YOU ARE HEREBY NOTIFIED, that Albert N. Hieronymus and Freda Hieronymus,
the owners of certain real estate upon which you propose to construct a dam or
water detention facility do hereby object to the proposed "taking" as specified
in the present plans for the following reasons:
1. The east line of the proposed taking is irregular and impossible of
definition on the ground making it impossible for the adjoining land to be
farmed without trespass and in any event creating a difficult farming situation
because of point rows and other impediments. Of course, the same problen would
exist to a lesser extent in any proposed subdivision development. However,
future subdivision development of the remaining property after acquisition will
have been irreparably damaged by the taking.
2. At the time utility easements were obtained, it was understood and
agreed by the City representatives that Scott Boulevard would include the
utility easement area. The present plan for Scott Boulevard is outside the
easement area.
3. As a result of the taking, certain property belonging to the owners
will be irreparably damaged by the use of it as a borrow area which will have the
effect of lowering its elevation and reducing its value to such an extent as to
constitute an uneconomic remnant. There is no satisfactory access to this
property which would be located on the west side of the dam after the taking.
For this reason, any proposed taking should include that area (consisting of
approximately 6 acres).
4. The plans and specifications do not indicate fencing requirements and
it is not clear whether the property owners will be responsible therefor.
5. The right of way for Scott Boulevard specified as 100 feet is actually
40 feet more than needed.

Re: South Branch Ralston Creek Stormwater Detention Project
Dear Mrs. Hieronymus:
This letter will confirm our meeting with you on February 26, 1980,
to further discuss the above project. The following information is
provided to you in answer to questions which were raised at the
meeting:
1. Public use of the taking area. Once purchased by the City, the
land in the taking area will not be available for public use. i
The area will be posted with "no trespassing signs and the Iowa
City Police Department will have enforcement authority in the
area. As a further deterrent to public use, this area will be
planted in some kind of erosion -control grass or legume that
will not make it an attractive site for any kind of recreational
activity. With your permission, that planting could take place
-early this spring to ensure that it gets a good start this year.
2. Size and length of pipe. As Dick Plastino indicated (and as
shown on the fourth page of the plans sent to you), the pipe
running through the dam will be 42 inches in diameter and 210
feet long from inlet end to outlet end. In addition, a stone-
lined culvert will extend 20 feet from the inlet end and 80 feet
from the outlet end.
I 3. Nature of the borrow easement. Enclosed please find a scale
drawing of a cross-section of the borrow easement area. Unlike j
the drawing of this area included in the plans, the enclosed
I drawing uses the same scale (one inch equals 10 feet) both
horizontally and vertically. We hope that this drawing will
better indicate to you the end result of the cutting and grading
that will be done by the City in the borrow easement area,
Please note that the exact grade of the new Scott Boulevard has
not yet been set, so only the center line is shown on this
drawing.
4. Access to and use of the borrow easement area. The existing
portion of Scott Boulevard and Arbor Drive can both be extended

to provide access to the borrow easement area once residential
development begins. Because residential development can take
place in this area, the City's appraiser did not consider this
area to be an uneconomic remnant. For your information,
enclosed please find a schematic drawing of possible
residential development in this area. This sketch was prepared
by the City's senior planner for use during consideration of the
Scott Boulevard realignment.
5. Boundary markers for east side of the taking area. Upon your
request, the City will mark the eastern boundary of the taking
area with monuments, stakes, or other suitable markers so that
your farmer will be able to distinguish the boundary of your
property.
6. Agricultural easement. The City will consider any proposal you
wish to make regarding a clearly defined access easement for
agricultural purposes across the taking area.
7. Scott Boulevard right-of-way. As you know, the new Scott
Boulevard is being planned as a secondary arterial street and
access to it will be limited. No curb cuts and probably no
local streets will be allowed. The currently planned 100 foot
right-of-way for the new Scott Boulevard does not impinge on any
curb cuts -along Muscatine Avenue. In addition, the City will
investigate the feasibility of retaining as many trees as
possible in the right-of-way area.
8. Farm access across Scott Boulevard. In our letter to you on
December 6, 1979, we indicated that your farmer may cross the
new Scott Boulevard with his farm equipment for access•to fields
on either side of the road. Since there will be a distance of
34.5 feet from the back of the curb to the edge of the right-of-
way, the shoulder grade will be gradual and should present no
access problems for farm equipment.
9. Negative construction easement. Enclosed is a sketch of the
area dowream from the dam, over which the Iowa Natural
Resources Council will apparently require a negative
construction easement. We will provide you with further
information about this easement as soon as possible.
10. Nature of the detention dam. We are aware that it is difficult
To visualize how the dam will look upon completion. We
therefore asked Stanley Consultants to prepare an air
photograph with an overlay of the dam to help demonstrate how it
will look. Enclosed please find this overlay and a copy of the

