MINUTES OF -A REGULAR COUNCIL IMEETING
JANUARY 7, 1975
7:30 P.M.
The Iowa City City Council met in Regular Session on
the 7th day of January, 1.975 at 7:30 P.A1. in the Council
-Chambers at the Civic Center. ---
Councilmembers present: Czarnecki, Davidsen, deProsse;
Neuhauser. Absent: Brandt. Mayor Czarnecki presiding.
The Mayor noted that hXIC Radio Station recorded the meeting,
portions to be broadcast later arc at the discretion of the
radio station and in no way controlled by the City or the
Council.
It was moved by deProsse and seconded by-Davidsen
that the minutes read thus far constitute a full reading
of the minutes for December 17th Regular -Meeting and that
Council approve them subject to correction. Motion carried.
Mayor Czarnecki proclaimed the month of January as
Alien Address Report Month.
It was moved by deProsse and seconded by Davidson
to adopt the Resolution of Commendation for Lamontc
Trexler for Meritorious Service in the Urban Renewal De-
partment to the City of Iowa City. Upon roll call Czar-
necki, Davidson, deProsse, Neuhauser voted 'aye', Brandt
absent. Motion carried.
Nancy Sieberling appeared representing Project GREEN,
presenting a plaque for national recognition of Iowa City
Gardens from the Burlington House Awards for American
Gardens noting this was the only award given in Iowa and
that the plaque would be placed in the Civic Center.
It was moved by deProsse and seconded by Neuhauser
that the minutes of the meeting of Library Board of 11/20/74
be received and filed. Motion carried. Mayor Czarnecki
announced Council has arranged a tour of the library
facilities at 12:30 P.M. Sunday.
Mayor Czarnecki announced that this was the time
set for the Public Hearing to Rezone Governor, Lucas and
Dodge Street areas south of Burlington Street and north
of the CRI&P_Railroad from an 113A zone to an R3 zone. lie
announced receipt of a letter and petition from Letha

property owners on SouLh Governor Street supporting the
proposedrezoning from'R3A to R3. It was moved by Davidson
-and seconded by deProsse that _tile _letter and petitions be
received and filed and made part of the public hearing.

-- - Motion carried. Those appearing in favor of the rezoning
were: Cynthia Gardiner, 601 SouthGovernor, who pre-
sented a new petition showing statistics; Paul Durrenberger,
616 South Governor; ,Phil -Shiveley, 416 South Governor;
and Emil Trott, proPerty owner. Those appearing that
were opposed to the rezoning were: E.W..Wells,. 648 South
Governor; Charles Grunewald, 436 South Governor; and --
Marion Miller, 624 South Governor. It was moved by de-
Prosse and seconded by Davidsen that "the 'survey presented
by Mrs. Gardiner be received and filed and made part of the
public hearing. `There being no others present-to.sreak, the
Mayor declared the 'hearing closed
Mayor Czarnecki announced that this was the time set
for the Public hear-ing -to Rezone 7.3 Lots in the Summit
Street area south of Burlington Street from an 113A zone
to an R2 zone. Acting City Manager Dennis Kraft commented
that the R2 zone would set a 6,000 square feet minumum lot
area. Emil Trott appeared favoring the rezoning. There
being no others present to speak for or against the re-
zoning, the Mayor declared the hearing closed.
Mayor Czarnecki declared a five minute recess.
The Mayor announced that this was the time set for
the Public Hearing to Vacate the Alley in Block 86 re-
quested by the University of Iowa, recommended by Planning
$ Zoning Commission. The alley is located north of the
First Presbyterian Church. There being no persons present
to speak for or against the vacation, the Mayor declared
-- the hearing closed.
Mayor Czarnecki -announced that this was the time set
for the Public Hearing on a Proposed Ordinance Amending
Pence and 'Shrub Height Requirements of the Zoning Code.
After discussion, it was decided toschedulethis for an
informal meeting. There being no persons present to speak
for or agianst the Ordinance, the Mayor declared the hearing
closed.
Mayor Czarnecki announced that this was the time set
forthePublic Hearing on,a Proposed Ordinance Amending
Fence and Shrub Height Requirements of Chapter 3.38 of
the Municipal Code. It wasdecidedthat this also should
- be scheduled for an informal: meeting. There being no
persons present to speak for or against the Ordinance,

