I received the reply on May 15 but was disappointed because alltkat Mr. Berlin wrote was that my letters had been received and placed on file, and he thanked me for my patience in waiting for the reply, Mr. Berlin did send me a copy of a letter he had just received from Mr. Russell Proffitt of the Heritage Agency on Aging. This letter is really scarey because it appears to show such a complete lack of concern for Johnson County's aged elderly. Why should he indicate that priority in the delivery of service will be giWen to those persons age 60 and overl and their spouses, who make reservation first, when the Older American Act and the regulations of 198) provide thatpriority _ ference be given to those persons age 60 and over, and spouses, a whop have the greatest economic or social need.? In his letter Mr. Proffitt also states: "It seems c16ar to me that since the regulations prohibit the use of a means test we will never be in the position to determine on an individual basis those persons with the greatest economic or social need.11 That statement a that on this point Mr. Proffitt is not veryPPeare to indicate well informed Section 1321,25 defines MEANS TEST as "the use of an older person's income or resources to deny or limit that person's receipt of services." The City of Iowa City has no difficulty in determining eligibility without using a means test. Typical examples are free inbbish removal and removal of snow from public sidewalks. When the City first began to make a charge for rubbish removal. each household received a notice with their water bill which reed: "Effective July 1, 1979, low income residents who qualify for any of the programs listed below will befoable to sign up for free refuse collection. A re— lease of information, a%ailable at the Civic Center, must be signed and will be used to verify the individual's participation in a program with the proper agency. All residents of a household must be eligible under the low income criteria of one of the following programs: Supplementary Social Security Benefits, ProgramTitle XX program, ADC program, Food Stamp , In addition, those individuals who qualify to file an Iowa Disabled and Senior Citizen Property Tax and Rent Dish ement Claim with the State can present a copy of the form most rec tly le to show eligibility. In the fall of 1979 the City set up a service for snow removal from public sidewalks for the elderly and disabled. The r-esoluti4n provided that this service was to be for those persons who live alone in a one -family house in which no other person resides who is physically chpable of performing the necessary snow removal activitite� and who presents a doctor's statement certifying that,because of age orrother infirmities, the person is no longer able to perform the snow removal duties. For those persons who o ualify for this service who meet the low income qualificatioms already established for refuse fee exemption shall also receive snow removal service at no cost. Here too { eligibility is determined without the applicants being asked how rpuch they have in the way of income or resources. The above two cases illustrate that eligibility can easily be determined without the use of a means test. After the County Attorneys filed their legal opinion on Oct. 'j, 1dr.Proffitt may have tried to convince the Supervisors that the opinion was wrong. In a letter to the Supervisors dated Oct. 30, 1980 (of which I have a copy) he said: "I have read with some concern the opinion i rendered by County Attorneys Dooley and White in regard to eligibility for the congregate meals program., and he called attention to Section 1321.141. I wrote to the Department of Health and Human Services, Washington, D.C., asking for clarification of Section 1321.141(b)(1). Mr. Willis Atwell, Associate Commissioner for Program Development, of that depart- ment replied in a letter dated December 19, 1980. I quote from that letter: "The age eligibility and emphasis on those with the greatest economic or social need are requirements of the Older American Act, as amended and are simply repeated in the regulations." This, and other parts of Mr. Atwell's letter combined with the opinion of our County Attorneys seems to explain why part of the section regarding eligibility is in the Older American Act as amended, and the other part is in the rules and regulations adopted by Congress on March 31, 1980. This no doubt came about when the 1980 regulations were being written. Section 102 (2) of the older American Act, as amended provides ttthat "pending the availability of programs for all older aon yeeo�la.Ianerd�ority be given to the elderly with the greatest economic Since the words "older citizens" and "elderly" can meannanything from age 40 to age 100, Section 1321.141(b�)1)was written so as to set a definite age limit, which in this case is age 60 and older. Mr Proffitt also said, " I will be speaking with Bob Welsh about this matter to see if the Board of Supervisors will be willing to modify the newspaper notice for congregate meals". That is the first important steps that needer to be taken in order to get the congre- gate meals program on the right track but, as of last Saturday, the notice was still the same as it has been since June 26, 1980 when the word "eligible" was taken out. Mr. Proffitt mentioned one other section that he would like to think settled everythingl. Mr. Helling then stated that it was a possibility that a policy might be drawn up whereby commissions of the City would have to go through the City Council before making any public statements. We are writing to express our concern over any such policy and assure the City Council that our Commission intends only to make statements (both written and oral) concerning issues of civil rights and will represent such statements as being those of the Human Rights Commission, and not the City itself. We feel that a prior review by the City Council of positions or statements to be made by the Human Rights Commission would set a dangerous precedent and would violate the ordinance under which the Commission was created. This proposed policy could be interpreted to mean that the City Council could review Commission findings in individual cases before we issue a decision. It could also mean that the City Council would have the power to review any public lectures or forums we might sponsor before we give them. Clearly, that is not what is mandated by Section 18-16 and 17 of our ordinance. Among the powers given to the Commission include the education and dissemination of information, to further the goals of eliminating discrimination. The Human Rights Commission feels that we have already spoken out on issues of human rights and we will confine our activities to that area, as is mandated and authorized by Chapter 18 of the Iowa City Code of Ordinances. This letter reviews concerns of the Commission regarding our discussion at your April 27, 1981, meeting. It is clear that some misunderstanding has resulted. While the letter indicates that the concern of the City Council relates to statements made to area legislators at a recent public forum, I believe I indicated very clearly that these concerns resulted from item M14 in the minutes of your February 23, 1981, meeting in which a Commission member was instructed to write a letter on behalf of the Commission voicing opposition to a certain proposed bill. A copy of page 3 of those minutes is attached. That same letter further states that I related that a policy might be established requiring Commissions to gain approval of the City Council before making "any" public statements. It certainly was not my intent to leave the Commission with that impression. On several occasions during that discussion, I tried to emphasize that similar concerns raised by the Council in the past have been precipitated by communications from boards or commissions to legislators which would then be construed as representative of the position of the City of Iowa City. I thought it was clear from my remarks that the position of the Council, as the City policy making body, applies to advisory boards or commissions only as it relates to their making policy statements regarding City positions on legislative or other political issues. Having reviewed the content of the discussion at that meeting, I find nothing to suggest that the Commission should assume that the City Council would involve itself with either the review of findings in individual discrimination cases or with the review of the content of any public lectures or forums sponsored by the Commission. For any commissioner who may have drawn this inference, I hope that this will serve to ease their concerns. Section 400.15 provides that in the commission form of government, the superintendents of the respective departments shall make all appointments and promotions with the approval.of the city council. Thus, the super- intendent of public safety would make all appointments and promotions for the police department. Such is a statutory duty which the office holder cannot shirk, nor can anyone else assume that responsibility. To hold, under these facts, that a conflict of interests exists which would void any such action now and in the future would severely hamper the administration of a city and its employees. There may be such facts, as indicated in sone of the above cases, which would require a court to void a similar action. However, under the set of facts here, no such situation exists.