The steering committee of Project GREEN wishes to ask
the City Council for support of the work of the River
Front Commission. We encourage the Council not to
abandon the important work of this Commission to protect
the development of the Iowa River corridor. Within this
same format we support :bikeway planning along the river
front and other places in the city. To this point in
time the funding for the River Front Commission and
bikeway planning have been federally funded. We
feel that federal funds will continue to be available
for this type of planning and thus, if the City of Iowa
City can budget a planner's salary or time to write
grant porposals, the necessary federal. funds will continue
to come to our city.
We urge you to give these areas continued financial sunnort
in the budget to allow preparation time for federal grants.

As directed by Section 23-16 of the Municipal Code of Iowa City, this is
to advise you of the following action:
ACTION:
Pursuant to Section 23-274 of the Municipal. Code of Iowa City, the City
Traffic Engineer will authorize that parking meters designated as BLB,
BL10, and BL12 be removed and replaced with a parking prohibition sign.
This action will occur on or shortly after 15 May 1980. Parking meters
will be replaced in late August of 1980 and the parking prohibition will
be removed.
COMMENT:
This action is being taken to facilitate University of Iowa construction
efforts to the loading docks of Burge Hall. Meter removal and parking
prohibition will facilitate freight delivery access to the south side of

First, in regards to your concern over the repairs which you are required
to make to meet the Housing Code; a proposal has been recommended to the
City Council to place a moratorium on Code enforcement on those properties

The second item you were concerned about was how your property will be
appraised. Briefly, recent comparable property sales from as close to the
same area as possible will be used, along with the present value of the
future operating income (income and expenses are estimated to arrive at an
operating income which can be expected). This information is then put
together to determine the fair market value of your property. You will not
be able to receive loss of income monies since the income is taken into
consideration in the sale price. We will be holding a meeting on this
subject sometime ,in early July at which we hope to have an appraiser and an
acquisition speaialist from HUD present to answer your questions in more
detail.
Your third concern was that you had a balloon payment coming due in April
of 1981. Because of this fact you wished to start negotiations as soon as
possible. This should be no problem as we plan to begin acquisition
procedures in the early spring of 1980. This should leave plenty of time
to complete the acquisition of your property before your payment is due.

Mike Flaherty, Planner/Program Analyst, explained the budget for the Small Cities
project and also explained the adjustments that had been made to comply with
HUD recommendations. After a brief discussion, Horton moved and Hall seconded
that the budget for the Small Cities project be approved as distributed. Motion

'j Jim Hencin, CDBG Program Coordinator, explained the purpose of the Environmental
Review Record. After a brief presentation by Mr. Hencin, he turned the program
over to Kevin Laverty who presented a slide show of the project area. Following
-the slide show, he explained the various maps showing the effect of the proposed
_;improvements to the area and answered questions from Committee members. Laverty
also briefly explained the outline environmental review distributed to CCN members.
The discussion centered on the parcels to be acquired, which are not essential to
the Ralston Creek Channel improvements. These parcels include most of the 900
_ block.of S. Dubuque and most of the 200 block of E. Benton Street. Committee

