Comment: Information will be available on June 5, 1981, for public inspection. (2) Consider resolution setting public hearing on June 16, 1981, on plans, specifications, form of contract, and estimate of cost for the FY82 asphalt resurfacing project, directing City Clerk to publish notice of said hearing, and directing City Engineer to place said plans, etc., on file for public inspection. Comment: This project consists of Division I, various streets to be overlayed with two to three inches of asphalt as per revised list to Council including Friendship Street. Other streets to be added if additional Road Use Tax money available. Division II is overlaying Waterfront Drive (old Sand Road) from railroad tracks, south to end and Division III is for railroad crossing improvements at Kirkwood Avenue as included in FY82 CIP Program. N1 (3) Consider resolution setting public hearing on June 16, 1981, on plans, specifications, form of contract, and estimate of cost for the CBD Alley Paving - Phase II, Block 82, O.T., directing City Clerk to publish notice of said hearing, and directing City Engineer to place said plans, etc., on file for public inspection. Comment: This project is the result of the electrical undergrounding of Iowa -Illinois Gas & Electric Company. It involves the east -west alley connecting Dubuque Street and Clinton Street between Burlington Street and College Street. The Engineer's estimate is $37,852.50. Correspondence. (1) Letter from John D. Cruise,.attorney, representing Bruce Glasgow, Florence Glasgow and Condowa, Inc., requesting that the City Council waive the three readings of the ordinance vacating the right-of-way along Foster Road and St. Ann's Drive. This ordinance appears as item 4a. on the agenda. (2) Letter from Della Grizel regarding congregate meals. This letter has been referred to the City Manager for reply. (3) Letter from Nancy Baumgartner of the Human Rights Commission regarding public statements by Boards and Commissions. This letter has been referred to the City Manager for reply. (4) Letter from the City Attorney regarding Freeway 518 - Larry Lynch. Action: 30,23 Action: a. Consider an ordinance to vacate right of way along the original alignment of Foster Road and St. Ann's Drive between Buresh Avenue and Prairie du Chien Road. (first consideration) Comment: The Planning and Zoning Commission at a regular meeting held March 5, 1981, recommended by 5-0 vote that the right of way along the original alignment of Foster Road be reduced from 66 to 55 feet and the City retain a uniform 40 foot right of way along St. Ann's Drive. This recommendation is consistent with the staff's recommendation presented in the staff report dated March 5, 1981, which was attached to the Council agenda of March 24, 1981. The ordinance regarding the subject vacation was included in the Council packet of May 5, 1981. b b. Consider an ordinance amending Sections 8.1u.zuu.z ano 8.10.20E.2 of the Code of Ordinances of Iowa City, Iowa (Planned Area Development Ordinance). (second consideration) Comment: The Planning and Zoning Commission, at a regular meeting held April 16, 1981, recommended by unanimous vote to amend the aforementioned sections of the planned area develop- ment ordinance to permit the calculation of density by dwelling units, rather than population, and on the basis of the least restrictive use within the planned area of development. This recommendation is consistent with the staff's recommendation. A copy of the ordinance was included in the Council's packet of May 5, 1981. (first consideration) Comment: The Planning and Zoning Commission, at a regular meeting held April 16, 1981, recommended by unanimous vote to approve the preliminary and final plat and planned area development of Regency Gardens, Parts I-IV, located west of Mark IV Apartments and south of Westwinds Development. Staff has changed the title of the ordinance and therefore the Council should again give the ordinance first consideration. Staff recommends that the second consideration also be given at this time. Action: eu d. Public hearing to consider the rezoning of a two -acre tract y j located on the west side of Emerald Street between Melrose Avenue and West Benton Street from R3 to RX Z-8102. II I Comment: The Planning and Zoning Commission, at a regular meeting held April 16, 1981, recommended by unanimous vote to approve the subject rezoning. The Commission also recom- mended by unanimous vote that the City, enter into an agreement and protective covenant whereby the applicant recognizes the intent of the City to rezone the entire tract to a more restrictive zoning category in its forthcoming revised zoning ordinance and agrees not to expand the use of the property beyond 158 units in existence upon the date of the subject rezoning. A copy of this agreement and protective covenant was included in the Council packet of May 5, 1981. This document'has been reviewed by Legal and found to be in acceptable form. Riverside Court from RIB to RSA and to amend the Comprehensive Plan. Z-8103. 