JUNE 22, 1976

The Iowa City City Council met in Regular session on the
22nd day of June, 1976, at 7:30 P.M. in the Council Chambers
at the Civic Center. Present: Balmer, deProsse, Foster, Neu-
hauser, Perret, Selzer, Vevera. Absent: none.
presiding. Mayor Neuhauser
RobeSt_Welsh, 2526 Mayfield Road, appeared concerning Urban
Benezral. He commended Council on their spirit of openness and
cooperation toward their decisions on Urban Renewal. He felt
their decision to amend objectives to include an affirmation of
commitment to housing, mass transit, pedestrian ways, and open
spaces correctly reflected the view of the community. He further
endorsed several positions taken by Council. clL y
Item 3.d.4., letter from Atty. William Meardon,regarding the
connection'to a sewer line outside the City limits, was pulled
from the consent calendar for discussion. Several Councilmem-
bers felt the BaLke;,s should be allowed to connect to the exist-
ing sewer line provided they would submit to annexa ion by the
City if required in the future. It was the consensus of the
Council to receive and file the letter and to defer this matter
until June 29 pending the City Manager's investigation. 7D
Items 3.c,6 and 3.c.7, resolutions approving Class_C_Ziq.U"
Control_,License_and__Class__C_Liquox—S-unday Sales applications
for Aycori_Mfg.,,__._Inc__,_dba/_Copper_.ollar, from the consent calendar
were discussed.. Robert_[iel_$h, 2526 Mayfield Road, questioned
the status of the proposed ordinance regulating noise, littering,
and responsibility of such establishments. He asked,Council to
consider the problems previously encountered by the First Christian
Church with a similar business located in the same area. He
further questioned whether or not Council would consider revoking
the Sunday Sales permit if this business would become a nuisance
to the neighborhood. City Clerk Abbie Stolfus indicated the
Policy initiated by previous City Council was to allow the estab-
lishment ninety days to "prove" themselves. After further dis-
cussion, Foster withdrew earlier motion to delete Item 3.c.7.,
and made a motion to defer Item 3.c.7. for one week which was
seconded by Vevera. Motion carried, 5/2, with deProsse and Perret
voting "no". City Attorney Hayek will study how the State Code
applies to Sunday Sales and report to Council June 29. '77/
Mr. Berlin informed Council he would direct City Staff to
initiate publicity concerning the proposed cemetery ordinance.

a proposal which better meets the objectives of their Ur_ ban
Renesial plan rather than the bidder who offers the highest _ 111?
price for the purchase of property. Mayor Neuhauser reported
that Steve Morris, representing the transit operators, al
Baker from Coralville, representing their system, and herself
were in attendance for the signing of the transit subsid_,y bill_
in Des Moines. Iowa City and the Johnson Count Re �`�
mission were congratulated at this ceremony. There gwas adis-
cussion concerning the issuance of tickets to vehicles 22rked
in a 10_c1di g+zone on Sunday. Mr. Berlin informed Council that
City staff was working on incorporating this matter in
new, proposed traffic ordinance. to the
Mayor Neuhauser stated .Stetie�ombasdi had spoken to her
about the need for publicity to get interested people involved
in the "Rent for Service_Program" which is being sponsored_
the University of Iowa. There were some comments concerning'i"'"^
an editorial which was printed in the Press Citizen regarding
raising the bus fare and not increasing rates for the parking
mers tealso. Concern ivas expressed that this might tend to
divert people who normally ride the bus to drive their cars
instead. Council will be receiving a report from the Finance
Department concerning this matter in the future.
Mr. Berlin stated the Parks and Recreation Department was
currently seeking solutions for use of the City ParkpoBds,
Councilman__Selz.ex_suggested stocking them with fish to
recreation with minimum maintenance for the young and elderde.
Councilman Foster informed citizens that Informal Council meet . '

City Attorney Hayek presented several reports to Council:
(1) He explained Council did not have the authority to halt
development of a

