Approval of the revised Citizen Participation Plan -
Resolution adopting Iowa City's Citizen Participation Plan
and authorizing the City Manager to submit said plan with
all necessary certifications to the U.S. Department of
Housing and Urban Development and rescinding
Resolution No. 10-265.
Comment: This is a revision of the City's Citizen Participation Plan that was
last adopted by City Council on May 10, 2010. The proposed revision is
required for the use of federal CDBG and HOME funds for local projects
pursuant to new federal requirements. The Housing and Community
Development Commission (HCDC) met on June 15, 2017 and
recommended unanimously that City Council approve the revised Citizen
Participation Plan attached to this resolution.
2017 Sewer Rehabilitation - Resolution awarding contract
and authorizing the Mayor to sign and the City Clerk to
attest a contract for construction of the 2017 Sewer
Rehabilitation Project.

Item 3d(8) Pavement Repair - Resolution authorizing the extension of
the contract for the annual Pavement Repair Project.
Comment: Each year the Public Works Department bids a project to
remove and replace street and sidewalk pavement as necessary to repair
water main breaks. This year, the location, number and severity of the
water main breaks has increased the amount of pavement repairs when
compared to previous years. Currently, the contract amount is approaching
$150,000. This resolution, as required by the current purchasing policy,
requests council authorization to exceed the $150,000 contract value.
Item 3d(9) Friendship Street Traffic Calming - Resolution authorizing
the installation of speed humps on Friendship Street,
17_3c/ between Court Street and Brookside Drive.
Comment: The residents of Friendship Street, between Court Street and
Brookside Drive, have successfully completed the City of Iowa City's
adopted traffic calming program. A survey of neighbors yielded an 82%
response rate. Thirty-three households were surveyed; twenty-seven
households responded. Of those households that responded, 78%
indicated their approval of the proposal to install speed humps. Funding for
the project is available in the annual traffic calming budget [CIP #S3816].

50% of the cost of improving the remainder of the Rohret Road adjacent to
this property, and 3) complete a water pressure analysis and, if necessary,
design and construct the water system to include a booster pump to
provide adequate water pressure. Approval of this rezoning will allow this

Inc. that staff has negotiated for the sale of Lot 2 (approximately 11.2 acres) for
$589,495 contingent on Council approval and authorizes the conveyance. The 42V,
Street Industrial Park is a 173 -acre shovel ready parcel for industrial use, which the
City has been marketing since acquisition in 2008. If approved, this will be the first
sale in the industrial park.

Mixed Use Development - Resolution approving an agreement
for private redevelopment by and between the City of Iowa City,
Iowa, and Hieronymi Partnership, L.L.P., Hieronymus Square
Developers, L.L.C., Iowa City ES Hotel, L.L.C., and HS314,
L.L.C.
Comment: An Agreement has been negotiated for the $40.75 million
development of the property at the corner of Burlington and Clinton Streets,
at 314 S. Clinton Street. The development will consist of two 7 -story buildings
connected by a vestibule. One building will be mixed use and contain retail,
office and residential units. The other will be an extended stay hotel. One
level of parking will be built in the basement and be accessible through the
Court Street Transportation Center. To satisfy affordable housing
requirements, the developer will provide at least two of seven required
affordable units on site and for the remaining five units, will pay a fee in lieu or
provide the units on site. City contributions to the Project include a one-time
$600,000 lump sum upon completion of the buildings and TIF rebates of
100% of the TIF revenue for 15 years, the total of which will not exceed
$8,000,000.

Item 9. Prohibit tobacco use in parks. Ordinance amending Title 6,
entitled "Public Health and Safety," Chapter 10, entitled "Smoke
Free Places," and Title 10, entitled "Public Ways and Property,"
to prohibit the use of tobacco including smokeless tobacco in all
City parks. (First Consideration)

Comment: Currently it is illegal to smoke tobacco and use electronic cigarettes in
some parks, and the use of chewing tobacco is not prohibited in any park. This
ordinance prohibits smoking tobacco, chewing tobacco and using electronic
cigarettes throughout all parks except inside a privately owned vehicle. This
includes trails that traverse parks.

