COMPLETE DESCRIPTION OF COUNCIL ACTIVITIES
DECEMBER 14, 1976
7:30 P.M.
Iowa City City Council, regular session, 12/14/76, at
7:30 P.M. at the Civic Center. Councilmembers present:
Balmer, deProsse, Foster, Selzer, Vevera. Perret arrived
at 7:40 P.M. Absent: Neuhauser. Mayor Pro Tem deProsse
presiding.
Dr. R. L. Dryer, 15 Seventh Ave. S., presented a state-
ment of rebuttal concerning the Public Works Director's memo
regarding traffic problems on 7th and Glendale Streets.
Lowell Cross, 1705 Lindale Rd., also appeared and urged adop-
tion of the proposed RESOLUTION AUTHORIZING TRAFFIC CONTROL
DEVICES IN THE VICINITY OF 7TH & GLENDAtE. Councilman
Vevera commented that the effect of the ordinance which would
reduce the speed limit on Rochester (making their intersec-
tion 10 blocks from the 35 m.p.h. zone) should be considered.
It was moved by Selzer, seconded by Perret, that Dr. Dryer's
statement be received and filed. Motion carried, 6/0, with
Neuhauser absent. Mayor Pro Tem deProsse noted this reso-
lution will be considered later in the meeting.
Steven Victor. representing ,Southgate Development Co.,
appeared and requested that Council reconsider their appli-
cation for a curb cut on S. _Riverside Drive to provide a
frontage road to the ten -acre tract of land owned by them.
Mayor Pro Tem deProsse suggested this matter be discussed
under Council Business.
Attorney Bob Downer, representing the Edwin Zastrows
and Bushnell's Turtle, Clinton Street Mall, appeared .and
formally indicated their interest in the College Block Build-
�ng. He further stated he would like to discuss this matter
at greater length at a later time. After being asked by
Mayor Pro Tem deProsse to explain past and present policies
on marketing this parcel, City Manager Neal Berlin pointed
out that the staff had been preparing documents for several
months for disposal of certain individual parcels; however,
U. R. Consultant Zuchelli explained there would be problems
in early marketing of the College Block property and had rec-
ommended that this parcel not be marketed independently at
this time for the following reasons: (1) the nature of the
public improvements as they relate to that building are not
resolved (which might have a bearing on the use), (2) the use
of the parcel adjacent to the building has a bearing on its
use, and (3) he is reluctant to have the City institute
piecemeal disposition of property. U. R. Program Coordina-
tor Glaves explained that in discussing the parceling of this
piece of land with interested representatives he indicated
to them that he was conveying his personal opinion, not that

The Council took notice of Planning and Zoning Commis-
sion's recommendations that Council approve Ty 'n Cae, Inc. 's
application to rezone from an R1A to an Rin zone and their
application for a Preliminary Large Scale Residential Devel-
opment Plan and Planned Area Development Plan and Plat,with
certain stipulations, for a 46.64 acre tract of land located
east of Mormon Trek Blvd, and north of the City limits adja-
cent to the City. Council also noted the P&z Comm.'s recom-
mendations that Council disapprove the application submitted
by Paul Kennedy to rezone a tract of land located
Winebrenner Dreusicke Ford from an R1A to an Ml south of
Zone and the
application submitted by HyVee Food Stores, Inc.,.to rezone
a tract of land located at the northwest corner of North Dodge
St. and North Dubuque Road from an R2 to CH and PC zones. It
was moved by Vevera, seconded by Balmer, to set a public hear-
ing on January 4 on an application submitted by Ty 'n Cae
Inc., to rezone the above tract of land from an R1A to R1B
Zone. Motion carried, 6/0, with Neuhauser absent.'
Mayor Pro Tem deprosse announced there w-m+ere o a an_
cies on the Committee on Community Needs with terms expiring
October 1, 1977. She indicated Council will be making the
appointments to this committee on January 18, actual/term be-
ginning on February 15th, and requested citizens be given a
30 days' notice.
Mayor Pro Tem deprosse announced that vacancies on the " y
Board of Examiners of Plumbers (one Master Plumber) and the
Board of Appeals would be readvertised for 30 days. It was
moved by Balmer, seconded by Perret, to appoint the following 21�i2
persons to the following boards and commissions:
Parks & Recreation Commission: Flo Stockman 2514 Poto-
mac, a one-year term expiring 1/1/78 accomplishes
continuity regarding expiration of terms, due to addi-
tional member allowed under the new Ord.); and HQb
Crum, 2934 Court, with 4 -year term expiring 1/l/881.

