The Iowa City City Council met in regular session
'on
the 5th day of October, 1976, at 7:30 P.M. in the Council
` Chambers at the Civic Center. Councilmembers present were:
Balmer, deProsse,'Foster, Neuhauser,'-Selzer, Vevera. 'Berret
arrived at 7:35 P.M. Absent:' none:- Mayor Neuhauser-pre-
siding.
Mr. Thomas Anthony, 1004 Kirkwood,-appearedand pre-
sented a proposal for _gmbarcro of large truck traffic -on
KirkwooSl Ave. from area.residents and requested that Council
takeactionon alleviating the problems caused by these
trucks. City Manager Berlin stated that Section 64.64, Code
of Iowa, authorizes Council to designate`' truck -routes.'' He
also explained that a new model traffic code procedure would
be presented in the near future. Mayor.Neuhauser stated this
matter would be discussed along with the new traffic code at
the end of the month. 1 $3
After City Clerk Stolfus requested that a Resolution
Approving -Cigarette Permit be added to the Consent Calendar,
it was moved by Foster, seconded by,Perret, that_the`follow-
ing_agenda+items and recommendations

The Se� 2_ request for permission for a covered 'open
ing in thCLside-alk was discussed by Council.- City Attorney '
Hayek informed Council the procedure for acquisition of the
alley involved identification of ownership, appraisals, nego
tiations, and a possible condemnation proceeding.This,pro-
cedure might take ,from three to four months to complete.
After further discussion, Mayor Neuhauser asked Mr. Hayek to
report to Council in one month as to how complicated this mat-
ter -would be. Councilman' Selzer suggested the Engineering
Dept. also investigate this matter. There were no Council ob-
jections.
City Attorney Hayek stated the ,nqgotiattions with Perpetual
Savings & Loan and Iowa State Bank are progressing. He noted.
there had been a meeting scheduled with•O1d Capitol Associates
on Friday, Oct. 8. /7p
Councilman Selzer expressed his concern to develop a belt -
line around the City for truck traffic. City Manager=Berlin'1
indicatedhehad checked into thepossibilityof-'constructing:'
a beltline to run-on Scott Blvd. from Lower Muscatine up to
theLocal Road, and if the Council would wish to implement
this program, its cost could _be'incorporated into _the;C.I.P.
_ which will be updated in the next four months. After discus-
sion, it.was-decided to"request-that-Public Works determine
what right-of-way would be needed for the'beltline and also .
find out whatplansthe developer has for Scott Blvd. before
the C:i_P. is discussed. /7Ab
Councilman Foster requested that the press releases
divorce ticketing from towing, noting that -the.City is not in
the towing business -- a private individual is doing the /Ti/'
towing.
Councilman Balmer questioned as to when the Riverfront
Commission's request for information on the.acqusition'of land
would be discussed. Mr. Berlin stated this matter could be
determined after the funds are identified upon the City's buy-.
ing out the -Federal -Government in Urban Renewal.
Councilman Balmer and Councilwoman deProsse indicated they
would be absent from the informal meeting.of the 18th and -Coun-
cilman Balmer for the formal meeting -of the 19th.:
It was moved by Selzer, seconded by deProsse, to return
the amount of $4,670'($5,000 less the cost incurred by`_the City)
to ConstaT:ce Merker_in reference to the house located -ons 22_E-
.Court,St. :.hich she had intended to move. Then, Councilman
Foster mcued, and"deProsse seconded to table the motion in or-

Parking OrdinancQ by providing, recourse against motor..vehicles
parking on private property. He explained its two sections,
impediment of private access to public way and parking upon
private property. Because of Councilman..Selzer's request for
time to study the ordinance, Council later came to the con-
sensus to consider the ordinance October 12.
City Attorney Hayek suggested Council schedule discus-
sion on Bending litigation within the next month or so. There,
were no Council objections.
The public hearing was held on the.Planned_AiDevel
ea op
ment of A & H Apartments. Atty.Alan Leff appeared on behalf
of the --owners of the complex and asked Council to suspend the
rules and give the final vote for passage that evening.There
was some discussion concerning,.accessibility for the handi-
capped, with Councilman Balmer requesting information, from the
City Manager as to how many apartments in Iowa City provide
handicapped accessibility. It was moved by Foster, seconded
by Selzer, .that the rule requiring that ordinances must be
considered and voted on for passage` at,two `Council meetings
prior to-the.meeting at which it is to be finally passed be
suspended,' that the first and second considerations and vote,_
be waived, and that the ordinance be voted upon for final pass-
age at this time. Affirmative roll call vote was unanimous,.,
all Councilmembers present. It was then ,moved _by Foster, sec-
onded by Selzer, that ORDINANCE'76-2810, as recorded in Ord.'
Book 10, pages 41-42, ESTABLISHING A PLANNED AREA DEVELOP-
MENT FOR A &"H APTS.,be finally adopted at this time. -Affirma--716

It was moved by Selzer,_ seconded by Balmer, to adopt RESO-
LUTION 76-365, Res. Book 36, pages 474-5, ACCEPTING PRELIMI-
NARY &'FINAL LSRD:.FOR A & H APARTMENTS. Affirmative roll call �7l
vote was unanimous, all Councilmembers present.