Item 10. Under 21 Amendment for SHOUT - Ordinance amending Title 4,
Alcoholic Beverages, Chapter 5, Prohibitions and Restrictions,
7- 47a.y Section 8, Persons Under the Legal Age in Licensed or
Permitted Establishments, Subsection C, referencing the City's
under 21 law, adding an exception for those working with a law
enforcement agency. (Second Consideration)
Comment: This Amendment to the City's Under 21 ordinance will make clear that
those working in conjunction with a law enforcement agency will be exempt. This
will accommodate those participating in the University's new Students Helping Out
("SHOUT") program, as well as those engaged in ride-alongs or compliance

Item 11. Unattended Vehicle Ordinance Amendment - Ordinance
amending Title 9, Motor Vehicles and Traffic, Chapter 3, Rules of
7 - `t-TaS the Road, Section 9, General Driving Restrictions, Subsection C,
referencing unattended vehicles, to allow safely parked vehicles
with the motor running to be left unattended, matching State
code. (Second Consideration)
Comment: The current City ordinance prohibits vehicles from being left unattended
unless their motor is turned off and the ignition keys removed. The growing
prevalence of remote start functionality, as well as keyless ignition, has rendered
those portions of this ordinance obsolete. For that reason, the State legislature
recently eliminated those requirements, while preserving the requirement that such
vehicles be safely secured. The ICPD wishes to mirror that change in our own law.

Item 12. Rent Abatement in Emergencies - Ordinance amending Title 17,
entitled "Building and Housing," Chapter 5, entitled "Housing
Code," to provide for the abatement of rent in emergencies.
(Second Consideration)
Comment: The Code of Iowa grants municipalities the authority to abate rent if a
dwelling does not comply with the housing code. The City's Affordable Housing
Action Plan includes a provision to allow the City to order that rent be abated in an
emergency. This ordinance allows the City to order that rent be abated in certain
instances when the Housing Code violations pose a substantial risk to the health or
safety of the tenant and when the landlord fails to obtain a rental permit.

Item 13. Occupant transition plan - Ordinance amending Title 18, Site
Plan Review, to require notification to occupants and an
occupant transition plan for any additions or alterations to a
residential development with more than 12 residential units.

Comment: The Comprehensive Plan was recently amended to support mitigating
the impact of large-scale residential redevelopment on occupants of existing
residential structures. This ordinance will require and define occupant transition
plans, which are to be approved by the City Council. See Council Action Report
for more detail.

Item 14. Parks Master Plan. Resolution approving the 2017 Iowa City
Parks Master Plan.

Comment: This resolution approves the 2017 Iowa City Parks Master Plan entitled
"Gather Here," which was presented to City Council at the Aug. 1 work session.
The master plan will guide City staff and officials in creating a park system

Item 15. Idyllwild Drainage Diversion - Resolution approving, authorizing
and directing the Mayor to execute and the City Clerk to attest an

Drainage Diversion Project.
Comment: This agreement authorizes HR Green, Inc. to prepare preliminary and

Item 16. Assessment Schedule — Resolution adopting an assessment
schedule of unpaid mowing, clean-up of property, snow removal,
sidewalk repair, and stop box repair charges and directing the
Clerk to certify the same to the Johnson County Treasurer for
collection in the same manner as property taxes.
Comment: The City has the authority under Iowa Code §364.136 to assess the
nuisance abatement costs in the same manner as a property tax. This resolution
allows the City Clerk to certify to the Johnson County Treasurer the abatement
cost to be assessed against the property. This assessment is being pursued only
after the City took many steps to resolve the matter. The City notified the
homeowners to abate the nuisance (for example, to remove snow from the
sidewalk) and after the homeowner did not take action to abate the nuisance, the
City abated the nuisance and billed the owner. The City has sent a letter to the
homeowner giving them notice that this resolution would be on the agenda, a copy
of which is attached to the resolution. No interest will be charged if the owner pays
within 30 days of the first required publication. Attached as an exhibit to the
resolution is a list of the properties that will be assessed and the amount that will
be assessed.
