CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT FOR 2814 IRVING AVENUE. Comment: The City sold 2814 Irving Avenue through the Affordable Dream Home Program. As a condition of the sale, the owners agreed to restrict their use of the property for 15 years. The owners recently received a loan from a local lender, and the lender is requesting that the City subordinate its Resale Agreement to the private mortgage. og-~o~ 2. CONSIDER A RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIENS REGARDING TWO MORTGAGES FOR THE PROPERTY LOCATED AT 1417 FRANKLIN STREET, IOWA CITY, IOWA. Comment: The homeowners have two loans, secured by separate mortgages, from the City, which have both been paid off. In addition, the owners signed a resale agreement when they purchased the home as part of the tenant to ownership program (TOP) that requires, in part, that the home must be sold to an income eligible buyer if sold before June 30, 2015. Although the loans have been paid off, the restrictions contained in the resale agreement remain in place until 2015,. which is why one of the mortgages is only partially released. ~ ~ - <7~0~ 3. Comment: The owner of the property located at 924 Van Buren Street South received assistance through the City of Iowa City's Housing Rehabilitation Program. (Item "a,c,e,f' will proceed as outlined in the City Attorney's memo of 2/28/07 entitled "Rezonings, Due Process and Ex parte communications.") a) CONSIDER A MOTION SETTING A PUBLIC HEARING FOR AUGUST 11 ON AN ORDINANCE AMENDING THE CONDITIONAL ZONING AGREEMENT TO MODIFY THE CONCEPT SITE PLAN FOR APPROXIMATELY 25.16- ACRES OF PROPERTY IN THE COMMUNITY COMMERCIAL (CC-2) ZONE FOR WESTPORT PLAZA INCLUDING WAL-MART AT 855, 911 & 1001 HIGHWAY 1 WEST. (REZ08-00006) Comment: At its July 3 meeting, by a vote of 4-1 (Plahutnik voting no, Busard absent) the Planning and Zoning Commission recommended approval. The amendments will allow the property to be redeveloped with one retail building rather than a series of buildings depicted in the original Conditional Zoning Agreement. The amendments will also allow the addition of a third free standing sign. (SU608- 00002) Comment: At its May 15 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval. Staff recommended approval in a report dated April 25. Approval will allow the development of Hendrickson Lytham Condominiums a 2-lot, 9,48-acre residential subdivision located south of Olive Court and Learner Court and east of Marietta Avenue. Action: ug - ~/~. h) CONSIDER A RESOLUTION APPROVING THE FINAL PLAT OF KENNEDY'S WATERFRONT ADDITION PART FIVE, IOWA CITY, IOWA. (SUB08-0007) Comment: At it June 19 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval subject to staff approval of legal papers and construction drawings prior to City Council consideration. It is anticipated that legal papers and construction drawings will be approved prior to the Council meeting. Staff recommended approval in a report dated June 19. Approval will allow the development of Kennedy's Waterfront Addition Part Five, a 4-lot, 6.48 acre commercial subdivision located west of S. Gilbert Street, south of Stevens Drive. CONSIDER AN ORDINANCE AMENDING TITLE 2 OF THE CITY CODE, ENTITLED "HUMAN RIGHTS," CHAPTER 3, ENTITLED "DISCRIMINATORY PRACTICES" TO EXCEPT SMALL EMPLOYERS FROM DISCRIMINATION CLAIMS AND CHAPTER 4, ENTITLED "ENFORCEMENT," TO INCREASE THE TIME PERIOD FOR FILING A DISCRIMINATION CLAIM. (SECOND CONSIDERATION) Comment: This ordinance increases the time to file a discrimination complaint from 180 days to 300 days. This will make the City Code consistent with the recent amendment to the state law that goes into effect July 1. The ordinance also adds an exception to the employment discrimination provision for small employers. The Supreme Court recently ruled in Baker v. City of Iowa City and Iowa City Human Rights Commission that the City did not have the home rule authority to impose liability on employers with less than four employees. CONSIDER A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF IOWA CITY AND THE ARTIST FOR THE WASHINGTON HILLS ~ ~S' ~f_3 _ NEIGHBORHOOD ART PROJECT AND AUTHORIZING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST THE SAME. Comment: The Iowa City Public Art program offers the opportunity for neighborhoods to develop their own Neighborhood Art Project. The Washington Hills neighborhood association has been working with local artist Jill Harper to create a project to highlight the entranceway to Pheasant Hill Park located in their neighborhood. The project consists of a mosaic covered bench and a "woodlands walkway" comprising of 12 concrete plinths incorporating local children's designs recreated in mosaic and ceramic bas relief designs. The contract and proposal are attached to this resolution. Action: ITEM 8. CONSIDER A RESOLUTION AUTHORIZING THE INSTALLATION OF SPEED ~ g- a ~ y HUMPS IN THE 1000-1200 BLOCKS OF FOSTER ROAD Comment: Residents of Foster Road have successfully completed the City of Iowa City approved traffic calming program. Residents of Foster Road submitted a petition. for traffic calming, and a neighborhood meeting was held. Staff subsequently conducted a survey of the neighborhood in which 75% of respondents were in favor of installing speed humps in the 1000-1200 blocks of Foster Road. Twenty-eight households were surveyed; 12 responded and 16 were not returned. Correspondence included in Council packet. Action: July 15, 2008 City of Iowa City Page 11 ITEM 9. CONSIDER A RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE o ~- a 15 MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR CONSTRUCTION OF THE HIGHLAND COURT WATER MAIN REPLACEMENT PROJECT. CONSIDER A RESOLUTION AUTHORIZING THE EXECUTION OF AN AMENDED CHAPTER 28E AGREEMENT BETWEEN THE CITY OF IOWA CITY AND JOHNSON o ~- a~ 9 COUNTY FOR PARATRANSIT SERVICE FOR THE PERIOD OF JULY 1, 2008 THROUGH JUNE 30, 2013. Comment: On April 1, 2008, City Council approved a 28E Agreement with Johnson County for paratransit service for the period of July 1, 2008 through June 30, 2013, pursuant to Chapter 28E of the Code of Iowa (2007). Subsequently we determined that two reporting requirements, provisions #4 and #5 under "Extent of Agreement" in the original agreement, do not apply to this type of 28E agreement, and therefore, are deleted from this amended agreement. No other changes have been made to the terms originally agreed on by the two entities. CONSIDER A RESOLUTION ADOPTING AN ASSESSMENT SCHEDULE OF UNPAID MOWING, CLEAN-UP OF PROPERTY, SNOW REMOVAL, SIDEWALK ~ g.., a~ REPAIR, AND STOP BOX REPAIR CHARGES AND DIRECTING THE CLERK TO CERTIFY THE SAME TO THE JOHNSON COUNTY TREASURER FOR COLLECTION IN THE SAME MANNER AS PROPERTY TAXES. Comment: The City has the authority under Iowa Code §364.136 to assess the nuisance abatement costs in the same manner as a property tax. This resolution allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to be assessed against the property. This assessment is being pursued only after the City took many steps to resolve the matter. The City notified the home owners to abate the nuisance (for example, to remove snow from the sidewalk) and after the home owner did not take action to abate the nuisance, the City abated the nuisance and billed the owner. After being billed at least twice, these owners still have not paid the abatement costs. The City has sent a letter to the home owner giving them notice that this resolution would be on the agenda, a copy of which is attached to the resolution. No interest will be charged if the owner pays within 30 days of the first required publication.