A neighborhood meeting for the Lower Ralston Creek Neighborhood was held
on Wednesday, September 12, 1979 at 7:30 PM in the National Guard Armory.
Staff present: Hencin, Laverty, Milkman, Flaherty.
CCN member: Johnson
Residents and property owners: Gillespie, Busch, Graham, Alexander,
Foster, M. Jones, C. Jones, H. Adair, J. Adair, Petersen.
This informal meeting was called to discuss the Environmental Review of
the Lower Ralston Creek/Small Cities Project. Staff explained the federal
requirements concerning environmental assessment and presented a summary
of the Lower Ralston Creek/Small Cities Environmental Review Record. A
meeting agenda and an outline of the presentation is attached.
Questions and concerns expressed by residents and property owners
included the following:
1. Ron Johnson, 2195 E. Benton Street, pointed out that the project
preapplication had indicated that fill was required over the area in
the 900 block of S. Dubuque adjacent the creek.
Staff responded that the Ralston Creek Storm Water Management Plan,
which was completed after the preapplication was submitted,
recommended the construction of an earthen dike along the creek's
west bank rather than filling the area.
2. Clark Jones, 930 S. Dubuque Street, asked if engineering studies were
complete and accurate in showing which properties would need to be
acquired for creek improvements.
Staff replied that the engineering for the Small Cities Project was
done in conjunction with the Storm Water Management Plan for the
Ralston Creek watershed, prepared by Shoemaker & Haaland. The
improvements proposed for the Small Cities Project are a part of the
recommended improvements of this plan and are accurate to the best of
our knowledge.
3. Ron Johnson said he felt that property owners and residents are
uncertain about the project because the City seems uncertain about
what property should be acquired.

9. Ron Johnson asked that if one or more residential properties remained
on the 900 Block of South Dubuque, wouldn't it be more difficult to
resell for commercial use?
Staff replied that it would be, however, the first priority of the
project is to be flood control. Commercial redevelopment is a lesser
priority. City Council has indicated that home owners should be
permitted to continue residing in their homes if that is their
preference. Staff pointed out that the neighborhood had lost much of
its residential character and that the closing of the Hy -Vee store
would diminish its residential character further. Eventually,
market factors are likely to replace residential uses in the area.
11. Johnson asked if it were possible for current property owners to
retain ownership while improvements were made, or if not, to purchase
the property after improvements were made.
Staff replied that federal requirements would not permit public
improvements of this nature on private property. In reselling the
property the City must follow State law which requires a bidding
process. Current owners could bid on property but could receive no
preference.

of the M1 zoning, and that he had intended to eventually convert his
properties to
commercial use. Johnson also pointed out that the area
was the only available commercial area that remained near the
downtown, and that because of the rising cost of automobile
transportation, commercial development in
this area would be
particularly important. Johnson also pointed out that because of the
demand for housing in Iowa City, particularly after the down zoning
of the north side, the development of housing in the area should be

considered.
Staff pointed out that in order for the land to be developed for uses

other than land consumptive commercial the Comprehensive Plan would
have to be changed. However, in the process of developing the City's
new Zoning Ordinance, some changes could possibly be expected. Staff
suggested that Mr. Johnson become involved in the development of the
new Zoning Ordinance.

improvements could be retained by current owners.
Staff responded that purchase offers would be extended to all
property owners. Any additional changes in the original plan to
acquire properties would have to come from City Council.
14. Denny Petersen, 932 Oakcrest, owner of commercial property on
Lafayette Street, asked what a Small Business Investment Corporation
would do.
Staff explained that a SBIC was a non-profit organization that would
provide incentives, in the form of low interest loans, for small and
minority businesses to be initiated in the area. This concept could
be developed and carried out using CDBG and SBA funding as seed
money.
15. David Busch, 223 East Benton Street, asked about the bike path

Staff replied that a bike path could be constructed in the area along
the newly constructed west bank of the creek. The Comprehensive Plan
encourages this use. The construction of a bike path would also
facilitate access needed to maintain the creek and the creek bedding.
16. John Gillespie stated that he would prefer to see the area developed
as a park rather than for commercial use.
Staff replied that a bike path would in effect provide a linear park,
and that some commercial uses might even benefit from having such a
use in their backyards.
17. Josephine Graham, 205 E. Benton St., suggested that the creek should
be deepened rather than widened and that banks be stabilized with
brick.
Staff pointed out that the creek will be dredged in some area, but
that in order to provide sufficient capacity the width of the west
bank would have to be increased.
18. Several residents stated that they were much more comfortable with
the project as it now was stated.
