MINUTES OF A REGULAR COUNCIL MEETING
JUNE 24,'1975
7:30 P.M.
The Iowa City City Council met in Regular Session on
the 24th day of June at _7:30 P.M. in the Council,Chambers
at the Civic Center.
Present: Brandt, Czarnecki, Davidsen, deProsse, Neuhauser.
Absent: none. Mayor-Czarnecki presiding.
It was moved by-deProsse and seconded by Davidsen .that
the minutes read thus far `constitue'a £ull`reading of the
minutes of the June 10,: 1975_Regular Council Meeting, and that
Council approve _them subject to correction. Motion carried.
Linda Fisher, 941 South Van Buren appeared requesting a
one week deferral on the vote for amendments to the Urban
Renewal `contract to allow for public reaction. Mayor Czarnecki
advised that the matter would be discussed under Council
Business, Item 7.
A citizen appeared requesting carpenter work in this area
in the _future. The Mayor ,pointed out that the City had only
employment as a result of certain grants
temporary openings for.

Mayor--Czarnecki called attention -to-the Landlord Tenant
report ,from the Housing sub-committee on`July 16th. He also
asked that as.discussed in-the Housing minutes,conversion
from Section 23 program to Section-8 and compliance to Lease
regulations be scheduled for informal discussion. In answer
tothequestion concerning the Library personnel rules, the
City Manager advised he would investigate.
It was moved by Neuhauser and_seconded by Davidsen to
approve the Design ;Review `committee's recommendation_ for
sodium lighting on 15' standards, placed at 501 intervals,
2' candle levels on Washington Street with additional_lighting

Neuhauser to -adopt the Resolution Amending the -1979-1975
Budget. -Upon roll call Brandt, Czarnecki, Davidsen,_deProsse,
Neuhauser voted 'aye'. Motion carried. There being no others
present to speak, the -Mayor declared the hearing closed.
It was moved by Neuhauser and seconded by Davidsen to'
approve the Rules Committee minutes of their meetings on
- May 19, 1975 and June 20, 1975 where matters relating to
all Boards and Commissions were discussed and, -four ,recommendations
were made. Motion carried. The City Manager advised we would
move toward having the Staff.recommendations and Commission
recommendations, with Staff reports used,

Mayor Czarnecki announced discussion of the contract
amendments to the Urban Renewal ._Contract 'with -Old -Capitol
Associates. The Mayor pointed out -that -the Council had
discussed -the Fourth Addendem at the informal session, yesterday
including questions dealing with the lease arrangement on
parking lot at Washington and Clinton, penalties and incentives
and provisions concerning penalties relative to the deposit,
and in the case of a default;process used for, price for the
payment of the land, &--additional information. was received from
the :Finance Department. Councilwoman deProsse-read'a-state-
ment-into the record concerning her Viewpoints on the proposed
amendments and other solutions, and stated that she would not
support the O1d.Capitol Associates'_proposed amendments`. Urban
Renewal Director Richard `Wollmershauser'gave a;brief rundown
on, the changes outlined in the Fourth Addendum„'and -Finance
Director Joe Pugh ;explained the financial data he had, presented.
Marv`Hartwig, President oftheChamber of Commerce read a
letter which was in support of the urban renewal contract
provisions. It was moved by deProsse and 'seconded 'by Neuhauser
to--receive,-and'file the letter. Motion carried.' Harold
Bechtoldt appeared objecting --to the amendments to the contract
and asked that the decision be Put off a.week. Robert Welsh
presented a statement requesting staff and Council investigation
concerning` comments made at yesterday's informal session. --
deProsse questioned a.provision on Page 8_ -concerning interest
provisions relative to the City purchase of the -south -120' --
of Block 83. Sue Futrell, appeared representing-`-ISPIRG,
asking Council to vote against the amendments -and to Postpone
the consideration of them.
Rosalind Moore, representing the Downtown Association
appeared urging Council to accept and approve the. -amendments
as in the best interests of the community. 'Charles Griffin,
711 Third Avenue, appeared requesting that the CPostpone

