Dear Dr. Nickelsburg:
Thank you very much for your letter of December 18, 1979, in which you
commented on proposed changes to the Iowa City transit system. I will
respond to your comments one by one.
Regarding the proposal that transit fares be higher during the peak
period, even if the fare were doubled to 501 the passenger would be
paying less than the full cost of his or her transportation. For the
past generation public transit has been deliberately underpriced in
order to attract and retain riders. Today, when on many routes there
are no empty seats to fill, it seems highly illogical to continue a
pricing policy designed to encourage greater patronage. Off-peak, when
ridership is low, I believe it still makes sense to keep the fare artifi-
cially low as a means of encouraging people to ride.
The concept of staggered work hours is one avenue that could decrease
the great disparity between rush hour and off-peak transit use. Due to
the large organizational problems involved in changing employees' work
schedules, this avenue seems to lend itself to long range planning,
while the transit system is faced with immediate problems. Also, because
many university oriented riders do not adhere to an 8 -to -5 schedule, the.
peak period for Iowa City transit runs as late as 9:15 AM and begins as
early as 3:15 PM. With such a broad rush hour already, staggered work
hours may not provide much relief.
The problem of transfers in the downtown area is not easily solved.
While it might seem desirable to have all buses arrive downtown at the
same time and none depart until all transfers were accomplished, it is
our view that such a procedure would involve an unacceptable waste of
bus time. At rush hour when traffic is heavy and the number of passengers
on each bus is high, the time lost downtown invariably results in buses
running substantially behind schedule. Because our statistics indicate
that only 13% of bus riders transfer in the downtown area, we feel that
a better level of service is provided to a greater number of riders if
buses do not wait downtown beyond their scheduled departure time. It is
our intention to have buses wait in the downtown area to facilitate
transfers whenever possible; however, when conditions dictate that a
choice be made between waiting downtown and operating on schedule, the
downtown waiting time will be sacrificed.

Re: Proposed Changes in the Transit system
Since I am unable to attend the hearing this evening, I am writing
this letter to you for your consideration.
For ten years now I have been a strong advocate of a viable bus -'sys-
tem in Iowa City. I have also been a regular passenger on the
buses. Publicly and privately, in committees and outside of them,
I have spoken against proposals that I thought would weaken the
system and I have supported ideas that I thought would strengthen
the system. For some years I have been convinced that energy short-
ages would force us to develop transportation patterns that favored
the bus over the automobile.
It is within this context that I write to voice my disagreement with
two proposals for the revamping of the transit system.
While I appreciate and commend the fine work that Mr. Mose has been
doing, and while I would not want to be in his shoes in the present
energy crunch, I do find two of his suggestions unfair, potentially
counterproductive, and therefore lacking in sense.
Regardingthe proposed hike in rush hour bus fares:
1. The proposal assumes that the people riding the buses during
the rush hours have the option of riding them at a different time.
This is simply not the case with a large number of riders. Many of
these people have 8-5 jobs at the University. Others must teach or
attend 7:30 or 8:30 classes.
2, At the same time, people who come to shop downtown are not
likely to ride the bus during rush hours, at least into town, since
the stores are generally not open that early,
3. To penalize people who must ride the bus during rush hours is
unfair, to say the least.
4. Furthermore, the proposed fare hike could very well be counter-
productive. The more you raise fares, the more feasible it becomes
for people to drive their automobiles.
�. 5. The idea of staggered work hours is not a bad one. However,
c the proper procedure would be first to encourage employers (in-
cluding the University) to stagger their hours.
6. Even with staggered work hours, there remains the problem of
classes that begin before 9 o'clock and that last past 3:30. A Uni-
versity of this size cannot schedule all its classes within six hours

not on salary.

