I am submitting more information per our conversation. I just want to bring up again that I could not type in the
"what I knew about the board" box when I had "background information" box filled in... I thought it was an
either-or-option. I was running a Mac product so maybe that screwed it up. My knowledge is as follows:
The BOA members are public citizens who are appointed by city council to represent their communities. The
board consists of five members who rotate with staggered 5-year terms. Staggering the terms limits the
degradation of experience within the board. Iowa State Code 414.12 outlines the duties of BOA and states what
responsibilities it holds within the municipality.
Within these responsibilities the board holds the power of appeal of a city council issue. Usually this is a very
contentious issue that city council has already voted on. Remember that the decision of appeal must conform to
the provisions stated within law. Special exemptions or sometimes referenced as conditional use permits, and
the appeals of administrative bodies are the most common. My job would be to apply the law equally to all
parties involved.

Furthermore, the BOA have the power of appeal. The Boar may reverse or affirm, modify the order, or make a
new order that originally should have been made. Each member has the power of an officer of government.
BUT, for approval the board needs a concurring vote of the majority of the board. In this case three of the five
must decide together.
Common problems must be linked to flawed government. City Council must know about loopholes or other
erred laws. Intergovernmental relations must pre-sent a united front. At no time should differing judgments be
evaluated on an extended timeline.
For building issues, it compares/contrasts what the request for change is (as defined) within the neighborhood
that has been sought in the request. It considers developers/owners desires and the compares that with the city
code to come up with a (possible) variance that allow for small alterations to building design and use (IF
allowable by law). The board looks for cues in contextual features and compares the request against the scope
size, matching architecture, and other compatible visual cues from the surrounding properties. Sensitive areas,
pop. density, stormwater retention/detention, other building bylaws come into play in assessing whether or not it
could be an allowable use. Variances are approved or disapproved after careful consideration.
As a BOA member is to look at Iowa City's comprehensive plan in order to balance what city council has
disapproved and the land owner's grievance. If grievance have been found substantial, then further revision can
be ordered. If the law has been applied unfairly the board has the power to overturn the previous decision.
Regulations and Restrictions should be looked at from a quasi-judicial stance. All meetings should be
maintained as public. ALL DECISIONS should be nested within law.
Special Uses are decided within the BOA. Variances can be recommended to the City Council.
As a member of the board we must remember that we are a quasi-judicial board in which must take up appeals
from other municipality level of government in which "error" ar the "perception of error"has occurred by the
aggrieved.
Powers of the Board of Adjustment:
1.Decide Appeals on which a case of perceived error has occurred by a public or administrative official.
2. To decide special exceptions in which must be read within the ordinance in which it is based.
3. In specific cases an appeal is made based upon variance to which the needs of the community must be
assessed evenly. "Literal enforcement" of"undue hardship"be reassessed and the spirit of the ordinance be
carried out so legal precedent not be set.
I hope this helps in my application process. I consider the Board of Adjustment an honor bestowed on me by the
citizens of Iowa City. I will use that inspiration to interpret cases that make it to the board of adjustment.
