MINUTES OF A REGULAR MEETING
NOVEMBER 13, 1973

The, Iowa City City Council met in regular session on the
13th day of November, 1973 at 4:00 P.M. in the Council Chambers
at the Civic Center.
Members Present: Brandt, Czarnecki, deProsse, Hickerson,

Rev. Paul Akin, First United Methodist Church.
It was moved by Hickerson and seconded by Czarnecki that
the amount read be considered a full reading and to approve the
minutes of the Council meeting of November 6, 1973, subject to
correction.Motion carried.
Glen Epstein, President of Iowa City Clinton Street Tenant's_

to Council. Motion carried. Klaus Nuki, 1313 Grissel Place,
appeared requesting resumption of City practice of keeping a._�
compost pile at the Service Building. It was moved by White'
and seconded by, deProsse that the matter be referred to the City
Manager for report back to Council. Motion carried. Don Anderson,
AFSCME, AFL-CIO representative appeared presenting a letter stat-
ing that the City employees had formed a chartered union and re=
questing the Council to appoint a committee to meet and act upon

issues brought before the committee by the employees _ After
discussion, it was moved by White and seconded by Hickerson that
the letter be received and filed and referred to the City Manager
and City Attorney for review and report at an informal meeting,
at the earliest possible date, the report to include docking
of employees, as discussed. Motion carried. Skip Laitner,

After discussion of complaints and appearance of Rev. Welsh
who advised of the mess in the E/W alley behind the First Christian
Church on Sunday mornings, it was moved by Hickerson and seconded
by White to dopt the Resolution Approving Class_.0 Beer& Liquor,.

of Community Development, and recommendation that the request
not be granted, it was 'moved by Hickerson and seconded by

George Bonnett, Deputy Director of Public Works, explained
the project, after which the following resolutions initiating
the Demolition and Site Clearance of approximately 20 parcels
in the City -University Project; Iowa R-14 Contract #3 were
adopted. It was moved by Hickerson and seconded by White to
adopt the Resolution Setting Public Hearing on the Resolution
of Necessity for December 41 1973.' Upon roll call .deProsse,.
Ifickerson, White, Brandt, Czarnecki voted 'aye'. Motion
carried. It was moved by Hickerson and seconded by white to

After discussion of petitions received last week, and
explanation by Director of Community Development, Dennis Kraft
of previous action, it was moved by White and seconded by Czarnecki
that the Resolution Approving the Preliminarv'Subdivision Plat

staff requested to add to the agenda next week a report on the
matter of a park, including the relationship with the Cpaitol
Improvements Program. Motion carried.
After withdrawal of a motion by deProsse and second by
Czarnecki to change Council meeting time to 7:30 P.M. starting.__

that further discussion be scheduled for next Tuesday's informal

Councilman Czarnecki asked how the staff intended to respond
to the questions on the urban renewal proposal presented-by__Rev,
Welsh and Councilwoman deprosse_and questions and concerns raised
at the neighborhood meetings. The Mayor noted that the staff
should get information to the Council first for their discussions.
Councilwoman deProsse commented on Community Relations
Director, Julie Zelenka's memo concerning the WSUI call-in pro-
gram on December 6th concerning_ the urban renewal redeY�lQpLnent.

Councilman White noted .that the City_ha_s,.,_two vacancies on
the Regional Planning Commission, and that the next meeting was
tomorrow, Wednesday the 14th, and requested filling the vacancies
with the two new elected Councilmembers. After discussion and
input from Davidson and deProsse, it was moved by White and
seconded by Czarnecki that Carol deProsse be appointed as the
Cry's el€czed member to the Rey ional Planning Commission._ Motion
carried.
The Mayor reminded the Council of the_june_rals of_Donald_
Wehmeyer and Thomas Villhauer tomorrow.. He also noted the urban 1S
renewal discussion meeting at Horace Mann school tonite.

FOR GARBAGE BY THE SANITATION SERVICE AND AMENDING THE
CODE, BY REPEALING SECTION 3.42.3D. (Second Reading)_
Comment:
The text of Section 3.42.3D of the City Code is being'
amended for the prupose of establishing points of collec-
tion for garbage pick-up.` As has been discussed, all,
garbage cans or containers shall be placed adjacent to
the paved or traveled` portion of the street or alley
which is part of the collection route abutting the premises
of the dwelling unitofthe, customer.

CONSIDER ORDINANCE CONVERTING UTILITY BILLING TO
ELECTRONIC DATA PROCESSING SYSTEM. (First Reading)
Comment:
The City Council has previously authorized the conversion
of water and ,sewer billing to electronic data processing.
This conversion will involve a change in meter reading
frequency and necessitate some clarification in enforce-
ment authority.', Those changes are implemented in the
ordinance presented for first reading at this meeting.

