Box 2267 Iowa City, Iowa 5240 Dear Mr. Breese: On behalf of the City Council I would like to thank you for your letter concerning solid waste disposal fees. Letters such as yours are needed to help Council obtain all view points so that they may make a logical decision. At the present time the City Council is exploring options ranging, frau rebates to businesses, industry and apartment complexes to: adding a refuse collection and disposal charge to all residential homeowners now picked up by the City crews. Also provided is a memorandum from the Director of Public Works concerning that, request and the status of development in that area. After the City Council approved the connection to the sewer for the buildi,tng constructed by Carol Barker, the City Manager discussed with the Department of Community Development and the Legal Department what action would be required to undertake involuntary annexation. The Manager concurs completea,y with the recommendation of the Director of Public Works and has already instructed the Legal Department to take staff action necessary to initiate involuntary annexa- tion proceedings. If the Council does not believe this action is appropriate, please inform me accordingly. The City CounciL will be asked at a later (late to formally approve initiation of the proceedings. Plastino RE: Request from LINAC, Ltd. to Hook Onto Sanitary Sewer on Hwy. 1 West Another request has been received to hook onto the City sanitary sewer outside of the City Limits. There is no physical problem that would preclude attachment to the sanitary sewer; however, there are several either things happening that should be of interest to Councii; 1. Most of the property transactions .in this area of the County have been done, in vioLati.on of State Law. In 1964, one tract was purchased and it has been sold off in bits and pieces to Harris, Hagen;, Nall, Boyd $ Rummelhart, Barker, Iowa City Coach Company, Powers, Lynch $ Sladek, and Linak, Ltd. State Law allows subdivision of an original parcel of property into only two individual parcels before it must be brought in under a subdivision plat, whether it be County or City. 2. The building being constructed by Linak, Ltd, does not have a building permit from the County and yet the footings have already been poured. 3. The building is in the flood plain of Willow Creek and very possibly, the floodway of Willow Creek. Contact with the County reveals that they have no regulations at all concerning flood plains and floodways, yet the maps received from the Federal Government show that this property, and most other properties near Willow Creek will be subject to severe, fairly frequent flooding. It appears that development in this area of town is out of control in the literal sense. Development is occurring in .a totally haphazard manner, parcels of property are being sold in violation of State Law, and buildings are being built in areas where they will be subject to frequent and severe flooding. It is recommended that City Council obtain the advice of the Legal Department on actions that can be taken to annex this area 'to the City. Public Works page 2. • Linak, Ltd. Amitary Sewer Hook -on i recommends that this area of town be ivmmediately annexed to the City.