Industry building, nor any other area of development, unless there
is a request for change in zoning. (2) Upon reviewing the Iowa-
. -Gas &_Electric_ Company_franchise agreement, he dis-
covered the City could legally determine,in the interest of
the public,where the service line should be placed at the High-
way_..6_and Industrial_Park intersection without a formal ordi-
nance. (3) He was requested to give his le �.7
, opinion le-:er received from an attorney representing a development
asking the City's position as to whether or not it claimed
authority to review S1113_0y_ision_plats in the River Heights

Addition (specifically L�kegewKnoll3rd Addition). Mr. Hayek
stated the Council or Planning & Zoning Commission not only had
the authority, but also had the responsibility to review sub-
division plats within two miles outside the City limits as per
Section 409.14 of the Code of Iowa. He further stated the City
of Iowa City would have a particular interest in this area as
to how the subdivisions are developed and what kind of streets
and facilities are provided, since the Coralville Annexation
Agreement allocated this land to Iowa City for future annexation.
A motion was made by Vevera and seconded by Foster to direct the
City Manager to reply to the Johnson County Board of Supervisors
indicating that the City does have and insists it has the right
to review the subdivision plat for the development of Lakeview 100'
Knoll, 3rd Addition. Motion passed, unanimously. (4) Mr. Hayek
reported to Council the City had received partial judgment today
for the motions filed for summary judgment in the Amerex case.
This will relieve the City from paying $916,930 for claimed dam-
ages on rezoning but would not alleviate them from the $93,000
judgment for the alleged delay in implementing the Court order
following declaratory judgment action.
Mr. Berlin clarified the June 3, 1976, Planninc and Zoning
Commission minutes and indicated Planning and Zoning decided
not to pursue the matter of initiating a moratorium on the
northern sector of R3 Study Area, after it was determined the
City would have to hire an attorney outside of Iowa City to
obtain a legal opinion.

Several disturbed residents on Kirkwo_Qd Avenue had called
Mayor Neuhauser stating they were told the reason the telephone
company was laying the cable so far from the street was that
the City had immediate plans to widen the street. No one knew
where the telephone company obtained this information; how ver,
it was probably done in anticipation that the street might be
widened some time in the future. The Staff was directed to make
sure Northwestern Bell understood the situation.
The public hearing was held on the FY 77 Slabjackina PTOgram.

further discussion, the public hearing was declared closed.
Balmer motioned and Vevera seconded to adopt Resolution No.
7G-189,_ as recorded in Res. Book 35, page 231, approving Pro-
poses Pians, Specifications, Form of Contract and Estimated Cost
for the FY 77_,_Slabjacking_Program, and Directing Publication of
Notice to Bidders. Roll call: Ayes: deProsse, Foster, Neu-

Councilmembers discussed the final plat of the $�jxe

_G, It was noted that since the Preliminary
had been approved and all requests complied with the finalplatmust be approved as per the City's Subdivision Code.' Council
regretted the fact they were unaware the development would have
an effect on the Ralston Creek Watershed when they approved the
preliminary plat. City Attorney Hayek stated the Legal Depart-
ment is reviewing the Storm Water Management Ordinance, and this
ordinance will establish the law for future subdivisions in re-
gar,c2 to drainage into Ralston Creek. Selzer indicated he sup-
ported the concept of combining all subdivision requirements
into a "one developer" ordinance.
A motion was made by Foster and seconded by Vevera to adopt

Council considered a resolution authorizing the removal
of parking from the East and [vest side of Dubugug from the
intersection of College and Dubuque to a point 150 feet North,
and removal of parking from the North and South sides of College
Street, from the intersection of College and Dubuque to a point
150 feet West, and removal of parking meter stalls in this area.
There was discussion of closure of streets on July 1, vacated
by Ordinance to conform with the contract with the Urban Renewal
Plan_ Several Councilmembers felt the use of the downtown
streets should be reviewed in more detail before reaching a
decision as to what streets should be closed_
