HomeMy WebLinkAbout1979-04-03 OrdinanceORDINANCE NO. 79-2950 ORDINANCE AMENDING SECTION 5-2(2) OF THE CODE OF ORDINANCES OF IOWA CITY TO CORRECT A TYPOGRAPH- ICAL ERROR WHICH OMITTED THE CLOSING TIME FOR ESTABLISHMENTS SERVING ALCOHOLIC LIQUOR OR BEER ON WEEKDAYS. BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA SECTION 1, PURPOSE. The purpose of this ordinance is to amend Section 5-2(2) which con- tains a typographical error which omitted the closing time for weekdays for establishments which sell alcoholic liquor or beer. SECTION 2. AMENDMENT. Section 5-2(2) is hereby amended to read as follows: Section 5-2 (2) Sell or dispense any alcoholic beverage or beer on the premises covered by the license or permit, or permit the con- sumption thereon between the hours of 2:00 a.m. and 6:00 a.m. on any weekday, and between the hours of 2:00 a.m. on Sunday and 6:00 a.m. on the following Monday, however, a holder of a Liquor Control License or Class B Beer Permit who has been granted the privilege of selling alcoholic liquor or beer on Sunday may sell or dispense such liquor or beer between the hours of noon and 10:00 P.M. on Sunday. A holder of a Class C Beer Permit as defined in Article II of this chapter may sell beer from noon until 10:00 p.m. on Sunday. SECTION 3. REPEALER. All ordinances and parts of ordinances in confl ct with the provision of this ordinance are hereby repealed. SECTION 4. SEVERABILITY. If any section, provi- sion or part of the Ordinance shall be adjudged to be invalid or unconstitutional, such ajudication shall not affect the validity of the Ordinance as (070 MICROFILMED BY JORM MICROLAB CEDAR RAPIDS -DES MOINES r`1 Ordinance No. 79-2950 Page 2 a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. SECTION 5. EFFECTIVE DATE. This Ordinance shall be to effect after its final passage, approval and Publication as required by law. Absent: Neuhauser, Roberts Second consideration Moved by Balmer, seconded by Neuhauser, that the rule requiring ordinances to be considered and voted on for passage at two Council meetings prior to the meeting at which it is to be finally passed be suspended, the second consideration and vote be waived, and the ordinance be voted upor, for final passage at this time. Ayes: Vevera, Balmer, deProsse, Erdahl, Neuhauser, Perret, Roberts. Nays: none.
