEETING MOTION: Williamson moved to approve the minutes; Carney seconded. The motion passed 5:0. COMMITTEE TIME/UPDATES Nothing to Report Jill Harper presented revisions to the Washington Hills Neighborhood art project plans. She explained the animal sculptures were replaced by a mosaic plinth that would hopefully reduce the potential for vandalism. Harper plans to create 10 four-sided plinths leading up to the playground area. This would allow for the artwork of 40 elementary Iowa City Public Art Advisory Committee Minutes June 5, 2008 Page 2 students from Hoover and Lemme Elementary Schools to be displayed. The plinth would display the child's name and grade with a mosaic creature design on top, with the goal of keeping as close to the original design as possible. Along with the plinths, Harper plans to place a cement bench at the entrance of the park which would be covered in a mosaic design. The bench she proposed could be bought from Kay-Park which is a distribution firm. This design would incorporate the name of the Pheasant Hill Park so the bench would double as an entrance sign to the park as well. On either side of the bench, Harper also plans to place two plinths that would be slightly taller than the other plinths that will be in the park. Klingaman reported the cost estimate of $6100 received from All-American Concrete for manufacturing the cement plinths. Shirley Wyrick asked if that included installation. Kabat explained the cost estimate was vague, but he and Klingaman did not believe the total included installation. Khan asked if a circular post might help to decrease cost. Harper explained a circular post would limit the number of children who could be included in the project. Harper suggested the square plinths could be made narrower to decrease costs. Kahn wondered if a PIN grant could be combined with public art funds, but Klingaman clarified PIN grant monies are already being used for the bench. Kahn asked how much money could be allocated to the project by the committee. Klingaman explained the final total was up to the committee. The committee figured the total cost of the project based on the estimate from All-American Concrete would be $16,590 without installation. Williamson asked if there was any flexibility on the number of plinths to be installed. Harper said the number could be decreased, but 12 is already less than originally planned. Klingaman suggested the estimate may be too expensive and other options should be explored. All agreed. Harper asked the committee if concrete would be needed underneath the bench. Trueblood explained maintenance of the bench would be better with a concrete pad under the bench. He also said it would be the cheapest and most viable option. Trueblood offered to assist with installing a concrete pad and the bench. Harper asked if the bench could be installed in the summer, since it would be easier for her to work on the project at this time. Trueblood explained it would need to be known how much time is needed to get the bench before an installation date could be set. Wyrick asked if there are any placement requirements for the bench. Trueblood said the main concern would be what might be beneath the ground Tike utilities. Klingaman added access to the park might also be an issue. All agreed the Kay-Park bench would be good. MOTION: Williamson moved to approve an amount for the Washington Hills Neighborhood Art Project up to $16,600; Khan seconded. The motion passed 5:0. Klingaman explained to Harper and Wyrick that a contract would be drawn up and the exact costs would be found. TRAIL ART Klingaman suggested narrowing down a couple of options which the committee would like to consider for a possible trail art project. She further suggested the South Leg of the Iowa River Corridor Trail might not be the best option due to current construction in the area. Trueblood reminded the committee the original waterworks trail plan called for a Iowa City Public Art Advisory Committee Minutes June 5, 2008 Page 3 sculpture garden, however this has not happened. Klingaman added the waterworks trail would be a good location for interpretive signage whereas a neighborhood trail would be a good place for art that would announce the trail to the community. Carney asked about the amphitheater planned for the waterworks park. Trueblood explained the amphitheater will be very simple and geared towards school groups and small gatherings. Finlayson asked if a layout of the park and proposed amphitheater would be available. Klingaman said a map of the park's trail network could be brought to the next meeting. Trueblood added plans have been developed to create a hospice memorial garden in the park around 2012. He explained the project is in the same vein as the Willow Creek Park memorial but it will be about 5 times larger. He suggested this project could present an opportunity for additional public art. He offered to bring a concept map of the project to the next meeting. The committee agreed the Waterworks Park would be the best place for a possible trail art project. UPDATE ON ROBERT A LEE RECREATION CENTER POOL WALL ARTWORK The committee expressed disappointment with the temporary misplacement of the glass panels at the tempering plant. Klingaman informed the committee the panels had been recently found and went through the tempering process. She explained the panels should now be completed and ready for delivery. Klingaman relayed her disappointment that the panels would not be revealed in conjunction with the Artsfest and the delay will make installation more difficult since summer pool lessons are now in session. The art work will now be revealed in August since the artist, BJ Katz, cannot come until August 7~". Engineering is creating fully stainless steel fasteners to hang the piece; this material will be able to resist corrosion from the pool chlorine. Klingaman informed the committee the project was approved not to exceed $15,000 for lighting and installation. However the total cost is now at $17,400 without lighting. Trueblood asked if the lighting contractor is the supplier or the installer. Klingaman explained it is the supplier. ADJOURNMENT Trueblood motioned to adjourn; all seconded.
