General Comments; -
1.,The analcgiesof broken sidewalks, muddy bikeways, and so forth,
may be correct, but they make for a very narrow` Interpretation;

2. The whole'problem of safety and effectiveness has been rebutted
by comments from other engineers and a lawyer, cited above., The
engineers we cite are, like Mr. Plastino, of known professional
competence in their field. The lawyer has had experience as the
State Director of Public Safety,
3. If 2•ir. Plastino's construction of the law is correct,then the;
City is currently in violation of the law. The Lexington Avenue
installation includes sto signs where there is no intersection.
It is therefore hard to view this as other than a s eed`control
device. In addition it includes a rumble stria of -sorts.
4. It seems clear that this Council must now make a policy de-
cision. It may wish to accept the opinionexpressed by -Mr. Plastino,
"-- there are times when we must recognize our limitations and
say +noln, or it may wish to take the steps we have recommended
to relieve part or all of a serious problem.
5. We think the language of the Resolution before the Council
is particularly appropriate, in view of the need to modify
our initial presentation in light of the above engineering advice;

Dear Mayor Neuhnuser,
As a newcomer to Iowa City (Aug -^76), I feel I must
write to you and tell you how I feel about the deplorable
street conditions here in Iowa City since the first snow
fall on Frtday.
On Monday morning as I was driving my twins to 'nest
High Schoo, ;•fy_.de Green was slippery, Benton, west of
Sunset, Morman 'trek and Melrose, rest of Morman Trek were,
t.o put it Simply, dangerous to drive on. Melrose, in front
cf West H1. had traffic blocked so that some students were
an hour late for class ( an icy hill on the approach to the
school vas the culprit). Later in the day the bridge on
Burlington near Riverside was also icy. The streets in
general both thru and side were trecherous.
The school buses are another issue here. I shutter when
I see them driving down all those side -streets, filled to the
brim with our children. Are you going to wait for a serious
accident before you consider this problem?
One woman was hit by a car downthown because of icy
street conditions. There were numerous fender benders. Is
this to be the fate of Iowa City for the rest of a snol+
ladders winter ahead?

sponsored several meetings with area service clubs and staff
members of the Iowa Department of Transportation (DOT), to pro' -
mote the construction of Freeway 518: These meetings have been

Duties: In appropriate cases and subject to appropriate conditions
and safeguards, make special exceptions to the terms of the ordi-

granted under Iowa Code, Chapter 414.12(3) and Iowa City Municipal
Code 8.10.2811 1(d) may only be granted in the case of ,unnecessary
hardship." The hardship must be substantial, serious, real, and of
compelling force, as distinguished from reasons of convenience, maxi-
mization of profit or caprice.
