The Housing Commission's comments on the Steering Committee's
recommendations to the City Council. _
The Housing Commission believes the intent of the Housing.and
Community Development Act is to assist a community in aiding
primarily its low and moderate income citizens.
We recommend funds be allocated.to hire additional staff for
codeenforcement. We would like to haveallrental property
inspected annually 'on'a scheduled basis. We believe we would
need to hire 3 or 9 persons to make this possible. This-.would
require about $50,000 per year.
We do not disagree with loan money being made available for
rehabilitation but would desire that it only be 'made available
to low and moderately low income persons.
--As a part of this
we see the need for; some out-right grants. An elderly-person,
for instance, may be able-to retain his own home for a-longer
period of time if he could make some repairs.
The Housing Commission recommends that the City use $100,000
the first year to purchase houses and rehabilitate them and'then
_rent them, to low income families. It.would be possible after;
• a period of time for the tenant to use a portion of his sent as
a, down payment toward purchase of the house. Young families are
having difficulty in making house purchases. It is even more
difficult for low income families. We believe that it is
appropriate to use..some-zitle-J—money... for :-this-_purpose.—After_
or during:.::the-first_.year:.it .would be Possible' to evaluate its
effectiveness and plan for the next year accordingly.

The Commission as a

by what we felt was
a lack of support; by the Council for

We hope that we have

In closing we would

From: James Harris

Re for the Jo
Funding 's planning function and that
the division of labor between the City
of the regional commission.
s comprehensive planning process
I am a member, at Mayor Czarnecki
's request, of a committee to
develop a proposed study design for the City _ wort. done by.the
understanding that the purpose of this committee
and to recommend details of the interface between the planning
two jurisdictions. It has been my was seeking its
is toe explore the appropriate scope of planning and that the City
"guidance in this matter. -
In this perspective I find it difficult t o theundejCRPC atrstand oa level rreIqui ing
this week, can consider establishing its fundingto be these
a reduction in staff and programs. It makes n sense for us
a basis anot derived
policies after, the budget decision have
hasalready
from the considerations that we have been asked and scheduled to develop.
I have jumped ahead, see attached memo,_ to voice my views of the
scope of the City's planning function in the hop
e that these views will lead to
should reduce
a working defofi tof hough pe which doesonot indicate that othe City rk. This well show
the direction Y appreciate that there are frustrations, differences of
its support of the jCRPC. I appI dealt
Policy_ assumptioeed to be
n and criticisms,
(to deadlines,
nes,ncha changes of scope,tetc-)he context
of compromise and commitment
I cannot see any response on my Part other than to urge you to
ort of the multi county _ agency. you may.wish to
allocate the $83, 323 seq any r for the three categories: Commission's programs,
direct contract work and supe s an amount ($15;000*)

for 60 to 75 day
until the process now started has beToforce the reg onal commission intoa -
)bout scope and division of effort. from a carefully
reduction of staff and programs is a'serious step and' moves away on a countywide'
developed commitment to regional scale cooperation and planning
basis.
zebruary'11, 1975'
To the Study Design Committee
of the City's planning undertakings and
Statement by Jim Harris re: scope
its relationship to the JCRPC
-some immediate' and some of longer range operational
I see several facets,
nature:
Immediate-
A. The City is unhappy with the delays in completion of theareawhichpit is
study and with some of the detation
ils of the land use planning up
based. I suggest:
(1) the JCRPC (with the State Highway Commission establish Dept. schedule
Trans. anof
d the consultants working on this study)
for early_ completion, giving it highest priority.
(2) the City identify now explicitly any objections to the study thus far
and seek a resolution with the JCRPC - including policy assumptions.
(3) great care be given to the, remainder of process
flows (desir
oectedrelines), alter -
for in it are the identification of major projected
natives in route locations and traffic assignments to these various routes.
This process needs the fullest communication and debate, for the impacts
of -future improvements in streets, highways, etc. are determined by these
end product plans.
B. The City's present position has tendencies
tow,
based upon perceptionswishing to choose a
of
- parr of the regional commission's program for Supp _
direct benefit, without the assumptionolat ion the major about two thirds nofbwhichis in wide
Iowa
P for the entire county p p'
City,` and (2) the commitment built up for regional uated cooperation carefullyrbefore

Dear Mr. Ruben.
Attached is a copy of a letter to Reverend Robert Welsh
inresponse to your letter dated February 3, 1975.
In addition.to_the_information-contained intheattached
letter, the following is -provided for your information__—
Reverend Welsh is minister for the First Christian Church +_
and is quite active in local` civic affairs. His 'letter
to you did not, indicate the church's financial interest
in the 'proposal -submitted-by-.Knutson' Construction Company.
_It is essential to indicate that the First Christian
Church held the option to purchase the site'on_which the
Knutson Construction Company' proposed to build. The
assignment to the Knutson Construction -Company was based
upon several factors, one being that the First Christian
Church (or a nonprofit corporation of its choice) would
retain :the -option tomanagesthe-units. Another factor
was that the FirstChristianChurch (or a'nonprofit
corporation of its choice) would retain the right to pur-
chase at a later date. The option to'purchase has since
expired.

Dear Rev. Welsh:
Mr. Nate Ruben, Director of Department of Housing and Urban
Development, Federal Housing Administration, Des Moines
office, has referred your letter dated -January 9, 1975 to
this Authority for reply.
First, -I would like to reiterate Mr. Ruben's statements
concerning the intent of the Section 23 Housing Assistance
Payments Program. The HUD Handbook 7431.1: clearly and
-- distinctly provides the policies and procedures to be
followed from application time through_ operations to
completion of construction. It delineates specific responsi-
bilities for specific_ entities. Its clear intent is to
place the responsibility for determining the site, design
and construction quality, -rents, --capability and responsi- -
bility-of-developer/builder/owners of any proposed project
into the hands of the Local Housing Authority (LHA). The
Handbook also provides the LHA with the, authority to fulfill.
this responsibility. In essence, the intent is to give to
the Local Housing Authority not just a_housing project, but
the opportunity to determine that locality's future in
federally assisted housing The Iowa City Housing Authority`
has accepted this responsibility and has diligently -followed-
the procedures outlined to the best of their knowledge.
Rev. Robert Welsh

Page 2
Second, nowhere in your letter did you indicate that the
Knutson proposal did not meet the requirements of the
public solicitation, i.e., the units proposed to be con-
structed were not air conditioned. <I believe this is a
fact worthy of mentioning.- After the -official closing"
date for 'submission of proposals, the Knutson company
did affirm in writing that the _rental structure as -sub-
mitted was based on non -air conditioned units but ,that this
solicitation requirementwouldbe met and the rental structure
would be reviewed. Therefore, we are of the opinion that
-
it_can be reasonably assumed that the Knutson Construction
Company's proposal would not have had the lowest rent once
this omission was considered.- To add airconditioning
equipment and provide the energy to operate this system
surely would have some effect on the rental structure of
the project. -
Furthermore, other items submitted concerning administrative,
operating, maintenance and tax costs appeared to be so low
as to prompt the staff to question the financial' feasibility
of the submission. Knutson, again after'- the -closing date, _
stated in writing that these factors would be reviewed and
necessary adjustments made. These factors would have an
effect on .the rental structure of the project and serve to
reaffirm the position that the proposed rent -for the Knutson
project would probably not have been lower than the other
submissions.
Finally, the reasons stated in Mr. Kraft's letter of December
23, 1974 are valid. - The following information is provided
concerning each of the three reasons contained in the letter
to substantiate this position
a. "Its location in the central area... The Housing
Authority is also the City Council and in this capacity is
responsible for the planned and _orderly growth, expansion,
and development of the city. That the selected proposal
is consistent with the city's plans is most assuredly a
positive factor. That other proposals were not consistent
or_complement.--y with existing plans are- .negative factors.
The prohibition of site pre -selection was well known to the
authority before advertising for proposals. There are sites
within the preferred area that would have been consistent
with existing plans (for example`, within the R-18 renewal
area).
Rev. Robert Welsh
February 10, 1975
-Page -3 -
b. "The developer proposes to construct...." The current
housing situation in the city is of some concern to the
authority. Virtually anything that can bproperly located to
the `availability of the number of sound, p_ --p Y_ --
dwelling units in Iowa City should be encouraged.' That the
ins a'total.of_'100 units is quite
selected proposal conta
important. Further, that, the developer did propose 100
units is consistent with -the--:public solicitation. "The
structure or complex may contain more than the 62 units to
be assisted." That an economic mix of residents will be'
theendresult is a positive factor and'wi11 negate the
labeling of the structure as "The Housing for the Low Income
Elderly" C. "This project appeared to be more financially
feasible..." Several items supporting this opinion have
been presented above. The Authority could=not in good faith
accept or recommend a proposal that appeared to befinancially
infeasible. Construction costs in this area are well known
totheKnutson firm in that they are currently active in
construction in this area. That their proposal contained such
a low estimated construction cost was cause;for.doubting that
the firm could construct the building for_the`amount included
in their proposal The Authority, in its desire to provide
suitable housing, did not wishto enter into an agreement
with a -firm only to find.at a later date that the firm could
not build the structure, for the.proposed costs. If this
were to Occur, the IRA, and the citizens of -Iowa city would
then lose this 62 -unit allocation.
In response to the final two comments in your letter, the
following responses are presented:
a. Section A -2c of the checklist. The old Capitol
proposal was rated adequate in relationship.to other pro-
- posals,-and the Knutson proposal was rated superior; however,
because of the serious doubt concerning other factors in this
proposal as previously mentioned, a.superior rating in this
category was not sufficient.
Section A -3a. old Capitol's proposal was equal to the
maximum gross rent allowable.- The Knutson proposal contained
a`gross rent below the maximum; however, when considering
-
the factors previously outlined in this correspondence, it
is doubtful that the adjusted rents to be charged by Knutson
would fall in this category.

b. The selected proposal contains 60 one -bed -room units.
That the single occupancy label is on the drawings doesnot
limit occupancy to one person The Housing Commission and
members of the City Council visited other developments in
central and eastern Iowa. Apartments similar (and in some
cases smaller) in square footage were 'occupied by married
couples and the space in these units was considered adequate.
The goal_of this program is to provide clean, decent, safe
housing and not necessarily housing comparable to thatwhich
a person of greater economic means could afford.
In summary, I would like to add that the Local Housing -
Authority has

north of Burlington Street and east of Van Buren Street from
a C2 and R3A Zone to an 113B Zone; date filed: 2/4/75; 45 -day

STAFF Dean G. and 'Evelyn M. Oakes
ANALYSIS: have submitted an application
to rezone the east 20 feet of
-- Lot 6 and all of Lot 7, with
the exception of a 30 by 34.8 foot parcel in the northeast corner,
to an R3B Zone for the purpose of permitting!the construction'.of
- apartments at a higher density in combination with offices in the
following manner: as proposed, the two existing converted duplexes
on portions of Lots 6 and 7 would be razed and a new building
constructed and attached to the building containing the offices -
of A & A Coins Inc. and [ioffman-Waters Realtors and four second -
level apartment units on the westerly portion of Lot 6. Only the
`easterly 20 feet of Lot 6, which has an 80 foot frontage, is
-
petitioned for rezoning since it is necessary to retain a minimum
area of 2000 square feet per unit in the C2Zonefor the four
unitslocatedin the C2 Zone.
Land uses presently existing adjacent to the subject parcels
include two single family homesanda multifamily apartment
building which rear upon Lot 7 to the east,' three multifamily
apartment buildings located across an alley to the north, the
office -apartment building previously mentioned to the west, and
an 18 -unit multifamily apartment building and an industrial use
across Burlington Street to the south It is improbable that like
uses permitted in the R3B Zone would have any adverse effect upon
adjoining property.
There are other factors involved, however, which are of some
concern to the staff including:
1. The high density of development permitted in an R3B Zone,
2. The inconsistency of the rezoning request with any established
comprehensive development plan, and
3. The establishment of an R3B Zone on a relatively small area
encompassing portions of two lots where such zoning does not
exist within two blocks of the subject parcels.
It must be assumed in considering a zoning change that the subject

There is no reason to deny R3B Zoning on adjacent property for

acceptable,
the street alignment of Penn Circle is certainly