The Mayor clarified the three appointments made to
the Parks and Recreation Commission, noting two should

have been appointed to four year terms and one for a three
year term. It was moved by Davidsen and seconded by_Neu-
hauser that Mary Mascher be appointed to the three year
term on the Parks and Recreation Commission. Motion carried,
deProsse voting 'no'.
Mayor Czarnecki asked for Council concurrence in the

had asked for a 60 day extension in considering uses for
the Old Post office Building. Dennis Kraft stated building
was not suitable for police use and tile cost of remodeling
was discussed with law enforcement agencies and the LLAA.
It was moved by Davidsen and seconded by deProsse to set
a public hearing on the disposition of Community Development
and Housing funds for January 21st at the 7:30 meeting in
the Council Chambers. Motion carried. Mayor Czarnecki
su,,gested a committee be set up to determine what the
building could be used for.
Councilwoman deProsse reported on a meeting held in
her home on the Ralston Creek problem. She noted Director
of Public Works, Dick Plastino, had also attended, and had
commented that dredging should not be considered at this
time. She also commented that the people want to know
what work is being clone and would like to be better informed.
Gerald Stevenson, 119 S. Dubuque, appeared urging
Council to preserve Block 81 in the Urban Renewal area
on which Donnelly's is located.as a historical site. The
Mayor reported the property was sold to Old Capitol Assoc-
iates and a contract is being prepared.
The Mayor commented on issues that were discussed at
the informal session. He also noted a letter from Mercy
Hospital announcing that January is National_B1ood Doner
Month, indicating they needed publicity and would like
Council to contribute.

Associate Planner for the Community Development Department
and stated this was a budgeted position.
Mr. Kraft presented aResolution Authorizing the City
to Incur Costs for Entitlement Grant for the Housing and
Community Development Act of 1974. It was moved by Neu-
hauser and seconded by deProsse to adopt the Resolution.
Upon roll call Czarnecki, Davidsen, dePorsse, Neuhauser
voted 'aye', Brandt absent. Motion carried.
Acting City Manager Dennis Kraft requested authoriza-
tion to interview to hire consultants for the Parking
Ramp. It was moved by Neuhauser and seconded by Davidsen
to instruct the,Ci.ty Manager to interview possible consul-
tants. Motion carried, deProsse voting no,, Brandt
absent.
Mr. Kraft reported the City had received bills for
child care from members on the Housing and Community
Development Committee and requested concensus of Council
to pay the bills. Concensus was given._
It was moved-by-Davidsen:iand seconded by Neuhauser
that the rules be suspended ,and the third reading of the
Ordinance Rezoning Certain Parcels in the R-1.4 Urban Renewal
Area to CBS Zone be given by title only. Upon roll call
deProsse, Neuhauser, Czarnecki, Davidsen, voted 'aye',
Brandt absent. Motion carried and third reading given by
title only. It was moved by Davidscn and seconded by Neu-
hauser to adopt the Ordinance. Motion defeated, Czar-
necki and Davidson voting 'aye', Brandt absent, deProsse
-voting 'no', Neuhauser abstaining. After discussion, it _
was moved by deProsse and seconded by Neuhauser to table
the item until next week, motion defeated, Davidsen and
Czarnecki voting 'no'. Since Council could notreacha required vote, it was decided to leave this i.tcm until
next week.
It was moved by deProsse and seconded by Neuhauser
that the rules be suspended and the third reading of the
Ordinance to Amend the High Rise Provisions or the Zoning
Code be given by title only. Upon rol.l call Czarnecki.,
Davidsen, deProsse, Neuhauser voted 'aye', Brandt absent.
Motion carried and third reading given by title only. It
was moved by deProsse and seconded by Neuhauser to defer
the Ordinance and refer it to Staff foranalysisand
retort. 1•lot:ion carried.
It was moved by deProsse and seconded by Neuhauser
to adopt the Resolution Accepting the Work on the Burlington
Street Improvement Project done by Metro Pavers. _ Upon roll
call Czarnecki, Davidsen, deProsse, Neuhauser voted 'aye',
Brandt absent. Motion carried.
It was moved by deProsse and seconded by Neuhauser that
the telegram from Allen E. Pritchard, Executive Vice President,
National League -of -Cities, Washington, D.C., regarding the
Supreme Court case of the, National League of -Cities vs.
Brennan be received and filed. Motion carried.,
It was moved by deProsse and seconded by Davidsen that the
letter from Marcia L. Claxton, Urban Affairs Specalist, Institute
of Public Affairs, University of Iowa, regarding a meeting to
discuss revision of the current civil service law be received
and filed and referred to the Human Relations and Civil Service
Commission. Motion carried.
It was moved by Neuhauser and seconded by Davidsen that
the letter from Thomas 1. McCoy, Executive Director,_regarding

the Dollar Checkoff Provision of the Federal. Income Tax
Return be received and filed and referred to the City Manager
to circulate among employees. Motion carried.
It was moved by deProsse and seconded by-Neuhauser to
adjourn the meeting, 12:00 P.M.

