A motion was made by Cain, seconded by Bluni, to defer until the next P&Z
meeting consideration of A-7602 petition submitted by Ty'n Cae, Inc. for
voluntary annexation of a 39.84 acre tract directly soutli and contiguous
to Z-7617 above. The motion carried unanimously.
Commissioner Blum requested that the Staff Report specifically include how
the land was addressed in past land use studies. Mr. Schmeiser indicated
that the Southwest Study is particularly relevant and the staff is presently
reviewing that study.
S-7635. Oakridge Estates, Part 1 - preliminar;r plat submitted by Willis M.
Bywater, Daniel W. Boyle, Attorney. North side of Linder Road ,just east of
Old Linder House. Date filed: 10/4/76. 45 -day limitation: 11/18/76a
referred to River£ront Commission: 10/21/16.
Commissioner Vetter stated that the Riverfront Commission recommended approval
of S-7635, Oakridge, Estates, Part 1, preliminary plat, and S -7E36, Limp Kiln
Farm Estates, preliminary plat, but expressed concern about tho.possihle sub-
division of lots, especially those lots close to the river that might possibly
have inadequate septic tanks., Tony Osborn, Associate Planner, stated that
septic tanks would have to meet the .regulations of the County.
Chairman Ogesen expressed concern about the 20 percent grade.of the street
and explained that City specifications allow no more than a 12,percent grade.
Because there is a possibility of the City annexing this land in the future,
he said, the grade might represent a major problem for emergency vehicles,
i.e., fire, ambulance, etc.
Angola Ryan, Assistant City Attorney, stated that the area of tort liability
fon municipalities is developing rapidly and this might include, approval of
a plat where there was a physical barrier to providing fire protection.
Mr. Willis M. Bywater stated that the Fire Chipf had not seen the property
until a few hours prior to the P&Z Commission meeting and he had indicated
no real problem with.the grade except undex icy condition's. Commissioner
Kammermeyer stated that he would vote against 1ipproval of the subdi'vi'sion
unless the grade could be changed. lie felt: it would be erroneous to giant

approval of a subdivision with a 20 percent street grade and, perpetuate
problems for emergency vehicles.
Commissioner Lchman questioned whether :gnother configuration of lots could
possibly eliminate the 20 percent grade. Mr. Bywater indicated that; this
would probably not be possible because of the topography of the arca.
After further discussion, a motion was made by..Jakobsen, seconded by Vetter;;.
to defer until the November 1.8, 1976 PF,2 Commission meeting consideration
of S-7635, Oakridge Estates, 'Part 1 -- preliminary plat on the north side
of Linder Road just east of Old Linder House, and to request: a written static
ment from the Fire Chief concerning the grade of the proposed street.. The
motion carried unanimously.
Commissioner Blum explained that the Commission was responsible for deters
the best use of the land which would be consistent with good planning for
entire community, He urged the applicants to consider ather.alternatives
that might be more consistent with good planning.
Commissioners requested that in the futun•e staff comments be in writing.

After discussion, a motion was made by Lehman, seconded by Vetter, :to.recomme
to the City Council approval of S-7636, 'Lime Kiln Farm Estates, preliminary,
plat, north side of Linder Road just northwest of Linder House, and to grant+
waivers to the following requirements:
(1,) the street located in the subdivision should be constructed at.a
width of 28' instead.of 18' and according to City specifications-;
and
(2) lot lines should intersect with the proposed street at angles .between
80°and 1Q06

It is further recommended that at such gime as the final plat is filed, an
agreement and assessment waiver be submitted to reconstruct the street
according to City specifications upon annexation.
The motion carried unanimously.

1. Paul Claves of the Urban Redevelopment Divisio'p discussed the Urban Renewal
project financing. A brief question/answer period followed the presentation_
a. Why can't we get an itemized statement of: where the money goes?
I can show you the budget between now and December, 1977. For last
year we had the $600,000 plus $412,000 plus $412,000 from the previous
year. The $600,000 remains unspent, and will be spent to cover costs
which exceed the 11,14 project budget. The $824,000 is to be sent to
purchase land by the City from the City as LPA.
b. Does the City intend to sell all of the Land?
I think the City may retain some of the land for parking. Whether or not
the mini parks are retained depends primarily on what is done with Dubuque
Street.
c. Are all of the funds from sale of land refunded to HCDA?
Yes, once HUD has been repaid. Any revenues will be used for community
development purposes.
d. Do you think the land will have increased in value?
We don't know. When we get the appraisals we will know for sure, but: I
think it may have decreased in value because Ijf the great increase in
construction costs.
e. How much of the Dubuque Street closure depends on the Department of
Transportation?
None.

The meeting was set for Tuesday evening at 7:00 p.m, in the Recreation Center
to be followed by the Ralston Creek neighbors me,:ting at 8:00 P.M. in the
Civic Center. Members were asked to bring in proposed questions for the
survey so that a consolidated list of questions could be drawn up,.
7. Vann suggested that after all neighborhood meeting ideas are received, in order
to expedite processing, that she and Wilkinson prepare a worksheet of these
ideas for members to prioritize. The idea met with committee approval.
8. Hauer stated a request of staff regarding the establishment of an absentee
Policy. This will be an item for next months meeting.
9. Dennis announced that the radio shows would be discontinued after the foWrth
show of the initial airings as far as City participation is concerned.
10. It was moved by Bolnick and seconded by Askerooth that the meeting be
adjourned. Motion carried.

Osborn presented preliminary plats for subdivisions on Oakridge Estates And Lime Kiln
Estates. Bill Bywater (Oakridge Estates) and L. W. Pete Knapp (Lime Kiln Fazq Estates