7. If it becomes necessary to raise fares, the raise should be
across the boards and not penalize those who must ride the buses
during rush hours. Remember, they are your lifeblood,
As to the matter of waiting for transfer passengers:

I Ten minutes is a long time to wait, Five minutes is not all
that bad, and it is better that making passengers wait 24 minutes
for the next bus.
Iowa City has a fine bus system --one we can well be proud of.
Things have changed greatly since the days of the privately owned
system, thanks to the foresight of the councils, the support of
citizens and citizens, groups, and the wise response of an incredible
number of passengers. The Council should think long and hard before

consider applying a new flush coat to ;protect the asphalt
surface on the small portion of Hutchinson Avenue that
extends south approximately 450 feet from Park Road.
The original asphalt is in good condition
except for a few places where some patching might be con-
sidered before a flush coat is applied.
The propertj owners adjacent to this part
of Hutchinson Avenue paid the entire cost of laying the
asphalt about 7 years ago. We believe that a protective
flush coat aoplied in 1980 would preserve the original as-
pha.1t for several more years.

Enclosed are copies of letters to the director of the Department of Transpor-
tation and to the State Executive Council informing them of action taken by
the State Board of Regents at its November meeting relative to construction of
a West Campus Roadway at the University of Iowa. This important project to be
funded from appropriations and assessments has been approved by the Board of
Regents and the board pledges its full support to efforts by the city of Iowa
City in accomplishment of the project.
The University of Iowa and the Board of Regents will make arrangements, as
necessary, to assure that the city of Iowa City bears no costs and invests no
funds in connection with the construction of this road. Upon completion of
the road, all rights will be transferred to the state of Iowa and the road
will become an institutional road to be maintained from that funding source.
We would request that the city of Iowa City take whatever action is necessary
to formally initiate actions on both the state appropriations request to the
1980 Legislature and to assess the Department of Transportation both under the
nuthority contained In Section 307A.5 of the Code of Iowa 1979.

The purpose of this letter is to bring to your attention action taken by the
Board of Regents at its November 1979 meeting as regards construction of a
West Campus Roadway at the University of Iowa. The road that will be con-
structed in connection with the Hawkeye Sports Arena is proposed as a four -lane
road intersecting with Woolf Avenue on the east and running westward past the
arena to intersect with primary highways 6/218. The project will include the
construction of a four -lane street at this location and widening of Woolf Avenue
between the arena and the hospital to facilitate traffic movement from the Uni-
versity of Iowa Hospitals and Clinics and the west campus to highways 6/218.
New turn-off lanes will be constructed on highways 6/218. Some reconstruction
of the intersection will be done where the new road meets the highway.
It is expected that this road will serve as a means of access to the proposed
Hawkeye Sports Arena and as a much-needed improvement for daily traffic to and
from Elle west campus of the university. The road will become the main entrance
to Elle west campus of the University of Iowa.
Funding for the road is proposed in two parts. First, the Board of Regents and
the university plan to cooperate with the city of Iowa City in making a request
for a direct capital appropriation in the amount of $1,363,000, with said state
appropriations being made to the Executive Council. This financing would be
accomplished under the authority of Section 307A.5, Code of Iowa 1979. That
section states that "No such assessment in excess of twenty thousand dollars shall
be valid unless it is provided for by or contained within a capital appropriation
by the general assembly,"
The second portion of the funding involves road use tax funds. The Board of Re-
gents and the University of Iowa plan to cooperate with the city of Iowa City
to assess the State Department of Transportation for the construction of the
required alterations and needed improvements at the intersection of the proposed
access road, Rocky Shore Drive, and highways 6/218. That portion of the project
Is estimated to cost $492,000 and the funding will be done pursuant to Section
307A.5 of the Code. This section states, in part, "Municipalities and counties

rent annual construction share from this source is about $600,000. At that
funding level (and with no inflation factor) the Board of Regents has identified
construction needs which will take in excess of 23 years to complete.