area located. along and adjacent to the intersection of South Summit Street

Comment: The ]�Janning and Zoning Commission on November 26, 1974, recommended by
a 4-0 vote and one abstension vacation of the alley in the block hounded
by Clinton, Market, Capitol and Bloomington Streets subject to either
the establishment _ofa._.utility .easement within said alley or provisions
for relocating existing utilities within said alley. The request

Because of illness, Olive McKenzie will
delay her departure from the library staff
until approximately Jan. lst. Susan
McGuire has been chosen to fill her job.
Howard McKenzie will be replacing Dewey
McGuire as head library aide Dec. 1st.'
The City Administration has questioned
our policy of giving benefits to library
aides who work 29 hrs. week or more. I -
ask the Board to re-examine and re -affirm
their policy on this.
We are 83 1/3% through the year as of
Nov. 1, 19-74 with total_ expenditures -just
under 80%. Farber, Newsome, Richerson
and myself appeared at the Nov. 4th work
session of the Council'. -to -defend our 1975
(6 mo.) budget request It was approved
without change at the formal session that
day.
I recommend that the Board react positively
and immediately to the Mayor's request that
the Council be given an overall review
of library operations before the final
hearing of the library's 19,75-76 budget
request.
The City has decided not to close their books
at the end of calendar 1974. Our 1975 six
month budget 'amounts will be added on and
will become a continuous -18 mo. period with
no adjustments needed until June 1975.
Positive response to our request for in-
creased fees for the Jan 1 June 30, 1975
period have been received from all 3 con-
tract areas although the contracts from
North Liberty and Lone Tree have not yet
been returned.
Contracts for the 1975-76 period must o
out soon. I recommend continuing the 52.00
per capita fee and using new census figures
if possible.

Equipment & Buildine:
The library is negotiating with IRS
and ISPIRG to provide tax counseling
by IRS trained volunteers at the
library durine regularly scheduled
periods from Jan. 1, 1975 til April
15, 1975.
I recommend that sunday hours beginning
Jan. 1, 1975 be 1:00 P.M. to 5:00 P.M.
Both staff andusers seem to prefer -
these hours to the former 2-6 P.M.
The library has been receiving good
publicity lately from the new radio
station KRNA and a direct response to
these announcements are being felt
especially telephone reference service.
A new structure for "paging" service
and the re -shelving of library materials
was instituted on Monday Nov. 18.
The system allows for more efficient
use of the library aides hours of service;
for quicker shelving of new books and
for better "policing" of the public
service areas. Each library aide must
sort, inspect, stamp and re -shelve an
average of 53 items per hour in order'
to. keep up with the library's volumne
of use. This average does not allow
forthehundreds of other miscellaneous
tasks required of them -mail duty, search-
ing reserves, locking up at night,
staff meetings, "shifting" books, fill-
ing magazine requests, etc., etc.
The new shelving is here.and will be
installed early in December in the
North Reading Room. The -new -arrange-
ment will necessitate the shifting of
almost the entire adult collection
during December. The new periodical
shelving is in place and the "new
books -have -been returned to the South---- -=
Reading Room.

Survey of Neighborhood Opinion on the PAsed Rezoning. ,� <
of S. Governor, S. Lucas, and Bowery Streets. \
This is a somewhat revised and up -dated version of the survey presented
to the Planning and Zoning Commission on 14 November 1974. It is supported
by petitions and statements signed by the property -owners. Opinions which
were obtained by telephone have been so noted, together with the date and
the initials of the interviewer.
We attempted to interview in person as many of the resident property -
owners as possible, and we have recorded their stated opinions. We always
identified ourselves, stated the fact that we supported the rezoning, and
offered our information -leaflets (copies are; attached). We answered all -
questions as fully and as accurately as we could.
We stress our care and thoroughness because of the inherent confusion
between opposing the rezoning and opposing apartment buildings or "change in
the neighborhood".- We spoke with several persons who felt that Ifte a petition
opposing the rezoning had been presented to them in an imprecise and confusing_
manner. We attempted to dispel this confusion and to ascertain the owners'
true opinion, all of which -- support, oppose, undecided -- have been accurately
recorded. We insisted that the signers of the supporting petition read the
petition carefully (we often also read it aloud, slowly). We are therefore
certain of the accuracy of this survey.
We did not approach non-resident owners in person, although we did
communicate with some. by telephone. When resident owners were not athome
we often left a leaflet and tried to return later, although time did not
always permit this. We did not approach owners, resident or non-resident,
who are known to us clearly to oppose the rezoning; but we have recorded
their opposition in the survey. All recorded "support" opinions, however,
have been carefully verified, either in person or by telephone.
The "owners'_ opinion" means the consensus of the ownership of the
property (e.g., husband and wife).When only one owner signed the petition,
we ascertained that the other owners agreed.' The few cases of differing
opinions among owners are recorded on the survey.

