MINUTES OF A REGULAR COUNCIL MEETING
JANUARY 14, 1975
7:30 P. M.
The Iowa City City Council met in Regular Session on
the 14th day of January, 1975 at 7:30 P.M. in the Council
Chambers at the Civic Center.
Present: Brandt, Czarnecki, Davidsen, deProsse, Neuhauser
(7;45). Absent: none. Mayor Czarnecki presiding. The Mayor
noted that KXIC Radio Station recorded the -:meeting, portions to
be broadcast later are at the discretion of the radio station'
-
and in no way controlled by the City or the Council.
It was moved by deProsse and seconded by'Davidsen 'that the
minutes read thus far constitute a fullreadingof the minutes
for December 30, 1974 and January 2, 1975 Organizational Meeting
and that Council approve them subject to correction.; _Motion
carried. -
Mayor Czarnecki proclaimed the week of January 20th thru,
25th as Iowa City Blood Donor Week. Ile reported that Council
is _scheduled to be at Mercy Hospital at 10:00 A.M. on Jail. 20th.
• It was moved by deProsse and seconded by Davidsen to adopt
the Resolution of Commendation for Anna Rothenhoefer for Meri-
torious Service in the Department of Finance for 11 years.
Upon roll call Brandt, Czarnecki, Davidsen, deProsse voted 'aye',
Neuhauser absent. Motion tarried.
Charles Johnston appeared presenting a letter concerning
the purchase of Urban Renewal demolition dwellings for relocation
and asked Council to amend the contract. (Councilwoman Neuhauser
arrived, 7:45). Acting City Manager Dennis Draft reported on
his discussion with IIUD in Omaha concerning procedure for amending:
demolition contract. It was moved by Brandt and seconded by
deProsse that the City ,Manager, Mr. Johnston and the City Attorney
meet to talk to HUD officials and report back. Motion carried.
It was moved by Davidsen and seconded.by deProsse that
the minutes of the meetings of -Steering Committee, 12/30/74,
1/6/7.5,1/7/75 and 1/8/75; Human Relations Commission 12/16/74
and Parks and Recreation Commission of 1/8/75 be received and
filed. Motion carried.
Mayor Czarnecki stated that the Parks and Recreation
recommendation ranking the distribution of $80,000 neighborhood'
park item in the Fiscal. Year 1976 Capital. -Improvements Project:
was noted. Ile added that the Commission asked for a staff review
• and position on the motorcycle trail..

Mayor Czarnecki. announced that this was the time set for
the Public Hearing on the. Disposition of City Property at the
Northeast Corner of Gilbert and Benton Streets requested by
W. A. Fotsch. Acting City Manager Dennis Kraft advised that
as more than one firm was interested in the parcel, he
recommended formal advertising for proposals for the whole
parcel. It was moved by Brandt and seconded by deProsse to
Instruct the City Manager and City Attorney to prepare documents
for competitive sealed bids on the whole parcel. Motion
carried. There being no others present to speak, the Mayor
declared the hearing closed.
Councilwoman Davidsen pointed out theneedfor ,Council
review of the Transit Development Plan before taking action next
Tuesday and asked that the item be added to the informal agenda
for Tuesday the 21st. The Mayor added that discussion of the Marijuana
Ordinance would be moved, to the 28th, and reminded Council of
the 1:00 P.M. meetings on Wednesday, Thursday and Friday, '
January 29th, 30th and 31st on the Budget.
Concerning the question raised about Johnson County's approval
of the Valley View Subdivision, Attorney Hayek noted that as the
subdivision was closer to Coralville, they were under`Coralville's
jurisdiction. He advised that the approval was contrary to the
annexation agreement Iowa City has with-Coralville, and it would
be appropriate for the City to remind Coralville not to pass
on areas under this agreement, to prevent it from happening in the
future. After discussion, it was moved by Neuhauser and seconded
by Brandt that the City Manager and/or the City Attorney be
instructed to forward a letter to Coralville reminding them
of the annexation agreement as it affects this property. Motion
carried.
Councilwoman Davidsen and deProsse reported on the progress
made in regard to policies encouraging employees to participate
in government and also on check -off provision for presidential
campaign funds. A letter has been drafted to -send to employers,
news releases are set up, and a` -letter will go to the Chamber
of Commerce and other organizations explaining the policy and
asking for ideas concerning participation in, government. The
Mayor asked that -the City;Manager -alert city employees to check-
off on income

letter concerning the check -off provision will be sent to employers
also.

