pressed concern about the waiving of re-

cussion, Council agreed to an agreement
with'BDI that if there were any future'

As a private citizen, Richard Blum asked

the sewer system. He pointed out that the developer would sign an
agreement that they would pay for'the entire reconstruction of the sewer
system at that time. This agreement could be made binding on successors.
Hayek explained that when a City -attempts to contract or covenant to
vary the terms of zoning, Courts split 50/50 on whether or not it is
spot zoning and illegal.
The Mayor noted that it would be helpful to discuss the suggestion made
by Schmeiser; and try to get the problem resolved as-soofi`as'-the'y-aan%
and agreed that Council should be as helpful,to`them-as�they possibly
can.
The City Manager noted that basically the Council had the information on
the request from Linak, Ltd., to connect 'to-the'City''sanitary'sewer?:`'',He
advised that the staff would proceed with involuntary annexation unless
Council directs otherwise, but would need specific Council direction.
The Mayor suggested that copies of the County subdivision ordinance -:lie.

Concerning evaluation of Council, Councilwoman deProsse' noted concern
over.,A. Policy: -Performance Criteria #1. The'City Aanager"pointed out
that the whole question of evaluation and performanceis not-ari exacto
science. The Mayor suggested looking at the evaluation processusa
constructive idea. She expressed reservations"concerning-the process
questioning if it was appropriate for the Department Heads to be evaluating
the Council (citizens elect Council), also noting that':the'Departnent`T
Heads were the best qualified to evaluate the City Manager. The Council
can evaluate him from their perspective as he deals with then and the
community. The Mayor asked whether or not Council wanted to discuss the
evaluations in executive session. Six councilers agreed to executive
session to be held on December 8th at 7:30 P.M. for discussion of
individual evaluations of the City Manager.
GTHER
Mayor Neuhauser pointed out that one appointment had been received from
Johnson County for the Riverfront Commission. A newspaper article
stated that the two others had also been named, so when the letter with
the two other names is received, Council can appoint all three members
at one meeting.
The City Manager stated that the bricks used on Washington Street Project
did not comply to the specifications. He reminded all that there would
not be any Council meetings on November 29th or 30th, as 4 members will
be absent.
Councilman Perret called attention to the representation from the Council
on the Nominating Committee for Johnson County Regional Planning Commission,
and Councilman Selzer suggested the the Mayor be appointed. All agreed.
Councilman Balmer questioned if the city was talking to the University
about the hospital expansion, or if JCRPC was. The City Manager stated
that if anything is going to be done, the City Council is going to have
to take a strong policy position to make that happen, as it will not be
done by JCRPC and not by University Heights. The Mayor stated that she
would be meeting with University President Boyd and talk about the
Comprehensive Plan and the role she hopes that the University will play
in helping the City determine what is going to be going into the Compre-
hensive Plan, particularly as it relates to the whole question of public
improvements that the City has to provide, so that the City has a way of
knowing what's being planned. She noted that it was important that it
comes from President Boyd. She pointed out the City is bearing a consid-
erable burden because of the University. Councilwoman deProsse brought
up the issue of the River Corridor Sewer.
Councilman Balmer suggested going back to the $1.00 fine for parking
tickets. The City Manager advised that the staff was opposed to this,
as it is hard, almost impossible, to determine the date the fine was
actually paid. It was suggested that the fine be $1.00 if paid in
person within 24 hours, at the Parking Ticket Office or at the Police
Department on Saturdays. The City Manager noted that the Ordinance
spells out the days that the meters are not enforced.