MINUTES OF A REGULAR COUNCIL MEETING
NOVEMBER 61 1973
4:00 P. M,
The Iowa City City Council met in regular session on the
6th day of November, 1973 at 4:00 P.M. in the Council Chambers
of the Civic Center. Mayor Brandt presiding.
Members present: Brandt, Butherus, Czarnecki, Hickerson,
White. Absent: none. The invocation was given by Rev. Robert
Iiolzhammer, Trinity Episcopal Church.
It was moved by Hickerson and 'seconded by White to consider
the 'amount read to be a full reading and to approve the minutes
of the regular Council meeting of October 30, 1973 subject to
correction. Motion carried.
It was moved by White and seconded by Czarnecki that the
minutes of the Project Area Committee meetings of 7/5/73 and
10/24/73 be received and filed. Motion carried.
- It was moved by Butherus and seconded by White that the
letter from the Director of 'Project Area Committee recommending
acceptance of the proposal submitted by Old Capitol Business
Center Company for City -University Urban Renewal Project R-14.

It was moved by White and seconded by Hickerson that the
petition from residents of Hollywood Manor Part V, requesting
that provisions be made for a neighborhood park be received
and filed and referred to the City Manager, Parks and Recreation
Commissionand Planning and Zoning Commission for report back to
Council. Motion carried. William Schnute appeared and read
his letter concerning this request. It was moved by Hickerson
and seconded by Butherus that the letter be received and filed
and referred to the City Manager and Parks and Recreation and
Planning and Zoning for report back to Council. Motion carried.
It was moved by White and seconded by Butherus that the
petition requesting amendment to the Subdivision Code, Chapter
9.50.5, of the City Code of Iowa City to provide for open space
for use as a neighborhood park in all new residential sub-
division be received and filed and referred to Planning and
Zoning for recommendation to Council as soon as possible.
Motion carried. Councilman Iickerson suggested the City Manager
and City Attorney prepare an informal, brief memorandum on
existing laws, budgetary considerations and Council's alter-
natives.

boundaries of districts and zones to be entitled "Zoning of

that the amendments bring the zoning ordinance into conformance
to the urban renewal plan, and allows a Central Business Service
zone, and noted that Planning and Zoning will be studying a

At the request of the Optimist International, Mayor
Brandt proclaimed the week of November 12th through 18th as
Youth Appreciation Week in Iowa City, and at the request of
Science of Creative Intelligence, the week of November 11th
through 18th as 'World Plan Week.
Mayor Brandt expressed the gratitude of the Council
members for Councilman Butherus' services as a Councilman
when calledSeptember 1st to fill the vacant seat on the
Council.
City Attorney Jay Honohan reported that the Secretary
of the State Appeal Board in Des Moines had advised that the
hearing on the budget appeal would be during the week of
November 12th, but not on Tuesday night.
The City Attorney also reported on a complaint filed
With the Iowa Civil Rights Commission against the City alleging
discrimination against Howard Caroll concerning use of the
Board in the Police Station for an alarm business.
Skip Laitner, 422 Brown, appeared for the ISPIRG group
concerning alleged harrassment by the City Attorney of signers
of the appeal of the budget, and requested censure by the Council.
It',was moved by White and seconded by ;Hickerson that the letter
bel received and filed. Motion carried. In answer to the
question if anything was going to be done, the Mayor advised
that the attorney was hired to take care of legal problems such
as the appeal of the budget.
Rev. Robert Welsh, Chairman of Citizens for a better Iowa
City, appeared congratulating the City for conducting the
neighborhood meetings on the urban, renewal proposal. The group
requested several pieces of information be made available to
the citizens. It was moved by Czarnecki and seconded by Butherus
that the letter be received and filed. Motion carried.
Rick Larew, for ISPIRG explained their request to the
Chamber of Commerce concerning a 'shop and bus' plan. It was
moved by White and seconded by Butherus that the letter be
received and filed and referred to the City Manager for report.
Motion carried. Richard Burger, President of the Chamber of
Commerce was present and advised they would have a report back
to the Council soon.
It was moved by Hickerson and seconded by Butherus that
the meeting be adjourned to executive session for discusion of
fair market value of Urban Renewal land. Upon roll call Brandt,
Butherus, Czarnecki, Hickerson, white voted 'aye'. Motion carried.

On the evening of November 7, 1973, the Iowa City Clinton
Street
Tenant's Association met with a representative from the
Old Capitol Business Center Company. At this meeting, Old Capitol
opened the meeting with an encapsulated history of the Iowa City
urban renewal project from the early 60's to the present time;
followed by a description of their proposal to you, the City Council,
on October 18, 1973.
After a closer and more detailed discussion of the proposal,
paying particular attention to the proposed "University Plaza"
(since we, the businesses of this association could and might
conceivably, relocate there), we the Iowa City Clinton Street Tenant's
Association would like to address the following three points to the
council:
POINT ONE. As a viable working solution to,the redevelopment
of down town Iowa City, and taking into consideration the needs of
all of Iowa City, we feel that this proposal is a productive piece
of work. Not only does this proposal rebuild down -,town Iowa City,
it does it in a way that includes the pedestrian, existing public
transportation, and the much needed parking for the motorist as well.
To do all of these things and still come up with a proposal that is
in keeping with everything which make Iowa City, Iowa City, makes us

feel the proposal is the 'roduct of great effort and close study.

sources that is possible before making this historic decision.