City Attorney John hlayek presented a Resolution Approving
the Execution of Employment Contract with Neal G. Berlin, as
City Manager for Iowa City effectiveFebruary 1, 1975. It was
moved by Brandt and seconded by deProsse to, adopt the Resolution.
Upon roll call Czarnecki, Davidsen, deProsse, Neuhauser and -
Brandt voted 'aye'. Motion carried, 5/0.
The City Attorney reported that concerning the Amerex and
Short lawsuits, the City's liability carrier, Hawkeye`Security
Insurance Company, will participate in defense of those lawsuits,
but have requested that the City execute a Reservation of Rights
agreement. Ile recommended this procedure and circulated the
agreement for signatures by Council members.
Mayor Czarnecki explained actions taken last week on the,
Ordinance Rezoning Certain Parcels in'the 'R-14 Urban Renewal
Area to a--CBS Zone. It was moved by Brandt and seconded _by_ -
Neuhauser to adopt the Ordinance. Upon roll call Davidsen,
deProsse; Neuhauser; Brandt, Czarnecki voted 'aye'. Motion
carried.
Concerning the Ordinance Amending the High Rise Provisions
• of Section 8.10.19 of the Zoning Code, Mr'. Kraft noted that the
Staff recommendation of approval was the same as Planning and
Zoning Commission recommendation. lie outlined the proposed
changes in the Ordinance, and concerning the question 'would the
urban renewal plan, allow construction of: a high-rise apartment
in Block 103?' he noted that in the two block area bounded by
Clinton, Court, Madison and Bloomington Streets, the amendment
to the zoning ordinance would allow this, but the urban renewal
contract would appear to prohibit it. After disucsion of the
high-density district, it was moved by Brandt and seconded by
Neuhauser to adopt the Ordinance. Upon roll call deProsse,
Neuhauser, Brandt, Czarnecki and Davidsen voted 'aye'. Motion
carried.
It was moved by Brandt and seconded by Davidsen that the
rules be suspended and the second reading of the Ordinance to
Rezone a Tract of Land at 2650 South Riverside Drive from RIA
zone to an M1 Zone be given by title-only. Upon roll call
Neuhauser, Brandt, Czarnecki, Davidsen, deProsse voted 'aye'.
Motion carried and second reading given by title only. Council-
woman Davidsen asked Staff to schedule a discussion meeting with
Planning and Zoning Commission+at 3:45 P.M. Monday,,January.20th
and include this item. Council decided to add discussion of the
street lighting policy.

rules be suspended and the first reading of the Ordinance to
Rezone Governor, Lucas and Dodge Street Areas South of Burlington
Street and North of the CRI $ P Railroad from an 113A zone to
an R3 zone be given by title only. Upon roll call Czarnecki,
Davidson, deProsse, Neuhauser voted 'aye's Brandt abstained.
Motion carried 4/0, and first reading given by title only.
Attorney Hayek reported that concerning the comment made last
week that the changing of zoning category to a more restrictive
category involves a taking of property for which compensation
must be paid, this was not the law.
It was moved by Neuhauser and seconded by Davidsen that
the rules be suspended and the first reading of tile Ordinance
to Rezone 13 Lots in the Summit Street Area South of Burlington
Street Erom-an 113A zone to an R2 Zone be given by title only.
Upon roll call Czarnecki, Davidson, deProsse, Neuhauser, Brandt
voted 'aye'. Motion carried and first reading given by title
only.
Attorney Hayek advised that the Ordinance Amending Fence
and Shrub Height Requirements oftheZoning Code drafted by
Planning and Zoning, Commission should be consistent withtheOrdinance Amending Fence and Shrub Height Requirements of Chapter
3.38 of the Code drafted by the Attorney's -Department. After
discussion of measurements, it was decided to discuss these
ordinances with Planning and Zoning Commission at the meeting
on the 20th. It was moved by deProsse and seconded by Davidsen
that the rules be suspended and the first reading of the Ordinance
be given by title only. Upon roll call Davidsen, deProsse, -
Neuhauser, Brandt, Czarnecki voted 'aye'. Motion carried and
first reading given by title only.
It was moved by Davidsen and seconded by deProsse that the
rules be suspended and the first reading of the Ordinance Amending
Fence and Shrub Height Requirements of Chapter 3.38 of the
Municipal Code be given by title only. + Upon roll call deProsse,
Neuhauser, Brandt, Czarnecki, Davidsen _voted 'aye'. Motion
carried and first reading given by title only.

rules be suspended and the first reading of the Ordinance to
Vacate the Alley in Block 86 of the Original Town bounded by
Clinton, Market, CapitolandBloomington Streets be given by
title only. Upon roll call Neuhauser, Brandt, Czarnecki, Davidsen,
deProsse voted 'aye'. —Motion carried and first reading given
by title only.

it was moved by Brandt and seconded by Davidsen to instruct the
City Manager to report on that meter request and the traffic
circulation in the area of Gilbert and College intersection.