The Iowa City City Council met in informal session
on the 23rd day of June, 1975 at 1:00 in the Conference
Room at the Civic Center. Councilmembers present: Czar-
necki, deProsse, Neuhauser, Davidsen, Brandt. Staff members
present: Berlin, Hayek, Wollmershauser, Stolfus, Kraft,
Strabala, Taylor. Mayor Czarnecki presiding.
The Mayor announced discussion of: 1) Vacation of
streets in the Urban Renewal project area, and 2) Urban
Renewal.
City Manager Neal Berlin pointed out Council's concern
it this was the time to take action of,vacation of streets
in the Urban Renewal area. City Attorney John Hayek advised
that Council could l) vacate now, 2) not vacate, or 3)
vacate now with an effective date later, and noted concern
if the deferral was after the first of next year, when the
Council changes. Urban Renewal Director Dick Wollmershauser
pointed out that it was urgent to vacate Capitol Street
south of Burlington, as to convey the property to Old Capitol,
the property should be vacant. Dubuque will be retained
under City ownership.
Attorney Jay Oehler advised that they needed to know
that Dubuque Street is going to be a pedestrian mall, but
not a mall until their building is pretty well built, for
construction traffic. It was determined that the streets
to be conveyed to the developer were the alley in Block 101;
College Street, Clinton to Capitol; the alley in Block 64,
the alley in Block 83 is already vacated, and will be con-
veyed; the alley in Block 84, part of the alley in Block 82;
part of the alley in Block 102; Capitol Street, Burlington
to Court. Those to be retained in City ownership will be
Dubuque Street, Washington to the south edge of College;
College Street, Dubuque to Clinton; College Street, Dubuque
to Linn; Capitol Street, College to Burlington; Dubuque Street,
College to Burlington; and Capitol Street, College to
Washington. deProsse noted she had changed her mind con-
cerning the closing of Dubuque, because of the impact of
the Mall on downtown businesses. Council discussed the timing
for the deferrals. Freda Hieronymus stated that they needed
assurance on the street closures and could start Plaza I by
September 1st. The Mayor noted general concensus to put
the first reading of the Ordinance on the agenda for the
24th. Attorney Hayek advised that Council could amend out -

be only to vehicular trAffic, and the utility company
would pay the cost of utilities and move them before the
land is conveyed. Also discussed was the vacation of
the intersection of College and Dubuque Streets. Kraft
reported that any changes or amendments should be conveyed
to the engineer and legal representatives of the utilities.
Mayor Czarnecki announced discussion of the Staff
Report on Urban Renewal. Assistant Finance Director Pat
Strabala was present to•explain the two financial charts
previously distributed. Wollmershauser presented the most
recent changes in the addendum. Council discussion included:
the next to last paragraph on Page B of the addemdum;
lease agreement on the Washington/Clinton Street parking
lot; penalties and incentives; provision concerning penalties
relative to the deposit, and in case of a default, the pro-
cess used for price for the payment of the land;• the third
addendum to Part I, September 1974, further review by the
attorney necessary; the powers of the Design Review Board;
option of the developer to freeze tax assessment on proposed
construction; other revenue sources mentioned on Page 11
of the Staff Report are parking revenues; in the last sentence
on Page B of the Staff Report, proposal can be reasonably
accomplished; use of Housing and Community Development Act
mones; commitment to build first parking facility; City's
bonds have a Triple -A rating; on Page 6 of the Staff Report,
increase in construction costs, increase in taxes, and lag
effect is a disadvantage; rumors over townhouse property;
on Page 17 of the Staff Report, financial arrangements
need to be developed. The Mayor pointed out Muscatine's
incremental financing, and bypassing of a referendum. There
was no apparent concensus by the Council to approve the
amendments. Coucilman Brandt left the meeting at 3:25 P.M.
Freda Hieronymus requested a Council vote at Tuesday's
informal session, so that they will know if the addenduM
is acceptable. The Mayor advised that the discussion
would be continued at 4:00 P.M. on Tuesday to go over the
questions raised, the Clerk to notify Councilman Brandt.