Mayor and Council Members:
. At the City Council Meeting on December 11, 1979,
representatives of Goodwill Industries requested that
the City waive certain penalties required to be paid by
Goodwill Industries. I indicated to you that I would
lcok into this matter and respond.
Goodwill has previously contacted the City concerning
waiver of the penalty. On July 19, 1979, Angela Ryan,
Assistant City Attorney, wrote a memorandum indicating
that in her opinion the City did not have the authority
to waive a statutory penalty on a street improvement
assessment. I have reviewed Ms. Ryan's memorandum and
have also researched this matter myself. In addition, I
have requested and received information from Mr. Glen
Muller, representing Goodwill Industries.
In my opinion, the city council of Iowa City does
not have authority to waive statutory interest or penalty
in connection with a public improvement assessment. The
assessment procedure contained in the present Code of
Iowa has been basically unchanged during all times material
to this particular assessment question. Once the council
certifies a final assessment schedule, the city clerk
submits that schedule to the county auditor and thereafter

all collection proceedings are conducted by county offi-
cials. See §384.60 of the Code of Iowa. The law provides
that at the time the assessment is certified, a notice
must be published and the clerk shall send by certified
mail to each property owner a notice of the assessment.
These steps were taken by the city clerk at the time of
the original assessment. The law specifically provides

Re: Collection of Special Assessments
A substantial decline in the amount of special assessment revenues paid to
the City has led to an investigation of the procedures followed by the
Johnson County Treasurer's Office in collecting the assessments levied by
the City. Although state statute provides for the collection of special
assessments in a manner similiar as to real property taxes, the
Treasurer's Office has not made the same effort to collect special
assessments. Thus, if a property owner was delinquent in payment of
her/his special assessment installment but not in payment of the real
property taxes owed, the property generally was not published on the
delinquent tax list: or included on the tax sale listing. Moreover, if a
special assessment remained delinquent after the end of the ten year
installment period, no further billing of the property owner was made. As
a result of such procedures, many special assessments remain delinquent
and unpaid. A preliminary review indicates that approximately $40,000
plus interest and penalties remain outstanding from assessment accounts
which are being carried well beyond the ten year installment period and
from accounts for which no payment has been made in the last five years.
This category includes approximately 60 properties.
Despite the lack of collection, such special assessments remain valid
liens upon the properti^_a assessed. When a special assessment for a
public improvement project is levied by the City Council, the amount
assessed against each property is certified to the County Auditor. That
information is in turn certified to the County Treasurer who records the
assessment in the Special Assessment Book. As part of the public record,
such assessments become liens on the property and subsequent purchasers
take title to the property subject to the liens. Usually provision is
made for the payment of such liens at the time of transfer of any
property. However, due to the state of the special assessment records in
the Treasurer's Office, the abstracts of title of such properties may not
have included the outstanding special assessments, and the purchasers may
not have been informed of the liens on their property. It is impossible,
however, for us to estimate the number of property owners who fall within
that category and those property owners who are knowledgeable of a special
assessment levied against their property but chose not to pay since no
collection efforts were made.
The County Treasurer has expressed a willingness to work With the City in
implementing collection procedures. We have tentatively convinced the
Treasurer to follow the same procedures as with the non-payment of
ordinary real estate taxes, as provided in Section 384.69 of the Code of
Iowa (1979). In light of the potential that some property owners may be

unaware of the special assessment liens on their property, we are
proposing that the City send notices in early February to all affected
property owners informing them of the lien on their property. Although
not required by statute, such notice would provide the property owners
approximately four months to make arrangements for payment before their
property is published on the delinquent tax list in early June.
It is important to note that these collection efforts will not
automatically result in immediate payment of the $40,000. If property
owners choose not to pay the delinquent special assessments, tax sale
procedures may take as long as four years or more before the City could
receive the payments.

As directed by Section 23-16 of the Municipal Code of Iowa City,
Iowa, this is to advise you of the following action:
ACTION:
Pursuant to Section 23-234 of the Municipal Code of Iowa City, Iowa
the Traffic Engineer will direct that signs be installed so as to
prohibit parking at all times on the north side of Rochester Court
from the intersection of Rochester Court with Rochester Avenue east
to the intersection of Rochester Court with Ashwood Drive. This
action will be taken on or shortly after January 14, 1980.
COMMENT:
This action is being taken at the request of a local resident. A
postcard study was conducted and it was learned that 59% of the
responding residents favored the removal, 59% of the responding
residents preferred removal from the north side. The action being
taken does represent the consensus obtained of the majority of
responding residents.