Mayor Czarnecki noted receipt of a letter from Charles
McKinney of _General Services Administration grating an extension
of 30 days time for consideration of purchasing the Old Iowa
City post Office (to January 22, 1975). After some discussion,,
Council decided to schedule the item for discussion at the
Monday meeting.It was moved by deProsse and seconded by
Davidsen to receive and file the letter._ Motion carried.
It was moved by Brandt and seconded by Neuhauser to adopt `
the Resolution Approving Class B Beer Permit Application for
Things, Things, and Things, 130 South Clinton.— Upon roll
call Davidsen, deProsse, Neuhauser, Brandt, Czarnecki voted
'aye'. Metion carried.
It was moved by Heuhauser and seconded by Brandt to adopt
the Resolution Approving Class C Beer Permit Application for
Giant Food Store k6, 2527 Muscatine Ave. Upon roll call deProsse,
Neuhauser, Brandt, Czarnecki, Davidsen voted 'aye'. Motion
carried,

the Resolution Approving Class C Beer Permit Application

disbursements in the amount of $1,122,290.88 be approved subject

Summary of Discussion:
The Committee reviewed the proposals submitted to date, including several
newly received (and listed in attachment). Taking all proposals received from
community_ groups and City commissions, relevant sections of the Capital Improve-
ments Plan, and figures on possible replacement of General Revenue Sharing
Fund expenditures, Ira Bolnick reported a total maximum outlay of about
$8,006,500. This compares with total Title I funds of $8,239,998 (computed as
basic grant X three plus 2/3 of basic grant fourth year plus 1/3 of basic grant
fifth year). This maximum is based on the 'highest figures given by City staff,
commissions, and organizations:
The Committee agreed to await the results of our survey (which will be reported
at the next meeting, January 6) before making judgments as to priorities for
first year, second and third year, etc., expenditures. The development of a
• three year plan, with specific recommendations for first year expenditures, is
proceeding.
The Committee also recognized the -need for publicizing the current status of our -
deliberations and arousing public awareness of our work.

SUMMARY OF DISCUSSION
Ira Bolnick reported that the total required for supplies for the Senior Citizens'
Center, under the Board of Supervisors' recommendation, is $2,000. This includes
purchase of drapes, a TV and radio, magazine subscriptions, a pool table, craft
supplies, card tables and chairs, and reading lamps.
Sheran Matson presented the results of the community survey. The results were
summarized in a chart in which the 13 listed projects are ranked under each of
eight columns: four age groups, each divided into two income groups with $7,750
as the division. Additional charts of comparative rankings were presented. -General
summary and explanation of the survey will be made in the Committee's report. This
section of the report will be compiled by Claudia Dalrymple, since tonight's meet-
ing was Sheran's last as a Committee member. 'Sheran will be moving to Des Moines,
having worked feverishly, to finish the -survey. Her efforts -speak for:_themselves in
• the form of the survey results. Thank you, Sheran.
Further discussion of the survey results will occur at our next meeting.

G. Berlin as City Manager of the City of Iowa City, as provided by

benefits, establish certain conditions of employment, and to set working

Section 7, Moving Expenses
- Employee shall be reimbursed, or City may pay directly, for the
expenses of packing and moving himself, his family, and his personal'
property from Hanover, New Hampshire, to City, with said payment or
reimbursement to be agreed upon prior to execution of any contract to

and insurance charges.

insurance presently covering Employee and his dependents, amounting to
approximately $1, 000. 00 annual premiums.
B. City agrees to provide hospitalization, -surgical, and compre-
hensive medical insurance for Employee and his dependents.
Section 13, Retirement - Deferred Compensation Plan
A. In addition to the base salary paid by City to Employee, City
agrees to continually set aside an additional sum equivalent to 10 per cent
(101o) of the base salary, as deferred compensation, which, in equal
proportionate amounts each pay period shall be credited and paid into a
"Deferred Compensation Account" to be established with the City Treasurer, -
Such deferred compensation plan will be administered as consistent with
provision of the IRS and ICMA Retirement Plan asset forth in a separate
agreement to be executed by all parties concerned.
Section 14, Normal Retirement System
Employees shall be covered by the normal City retirement system
in the category of City Manager.
Section 15, Other Terms and Conditions of Employment
A. The City Council shall fix any such other terms and conitioas

of employment, as it may determine from time to time, relating to the
performance of Employee, provided such terms and conditions are not
inconsistent with or in conflict with the provisions of this agreement, the
City Charter, or any other law.
B.. All provisions of the City Charter and Code, and regulations
and rules of City relating to vacation and sick leave, retirement and pension
system contributions, holidays, and other fringe benefits and working con-
ditions as they now exist or hereafter may be amended, also shall apply to
Employee as they would to other employees of City, except as herein
provided.
Section 16, General Provisions
A. The text herein shall constitute the entire agreement between
the parties.
B. This agreement shall become effective commencing February 1,
1975.
C. If any provision, or any portion thereof, contained in this
agreement is held to be unconstitutional, invalid or unenforceable, the
remainder of this agreement, or portion thereof, shall be deemed
severable, shall not be affected, and shall remain in full force and effect.

with the Iowa State Commerce Commission a proposed power
supply cost adjustment clause which replaces our fuel cost
- adjustment clause. The power _supply cost adjustment clause
includes changes in nuclear fuel and the energy component
of purchases and sales as well as changes in fossil fuel

costs.