simplistic, but I think it must be drawn to serve as a example-whan we make the
decision about what to do with the future of Urban Renewal in Iowa City.
The atmosphere in City Hall has been remarkably quiet ever since the developer
requested the contract ame dnments. There has not been the pressure to accept the.
proposed changes as there was to sign the original contract. I know this is because
other people share the concerns I have expressed above. It's as tboueh we have been
given breathing time in order to correct a serious flaw 'in the design of downtown:
In addition, I believe the latest staff report, issued June 20, 1975, reinforces
50-:e of my earlier reservations rather than eliminating th ,m. I sugcested'over a year
ago that we shouldn't be concerned about the "short run" if the "long run" 1was going,:_
to -prove to be detrimental to the goals we wanted to achieve. The report emphasizes
over and over that if it ttiere just the short run we were concerned about we 'would
not have embarked on any Urban Renewal plan.
Of major concern in the report is the suggestion that it may be difficult for the
City to finance the mall parking ramp. An excerpt from page 11 of the report reads
as follows: "Although a specific financing plan has not been recommended, it can be
said for certain that the current climate for parking revenue bonds is not what it eras ,
LWO years ago,nor whatitis expected to be two years from now. In our opinion, i -t is
doubtful that the City, even with the excellent credit rating that it now maintains:
could successfully sell parking revenue -bond: today with a 7c/ interest rate - ceiling.-
This would be a certainty if it were attempted without a demonstration that major

3. Coordinator's; Report.
Seydel-submitted seven applications -and recommended
approval of all seven. Seydel requested that three of the
applications be considered as Priority I'instead of Priority II
in assigning priority preference. Two of these applicants
are.; presently enrolled as students and are receiving money
through the Special Services Support' Program. One of the
` applicants will probably be participating in this program.

The ;Special Services Support':Program utilizes federal money
and -is'replacing the WIN Program. WIN participants would be
considered Priority I. Since there were no objections,` these
applicants will be considered the same as WIN students and
willbe given Priority T -ratings.
There are 198 units presently under lease. One unit
is empty and being shown.
Seydel--discussed HUD Notice 75-17, which concerns
conversion from the Section' 23 program to Section 8. This is:
the subject of a.special meeting with HUD, Des Moines, to be

held in July. It -appears that there will:- -be-little choice
and the present program will have to be converted too -Section 8.

did not comply with all HUD regulations. 'Specifically,

Seydel has written a new lease to be studied by the- commission
members.' Seydel stated that there is in existance a rule -

that he'cannot lease from members of the Housing Authority, -
Housing -Commission or -employees of the Department of Community

Kamath suggested that this definition might be broadened
to include family members. ;
The results of the Equal -Opportunity -Review have been
received. 'It was recommended -that '_applications be date; time -
stamped. Also that the Authority; collect -racial' -and ethnic

data. The applicationswill be date stamped in the future.
'Racial and ethnic data will be entered on the application
in the form of code. This will be the same code HUD utilizes.
The Annual Contributions Contract for the elderly housing
has been signed and sent to HUD Des Moines.

Branson has met with Tony Kushnir, Assistant City Attorney

concerning the proposed Tenant -Landlord Ordinance. The Council
does not want a specific ordinance from the Housing Commission.

the 16th to discuss the initiation of. -formalization procedures, and to give the
Coicmi-tee°insight as to how each Council ;person envisions the future functioning
of the CIC_ No minutes viere made of the meeting on June 2nd due to the lack.of
members present.
Views presented at the June 16, 1975,, meeting included the Committee as an
advocate -for -low and moderate income; persons, with such business as suggested
distribution of funds (revenue sharing,`CIP, etc.) which directly affect these
groups. The human needs planner, when hired, was suggested as the logical City;
staff person`to_providz inForma-ion and assistance to the Cc.mittee. -A review"
of the current standing of projects funded under the-HCDA o` 1974 was also
suggested. Composition of Committee membership was discussed with the general
opinion being that it can remain basically the same in the future.
The Rules Committee will submit steps to be taken for formalization of the
CIC; as well as possible by-laws for the group, to the CoT.nitten for review at-
• its `r t m>_eting. Corr ittee members will also present ideas for by-laws and a
statement of purpose.
Thoughts For summer blrsiness; plans for reaching low-income persons and
receiving input from then; look:ng'`into housing code enforcement and rehabilita•.
tion, possibly suggesting criteria .for selection -,of persons to receive -housing
rehabilitation loans, as funded by HCDA of 1974; -"tying up loose ends"-- report
of what -the Committee has accomplished,'its expenditures, where it's heading.
Thea Sando and 5leatherill Winder have resigned fromtheCommittee. Horace
Amiden wilt now be the Senior Citizen representative.
The next Committee meeting is scheduled for -;June 30th, at 7-P.1,11. in the
Council Chambers.

request permission to appear before the Board at your meeting June 24-26
to discuss the_following_points:
1. The economic feasibility of maintaining the property. We have
_knot•Fledge of conflicting analyses regarding ,th-costs involved.
2. The responsibilities of theownerof a Mational Register historic.

preserved, :it_need not necessarily. be restored as a museu;. building.
3. The viability of a specific proposal for_the use of the prcperty.,'Sie
have knowledge of one proposal which could,be feasible on a lease or

We understand that the University has no immediate need or proposed use
for the building or the property.