Riverfront Commission: Sam Fahr. 6 Knollwood Lane

Human Relations Commission: Mori Costantino, 407 Brown;

Mayor Pro Tem deProsse requested suggestions for topic-,
that should be discussed with Congressman -elect Jim Leach at
Monday's meeting. Councilman Balmer suggested purchase of
the old Post Office for a nominal sum. Councilman Selzer pro-
posed (1) Discussion of Federal Revenue Sharing, (2) Problems
of small City Governments vs. Federal Bureaucracy, and (3).
Frivolous spending by Federal Government. Councilman Perret
suggested discussion of UMTA providing operating subsidies
to municipalities under 50,000 population and concern with the
definition of a Standard Metropolitan Statistical Area.
Councilman Foster called attention to two matters he had
discussed with the Public Works Director, (1) the difficulty
for traffic coming from the frontage road getting on Keokuk
because of the right turn on red on the Bypass, and (2) need
for, at the Governor/Dodge intersection, an arrow turning
right lane traffic to the right and left lane traffic to left
turn and straight ahead. It was pointed out by the City Man-
ager that these suggestions would have to be approved by the
Highway Commission. 2197
It was moved by Selzer and seconded by Vevera t6 approve
the application from Midwest Realty and Building Corporation
for a permit to construct a drive approach on Highway Right -
of -Way (for Wendy's on Riverside Drive), if approved by the
Iowa Department of Transportation. Steve Victor, represent-
ing the requestor, was present to answer several questions
concerning the frontage road, access easement on Bypass 6,
consideration by Planning & Zoning and Riverfront Commissions,
recommendation by Public Works and Traffic Control, compli-
ance to Iowa Natural Resources Council requirements, plans
for flood zone area. John Kammermeyer, Planning and Zoning
Commissioner, presented a summary of preliminary discussion
held by their commission, noting a consensus that informally
they were generally pleased with plans for Wendy's. Roll call
on the motion: Balmer, Foster, Selzer, and Vevera voting
"aye"; deProsse and Perret voting "no", Neuhauser absent.

Councilman Selzer commented in reference to the con-
versation yesterday concerning the willingness of this City
Council to work with the Iowa City Chamber of Commerce for
the betterment of Iowa City, noting that he was extremely 14 9
pleased with that arrangement.
Councilman Perret advised that because of the lateness
of the hour, he would defer his report on the Denver meeting
because it would be quite extensive. Councilwoman deProsse .
outlined the activities she attended at this meeting includ-
ing a Sunday morning Transportation Policy committee meeting,
leading a Trans. Comm. roundtable discussion in the afternoon;
on Monday morning, the General Session, and in the afternoon, workshop
on Marketing Public Services: How to Improve Productivity;
Tuesday morning she toured exhibits, attended the luncheon
and the afternoon session on Economic Development Tactics;
Wednesday's morning seminar was on Municipal Finance, prac-
tices, and auditing, and afternoon, a business session. ;ka 00
The City Manager called attention to the League of Iowa
Municipalities Board Meeting to be held at the Civic Center
at 2:00 P.M. on Dec. 15th with a reception at the Fieldhouse
at 5:30 P.M. He indicated he had received a letter from the
League asking for interested Councilmembers to serve on a —
legislative support group; and stated that if someone was in- 0I
terested, they should let him know.
Mayor Pro Tem deProsse called attention to the Resolu-
tion Directing Staff Implementation of Certain Street Clo-
sures and Restrictions in Connection with Urban Renewal Proj-
ect Iowa R-14 as presented. She proposed several changes
which were then discussed by Council. The final amendmeiits
were in the following form: (1) 45 to read, "Washington
Street between Capitol and Madison Streets, to be designed
with emphasis on transit and pedestrian traffic but allow-
ing limited automobile traffic."; (2)a new #6, "Washington St.
between Capitol and Clinton Streets to be designed with em-
phasis on transit and pedestrian traffic but allowing limited
automobile traffic, if possible."; (3) Changing present #6 to
#7 and present #7 to #8;(4) The new #8 to read, "Dubuque
Street from Washington Street south to the alley between
College and Burlington Streets, limited to emergency, transit
and service vehicles_" Scott MacDonald from consulting firm
of Zuchelli Hunter & Associates was present for discussion.
It was moved by Foster and seconded by vevera to adopt the
amendments as discussed previously. There was further dis-
cussion until Councilman Foster called for the question. Mo-
tion carried, 5/1, Selzer voting "no". The vote was then
taken on the motion to amend the Resolution. Motion carried,
6/0, Neuhauser absent.. Robert Welsh, 2526 Mayfield Road,ap-
peared concerning area for mass transit. Richard Gibson,

Director of Facilities Planning and Utilization for the
University of Iowa, appeared registering the University's
concern that Council reach decisions only after full con-
sideration of the potential impact on the University. They
have particular concern about the final resolution of the
treatment for Washington Street between Madison and Clinton
and Capitol Street between Washington and Burlington. They
were pleased to note the willingness to alter the status of
College Street between Capitol and Madison to a pedestrian
orientation. It is timely as they are in the final planning
stages for Lindquist Center for Measurement, Phase II. John
Kammermeyer,.P & Z Commissioner, expressed the Commission's
reservations about the closures, asking that Council not build
in any rigidity or any specifics in the Urban Renewal plan
document, to keep as flexible as possible. Councilman Balmer
asked that these closures be explained to the public, with
maps. It was moved by Foster and seconded by Perret that
Resolution #442, recorded in Res. Book #37, pages 642-644,
DIRECTING STAFF IMPLEMENTATION OF CERTAIN STREET CLOSURES AND
RESTRICTIONS IN CONNECTION WITH URBAN RENEWAL PROJECT IOWA
R-14, AS AMENDED, be adopted. Upon roll call deProsse, Foster,
Perret, Selzer, Vevera and Balmer voted "aye", motion carried,
6/0, Neuhauser absent. This resolution affects portions of
the following streets: Capitol, College, Washington and
Dubuque.