Explanation and Cost Analysis of,One Alternative
Iowa city currently provl-,a-- qarbage pick-up to 8,345 hou90-
holds. If one trucko flat bed or ptt�.i_qr' were to be used to
pick up only newspapers running 10 routes'- a two week poriodv
each route would have an anticipated 584 stops P- -a-v. (This
assumes 70% of the houseblds cooperating. 8345 4 10 routos times
70% cooperation= 584 stops) Tbo city estimates that for a 20 yd.
packer with 3 man crew and curb line service the number of
stops would be 569; this compares favorably with our estimate of
584. Each household would be serviced every two weeks*
The city estimates thai the total cost per collection day
for one 20 yd. packer with a 3 man crew to be $124.66. This
figure can be reduced with the use of a 2 man crew and,a packer
or covered flat bed truck. Because of less weight per pick-up,
a 2 man crew could be used in place of a 3 man crew.

1. Chairman White called the meeting to order. He reminded
the Commission that the purpose of the meeting was to finalize.

2. Bosserman pointed out an unclear statement in the second
draft, page 3, beginning;The Commission suggests that there
be more emphasis, placed on enforcement. By concensus, the
paragraph now reads;,, The Commission suggests that there be more
emphasis placed on enforcement of the housing standards, with
a specific recommendation for additional staff personnel to
carry out regular inspections of','permises, instead of inspections
only, on complaint basis.
3. Discussion resulted in a motion by Branson to amend Section B -
Rental security/damage deposits to recommend to City Council that
a .provision be written into the Code for interest to be paid on
any security/damage' deposits held for a year or longer.' Said
motion died for lack of second.
Discussion resulted with paragraph 2 o page 5 being revised ;to
read; Additionally the,Commission recommends the guidelines set
forth in the P.A.T. 'Model lease on page 7, item 24, referring to
a damage deposit to beheld in an interest bearing account from
the time of execution of the lease to be applied to damage or
non-compliance with the lease agreement with the additional pro-
vision that interest not be paid for a period of less than one
year on`the ,damage deposit. This to be written into City Codes.
Branson moved that this-paragraph'be accepted by, the Commission.
Frimml seconded, motion passed with all in favor.
Bosserman excused herself from the meeting.

if there were any corrections or additions to the minutes of`the
October ll, 1973 meeting. It was moved by, Mr. Galiher, seconded by.
Mr. Horner, to approve the minutes as written. The motion "carried
unanimously.
S-7320. Macbride Addition, Part 2. Preliminary plat of Planned Area
Development filed by Macbride Addition Inc. (vic. southeast corner-
of intersection of Melrose Ave. and Mormon Trek Blvd.). Date filed:
10/2/73. 45-dAy limitation: 11/16/73.
Dr. Ogesen pointed out that consideration of the above request would
be for the Preliminary Plat without a recommendation going to the
City Council at this time. A final recommendation will go to the
City Council, he said, at the time the Final Plat is considered.
Mr. Lyle Miller, Developer, indicated that both he and the owners
of Macbride Addition were in agreement with essentially_ all of the
recommendations as outlined in the City Staff Report dated November
8, 1973.
Mr. Henry questioned the Staff about the parking arrangements indicated
in an alternate site plan suggested by the Staff for the apartment
area. He said he was sympathetic to the need to keep the apartments

from le family as far removed as practical r g Y lots but questioned
the close proximity of the parking lot in this alternate plan to the
abutting single family development. Mr. Schmeiser explained that:
the intention of the alternate site plan was to give more privacy
to the interior court plus further, removing the apartments from the
single family development.' Dr. Ogesen stated that he would prefer
to see the multi -family separated arated or'set aside from the single
family area by the use of open space.
Mr. Galiher indicated he objected to the monotony of the expansive
continuous walls facing the single family' development, and asked
Mr. Miller if he might consider reducing the size of the proposed
apartment building from a 48 -unit, 3 -story building to a 32 -unit,
2 -story building. Mr.' Miller indicated he would be willing to do
• this.
Mr. Schmeiser indicated that some concern had been voiced at the
Informal Meeting on November 6,_1973 to change the street name
to one name and suggested "Macbride Drive."

approved contingent upon:
1), the continuous street having one name instead of
two names, and
2) that a 32 -unit, 2 -story apartment building be,substituted

