d) Resolutions.
o~ ~ ~ay 1. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO
EXECUTE AND THE CITY CLERK TO ATTEST TO A
SUBORDINATION AGREEMENT FOR 2814 IRVING AVENUE.
Comment: The City sold 2814 Irving Avenue through the Affordable
Dream Home Program. As a condition of the sale, the owners agreed to
restrict their use of the property for 15 years. The owners recently
received a loan from a local lender, and the lender is requesting that the
City subordinate its Resale Agreement to the private mortgage.
og-~o~ 2. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN

the owners signed a resale agreement when they purchased the home
as part of the tenant to ownership program (TOP) that requires, in part,
that the home must be sold to an income eligible buyer if sold before
June 30, 2015. Although the loans have been paid off, the restrictions
contained in the resale agreement remain in place until 2015,. which is
why one of the mortgages is only partially released.

ITEM 6. CONSIDER AN ORDINANCE AMENDING TITLE 2 OF THE CITY CODE,
ENTITLED "HUMAN RIGHTS," CHAPTER 3, ENTITLED
"DISCRIMINATORY PRACTICES" TO EXCEPT SMALL EMPLOYERS FROM
DISCRIMINATION CLAIMS AND CHAPTER 4, ENTITLED "ENFORCEMENT," TO
INCREASE THE TIME PERIOD FOR FILING A DISCRIMINATION CLAIM.
(SECOND CONSIDERATION)
Comment: This ordinance increases the time to file a discrimination complaint from
180 days to 300 days. This will make the City Code consistent with the recent
amendment to the state law that goes into effect July 1. The ordinance also adds an
exception to the employment discrimination provision for small employers. The
Supreme Court recently ruled in Baker v. City of Iowa City and Iowa City Human Rights
Commission that the City did not have the home rule authority to impose liability on
employers with less than four employees.

original agreement, do not apply to this type of 28E agreement, and therefore, are

CERTIFY THE SAME TO THE JOHNSON COUNTY TREASURER FOR
COLLECTION IN THE SAME MANNER AS PROPERTY TAXES.
Comment: The City has the authority under Iowa Code §364.136 to assess the
nuisance abatement costs in the same manner as a property tax. This resolution
allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to
be assessed against the property. This assessment is being pursued only after the City
took many steps to resolve the matter. The City notified the home owners to abate the
nuisance (for example, to remove snow from the sidewalk) and after the home owner
did not take action to abate the nuisance, the City abated the nuisance and billed the
owner. After being billed at least twice, these owners still have not paid the abatement
costs. The City has sent a letter to the home owner giving them notice that this
resolution would be on the agenda, a copy of which is attached to the resolution. No
interest will be charged if the owner pays within 30 days of the first required
publication. Attached as an exhibit to the resolution is a list of the properties that will
be assessed and the amount that will be assessed.