936 Comment: The Planning and Zoning Commission, at a regular meeting held May 18, 1981, recommended by a 6-0 vote to 4denL the subject rezoning and request to amend the Comprehensive Plan. This recommendation is not consistent with the staff's recommendation presented in the staff report dated May 21, 1981, which is included in the Council's packet. Approval of the subject request would require a favorable vote of three- fourths of the Council members because the Commission recom- mended against the rezoning. Action: A 'i . Woito, Assistant City Attorney RE: Agenda Addendum / AGENDA ADDENDUM Monday, June 1, 1981 Agenda Item: Resolution Authorizing Settlement Payment and Offer to Purchase Portion of South Market Square, Iowa City, Iowa Comment: The City and the Rock Island Railroad have been in litigation for a number of years over South Market Square ; and pursuant to court order on remand from the Iowa Supreme Court, docket N 42535,the City is obligated to the Railroad in money damages. Page 10 Item —�- CONSIDER RESOLUTION APPROVING THE PRELIMINARY DESIGN PLANS FOR LANDSCAPING FOR URBAN RENEWAL PARCEL NO. 93-3 (THE BREESE COMPANY). Comment: The Design Review Committee, at a meeting on May 13, 1981, recommended that the City Council approve the preliminary design plans for landscaping submitted by The Breese Company (Urban Renewal Parcel No. 93-3, corner of Madison and Court Streets). A copy of the landscape plan is attached to the resolution. On April 9, 1981, this landscape plan was approved by the Building Inspection Division staff as meeting the requirements of the City's tree regulations. On May 19, 1981, the City Council deferred this item for a two week period. The Annual Contributions Contract provides the means for the Federal Government to provide funds for 32 units of Turnkey Public Housing. The Housing Commission and staff recommend adoption of this Resolution. Action: I, y Item No. 17 - CONSIDER RESOLUTION AUTHORIZING EXECUTION OF CONTRACT OF SALE - — 3 — PUBLIC HOUSING PROJECT IA 22-3. Comment: A copy of the Resolution was provided in Council packets. The Turnkey Contract�of Sale is between Southgate Development and the Iowa City Housing Authority and provides for the purchase of Public Housing Project IA 22-3. The project consists of 32 units on six sites with a purchase price of $1,553,423. The project will be completed and purchased in three phases. Construction will commence on or about June 15, 1981, and will be completed on a or about July 31, 1982. Page 11 Item - CONSIDER RESOLUTION AUTHORIZING EXECUTION OF GENERAL DEPOSITORY AGREEMENT WITH THE FIRST NATIONAL BANK. Comment: A copy of the Resolution was provided in Council packets. HUD requires that a separate Depository Agreement be provided for each separate contract. The City and the First National Bank currently have a General Depository Agreement in effect for the Preliminary Loan Contract. This agreement will provide for the Annual Contributions Contract. Staff recommends adoption of the resolution. Action:. I Item No. 19 - CONSIDER RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN AGREEMENT BETWEEN THE CITY OF IOWA CITY AND LESLIE COLE FOR THE LEASE OF CROPLAND. Comment: This cropland is owned by the City and located east of and adjacent to the south Ralston Creek dam. Originally, the City (Parks b Rec. Dept.) planned to plant alfalfa there this season, but this proved infeasible because of the carryover of the herbicide atrizine which was applied last season. i i This lease was negotiated with Leslie Cole whereby the City and Mr. Cole can mutually benefit. Mr. Cole will be able to plant and harvest grain sorghum, which will not be adversely affected by the atrizine, and the City will gain the following benefits: weed and erosion control, and the dissipation of atrizine. p Action: �nn• ��c��N ILL s In f..l(�i —� ztit_ Item No. 20 - CONSIDER RESOLUTION ENGAGING AUDITOR FOR YEAR ENDING JUNE 30, 1981. Comment: This resolution provides Council approval for engaging McGladrey, Hendrickson A Company, Certified Public Accountants, as auditors for/ the Cit 's Fiscal Year 1981 Financial Statements. Page 12 Peg Item No. 21 - CONSIDER RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR EMERGENCY ASSISTANCE IN THE IOWA CITY AREA WITH THE IOWA CITY CRISIS INTERVENTION CENTER. Comment: FY81 funding for the Crisis Center was $5,000. The Council on February 3, 1981, approved funding for the Crisis Center in the amount of $6,000 for FY82. The Scope of Services section of the j contract has been rewritten for FY82 to better define the agency's crisis services and Transient Service. Action: ILA„� Item No. 22 - CONSIDER RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT IN /3 THE IOWA CITY AREA WITH THE DOMESTIC VIOLENCE PROJECT. Comment: The Council approved funding in the amount of $4,750 for the Domestic Violence Project for FY82. The program was not funded under Aid to Agencies for FY81. Thus, this is a new contract.
