Comm Comment: This property. consists of a 20 foot by 120 foot. strip adjacent to624S. Gilbert Street and the Rock Island Railroad tracks. The City held a public hearing and authorized the execution of a quit claim deed fora larger g parcel which con - twined this property on December 7, 1976. Since Russell Krall, the adjoining property owner, and the City have now reached j agreement on a purchase price of $2,400, it is being resubmitted 9 to the Council. Page 3 Item No. 3 - PLANNING AND 7.ONING ITEMS. `�. Consider a resolution approving the final plat of Bryn Mawr Heights, ,Part 11. S-7830. Comment: The Planning and Zoning Commission, at a regular meeting held on September 7, 1978, recommended by'a six to zero vote ap- proval of the subject subdivision located south of Denbigh Drive and west of Sunset Street subject to approval of the legal papers i and the location of sewer easements and center line curves. This recommendation is consistent with the staff's recommendation pre- sented in a Staff Report dated September 7 1978, which was at- i tached to the agenda of September 19, 1978. The contingencies noted above have been resolved with the exception of the signing i of the legal papers. The applicant's attorney has indicated that @ the legal papers will be signed before 5:00 P.Mon Friday, Sep- _;.:, tember 22,.:1978. Specifically, Chapter 403A.5 of the Iowa, Code indicates that the City Council must give majority approval to the recommendation contained in the report that the subsidy, in the form of land write-down he provided to the Ecu- menical Housing Corporation. (Second conoid- } f' oration). t Comment: Since the new criminal code went into effect in January of 1978, i bars have not been allowed to feature nude dnncers. In a number f of Iowa,communities, tavern owners'have created a separate busi- nese adjacent to the tavern which features nude dancers but does not serve liquor. ,Such an arrangement frustrates the intent of the legislature and is a triumph of form over substance. It would create law enforcement problems because 'there would be'a tendency of tavern customers to want to take their drinks with ahem nextdoor to watch the dancing. While we, might he" ab ' prohibit the adjacent room under the present code, this amendto mend will remove any doubt. The provision that business may not be within 500 feet from each other has been added to prevent a concentration of such businesses In one area.