Keynote Address was given by Dr. Frank. Court of Denver

the Conference, just being away from -the crunch of city
government should give some serenity so we could go back

those -willing to go the 'second mile' Life makes us
do certain things, the first mile; but when you are free
to make a choice, that is the second mile. `And if 'life
goes sour, thank God for large garbage cans. Junk the
'sour' and start ;over. He advised of the need for inner -
security, faith and dreams, suggesting you are old only
if your dreams are all re -runs. (He was 83.and spoke for
45 minutes without notes.)
I attended the Monday morning session 'Women's Role
in Local Government' instead of 'Labor Relations:: The
speaker was Mary Buchanan, Secretary of State, Colorado,
Who pointed out that women have 35 years or so after mother-
hood to develop or continue a career, and to apply mother/
family skills to a career, as they also include manage-
mentm
of time and communication:
The afternoon session was 'All That You Wanted to Know
About: Records Management`But Were Afraid to Ask'.The
expert was Katherine Aschner, Director of Records-Manage-
aent Division, Uational' Archives and Records Services,
General Services Administration, Washington, D.C.
Tacoma, Washington used revenue sharing money to
set up their records management -system, $35;000, and hired
2_", persons to operate it, $25,000 a year. IG in-

The second afternoon -session was Council Minutes and
Agenda Preparation. One idea presented was the Consent
Calendar which was used by about 1/2 -of the -cities repre-
_-sented'. All routine, non -controversial items are listed
at the beginning' -of the agenda - minutes,- Council and
Board & Commission; bills, City Manager and City Attorney
reports; some resolutions(accepting;'secoers,--streets,' etc.)
motionstoreceive and-file.correspondence;_::beer & liquor
" and cigarette permits; appointments. These are adopted by
one motion, one vote, after the Mayor has inquired if
any Councilmember or cit:i.zen wants to .discuos,`any of the
items. Any question on bills, awards,of-contrac,ts,_or_nin-
utes corrections are investigated by Councilmembers before
the meeting.,One Council had routinely adopted up to 100

items in this manner. Council can adopt thisprocedure•
by a_Ilolicy statement.
In other cities, the tentative agenda was sent with
a Consent Calendar; the cut-off day for agenda items was
Wednesday the:agenda-was sent Thursday;. and Council removed
items -from the Consen t_Calendar by; Friday. Final agenda
was Monday, meeting Tuesday.
- Citizen participation was usually limited to five
minutes; scheduled oral presentations were listed on
public discussion cardapplicationforms turned into
the Clerk before the meeting started - then handed to the
Mayor to call on in the order he wished. Anyone not
filling, out the application card waited until the end of
the meeting for unscheduled oral discussion. If someone
needed more than five minutes they _could note this on
the card.
`Tueday's meetings were on Effective Communications -
'The Key to_P_ublic Understanding'. The panel=
started
discussion 46 methods of communication were given(list
attached). Then they asked for workable ideas used by
others. The ideas_ presented were:--

you will note that subsection d makes reference to Section 702 of Part II
of the contract.:
Section 702 of Part Il of the contract, as modified in Part I of the
contract, provides in pertinent part as follows:
In the event that (b) the redeveloper -shall, --after
preparation of construction plans for -any parcel
satisfactory to the Agency, -furnish evidence -
satisfactory to the Agency, that it has been unable,
after and despite diligent effort for a period of 60
days; after approval by the Agency, of the parcel
`construction `plans, ,to_obtain mortgage financing
for the construction of the improvements on any
such parcel on a basis and on terms that would
generally be considered satisfactory by .builders
or contractors for improvements of the nature and
type provided in such parcel construction plans,
and the redeveloper shall, after having submitted
such evidence -and if so requested by the Agency,
continue to make diligent effort to obtain such
financing fora period of 60 days after such
"request, but without success, then the agreement
shall, at the option of the redeveloper, be termi-
nated by written notice thereof to the Agency as
to such parcel or part thereof, and the redeveloper
shall be entitled to a return of a pro rata portion
of the `deposit and neither the Agency nor the
redeveloper shall have any further rights against
or liability; to the other under the agreement as ,to
: such parcel or part thereof provided that the
redeveloper shall immediately reconvey the parcels
involved to the Agency -free of all liens and the
Agency shall return the purchase_ price.
To summarize the language of Section 702, if the redeveloper has
:prepared construction plans and they have been approved by the City,
and then the redeveloper ,is unable to obtain' mortgage financing after
diligent effort of a type that would be considered generally satisfactory,
