To the Honorable Mayor and Members of the City Council of Iowa City, Iowa:
I am inclosing Page 4 of the History of the CongregateMeals Program,
to Add to the first three pages which I filed with your Board in April of
this year. I am sending this for the information of your Honorable Body,
and also for the information of the, Council of Elders, which group now
has offices in the Civic Center.
I was glad to receive Mn Berlin's letter of May 18. It is a good
letter because, in a way; it gives notice that the City, may not be inclined
to stand for any "monkey business" in connection with any of the programs
that may be conducted in:the Senior Citizens Center when and if it is completed.
However, the last two sentences of the last paragrap of this letter
need to be clarified.` These read, "However, in acoord with the attached
correspondence (Mr. Berlin had included with his letter,'copiea of the two

clear that your questions concerning congregate meals; eligibility have been
revised. Ttie'oonclusione are that the program complies with the applicable

Federal and State regulations."
-You note from the inclosed Page 4 that nothing has changed since

is being required of would-be participants in the meals program as is.

more than an attempted "run-around':

'that they know what has gone on from the very beginning.
I am sending a copy of the four pages to each of the oandidatas for
Johnson County Board of Supervisors, in order that they may study the
situation and make their comments during the coming election campaign.

HISTORY OF CONGREGATE 'US PROGRAM IN IOWA CITY (Th �!)aga written June 1, 1978)
How many of the groups that received the first three pages of the "History"
commented? I received throe communications. One was a letter, dated May 18,
written by City Manager Neil Berlin for the City Council, from which I quote:
Nit is not the intention of the City of Iowa City to be the '
operator sof the congregate meals program and the City will not beeome
one by reason of allowing the program to continue in the senior citizens
center. The City, by owning the building, does not become an insurer
that every program conducted therein is in compliance with all federal
or state rules, regulations and laws. Should !he City become aware: of
any irregularities in this program, or with any, other program conducted
therein, it would certainlyinform the proper authorities.
A letter, dated May 8, addressed"To Whom it May Concern was signed by
Patricia E. Greiner, Nutrition Project Director, Heritage Agency on Aging.
I quote from that letter as follows:
"Ap the representative of Heritage Agency on Aging, charged with
monitoring the Title VII meals program and insuring compliance with
state and federal regulations, I have found no violation in the
current method of Operation."
But Ms. Greiner didn't say where"'she looked. She 'didn't say that she had
looked at all. If you don't look, you don't find. I dialed 338-9294 ( the -
meals reservation number) and was calmly told, in reply to my question, that
all persons age 60 and over are eligible.
On May 26, at the County Fair for Older Americans) which had been put on
in our Public Library Auditorium by the American Association of Retired Persons,
'j the Heritage Agency had brought.:a stack of folders which they made. available �...
for pick-up by those in attendance. This folder, along with information about
other' programs, gives a list of the Congregate Meal Sites in the seven -county
Heritage Agency'area, and on another page it says, * * * anyone over, 60 and j
his or her spouse, regardless of age, are welcome to dine at the sites."
" The other letter, dated April 19, also addressed "To Whom it MayConcern"
was signed by Robert E. Welsh who, I am told, is Chairman of the Advisory
Committee to the sub -contractor of congregate meals; viz: the Johnson County
Board of Supervisors. This Advisory. Committee,''according to the Press -Citizen,''
is composed of'three Protestant clerygmen, one Catholic priest; two members of
the American Association of Retired Personst one from the J.C. Council on Aging.
The outstanding"sentencin'Rev. Welsh's letter is "We are not nor have we I
! operated in a manner in violation, of federal law. However our County Attorneys,
in their well written legal opinion of January 16, 1976; state, in no uncertain -
language, that our federal nutrition program is in violation of federal lax if
it is operated on an open-door or,blanket eligibility basis, as ours in Iowa
City and Johnson County definitely'is and has been.
Rev. Welsh says that the federal nutrition program in not WELFARE.
That it is different from food stamps, rent subsidy, etc. and so requiring
a statement of eligibility isnot required. But it isn't' different. Food -
m m c stamps; rent subsidy, etc. are welfare programs that have been set up by

the government to help people who have special needs, and are paid for from

0 tax funds.' Eligibility requirements are set by lax because such programs
couldn't possibly be funded if they operated on.fr-e-forall basic:
