EUHAUSER Page 2 Council Minutes: _April 22, 1975 During -tile discussion of -the -Ralston Creek Coordinating Committeeandthe five -point policy, the;_question'of the legality of the meetings was raised and whether the action taken:at the February- 18th meeting to officially designate the: Ralson- Creek Committee was proper. The City Attorney noted that it was not proper, but advised three alternatives that the Committee would have, 1) to continue as a private citizen group, 2) to ask Council to establish a Ralston Creek Committee or Commission, the Mayor and Council appointing members who wouldfollowpolicies as set up"for 'Boards and Commissions, and '3)`establish the Ralston Creek Coordinating Committee, -__and appoint the present members as -official members. This: could be accomplished by a Resolution or an Ordinance. The City Managersuggested that to resolve the problem, the Council could pass a simple motion stating that the intent of the Council'sprevious action on February 18th was not to recognize this Committee as an official.Board._or:Commission_of,the . City of Iowa City. Issues discussed_ were alternatives, recognition of appointment, one difference being the reference to hiring of a consultant; continuity of the Committee; the City_ Attorney's statement thatCouncilcannot delegate authority to a citizens' committee. Ken and Roxanne Haldeman were present for discussion. It was moved by Brandt and seconded; by Neuhauser that Councilwoman deProsse be appointed to discuss the suggestionswiththe Ralston Creek Coordinating Committee;, -work with the City Attorney and come back with recommendations for resolving the problem. Motion carried. Councilwoman deProsse suggested an Ordinance .be prepared' regarding the establishment' of Council salaries. Councilman Brandt requested that City Attorney Hayek and City, Manager Berlin bring the Flood Plain Ordinance back to Council for discussion. It was moved by Brandt and seconded by Neuhauser that the present -copy of the Flood, Plain "Ordinance beforwarded to -the Ralston Creek" Coordinating Committee for report in 60 days to Council. Motion carried. Mr. Berlin noted theFederalGovernment is in the process of delineating the Flood 'Plain. Councilwoman Neuhauser reminded Council of the meeting of the Joint Law Enforcement Comm.-, at 1:00 P.M. on Wednesday at -.the Davis Building. Councilman Brandt noted he would attend since the -other four members of the Council will 'be - out of town at that time. Mayor Czarnecki advised he had received correspondence from Governor Ray.r.esarding the Rock Island Railroad and a -letter. from Senator Percy. Comment: The Planning and Zoning Commission on April 10,--1975, recommended by a 5 to 0 vote approval of the preliminary plat of Penny Bryn_; Addition, Part 3. The subject addition was previously approved as the Part 2, but was invalidated for failure to submit a final plat within the alloted 18 months following its approval. b. Consider a recommendation by the Planning and Zoning Commission to vacate and remove the Lafayette Street Bridge. V-7501. Comment: The Planning, and Zoning Commission on April 10, 1975 recommended by a 5 to O vote that the Lafayette Street bridge_ over Ralston - Creek be vacated and removed and that Lafayette Street be barri- caded at the creek. Three alternatives' were thoroughly discussed including: vacation and removal'of -the bridge, replacement of the bridge, and redecking of the bridge. PARKING VARIANCfi ON 300 BLOCK SOUTH DUBUQU1:-OLU CAPtTO1. ASSOC. Mrs. Ili.eronymous was,present to speak in favor of the appeal. she explained that the Old 'Capitol Association proposed, in thCir plot -;plans -to provide one (1) parking space for each two (2) apartments, explaining that not all of the sixty-two (62) elderly or handicapped tenants will own automobiles, and that the plot plans provide -for adequate parking facilities, as well as areas set aside -for planting screens and flower gardens The Board asked Mrs. Ilieronymous what parking facilities would be 'available if there were less than sixty-two (62) apartments leased to the, elderly or handicapped, or if more parking would be available if required. Mrs. llieronymous replied that the City assured her and her Association of _the number -of -people using the facilities.' The City has entered into a five (5) year contract, to be continuously renewable, for the next twenty (20) years, to provide enought tenants. Mrs. Ilieronymous also explained that the parking facilities were at least "woman -size", that is, the parking spaces were designed for maximum comfort. - Lyle Seydel explained that, according to the plot plans, the parking spaces meet the standards`of'nine feet (9 ft.) in width, --set by the Federal Housing Authority ;(HUD). Mr. Seydel also went on to say that the City will enter into a -contract with the Federal Government to provide; housing for the elderly or handicapped for :twenty ,(20) years. The City will then enter into a similar, five (5) year, renewable contract with the -'Old Capitol, Association to provide such housing. Mr. Dueker showed concern whether or not, if the housing _project became anything other than elderly or handicapped housing, the City would have any authority over the _building in the future, once the variance was granted. An agreement was reached that -the variance could be granted, based upon the continguency that under different conditions'`than those ' proposed at this meeting, -the City has the right to review the Board of Adjustment's decision. Mr. McBride agreed. C'I' b z MINUTES IOWA CITY HOUSING COMMISSION :APRIL 2, 1975 DEPARTMENT; OF COMMUNITY DEVELOPMENT CONFERENCE ROOM MEMBERS PRESENT: Branson, Claypool, Fountain,_Retish, White. MEMBERS ABSENT: Bosserman.-Sheets. STAFF PRESENT: - Seydel, iIillis. GUESTS: There were six guests present.` • RECOMMENDATIONS TO THE CITY COUNCIL: Recommendation to adopt rent collection policy (see attached). LISTOFMATTERS PENDING COMMISSION -COUNCIL DISPOSITION: None. SUMMARY OF DISCUSSION AND FORMAL ACTIONS TAKEN: 1. Branson called the meeting to order. White moved that the minutes of the meeting of March 19, 1975, be'_approved as written. Fountain seconded the motion. Motion `--passed unanimously. 2. There was no public discussion. 3. Coordinator's Report. Seydel submittedfour applications. Seydel recommended three be found eligible and one be found ineligible because of income. -z- • 199 units are now under lease. Two units will be lost at the end -of this month. Seydel presented a study on increases -in -rents paid to owners in the Leased Housing Program. Retish stated that he would like the -Housing Commission ' like -_,to-talk to,landlords about rising rents. He would a Association askingr:them to send - - letter sent to the Landlords a representative to a Housing commission meeting to discuss the rent problem. Sey del presented a study on the sources of income of tenants in the Leased Housing Program. HUD auditors have recommended that a rent collection - policy be adopted. -Seydel submitted a draft of _a rent' is the generally collection policy_(see_attached). This ,policy in writing.. This policy if adopted followed but it is not would be -incorporated -in the Statement of policies. Fountain moved to recommend to the--City-Council to adopt the attached rent collection policy.`- White seconded the motion. Motion passed unanimously. 4. New Business. A memo from.Tony Kushnir, Assistant City Attorney, dealing with a tenant -landlord ordinance, was discussed. Accordingly, they are doing a'very preliminary investigation to determine whether the cost of such a construction project is less than the benefits. A -private consultant hired by the City will look into not -only this solution, but a number of other solutions such as clearing the floodway of homes: enlarging the channel and -others. '- • The only possible duplication that could occur is if the private - consultant determines that the plan being pursued by the -Soil Conservation Service isthebest plan for Iowa City -to pursue. Even this would not really constitute` duplication since I,believe the citizens will want to know how the Soil Conservation Service plan compares with other possible solutions in cost and desirability. The most likely scenario I envision is the Soil Conservation Service and the Corps of Engineers dropping out of the picture because of lack of a benefit -cost ratio greater than one and the City being left 'as -the only entity pursuing a solution.
