Engineering Conference Room MEMBERS PRESENT: Buchan, Ormond, Franklin MEMBERS ABSENT: Penick STAFF PRESENT: Siders, Frantz, Shima SUMMARY OF DISCUSSION AND ACTION TAKEN: Secretary of the Board Siders called the meeting to order and the roll call of the members was taken. It was moved by Ormond, seconded by Franklin, to approve the minutes of the meeting held on March 13, 1980. The motion passed unanimously. Chairman Buchan opened the meeting for discussion. Review of UBC and proposed changes were discussed as follows: Chapter 13 through 16 - No requirements (chapters no longer exist). Chapter 17 - Classification of all buildings by types of construction and general requirements. Recommendation by staff to make an amendment to Chapter 17 to include Section 1718 as follows: TRUSSES. Sec. 1718. Preparation, fabrication, and installation of trusses shall conform to accepted engineering practices and to the requirements of this code. No alterations, including but not limited to cutting, splicing, or re- moval of webs, gussetts, or chords, shall be made with- out approval of a certified engineer and the building official. Any alterations not acceptable to the build- ing official shall be ordered removed. Consensus to include Section 1718. Chapter 18 - Type I Fire -Resistive Buildings. Staff recommended no alterations or amendments. From meeting of March 13, Staff was directed to check the requirement for smoke closing devices in dampering systems at that time and to incorporate language from Chapter 8 into Chapter 6. Staff was to research and check to see if there was a code conflict; no problem. Recommendation to incorporate language into all chapters. Chapter 20 - Type III Buildings. One minor change in 'stair construction'. Staff has no recommendation for amendments. Discussion continued on stair construction. Chapter 21 - Type IV Buildings. Approve with one amendment found in Section 2106.(f); no other code changes. Chapter 22 - Type V Buildings. No amendments; Staff does not recommend any changes. Chapter 23 - Engineering Regulations - Quality and Design of the Materials of Construction - General Design Requirements. Staff has no desire to make any amendments. Chapter 24 - Masonry " 25 - Wood " 26 - Concrete " 27 - Steel " 28 - Aluminum Staff does not recommend any changes in the above- mentioned chapters. Chapter 29 - Excavations, Foundations and Retaining Walls. Staff has no recommendation for any amendments. Discussion continued requesting the Board's feelings for revision to provide footings (6" deep x 12" wide) for detached garages (less than 1,000 sq. ft.). Recommendation to incorporate a provision to introduce some steel or wire mesh before concrete is poured. Chapter 30 - Veneer. No recommendations or amendments. Staff has recommendation for one amendment. Add amendment to Section 3205.(a) Access, to include the language that attic access openings shall be located in a corridor or hallway of buildings of three or more stories in height and readily accessible in building of any height --"Closets are not deemed readily access- ible." This is a carry over of amendment into the '79 Code. Discussion continued. Revisions to Table No. 32-B, Roof Covering Application (Continued); page 496. Re: 13. Wood Shingles, 4:123 (Foot Note 3 should be Foot Note 6). Re: 14. Wood Shakes, 4:125 (Foot Note 5 should be Foot Note 3). Re: Number of Fasteners - 11. Noninterlocking Tile - Flat or Curved. 2 per tile or wire tie or (should be per) Section 3203 (d) 3 F. 12. Interlocking Tile - Flat or Curved. 1 per tie (should be tile) or wire tie 5 or (should be per) Section 3203 (d) 3 F . Chapter 33 - Stairs, Exits and Occupant Lo4d5. Staff would like to make recommendation for several amendments. Re: Sec. 3305.0) after Exceptions: 1 and 2 (page 506), Staff would like to incorporate language from '73 Code as follows: Exception: 3. Stairways having less than four risers need not have handrails. Consensus to include Exception: 3. Discussion continued; Staff would like to incorporate some language to say that a 20 or 2x6 handrail could be used as long as some grip provision was made 1n that handrail. Table 33A (page 525) Re: Occupancy grouping on #21. Swimming Pools. - under "Square feet per occupant"', 50 for the pool area; 15 on the deck; the comment "Minimum of two exits other than elevators are required where num- ber of occupants is over '50', is