Conclusions
In every case except the dead-end section of Governor St. the majority
of property -owners support the rezoning, and the great, often overwhelming, majority
of resident owners support.
Opposition is concentrated in the dead-end section of Governor St.,
where supporters of the rezoning are in the minority. Nevertheless, the majority
of resident owners support; and the majority of owners are residents. On the
whole of Governor St., the majority of owners support, and the great majority
of resident owners support.
For the entire area, support for the rezoning is decisive. Of 137
ownerships, 95 are resident owners. The majority of owners (58%) and the
great majority of resident owners (77 %) support the proposed rezoning.

In Support of the Proposed Rezoning from R3A to R3 of:
S. Governor 'St.,'S. Lucas St.; and'S Dodge St:
(all from Burlington St. to the Railroad Tracks).
The present zoning of this area is R3A. This allows one apartment -unit
for every 1000 square feet of land, and hence permits the construction of large
apartment buildings such as have already been built in the neighborhood.
The proposed rezoning is to R3. This would allow only one apartment -unit
for every 3000 square feet of land; it would prevent the construction of large
apartment buildings, but would still allow smaller ones.
In 1972, a group of the residents of S. Summit and S. Governor streets
petitioned the Planning & Zoning Commission and the City Council to rezone
- -S. Summit St. to R2, and to rezone S. Governor: St. to R3. Their _purpose was
to preserve the historic beauty of Summit St. and the pleasant and attractive-
neighborhood of S. Governor St., by reducing the number of apartment -units and
preventing any more large apartment buildings.
This petition was denied; but the Planning & Zoning Commission ordered the
City Planning Staff to do a thorough study of the whole R3A areq. The Staff
has now completed its study of our section. The Staff's report"supporta the
rezoning originally requested, and also extends the R3 rezoning to include
- S. Lucas St. and S. Dodge St. (from Burlington to the tracks). _As a result
of this report, the Planning & Zoning Commission is itself now proposing
the rezoning.

There appears now to --be -no opposition to the rezoning of S. Summit St. -.
But there are some property—owners-and investors who oppose the rezoning of -
S. Governor St.
We who support the proposed rezoning of this area believe that it is
time to stop the growing number of large apartment buildings, that they are
causing the area to become overcrowed and unsightly. 'de want to preserve the
pleasant character of our neighborhood -- a mixture of single-family homes
and small apartment houses or homes which are onverted to a -few apartments.
The Planning & Zoning Commission will consider the proposed rezoning
at its next meeting, on Thursday, November 14, at 4:00 p.m. at the Civic
Center. We urge you to come and express your opinions.

RESOLUTION AUTHORIZING CITY TO INCUR COSTS FOR ENTITLEMENT
GRANT.
WHEREAS, the Department of Housing and Urban Development
has issued Rules and Regulations for obtaining Entitlement
Grants under the Housing and Community Development Actof1974,
WHEREAS, said Rules and Regulations provide that governing
bodies may begin to incur costs for the planning and preparation
of an application for an Entitlement Grant,
WHEREAS, the City Council recognizes that tine Rules and
Regulations provide that reimbursement -for 'such costs will be
dependent upon the availability of funds to implement program
and the submission of a timely application in accordance with
application requirements,
WHEREAS, the City Council deems it in the public interest
to incur costs.

The Dollar Checkoff Committee is non-partisan. Our single
Purpose is to increase
Public understanding of the Dollar Checkoff.
Presently, the Presidential Election Campaign Fund contains
about $30 million: $4 million from '72 returns filed in 173, $9
million from 172 returns filed in 174 as amendments; and S17 million'
from '73 returns filed in '74. ,Fifteen percent of the taxpayers
used the checkoff with '73 returns.
The recently signed 1974 Election Campaign Reform Act places
substantial new demands on the Presidential Election Campaign Fund
as follows:
A. For the general election campaign for "resident; $20 TO
each for the nominees of the Democratic and Republican
Parties Total $40 million: "
B. The law provides for post election payments to any third or
fourth_ partycandidate who receives over five percent of the
vote. The Fund needs enough "money to cover. r;uch payments he

this need $10 - $15 million.