It was moved by Foster and seconded by Perret to adopt
Resolution #443, recorded in Res. Book #37, pages 645-646, CON-
CERNING DESIGN SERVICES FOit PU3LIC FACILITIES IN CONNECTION
WITH URBAN RENEWAL PROJECT IOWA R-14. Robert Welsh questioned
if the parameters for the architect to work under we;e in the
Resolution. The City Manager advised that the staff will be
working with the consultant to prepare parameters before inter-
viewing the architect and making recommendation. Council will
have the final decision; however, any concerns about the
parameters should be expressed at this time. Welsh
noted concern -for -costs of .the pedestrian ways
and malls, asking Council to keep in mind the maintenance
costs also. The resolution authorizes interviewing for a
consultant who will provide supervision services in connec-
tion with the construction of the public facilities in the
central business district. Roll call on adoption of the Reso-
lution: Ayes: sFoster, Perret, Selzer, Vevera, Balmer, and
deProsse. Motion carried, 6/0, Neuhauser absent.

Council discussed a request made by a local businessman
to allow free parking and bus rides for one day for Christmas
shoppers. There was not enough support by COuncilmembers to pass
a resolution allowing this.

Mayor Pro Tem deProsse declared a five-minute recess.
It was moved by Foster, seconded by Vevera, that ORDI-
NANCE 476-2821, as recorded in Ordinance Book 10, pages 78
and 79, SETTING SPEED LIMIT ON ROCHESTER AVENUE FROM FIRST
AVENUE TO SEVENTH AVENUE by reducing it from 35 m.p.h. to
25 m.p.h., be passed and adopted. Affirmative roll call vote
was unanimous, with Neuhauser absent and Perret temporarily
absent. Ordinance adopted, 5/0.
Patricia Passmore, President of H.M.H.O., appeared and
spoke concerning problems of mobile home tenants. Mary Ann
Zook, Sunrise Village, appeared and was advised to contact
Assistant City Attorney Kushnir concerning what contact he
has had with the Johnson County Supervisors. It was moved
by Foster, seconded by Perret, that the ORDINANCE AMENDING
ORDINANCE NO. 2359 (Chap. 9.54 of M.C.) BY ENACTING A NEW
SECTION WHICH PROHIBITS RETALIATORY CONDUCT AGAINST TENANTS .
BY THE OWNERS AND OPERATORS OF MOBILE HOME PARKS be consider-
ed and given second vote for passage. Affirmative roll call
vote was unanimous, with Neuhauser absent. Second considera-
tion given.

failed, 2/4, with Neuhauser absent.

fer consideration of the RESOLUTION REMOVING TWO METERED PARK-
ING STALLS ON THE SOUTH SIDE OF JEFFERSON STREET EAST OF THE
INTERSECTION OF JEFFERSON STREET WITH LINN STREET ESTABLISH-
ING THIS AREA AS A LOADING ZONE - 15 MINUTE STANDING. Motion
to defer carried, 6/0, with Neuhauser absent.

STREET WITH GILBERT STREET, PARKING METERS AND PROHIBITING
PARKING IN THAT AREA. Affirmative roll call vote was unani-
mous, with Neuhauser absent.

Councilman Balmer moved, Councilman Selzer seconded,
to adopt RESOLUTION #76-446, as recorded in Resolution Book
37, pages 655-657, AUTHORIZING THE TRANSFER OF REAL PROPERTY
FROM THE CITY OF IOWA CITY ACTING AS LOCAL PUBLIC AGENCY TO
THE CITY OF IOWA CITY, IOWA; AND AUTHORIZING THE TRANSFER OF
FUNDS IN PAYMENT THEREFORE. Affirmative roll call vote was
unanimous, with Neuhauser absent. This Resolution authorizes
transfer of $824,000 Of Community Development Block Grant fund
to purchase urban renewal land from the L.P.A.
It was moved by Perret, seconded by Foster, to adopt
RESOLUTION #76-447, as recorded in Resolution Book 37, page
658 and 659, OF NECESSITY TO AUTHORIZE THE CITY TO ENGAGE IN
A HOUSING REHABILITATION PROGRAM. Affirmative roll call vote
was unanimous, with Neuhauser absent.
