R-178 RESOLUTION AUTHORIZING THE CHAIRPERSON TO 10/9/03 EXECUTE AND THE SECRETARY TO ATTEST TO AN AGREEMENT BETWEEN THE AIRPORT COMMISSION OF THE CITY OF IOWA CITY, IOWA, AND THE CIVIL AIR PATROL (CAP) FOR OFFICE SPACE AT THE IOWA CITY MUNICIPAL AIRPORT R-179 RESOLUTION AUTHORIZING THE CHAIRPERSON TO 1/13/03 SIGN AND THE SECRETARY TO ATTEST THE FY 2005 FEDERAL AVIATION ADMINISTRATION AIRPORT IMPROVEMENT PROJECT RESOLUTION NO. 175 RESOLUTION AUTHORIZING THE CHAIRPERSON TO SIGN AND THE SECRETARY TO ATTEST AN AGREEMENT WITH IOWA REALTY COMMERCIAL TO SELL AND/OR LEASE PROPERTY IN THE AVIATION COMMERCE PARK WHEREAS, it is a goal of the Airport Commission to generate as much income as possible for the Iowa City Municipal Airport, and; WHEREAS,the Airport Commission and the City Council have worked cooperatively to develop a 17-lot commercial subdivision on Airport property, and; WHEREAS, the Airport Commission has agreed to contract with NAI Iowa Realty Commercial to lease the property known as the Aviation Commerce Park subdivision and the Iowa City City Council will consider said agreement at the Council meeting on January 7, 2003. NOW, THEREFORE, BE IT RESOLVED BY THE AIRPORT COMMISSION OF THE CITY OF IOWA CITY, IOWA, that the Commission approves the attached agreement, and authorizes the Chairperson to sign and the Secretary to attest said agreement. R-176 RESOLUTION AUTHORIZING THE CHAIRPERSON TO EXECUTE AND THE SECRETARY TO ATTEST TO AN AGREEMENT AMENDMENT BETWEEN THE AIRPORT COMMISSION OF THE CITY OF IOWA CITY, IOWA,AND JET AIR, INC. AND BETWEEN THE AIRPORT COMMISSION AND IOW AERO,INC AT THE IOWA CITY MUNICIPAL AIRPORT. WHEREAS, the Airport Commission of the City of Iowa City has negotiated an agreement for Building D and a storage area in Building H, located at the Iowa City Municipal Airport; and, WHEREAS,the Commission finds the proposed amendment to be proper and in the best interest of the Iowa City Municipal Airport; and, WHEREAS, if the amendment to the FRO Agreement is approved, the Hangar Lease, dated October 1, 2001, between the Commission and IOW Aero, Inc.will be terminated. NOW, THEREFORE, BE IT RESOLVED BY THE AIRPORT COMMISSION OF THE CITY OF IOWA CITY: That the Chairperson is directed and authorized to execute and the Secretary to attest to the attached agreement between the Airport Commission, Jet Air, Inc and IOW Aero, Inc. JAL' Approved by C IRPER�SONcr-Cki, ATTEST: 'r Oy chi �2� O - I0 ' a] SECRETARY City Attorneys Office AMENDMENT TO FBO LEASE AND TERMINATION OF IOW HANGAR LEASE This amendment to the Fixed Base Operator's Agreement is entered into between the Iowa City Airport Commission ("Commission") and Jet Air, Inc. ('JA") and the termination of the IOW Building D hangar lease is entered into between IOW Aero, Inc. ("IOW") and the Iowa City Airport Commission. WHEREAS, the Commission and JA previously executed a FBO agreement on November 1, 2001, with the agreement term from January 1, 2002 through December 31, 2006; and, WHEREAS, the parties wish to amend the agreement by adding subparagraphs f. and g., as stated below, to paragraph - 2. Rent ; and, WHEREAS, if this amendment is added to the FBO Agreement, the Hangar Lease for Building D, dated October 25, 2001, between the Commission and IOW will be terminated; and, WHEREAS, Paragraph 14 of the agreement between the Commission and JA provides that the parties may modify the agreement if both parties agree in writing; and WHEREAS, Paragraph 17 of the lease between the Commission and IOW provides that the parties may abandon the lease if both parties agree in writing. IT IS THEREFORE AGREED among the Airport Commission, Jet Air, Inc. and IOW Aero that: (A) Paragraph 2 of the FBO Agreement between the Commission and JA be amended to add the following language: 2. Rent f. Building D, the north 100' by 50' of the building. Utilities for the leased space to be the responsibility of JA. The rent is$ 500 per month until December 31, 2006 and will be subject to the same terms and conditions as the other leased areas in the FBO agreement. g. Building H, the north truck bay storage area. Utilities for the leased space to be the responsibility of JA. WHEREAS,the Airport Commission of the City of Iowa City has negotiated a lease agreement for Corporate Hangar No. 32, Building G, located at the Iowa City Municipal Airport; and, WHEREAS, the Commission finds the proposed lease to be proper and in the best interest of the Iowa City Municipal Airport; and, WHEREAS,the term of the lease shall be from October 1, 2003, through September 30, 2005. NOW, THEREFORE, BE IT RESOLVED BY THE AIRPORT COMMISSION OF THE CITY OF IOWA CITY: 1. That the proposed hangar lease for Corporate Hangar No. 32, is hereby approved. 2. R-179 RESOLUTION AUTHORIZING THE CHAIRPERSON TO SIGN AND THE SECRETARY TO ATTEST THE FY 2005 FEDERAL AVIATION ADMINISTRATION AIRPORT IMPROVEMENT PROGRAM Whereas, because it the responsibility of the Iowa City Airport Commission of the City of Iowa City to preserve and improve the facilities at the Airport; and, Whereas, the Airport Commission has jurisdiction to enter into grant agreements with the Iowa Department of Transportation and the Federal Aviation Administration; and, Whereas, a current three-year Airport Capital Improvement Plan must be on file with the Iowa Department of Transportation and the Federal Aviation Administration to apply for funding. NOW, THEREFORE, BE IT RESOLVED BY THE AIRPORT COMMISSION OF THE CITY OF IOWA CITY, IOWA, that the Chairperson is hereby authorized to sign and the Secretary to attest to the Federal Aviation Administration FY 2005 Airport Capital Improvement Plan.