questionable in regard to swimming pools. Another possible re- quirement mentioned; swimming pools should be made accessible to the physically handicapped. Discussion followed on the requirements for enclosed swimming pools, and the designation of a building as an R-1 occupancy and the pool area as an assembly area. Recommendation to add the word "enclosed" for clarification in regard to swimming pool category. Next Meeting April 10, 1980 at 8:00 A.M., Engineering Conference Room, to review Chapters 34 to conclusion of UBC. Meeting adjourned 10:00 A.M. MEMBERS PRESENT: Chairperson Klaus, Graf, Dennis, VanderZee MEMBERS ABSENT: Smithey, Owens, Haendel STAFF PRESENT: Hencin, Kucharzak, Flinn RECOMMENDATION TO COUNCIL: To Approve second year Housing Assistance Plan. I. Meeting was called to order by Chairperson Klaus at 3:35 p.m. II. Minutes of the March 5 6 7, 1980, Meeting were approved 4/0 on motion by VanderZee, seconded by Dennis. III. Coordinator's Report - 1. Section 8 Assisted Housing - It was reported that the program is full with 390 units leased on April 1, and that 27 new applications were submitted for approval. 2. Public Housing - it was reported that 12 Developer's Packets have been sold to date; that proposals will be opened May 2, 1980 at 4:00 p.m. 3. Iowa NAHRO Conference - Commissioners were asked, if they wished to attend the state conference on April 7, 8 6 9th. All indicated they would be unable to do so. 4. Fair Market Rent (FMR's) Increases we distributed as pub- lished in the Federal Register of March 26, 1980. S. Housing Assistance Plan (HAP) - Jim Hencin reviewed the HAP and explained that the goal does not match up with HUD's allocation for next year. He further explained that the HAP is part of the Small Cities Grant Application, and is the second year Application for Lower Ralston Creek Pro- ject. IV. Housing Opportunity Plan (AHOP) - Hencin explained that AHOP is an area -wide Housing Opportunity Plan and that East Central Iowa Council of Governments•(ECICOG) is currently proceeding with program design for next year. Kucharzak explained that city participation in an AHOP is not mandated, that they could negotiate own plan, but that 50 extra points are allocated for being part of a larger area. Consensus that Jim Elza of ECICOG should be invited to Commission Meeting in fall when more information is available. Moved by VanderZee, seconded by Graf, that Commission recommend to Council the approval of the second year HAP. Approved 4/0. Applications for Forgivable Loans - Barnes (Cases 4 4 5) Klaus indicated preference to have names of applicants deleted from information provided Commission. Moved by Dennis, seconded by Graf, that these applications be approved. Approved 4/0. CCN Report - Hencin reported that with beginning of new SMSA status, and new grant program, city will be looking to new programs and new projects and solicited input from Housing Commission. Question raised as to possibility of using such funds for housing inspection. Congre- gate housing cited as goal. Commission advised that you can't build, but can rehabilitate. Consensus that Congregate Housing should definitely be on the list. Commission further targeted September for a workshop on the issue of Congregate Housing including community leaders. Research required prior to workshop. Kucharzak suggested that in considering goals, Commission might wish to explore the problem of temporary housing for families of patients at University Hospitals. VanderZee indicated he would explore the need. An update on the Spouse Abuse Shelter was suggested. VI. Update State Housing Code Legislation - Kucharzak reported that the House had repealed Chapter 413 (State Housing Code) to be replaced by local options. Contained in the bill is inclusion of study committee (joint committee) to review and make recommendations. Full committee of Senate to discuss Wednesday or Thursday (April 2nd or 3rd). It is anticipated they will amend to mandate "regular" inspections as well as complaint basis. "Regular" to be defined by committee. VII. Update Task Force to Evaluate Iowa City Code - Diane Klaus reported that the Task Force is meeting every Tuesday at 7:15 p.m. in Law Library; that she is Chairperson and Goldie Haendel is Vice Chair- person. She reported that they are starting to talk about how to enforce code. They may have recommendations in July, depending on what