It'•contains some unwarranted assumptions :ge is " stubborn and inflexible--,; Insofar as this refers to comments . made by us, it is a personal reaction not borne out by the record of our previous conversations, Ie 2: "--suggested that the City cut deep grooves--; Nowhere in the pro -m posal vie submitted was there any mention of the depth of the cuts; indeed, the only specification made was that the length:of the rumble strips be at .least equal to the wheelbase-length,of the average motor vehicle, axes 1 & 2; Citations of the Iowa Code, Sections 321.235,*.255, 364.12(2) ! and Section 657,2(5)s In general, we do not feel it* t any more g ' proper for an engineer to interpret the law than for a professor of bio- chemistry to do so, This is an area proper to lawyers and the courts. Fie shall mention another legal opinion later. Page 4; "Stop signs should not be used for speed control": This is.a correct citation from the Uniform Code, Again, Mr. Plastino loses sight of the fact that speed control is not the major reason-;* we quest a 4 -way stop sign at the intersection of 7th Ave. and Glendale .. Road. We do wish to control the traffic. Any speed control would' be an added bonus. 2. Other professional opinions on the soecific allegations, Idr.. I'iorris Burr Resident Engineer, Johnson County Iowa Dept, of Transportation a- rumble strips are not simply grooves out into the roadway. They are areas in vrhich the level of the surface is cut 3/8' loner than the prevailing grade line. The cuts are made 4" wide and of Suitable length at an angle of loo to the direction of travel. They drain readilywhen so made. In his opinion they do not cause road damage from freezing and thawing.. b- to his knowledge, they have been used largely or exclusively In advance of an intersection as a warning 'device c- to his knowledge, lack of mention in the Uniform Code of Traffic Control Devices does not make a device illegal or ineffective. (NOTE• We realize this may be a case of anotheriengineer -Snterpreting the law, but at least iiT. Burr is on a par with Mr. Plastino. ) ZZ I4r. William Carmine Office of.Traffic Engineering and Safety, Aires Office Iowa Dept. of Transportation a- rumble strips should be out curb-to-curb`to promote good surface drainage. v b- to his knowledge there have been no complaints as .to safety, either to motorists or bicyclists, where rumble strips have been employed in the state highway system. c- he was not -certain that rumble strips were even mentioned in the Uniform Code of Traffic Control Devices. (In fairness, it must be repeated that this was a telephone conversation, with no opportunity for reference. However, he is in the engineering and safety office of I.D.O.T.) d- to his knowledge, lack of previous use in urban areas was no bar to their future use. (NOTE: Again, we recognise this opinion may not have legal standing.) "? e- in his opinion, rumble strips are recognised as_safe and effective` In the State of Iowa. ' f- in his opinion, rumble strips should not be out parallel to the direction of travel; neither should they be cut is the area where a motorist might reasonably be expected to be applying his or her brakes. (NOTE: This very positive statement leads us to alter the design of our previous proposal, in keeping with good engineering practise) Our earlier idea of "checkerboarding" the intersection is clearly inappropriate. J. Mr. William Sueppel 100 S. Linn St. Iowa City a- when asked about some of the citations to the Code of Iowa, I,r. Sueppel gave his opinion that Section, 657.2(5) was of dubious application in the present instance. He did.not comment: on the remaining citations. .-,T General Comments; - 1.,The analcgiesof broken sidewalks, muddy bikeways, and so forth, may be correct, but they make for a very narrow` Interpretation; Is it suggested that we should do away with sidewalks and bikeways, an or not build y more them, because they expose the. Clty:to the perils of law suits.? Should we ban motorists from the city; streets, or not build new streets, because one or more motorists' - might find some grounds for a law suit?' 2. The whole'problem of safety and effectiveness has been rebutted by comments from other engineers and a lawyer, cited above., The engineers we cite are, like Mr. Plastino, of known professional competence in their field. The lawyer has had experience as the State Director of Public Safety, 3. If 2•ir. Plastino's construction of the law is correct, then the; City is currently in violation of the law. The Lexington Avenue installation includes sto signs where there is no intersection. It is therefore hard to view this as other than a s eed`control device. In addition it includes a rumble stria of -sorts. 4. It seems clear that this Council must now make a policy de- cision. It may wish to accept the opinionexpressed by -Mr. Plastino, "-- there are times when we must recognize our limitations and say +noln, or it may wish to take the steps we have recommended to relieve part or all of a serious problem. 5. We think the language of the Resolution before the Council is particularly appropriate, in view of the need to modify our initial presentation in light of the above engineering advice; We urge you to adopt the resolution. z r i s "'..fe+ .. v:;'C'Sv. ._.._r. +. ` ,. _r.•r '; n v t ' f1 'a¢ y r 1: ` 3 Y,?y xh'.a, .?;I+ +.___ri_'•.. 5r,'j r 'h._ x.aau C. • Mayor Neuhauser City Hall Iowa City, Iowa •C^ "1` - - _ 1976 November 20,1076 Dear Mayor Neuhnuser, As a newcomer to Iowa City (Aug -^76), I feel I must write to you and tell you how I feel about the deplorable street conditions here in Iowa City since the first snow fall on Frtday. On Monday morning as I was driving my twins to 'nest High Schoo, ;•fy_.de Green was slippery, Benton, west of Sunset, Morman 'trek and Melrose, rest of Morman Trek were, t.o put it Simply, dangerous to drive on. Melrose, in front cf West H1. had traffic blocked so that some students were an hour late for class ( an icy hill on the approach to the school vas the culprit). Later in the day the bridge on Burlington near Riverside was also icy. The streets in general both thru and side were trecherous. The school buses are another issue here. I shutter when I see them driving down all those side -streets, filled to the brim with our children. Are you going to wait for a serious accident before you consider this problem? One woman was hit by a car downthown because of icy street conditions. There were numerous fender benders. Is this to be the fate of Iowa City for the rest of a snol+ ladders winter ahead?