Dr.Ogesen noted that the Planning & Zoning Commission some time
agorejected a request for multi -family zoning for property
across Mormon Trek from the Macbride Addition tract. Questioning
whether there is a need for more apartment, construction in Iowa
City, Dr'..Ogesen said he was opposed to apartment construction
along+Melrose Avenue which might become a major entrance into
the .Cityand, if so, should be a "showplace."
Mr. Henry 'expressed the hope that Melrose Avenue would never',
become a major entrance into 'Iowa City but added thateOalement
buildings did not necessarily seem offensive to many p p
Therefore, he found the,Macbride Addition, Part 2, to be an
acceptable plan.
The motion carried 4-1, with Dr. Ogesen dissenting.
Mr. Jack Klaus, Urban Renewal Director, gave a presentation on
the R-14 Urban Renewal proposal.
Dr. Ogesen noted that he had received the letter from Helen Konba
Kavanaugh concerning farm land east of the Village Green' residential
area, and the letter from Willard Boyd, President of the University
of Iowa, concerning a proposed zoning change.
The next Planning -& Zoning Commission meeting was scheduled for
November 29, 1973.

Jones presented minutes of September meeting. Hartwig
moved, Summerwill seconded the motion that 'minutes be
approved. Motion carried'.
Copy of the proposed lease between the Airport Commission
and Attorney Tooney was, presented. Jones pointed out Lhat,'
as written it was actually, a. six year lease. Summerwill
moved, Hartwig seconded the motion to have the city attorney
draw up a lease on the old United office for $150.00 per
month on a three year term receiving, the first and last
month's 'rent, with "the °lease being renegotiatedat the end of
three years. Notion carried.
The financial report for the month ending August 301 1973,
was discussed. It was pointed out that expenditures came
to $19,603.68, of which $6,700.00 was for clear zone easements,
(capitol expenditures) making operational cost for the
airport through August 30th of $12,903.68, and airport income
through the same date of $17,423.01, or $4,519.33 in the black.
There being no other business, the meeting was adjourned.

The meeting was called to order at 7:45 P.M.
The minutes of September 18 were reviewed and several corrections
and additionslwere made. After the correcitons°are "made the
minutes will be submitted to the Committee for approval,.
The State Interim Committee on CATV met October 2. The Commi-
ttee will meet again on October 29 or 30.' They would be
interested in someone from Iowa City attending. Blum, Cordier
• and Welsh were requested to attend this meeting. The Chairman
indicated that he will inform the members of the date set for
the meeting so that others who desire might attend.
MikeHolland' reported to Rev. Welsh on FM facilities. Only
the following would be needed:
1. FM equipment for 9 stations (cost',already computed
in runs)
2. Mic'and tape deck (approximate cost = $750.00)
3. Small area of studio
The Committee members share similar opinions on FM:
1. Inclusion of FM would be a plus item to the system.
2. There would be little additional cost involved to
provide this service.
It was moved and voted upon unanimously to accept Blum's provi-
sions as subsections under c.(4) on page 4 of ,the August 24
draft of Ordinance Provisions. (See Attachment A)
Procedure for Preservation of the FCC Rules Regarding the
Presentation of Obscene, Lottery or Advertising Information
was discussed next. The FCC requires that rules be estab
• lished to prevent obscenity, lottery or advertising informa-
tion. The system would be liable for all'cablecasting, as
cable is not considered a common carrier.

The question was raised as to who would '-judge technical s,tan-
dards,and the possibility of implementing two different sets
of standards.'
Eskin expressed her feelings against prerecording. She would
like the system to be a common carrier where the individual is
responsible for what he cablecasts. Blum indicated ,that this
is against FCC Regulations. :This fact was also called to the
attention of the',Committee by Mike Holland.
There was a vote taken on the acceptance of Blum's second
draft, entitled,, "Procedure for Preservation of the FCC Rules
Regarding the Presentation of Obscene,, Lottery or Advertising
Information. This is to become VI B 4d (7) of the Ordinance
Provisions,August 24, 1973. The votes on the sections of the
draft were as follows:

Discussion next centered on the report proposing workshops

Rev. Welsh expressed his concern about the community calendar
being too full this fall for such workshops'. He felt that
there were good ideas presented but they should be projected
for the first of the year. It was felt that assistance should
also be, sought from sources other than the library'. ,The Commi-
ttee should strive to attract people involved in education,'
government, medicine, students, etc. to attend.
Cordier expressed his feelings that the community, has never_
been informed on CATV and what kind of system the Committee
would like to see installed in Iowa City. He felt this infor-
mation,might draw more interest to the workshops.
Flo Beth Ehninger suggested that the Committee review,Eskin's
proposal for later discussion.
It was decided by the members that the Committee would hold
their meetings on the first and third Monday of the month.

be carried by the systema
(b) Minimum Signals
The following signals shall be the minimums carried by the
system:
(11)Any stations licensed for broadcast within the
communities which serve the system with primary
TV signals and which are affiliated with National'
Public Radio, or are non-commercial or educational
stations. _.._.

