ORGANIZATIOUAL MEETIUG
JANUARY 2, 1976

The Iowa City City Council met in organizational session
on January 2, 1976, at 12:00 P.M. in the Council Chambers at
the Civic Center.
City Clerk Abbie Stolfus called the meeting to order.
Councilpersons_present: Balmer, deProsse; Foster, Neuhauser,
Perret, Selzer, Vevera. Absent: none.
City; Attorney Hayek noted that before adopting the Rules
of Procedure for the Organizational meeting, -Council should
appoint Abbie Stolfus, City Clerk as Chairperson Pro Tem, for
the purpose of conducting the meeting until selection of,a
Mayor. It was moved by Neuhauser and seconded by deProsse to
appoint'Mrs.-Stolfus as Chairperson Pro Tem. Motion adopted,
unanimously. City Attorney Hayek then read the rules of pro-
cedure. It was moved by Foster and seconded by Balmer, to
adopt the Rules of Procedure for the organizational Meeting.
Motion adopted, unanimously.
.The Clerk requested nominations for the office of Mayor
of Iowa City for the years 1976 and 1977. Councilman Balmer
nominated Mary Neuhauser; Councilman Vevera nominated Carol
deProsse. Councilman Foster moved that nominations cease,
seconded by Perret. Secret ballot was :taken `and tabulated
by the Clerk and City Manager Neal Berlin. The Clerk then
advised that a majority of the Council had voted for Council-
woman Neuhauser as Mayor of Iowa City for 1976-1977.
Councilman Foster asked that the rules be suspended and
a unanimous ballot be cast for Carol deProsse as Mayor Pro Tem,
seconded by Neuhauser. Motion adopted, unanimously.

It was moved -by_---deProsse and seconded by Neuhauser to
reappoint John Hayek as City Attorney for an indefinite term
Motion adopted, unanimously.
It was_moved by Poster, seconded by deProsse, to appoint
Abbie Stolfus as City Clerk for an indefinite term. Motion
adopted, unanimously.
It was moved by deProsse and seconded by Vevera to appoint
Tony Kushnir and Bob Bowlin as Assitant'-City Attorneys for
indefinite terms. Motion adopted, unanimously.

- It was moved by deProsse and seconded by Perret that the
rule requiring that ordinances must be 'considered and voted
-<on for passage at two Council meetings prior to the meeting
at which it is to be finally passed be suspended, that the
first and second consideration and vote be waived, and that
the Ordinance, Adopting a Home Rule Charter for _the _City of
Iowa City, be voted upon for final passage at this time. Roll
call: Ayes: Balmer, deProsse, Foster, Neuhauser, Perret,
Selzer. Nays: none.- Absent: none. Abstain: Vevera.=
Motion adopted, 6/0. It was moved by Poster and seconded by
deProsse to adopt the Ordinance No. 76-2792, as recorded in
Ordinance Book 9, Page 78. Roll call: deProsse, Foster,
Neuhauser, Perret, Selzer -Balmer Nays: none.'Absent:
none. -Abstain: Vevera. Ordinance adopted, 6/0.
It was moved by Foster and seconded by Balmer to adopt
Resolution 76-1, recorded in Resolution, Book 34, page 1,
Approving Unclassified Salaries and Compensations for the City
Clerk retroactive to July 1, 1975. Roll call: Ayes: Foster,
Neuhauser, Perret, Selzer, Vevera, Balmer, deProsse. Nays:
none. Resolution adopted, 7/0.
It was moved by Foster, seconded by deProsse, to adopt
the following permit resolutions recorded in Resolution Book 34:
Approving Class C Beer Permit applications for 7 -Eleven
Store $18048, 1st Ave. & F St., Resolution No._76-2,
Page 2, and Dennis Ellis dba/Needs, 18 South Clinton,
Resolution No. 76-3, Page 3.
Roll call: Ayes: Neuhauser, Perret, Selzer, Vevera,.Balmer,
deProsse, Foster. -Nays:- none. Resolutions adopted, 7/0.
Attorney William Bartley appeared concerning a letter
from City Attorney Hayek on the matter relating to Councilman
Vevera. He noted there are questions vital to the issue of
-- - whether or not Mr. Vevera is both a Councilman and City employee
or one or the other, indicating this issue might have -grave
bearing on certain issues coming before the Council upon which
Councilman Vevera would vote. He requested that this matter ,
be submitted for determination on a declaratory judgment by:
the District Court of Johnson County. If this should occur,
he indicated he wished Council to consider incurring the expense
of authorizing employment of separate Counsel for Councilman
Vevera in the matter so the issue may be thoroughly determined.
City Attorney Hayek requested that this -be discussed at a subse-
quent meeting. City Manager Berlin indicated discussion could
be held at the Informal Session.scheduled for Monday, January
5th.