Mayor Mary Neuhauser presiding. The Mayor asked that each Councilmember,
list concerns to be discussed with Congressman -elect Jim Leach on
December 20th, so that an agenda may be prepared.
ZONING APPLICATIONS
TSenior Planner Don Schmeiser was present to explain the application for

here also an application for a preliminary large scale residential
development, planned area development and preliminary plat combined.
These will be considered with the ordinance rezoning the tract. The
staff says that the plat is acceptable and the developer had done a lot
of revision. Council will be setting a public hearing on the rezoning.
Mayor Neuhauser related a call received from Kent Angerer concerning
BDI. The City Manager advised that the staff has been instructed to
have a Resolution on the Council agenda next week approving the BDI' .

plat. The Planning and Zoning Commission is appoin

In answer to Councilman Balmer's questions, Schmeiser explained the
enned re uest for a C2 zone, Item 4a(3). The salvage yard is non-
conforming—a-n-d there is a question concerning the expansion of tle
present building with an apartment upstairs, which will have tobr=xplored
when they come in for a building permit. Presently the property is
bounded by 1.11 zone on the North, West, and East, and RIA to the South.
This entire area will be dealt with in the Comprehensive Plan review
process. Attorney Hayek pointed out a change in law provides that the
City does not have to bring the area in as RIA, but can bring in at the
zone they think is correct, after a public hearing.
It was pointed out that the vote by Planning and Zoning concerning the

is a sight clearance problem. The Mayor noted that the southwest corner

Councilman Balmer suggested that the public hearing be scheduled on the
HCDAet for January 12th, as requested in the memo from the City
Manager on December 9th, and set for discussion on the 20th. The City
Manager advised that it had been so scheduled, as Andrea Hauer would be
present on that day.

Regarding the City Manager's memo of December 10th concerning the City
Participation in the Chamber of Co`rce, Councilwoman deProsse commented
that the City should not be charging the Chamber for the maps. She
objected to the City being a paid member of the Chamber. From an ethical
standpoint, she noted that the City probably should not belong to organi-
zations that come down and lobby for or against particular items. The
City Manager stated that he thought there were benefits in the City
belonging. He agreed that they come down and proselytize for their
Positions, but noted that it was more critical that the City proselytize
at the end for our positions, and this is one way that it can be accomplished.

expenditures in traffic are supported by road use tax, so they would be
legitimate expenditures.

Tree Or_` dCe� and suggested that the COUDCil write a letter to the
School District suggesting that altho they are not required to comply,
that they are made aware of the requirements. Mayor Neuhauser had
discussed the matter with Barbara Timmerman of the School Board.

before hiring Zuchelli. Consultant Zuchelli recommended not allowing
disposition of College Block Building, or Dottie Dunn parcel. Glaves
recounted his actions concerning disposition of this parcel. The City
Manager noted that the staff would work up some information on the
problem.
Mayor Neuhauser asked Mr. Zuchelli for an explanation of why there would
be less development than contemplated, as he had advised the businessmen
at the breakfast. Zuchelli called attention to the fact that if the
amount of diversion of existing sales from existing competitive operations,
his concern is that it is public policy to not encourage development to
such a density, that you create profitability, ability to maintain
properties and encourage disinvestment in existing non -renewal property.
He stated that information would be available on how many public dollars
to spend to protect the existing tax base as well as to move to create a
new tax base. From 10 to 1 down to 6 to 1 factor is a measurement to
balance the public investment to get private reponse. Glaves advised
that the Attorney had insisted that the purchase sequence be identified.
MacDonald stated that the way the budget is set, the City can buy all
the parcels but the super -block. Zuchelli commented that when they come
up with the financial plan by February, he is hoping to come up with a
way to leverage 83 and 84 out, as well. He stated that the acquisition
sequence does not have anything to do with the disposition sequence.
Zuchelli advised he would be back in January. The staff and consultant
will be setting parameters for the architect tonight. Several key memos
on marketability will be submitted to Council. Ile stated that generally
all is on schedule. He noted that he will be meeting with the Library
consultant within the month.
Concerning the development of the post office, he advised the City
Manager on action Council should look into. Under an Executiye Order,
they may release the facility at no cost.
It was moved by deProsse and seconded by Foster to go into executive_
session to discuss appointments_ to boards_and_commissions. Upon roll
call Balmer, deProsse, Foster, Neuhauser, Perret, Selzer and Vevera