happens to the State Code. VIII. Klaus indicated that before leaving, she would like everyone to know that they are losing two people on the Commission, and will, hopefully, be getting one back (i.e. Kathleen Graf), and she would like to get into the record what a great job that Pat Owens and Jerry Smithey did. She expressed regret that they could not be present. She stated that both had served 3 years, that Jerry was Chairperson for about a year and a half of that time and did a great job, and that Pat served the Commission well on CCN. Both did a great job, and they should be thanked for serving. Consensus that commendation should be quoted' in letters to Pat Owens and Jerry Smithey. MINUTES - Minutes of February 14, 1980 Meeting approved 3/0 on motion by Haendel, seconded by Dennis. III. CASES FOR CONSIDERATION - Mrs. Lucille Miller, 620 Kirkwood, Iowa City, Iowa Mrs. Miller, duly sworn and appearing on her own behalf. Steinbach reported that premises were inspected September 28, 1979, by Kelly Vezina, that Notice of Violation was issued on October 8, 1979, that on October 22, 1979 Mrs. Miller filed her appeal with the City Clerk, and that on November 30, 1979, Notice of Violation was amended dismissing violations 2(a)(b), 4 (a)(b), and 6(a). Discussion N7 (light switches) - moved by Haendel, seconded by Dennis, tha iolation be upheld with stipulation that a wall-. mounted lame installed. Approved 3/0. Discussion M8 (improper location of heating unit) - North apartment contains an unsealed, combustion furnace in bedroom with no intake from outside. Mrs. Miller advised use was limited to auxiliary heat. Board members expressed concern over safety factors. Violation upheld in motion by Dennis, seconded by Haendel, and approved 3/0. Vezina advised Mrs. Miller she has 90 days in which to comply. Mr. James P. Schulze, 320 E. Davenport, Iowa City, Iowa Mr. Schulze, duly sworn and appearing on his own behalf. Steinbach reported that premises were inspected November 1, 1979, by Brian Kuebler, that Notice of Violation was issued on November 28, 1979, and that Mr. Schulze filed his appeal with the City Clerk on November 29, 1979. Steinbach reported that premises were inspected on October 30, 1979, that Notice of Violation was issued on November 14, 1979, and that an Appeal was filed by Mr. David Poula on behalf of Mrs. Hennessey on November 29, 1979, with the City Clerk. Violations were reviewed. Discussion Rla,b,c, and 2a - House was rewired approximately 3 years ago and brought up to code at that time. Current viola- tions due to changes in code since that time. Discussion H3 a$b - windows have been repaired but not reinspected. Discussion It4a - walls being repaired. Discussion R5a - not appealed. Discussion #6 E 7 - there is a lavatory just outside of bathroom. No health or safety problems seen. Moved by Haendel, supported by Dennis, that Board support a waiver on this property. Approved 3/0. Mr. John Penick, 130 East Jefferson Street, Iowa City, Iowa Mr. Penick, appearing on his own behalf and with his attorney, Mr. Tom Cilek, both duly sworn. Steinbach reported that premises were inspected January 26, 1979, that Notice of Violation was issued January 17, 1979, and that an appeal was filed with City Clerk by Mr. Cilek, Attorney for Mr. Penick, on January 29, 1979. A continuance was granted on this appeal to clarify the size of the kitchens. It was further reported that Noel Willis has been retained by the city to check the entire building for structural defects for purpose of determining appropriateness of applying for Rehabilitation Loan. It was pointed out by Mr. Cilek that in March of 1978, an inspection of the premises was requested as a condition of purchase, and no deficiencies were found. Subsequent to that, in May of 1978, the city code changed; however, there has been no change in state code since 1924. Discussion - Notice of Violation - January 17, 1979:- Concern ex- pressed over lack of movement around stove in Apartments 21, 24 C 48. Moved by VanderZee, supported by Haendel, that.Apartments 21, 24 G 48 be found not in compliance, but that others be allowed to remain as are because they were built prior to code taking effect. Approved 3/0. Notice of Violation dated January 21, 1980 on,inspection performed by Kelley J. Vezina on December 28, 1979, and appealed by John Penick and filed with city clerk on February 1, 1980.