In addition, at least one station from each commu-
nity which supplies TV signal shall be carried.
(c) So long as there is requested use, the.system shall main-
tain one FM signal as,a local access facility, for use by
the ublic local government and educational authority,

tain one FM signal of general listening music without
commercial interruptions.
(e) Insofar as possible, ,the signals carried shall be selected,

(f) All of the above, notwithstanding off the air signal need
be carried which is not sufficient in strength at the
system head -end to provide adequate signal' strength.
(g) Milimum'facilities shall consist of:
(1 1) Studio (not necessarily separate from TV studio)
(2 1) Sufficient microphones for cablecast of up to and
including small groups (approximately 6 people)
(31) Equipment for receiving and cablecasting telephone
calls
(41) Equipment for playing all commonly current prere-
corded materials over the cable

• PROCEDURE FOR PRESERVATION OF THE FCC RULES REGARDING THE
PRESENTATION OF OBSCENE, LOTTERY OR ADVERTISING INFORMATION
at shall be the general policy that presentations to be cablecast
over the access channels shall be prerecorded and delivered into
the hands of the operating personnel of the system no later than
24 hours prior to its scheduled cablecasttime.
Exceptions to this policy shall be made by the system management

when appropriate and shall be based primarily, although not
exclusively,', on requirements for spontaneity and timeliness. The
managements in addition, shall make available certain preannounced
times of approximately one hour per week, or more if that amount
of time seems insufficient, for so-called "walk in" live presen-
tations.

Procedure for Preservation of the FCC Rules Re ardin the -Presen-
tation of Obscene, Lottery or A vertisin In ormation:
(a) Live Presentations: One individual, who shall be designated
(Program Director, shall bepresent during all access pro-
gramming and shall have responsibility ',for maintaining rules
pertaining to presentation of matter which is obscene, adver
tisng or lottery information,
(b) Procedure for Prerecorded Presentations:' The management
shall esi.gnate an ;in ivi ua s to screen all prerecorded
materials for content as applies.'to the above mentioned!
rules. If the material is judged to be outside the rules,
the presenter shall' be notified and given' an opportunity
to make suggested alterations. If!the presentor objects
or disagrees with the management with regard to violation
of the rule,; he shall so notify the general management of
the system.' Upon such notification,' the management shall
convene an appeal hearing in accordance with the procedure
established above.
(c) CONSTITUTION OF APPEALS BOARD
The general management of the system shall appoint, within
10 days of the beginning of cablecasting activity, one
individual to serve on the above mentioned Appeals hoard.
The length of term shall be determined by the manngemnnl_
of the system.
The City Council of Iowa City, acting upon recommendation
•
of the community at large, shall appoint an individual 4
from the community, not an employee
of the City:, or any
municipal agency, to serve as Chairman of the Appeals
Board for a period of one year repeatable terms.

A third member of the Board shall be appointed on each
occurrence by, the individual or ,group whose presentation
has been challenged on the basis of obscenity, lottery
or advertising information.
Any decision of the Board in regard to presentations shall
be made by a majority of two members.
(11) PRE-EMPTORY CHALLENGE: Any "offended party" whose
cablecast`has been interrupted or prevented from
showing may pre-emtorily challenge either one of the
two 'permanent members of the Appeal Board from parti-
cipating in the decision on any one specific matter.
Upon such challenge, the challenged party shall be
excused from deliberations on the specifically named
appeal and the remaining two members ':shall "appoint
a third person to sit on the Board during the course
of that deliberations.
(d) If, at any time, any person or group is refused access to
the use of the cablecasting facilities on the access channels,'
for any reason whatsoever, that person or group shall have
the same rights of appeal as specified in Section
• (e) In accordance with FCC Regulations, there shall,be no
censorship of program content on Access Channels.

•PROPOSAL FOR WORKSHOPS ON CABLE

I propose we proceed immediately in developing a community
workshop program on cable in cooperation with the Library
(coordinating on collection of materials, bibliography, meet-
ing space and program planning, as already suggested by
Carol,Spaziani), and hopefully with the cooperation of school
board personnel, enlarging on their State workshop on cable
(that ,some of us attended last June, and their forthcoming
workshop on October 18), and drawing upon other individuals
with expertise in the community. our staff person from the
City should be used for aid in gathering speakers, material,
• obtaining meeting locations, etc.
I propose we aim for a two stage effort. In the fall (October
through December) we should hold three symposia, one being a
panel discussion of cable on WSUI and the others being meetings
with speakers, held at some central location, such as the
library.
In January we could branch out to smallworkshops,where audi-
ence participation is the major forum. These workshops, could
follow the program outlined in the Contemporary Public Affairs
Bulletin - which could be distributed as a text. The parti-
cipants could be special interest groups such as teachers, or
the general public who might sign up at the library.
Subjects for the symposium workshops could be divided as follows
(borrowing from the Contemporary Affairs Bulletin).