C. Payments for Presidential Nominating Conventions: $2 million
.each to the Democratic. and Republican Parties tocover con-
vention costs . . Total $4 million:
D. Presidential Primary Matching Payment Account; The Law pro-
vides
ro vides for the Presidential Election Campaign Fund to match
private contributions of amounts up to 5250 dollars to
Presidential candidates to a total of $5 million. This is -
one half of the maximum primary expenditure limit. If four-- -
Democratic and four Republican candidates each raised $5
million in contributions of $250 dollars or less, there
would be a $40 million demand on the Fund. The numbers will
probably not go that high, but a figure of $25 million is
not unreasonable to expect the Fund to pay out during the -_
nominating process.
This means the Fund by '76 will need $70 - 80 million. -Tax-
payer participation with '74 and '75 returns will have to reach
25 - 30 percent -- double the 15 percent with '73 returns-- in
order to insure adequate ,money in the Fund to cover reasonable
contingencies
We need to work together in reaching as many taxpayers as
possible -- urging them to use the checkoff and make this new
experiment in the financing of Presidential Campaigns work.
You can assist in this effort by:
A. Advising city employees on how they can do something to
end corruption in presidential campaigns. We are enclosin
samples of printed material which can be included with
employee's W-2 forms that go out in Januart. 1975.- Since 7
percent of the taxpayers file their Federal tax form after
March 1, 30 percent after April 1, -you 'might include a
second reminder with March/April paychecks.
B. Urging the major employers in your city to do the same.
C. In public statements you make, remind citizens of their
opportunity to reform presidential elections through check-
ing YES to line 8.
We appreciate your cooperation in this nationwide effort. Pleasi

ANALYSIS: To be consistent with an
approximate 10 'block area to
the north and east currently
- requested consideration_ be given
zoned CB, the Council has
the shalf-
block CB. The subject half-blocktisrezoning located withinbaetwo-block
area proposed for the construction of an enclosed shopping mall
in accordance with the R-14 Urban Renewal Redevelopment Contract.
There is no particular advantage to rezoning the subject -half -
block to a zone which has the same site and structural requirements
except for one notable exception -- height. In the CB Zone,
buildings shall not exceed 15 stories or 170. feet and in the C2
Zone, buildings shall"not exceed three stories or 45 feet.
According to the Contract plans, said proposed mall, excluding
a high rise apartment or office tower in -a Portion of the structure
outside the half -block area, would beapproximately53 feet high
at the third level parking deck or approximately 58

SUBJECT: - Z -7429. -,Rezoning of the East
40 feet of Lot 3 and all of
Lot 4 in Block 44 of the Original
Town of Iowa City from an R3B
Zone to a C2 Commercial Zone.
STAFF The subject lots are located
ANALYSIS: within the same block in which
the Civic Center is located.
An existing church is located
on Lot 4 and an apartment house which was purchased and razed by
:the:City for parking purposes was located on the East 40 feet of
Lot 3
A church is permitted in any zone according to the Additional
Regulations of Section 8.10.19 of the Zoning Code, and since the
church was constructed prior to 1962, it is exempt from the
requirements otherwise applicable in the zone in which it is
located. A "commercial" parking lot, however, is permitted only
in a C or M District. The`Civic Center parking lot, as an accessory
parking facility to the Civic Center only, would be permitted in
an R3B Zone. But, as a parking lot for public use subject to
the required parking fee, it also functions as a commercial parking
• lot. Although perhaps it could be substantiated that a municipal
body -is -exempt from the very requirements, it adopts and enforces,
it is in practice poor policy. If the lots were zoned C2, as is
the remaining portion of the block, zoning continuity would be
established and -an-existing nonconformity eliminated.

RECOMMENDATION: dation the subject lots be
-rezoned-to a C2 Zone.
STAFF A C2 Zone is intended for general
COMMENT- commercial development as
around the central business
district,but consideration
should be given to establishing a more compatible commercial zone
adjoining residential areas to avoid conflicts. --Perhaps ,best
suited to 'accomplish this objective, the newly.created CO
Commercial Office Zone should eventually be established on the
commercial fringes such as on the subject block.
