consider annexation of that area.
City Mgr.,' Berlin '� called attention to the
Certificate of Eligibi,lity for Police Officers
presented; by the Civil 'Service Commission. Moved

Hayek explained thejudges ruling regarding
Frantz/Mt. Prospect TV/Stormwater Management Ord.
lawsuit. He also advised that he and the City Mgr.

called attention to new _legislation giving IDOT
jurisdiction in certain areas.

Council discussed whether or not the Resources Conservation Commis-
sion should make a recommendation to the Dept. of Energy. Council
policy on recommendations was discussed. Representatives of Boards and
_ Commissions could be invited to discuss this matter at a later informal
meeting. It was suggested that'a disclaimer could be added to any
recommendation to the effect that 'this recommendation is not a recommen-
dation from the policy-making body, the Council.'
Regarding the petition from Brookland Park neighborhood residents)
for closure of exit -entrance to Melrose Ct. at Myrtle Ave./Greenwood
Dr., the following persons appeared: William Klink,, 219 Melrose Ct.;
John Kammermeyer, 2 Woolf Ave. Ct.; Mark Wolraich,'410 Melrose'Ct.
Staff will investigate and:report.
Mayor Vevera announced the continuation of the public hearing on
the application submitted,by Wagner -Murphy Foundation to rezone an 80-
acre tract of land from A2, County Resort, to M1 and Cl zones. Sr.
Planner Schmeiser outlined the.proposal, noting that:Parks & Rec. Comm.
and Riverfront Comm., had given their approval of.'the annexation. Atty.
Hayek recommended further discussion by Council of information to be
presented by Staff which would answer questions asked. Moved',by,Perret,
seconded by Neuhauser, to.further continue the public hearing to5eptember
19, 1978 at 7:30 P.M. 'Motion carried unanimously, 6/0, Erdahl absent. '

Public hearing was held on the application '3ubmitted by Jehovah's
Witnesses to rezone.a tract'of,land located at 1804 W. Benton St..(Kingdom
Subdivision) from RIA to R2 none. No one appeared.
Public hearing was held onla proposed ordinance amending the Zoning
Ord. by establishing provisions for elderly housing,in,the CBS Zone. An
innovativeparking' lot plan has been proposed., No one appeared.

of housing code provisions. He will present his inquiry 'in'writing,

relayed the Commission's request to make`a recommendation on the vacation
of a'portion'of S. Capitol St. for construction of the new jail facility.
There were no Council objections'. He also called attention to the
problem regarding blockage of the sidewalk from the Law College by
CRANDIC trains. Staff will add this item to the agenda for the next
City -University meeting.
Public hearing was held on the plans, specifications, form of:
contract and estimated cost for Governor Robert Lucas Square and fountain

that KXIC reporter Dick Hogan was leaving Iowa City and wished him well

consider annexation of that area.

The proposed reconstruction of the Iowa Ave. Bridge; as outlined in

picking up paper to be recycled. If they have not corrected the problems
in a week, the contract will be cancelled.
City,Atty. Hayek explained the judge's ruling regarding`Frantz/Mt.
Prospect IV/Stormwater Management Ord. lawsuit. He recommended that
Council not appeal the ruling. Mt. Prospect IV will not have to comply
with the stormwater management provisions. He also advised that he and
the City Mgr. are meeting with Webb Cramer of the Rock Island RR to
discuss the recent 'citizen complaints. He called attention to new
legislation giving IDOT jurisdiction in certain areas.

Larry Schnittjer, MMS, explained the type of street they are
proposing has been very effectively used in Cedar & Linn Counties.

P & Z Commr'. Blum stated their commission's policy re consideration
of extraterritorial jurisdiction applications. P & Z examines the
potential for foreseeable annexation of an area of land within a

The fact that an annexation policy was needed was reiterated.

There was favorable discussion for an intermediate set of standards
for rural subdivisions between the enforcement of all of the .

regarding lift stations.

asked to consider legal implications of denying or approving
lift stations for various developments, and Public Works will

Recreation Comm.

Parks & Rec.'recomnends it be used for development of facilities.

P & R Dir. recommends that $40,000 be used as match with B.O.R.
funds 'to acquire park land and $30,000 be used for Willow Creek
tennis courts.

Some,Councilmembers questioned whether or not the uses proposed