Dick Blum suggested the possibility of amending the Committee
voting procedures in light of the recent resignation'of one
Committee member. After discussion Blum made the following

Blum also raised the question in relation to FCC Regulations,
Section 76-251 A 10 II as to the implication of production
costs for taping cablecast over public access. The Chairman
indicated that he would seek specific information from Cable
Television Information Center.
The next topic of discussion was the State Hearing on CATV.
Rev. Welsh outlined the points that he will present to the
State Committee. (See Attachment A) 'It was felt the State
Committee should look at the potential uses and services of
CATV to'the 'State. "It was the feeling of the Committee that
a State Committee could provide services to a municipality
but that it should not become a: regulatory level.
There were several suggestions made concerning various types
and organization of CATV workshops:
1. Dick Blum thinks members could speak informally to
service clubs without interrupting the community
calendar`.
2. Sandra Eskin concurs with Hugh Cordier that Ordi-
nance Provisions might be made a part of workshops.
3. Make it known that we have members available to
speak to civic groups.
It was moved and voted upon unanimously to take the following
immediate steps to initiate dissemination of information and
news reports:
1. Send letters to civic groups.
2. Contact WSUI, KXIC',WMT and KCRG radio stations.
3. Contact the Daily Iowan and Press Citizen.
The idea was suggested to hold a special meeting and invite
the City Council candidates. 'f After discussion it was decided
to take no action in relation to the City Council candidates.

Gentlemen:
We presently have under construction at 1221 and
1223 East Bloomington, a duplex. We have proposed, that
the sewer line to this facility be connected to a line
which runs throughthe property at 1222 Rochester' Avenue
and which served a building formerly located on the
duplex lot.
We have been advised that permission for this
connection would need to be obtained from the City Council.
We are the owners of both of the properties in question.
The alternative to such a hookup is an angular connect-
ion running in two directions for a distance of approx-
imately 150 feet as opposed to a straight connection of
10 to 12 feet which we are proposing.

lot on the corner of Washington and DubuqueStreets during the holi-
day,season. We have contacted the City Administration previously and
find them agreeable with our proposal.
We would need the lot from November 19 thru December,29th and would
use it for all or 'part of the following purposes:
1. Park a camper or house trailer on the lot to be used for a
Santa House and possibly a place for shoppers to have free
coffee.

Thank you very much for your letter.
I certainly share your belief that Community Development
legislation is necessary. A Community Development and Housing
proposal is being "marked up" in the Senate Housing Subcommittee
and may be reported by the end of the month. Because of the Sub-
committee's intention to combine housing and community develop-
ment, and the Administraticds reluctance to move on housing pro-
grams, developing a bill which would be acceptable to the Admin-
istration is difficult. Further impoundments must be avoided.
I deplore the impoundments of funds for city programs, as
you know, and agree that cities need attention --not a moratorium
on concern. I hope that rapid, effective action by the Subcommittee
will get the programs moving again.
Thanks again for taking the time to write. I hope you'll keep
me informed of your views on issues of mutual concern.

pleted within sixty (60) consecutive calendar days from receipt of said Notice. -Par-
cels will be released as they become available. The entire contract is intended to

It is up to us to decide whether we wish to let the Council handle
it or use staff.At this point, I would recommend using Mayor Tim Brandt
and staffers Ray Wells, Jack Klaus, Joe Pugh and George Bonnett. You may
wish to add Dennis.Kraft, but thus far questions at meetings haven't
emphasized that element. We can make that decision a little later.
WSUI is willing to schedule another phone-in broadcas=oariate8time
date in addition to this one. I think that would be the eppinto the guts
to use the City Council, with staff back-up. We, aren't y
of the Council role in the plan and it would appear, more appropriate to
use them at a later date.
Could you obtain a Council decision at the informal session on
Tuesday, Nov. 13 on:
1. Whether or not to have the broadcast on Nov. 28 (the date could
be changed) and

Development located south of
Melrose Avenue and east of Mormon Trek Boulevard. An analysis of
the subject' development, which will subsequently involve the
preliminaryand final approval of a LSRD-and subdivision plat,
is submitted, herewith to assist you in your evaluation of the
subject proposal.
EXISTING CONDITIONS: The subject property is
presently zoned R1B; bounded
on the north by a golf course,
on the west by a church and
multi -family development, on the south by undeveloped land zoned'
R1B,on the east by large lot single family homes, and on the
northeast by a farmstead zoned R1B; accessible to Mormon Trek
Boulevard, Melrose Avenue and Macbride Road; and serviced by
existing sanitary and storm sewers and water mains located in
Macbride Road and Mormon Trek Boulevard.
PLAN ANALYSIS: The purpose of a planned
area development is to promote
to the extent possible:'
1. A maximum choice in the types of environment available to
the public by; allowing a development that would not be
possible under the strict application of other sections
of the Zoning Ordinance.
2. The permanent preservation of common open space and recreation
areas and facilities.
3. A pattern of development to preserve natural vegetation,
topographic and geological features.
4. A creative approach to the use of land and related physical,
facilities that results in better development and design and
the construction of aesthetic amenities.
5. An 'efficient use of land resulting in more economic networks
• of utilities, streets, and other facilities.