Dear Ed:
The League of Women Voters of Johnson County supports the new
City Charter and the Home Rule concepts it embodies.
In order to facilitate the coming election, when all seats will
be vacant, a redistricting plan must be prepared. It will require
- the cooperation of the city staff.
It is our understanding that the procedure for redistricting is
a lengthy one, and we believe that preperation should begin at once.
We urge the Council to initiate the necessary action so that voter
information on the new districts can be brought to the public.
Our experience shows that any change in election procedures re-
quires a great deal of time for public assimilation. ,The more
delay involved in giving the public the information, the greater
the confusion and difficulty in the conduct of the election.
It is for these reasons that we call attention to this issue,
since new voter information will be imperative for the success of
this election.

This is a follow-up to the letter you received recently about the one -
day meeting Friday, February 7, at the downtown Ramada Inn in Des Moines.
(I-235 Exit 3rd St.) The meeting will provide an opportunity for you to
hear about and express ideas and proposals for revision of the current civil
service law and will hopefully generate action to implement these needed changes.
We have put together an interesting program and have some excellent
resource persons. Enclosed is the tentative agenda which will give you the
- basic format of the meeting. - -
At the bottom of this page, you will find the pre -registration form.
Please fill this out if you do plan to attend. There will be a registration
fee of $5. This fee includes a buffet luncheon and break -time refreshments.
The registration fee will be collected at the meeting. I am alsoenclosing
the hotel reservation card if you do want-accomodations. -
It is very important that you return this form as soon as possible if
you plan to attend. As I said in the last letter, _a member of our legal
research staff is preparing a detailed report on revision of the current civil
service law. This report will be sent out before the conference to those who
have indicated to us plans to attend. We will 'mail the reports as soon as
we can.

RESERVATION OF RIGHTS AGREEMENT
THIS AGREEMENT is made and entered into between the
undersigned parties on this 30th"day of January
1975. The parties to this AGREEMENT are Hawkeye Security Insurance
Company (hereinafter known as "Hawkeye", and the defendants in
two separate lawsuits one of which is now pending in the District
Court of the State of Iowa, in and for Johnson County Law No s
42541_(brought by Amerex Corporation, Laurence R. Short and First
National Bank, Iowa City, Iowa, as plaintiffs) and the other of
which is pending in the United States District Court for the Southern
District of Iowa, Civil Action File No. 74-283-1 (brought by
Lawrence R. Short and First National Bank 'of.'Iowa City, Iowa, as
plaintiffs) hereinafter referred to as "Defendants".
THIS AGREEMENT is madeand entered into with respect
to the COMMERCIAL MULTI -COVER POLICY issued by Hawkeye to the
City of Iowa City,.Iowa, bearing the policy number or designation
HCC9-03907 and any predecessor policy thereto containing the
same terms and with respect to the COMMERCIAL UMBRELLk EXCESS
LIABILITY POLICY issued by Hawkeye to the City of Iowa City,
Iowa, bearing the policy number or designation ESP2-50285 and
any predecessor policy thereto containing the same terms.
All of the undersigned parties agree and covenant '
that the participation of attorneys provided at the cost of Hawkeye
in the investigation-, defense and trial of the above lawsuits >
shall not be a waiver of any provisions of,the policies and will
not be construed as an admission or acknowledgment of coverage
under the policies.- It is agreedthat all parties hereby reserve
- all of their rights tinder the provisions of the insurance policies
in question. Defendants do not require Hawkeye to specify and detail
the reasons or provisions of the policies relied on by Hawkeye.
Defendants are free to provide additional counsel or attorneys
at their cost to take part in the defense of said lawsuits_

and o=her urban amenities. You know that we endeavor always to make our j
work for community beautification fit in with the orderly develonment of our
whole area.
Thus, as consideration ofacomprehensive --plan: for Iowa-Cityisnursued,
.re-ovld like to offer some recommendations to_be.considered under the.. Civil
Design Section.
1. Environmental dosiCn consultants, should be retained by the city.

Iowa City park will bring new vitality to this diztinguished and long respected