to advise you of the following action:
ACTION:
Pursuant to Section 23-234 of the Municipal Code of Iowa City, the City
Traffic Engineer will direct that signs prohibiting parking at all times
be installed on the east side of Keswick Drive from the intersection of
Keswick Drive with West Benton Street to the intersection of Keswick Drive
with Westgate Street. This action will be taken on or shortly after 11
January 1980.
COMMENT:
This action is being taken at the request of a resident of Keswick Drive.
A postcard study was conducted to determine the opinion of the affected
property owners. Seventy-three percent of the responding property owners
preferred the proposed prohibition. Fifty-three percent of the
responding property owners preferred the east side prohibition and 43
percent of the responding property owners preferred a west side
prohibition. The action being taken by the Traffic Engineer is consistent
with the consensus of opinion of the affected property owners.

Appointments to the Commission
The Iowa City Human Rights Commission would like to submit the
following recommendations for your consideration in making appoint-
ments to the Commission. We appreciate your interest in our input
and trust it will be seriously considered.
Due to the large number of qualified applicants, this screening
process was extremely difficult. However, in recommending three
applicants, the Commission considered the necessity for cultural
diversity amongst the members, the need to maintain a balance
between community and university interests, and the skills each
applicant would contribute to the Human Rights Commission.
Since Dick Yates has reapplied for a position on the Commission,
he did not participate in our discussions nor participate in the
recommendations. However, the Commission unanimously supports and
recommends that Dick Yates be reappointed for a full term on the
Commission. We feel the training invested in Dick and his demon-
strated skills are a valuable asset to the Commission.
Based on individual vote, the majority of the Commissioners recommend
that Ms. Niambi Webster be appointed. Ms. Webster has experience
in the area of civil rights laws that would be immediately and directly
applicable to the Commission's work in enforcing the non-discrimination
ordinance.
Again, based on individual Commissioner input, both Ms. Rusty Nancy
Barcelloand Rabbi Portman were recommended by an equal number of
Commissioners. Based on Ms. Barcelo's background, she would not only
be a valuable contributor in the area of civil rights laws but also
bring to the Commission a Chicana/Latina perspective currently not
represented on the Commission. Rabbi Portman, a community resident
and religious leader, would bring a unique perspective to the Commis-
sion. As the Commission plans more community activities, Rabbi
Portman's involvement in the religious community will be a much
needed asset.
The Iowa City Human Rights Commission submits these recommendations
for appointment. Although there were many qualified applicants, it
is our feeling that each individual who is recommended will bring to
the Commission a skill or perspective that will facilitate the
Commission's continued work. We look forward to working with the
City Council in the future when vacancies occur, and trust our
recommendation will be of assistance to the City Council when making
the appointments.

I have enjoyed serving on the Commission for 6 years knowing the Commission

As you contemplate the 3 new appointees, may I share these thoughts with you?
There will be 4 women and 2 men left on the Commission. of the 14 applicants
I reviewed, I would recommend for 1st choice: Richard Yates for reappointment.
In his one plus year on the Commission he has learned quickly
and contributed much. He has been an active commissioner who
was faithful in attendance and thoughtful in deliberation. His
continuity on the commission will be doubly useful because the
rest of the commissioners are also fairly new.
For 2nd choice I would suggest Rabbi Portman:
as a townsperson and a religious leader. His contact with the
religious community would be invaluable. It has been a few
years since the Commission has had a religious leader.
The 3rd choice was quite difficult for me. Should the emphasis be for choosing
a racial/ethnic representation , or an active business woman to give more re-
presentation to Lhat segmenL of Lite community, or to seek someone with some
specific skill the Commission needs in their work? I opted for the special
skill: that of Nancy Baumgartner, an attorney.
Though the Commission has a competent and cooperative city attorney in Angela
Ryan, I have found an attorney/commissioner (e.g. Paul Neuhauser, Barry Matsu-
moto) invaluable in cutting through to the core of the issue in discussing
not only state , federal, local regulations but when we discussed Individual cases.
As the public hearing provision is utilized more in the future, immediate legal
input could move the commission in a speedy and assured manner. And, there is
work still to be completed in synchronizing our local ordinance with state and
federal laws, regulations and guidelines.
Thank you for your attention. I know your choices will help build a strong
and active Human Rights Commission.