6. A -land use which promotes the public health, safety, comfort,
• morals, and welfare.
The plan is consistent with the stated purpose in the following
respects:
1. By effectively platting 10.0 acres (less street area) of the
23.5 acre tract into average lot sizes of 14,050 square feet
for single family development, the applicant is capable of
providing 120 apartment units on 7.4 acres at a density of
2,690 square feet per unit. Not possible under the present
conditions, two types of residential housing are proposed
at an overall density of less than the required 6,000',square
feet per unit.
2. The applicant is preserving 2.6 acres for recreation and
open space use by the dedicationthereof to the City.
3.' The subject tract is bounded on the east by medium to high
quality residential' homes'. Although the R1B zone permits
lot sizes at a density of 6,000 square feet per residential
unit, the applicant is preserving the integrity of the
existing neighborhood by providing Targe lots adjacent
thereto.
4. Storm sewers are proposed to be located in drainage ways
utilized as open space, a creative and economic approach to
the use of the land.
Although' the planned layout is generally good, there are several
apparent problems necessitating additions and corrections
enumerated as follows:
1. In`order ,to properly develop'; the parcel located northeast
of the proposed development (see attached plan), it is
necessary to extend Jessup Court to the boundary line
of the subject tract.
2. The applicant is proposing to relocate the southerly platted
portion of Macbride Road',concave northwesterly. To facilitate
the change will require:
a. The purchase of approximately' 2,800 square feet of
land previously, dedicated to the City for park and
recreational use.
b. The vacation of a portion of the ROW for Macbride Road
previously' dedicated to the City.
c. The resubmittal of Macbride Addition, Part One, a Planned
Area Development, incorporating the above changes.
• 3. As is agreeable to the applicant, Lots 33 and 34 of Macbride
Addition,' Part, One should be utilized as open space in exchange

• I'or the open space dedicated to the City located directly
across the street to the west to provide a continuous
pattern of open space. To do so, however, will require:
a. Dedication of Lots 33 and 34 to the City for park
and recreational use.
b. The disposition of said land to the west of Lots 33
and 34.
c. The resubmittal and approval of Macbride Addition,
Part One, incorporating the above amendments.
4. Provisions for a 10 foot public walkway easement from the
undeveloped tract, northeast of the subject addition to
Macbride Road should be made to effectuate desire lines
of pedestrian movement from the northerly portion of the
tract to the proposed public open space and southeasterly
to the Ernest Horn Elementary School.
5. The extension of the sanitary sewer terminating at the
rear of Lot 54 northerly to the boundary line of the
addition to service those homes located on the north side
of Melrose Avenue.
6. Relocation of the proposed storm sewer through the public
open space to follow the low flow. The Department of Parks
and Recreation is planning to fill the low.-area for suitable
recreational use.
7. Minor additions and corrections as follow: -
a. The designation of "15 foot sanitary sewer easement"
along all sanitary sewers.
b. The designation of 12 foot utility easement" along
all property lines where utilities are ;proposed to
be installed.
C. The center line curvature on all streets.
d. The radii, to be 15 feet, should be illustrated at the
intersection of Jessup Court and Thatcher Avenue.
B. As a suggestion to the applicant when subsequently submitting
an LSRD Plan for the multi-family development proposed, an
alternate site plan is attached hereto. Basically, the
alternate plan affords:
a'. Less of an abrupt change from large lot single family
development to three story multi-family development.

interior court for complete recreational and visual
enjoyment.
c. Full exposure of the golf', course to the north.
d. Shorter building faces along the south and east to
"break up" the monotony of expansive continuous walls
facing the single family development.
e. Limited access along Mormon Trek Boulevard and Melrose
Avenue.
RCCORMGNDATIONS: It is the Staff's recommen-
dation that the subject

COMMENTS: approval

plat, future consideration
should be given to the
placement of sanitary sewers
along street boulevards as
it is very difficult to
clean sanitary sewers located
along lot lines. To facilitate,
the location of sanitary sewers',
along streets, gas lines should,
be located along property lines with the underground wiring. Also,
consideration should be given to permitting an 8'inch storm sewer
as an extension of the 24 inch storm sewer proposed through the
public open space to handle low flows and provisions made for a
swale graded to a minimum of a l to 4 slope to 'handle high flows.
Such an arrangement can work quite satisfactorily if properly
done.

At their regular meeting on October 2, L973, the "Iowa City City
Council received the letter from He Len Konba Kavanaugh, L330
Muscatine Ave., concerning farming Land east of Village Green
residential area on American Legion Road. The motion was adopted
to refer a copy of the letter to Planning and Zoning Commission.
The Council also received a letter from Willard Boyd, President of
the University of Iowa concerning a proposed zoning change. The
motion was adopted to refer his letter to Planning and Zoning for
their;deliverations.

On behalf of the University,I want to thank you for the opportunity'to
comment on the zoning code change proposed by Mr. George Nagle.
It appears that the portion of the code Mr. Nagle would have 'changed is
in the code for the purpose of maintaining a buffer area between RIA
property and high-rise living structures. We are of the opinion that
the current zoning protection is as important 'to'the University as it is
to privately owned RIA property. Accordingly we must urge, in the strong-
est terms„ that the request for changing the zoning restrictions not be
honored., An exception in the case of the University would be discrimi-
natory:
In its own planning activities, the University attempts constantly to be
aware of,' and to 'respect the interests of, adjacent property owners.
We try to evaluate all of the University's planning for change and growth
from an aesthetic perspective. We urge that the City of Iowa City do
likewise when considering changes which would have an enormous impact
on the nature of development at every boundary of the University.

COUNCIL DISCUSSION
NOVEMBER 13, 1973
12:30 P.M.
The Iowa City City Council met in informal session on the
13th day of November, 1973 at 12:30 P.M. in the Conference Room
at the Civic Center. Mayor Brandt presiding.
Councilpersons'present: Brandt, Czarnecki, deProsse,
Hickerson, White. Others present: Davidsen, Wells, Honohan,'
Pugh, Kraft, Klaus, Zelenka, Maune, Stolfus.
The Mayor announced discussion of parking in the area South
of Burlington Street generally between Gilbert Street & Madison.
The City Manager, Ray Wells, presented a memo, which was explained
by Finance Director Joe Pugh, with recommendations suggested for
Harrison Street, Court Street, Dubuque Street, Linn Street, Clinton
Street and Capitol Street. The Mayor requested that the Resolution
be added to the next Council meeting agenda.
The City Manager proposed that rumble strips be installed
on the down slopes of Lexington Avenue as a solution to their
problem. Council discussed vacation of the street, posting
notice of strips, and payment for resurfacing.
The City Manager then presented the list denoting the status
of items deferred by Council, and several items were discussed.
City Attorney Jay Honohan noted that the city would be
given,a five-day notice of hearing on the budget appeal. He
commented on what his presentation would contain.
Council then discussed the ballot for the Charter election,
and went on record as urging the citizens to vote 'yes' on either
form of government.
Mayor Brandt advised that an Ordinance clarifying the procedure
for water service would be on the next agenda.

On a continuing basis the Department of Finance, with assistance from the
Department of Community Development, provides administrative review of the City's.
parking system. The purpose of this memorandum is to document certain changes
that have taken place in the area South of Burlington Street generally between
Gilbert Street and Madison as identified by administrative review, and to reco-
mmend specific parking controls to accommodate those -changes.
During the past year this particular study area has experienced the following: -
1. The utilization of parking meters in the Southwest part of the study area
(Madison, Harrison, Capitol) has declined to the point that the meters are
now serving as no more than no parking signs for most of the day. .Revenues
are downconsiderablyin this area and the incidence of meter violations is
-increasing resulting in a non-productive use of municipal resources and per-
sonnel without a desirable service being performed.
- 2. The construction of the new Federal Building in the block bounded by Court,
Dubuque, Harrison, and Clinton Streets will result in a major change in
traffic movements in this area. The General Services Administration is
providing off-street parking for both employees and patrons on Clinton
Street between Harrison and Prentiss Streets which will allow greater
flexibility in providing street parking.
Also, the improvement of Court Street to its present width will accommodate
parking on one side from Gilbert to Madison. 'Recent demand for free curb
parking on this street would indicate that some control is desirable.
3. The City _Council and administration staff have received requests for park-
ing controls from merchants and householders on Dubuque Street between
Prentiss and the railroad tracks. This area was the subject of a personal
interview of each of the affected property owners to determine the extent
of the problem -and to obtain input on possible solutions.
Based upon an analysis of the above circumstances the following recommendations
are suggested for implementation by the Council:
Harrison Street-
No.parking anytime, except in the block immediately to the South of the
Court House where ten-hour meters would be retained.
Court .Street -
No parking anytime from Gilbert to Madison on the South side of the street.
On the North side, one-hour meters from Gilbert to the alley West of Gilbert
and five-hour meters from that point to Madison. This installation would remain
in effect until Spring of 1974 when the Burlington Street Improvement Project
will _-necessitate the use of Court as on arterial bypass.
Linn Street -
No change recommended.
Dubuque Street -
No change except the West side between Court and Harrison to be no parking
anytime. On South Dubuque between Prentiss and the railroad tracks it is reco-
mmended that nineteen (19) one-hour meters be installed to accommodate the de-
mand for controlled turnover parking 'in -this expanding commercial area.
