Village Green, Part 10 Date: May 3, 1979 GENERAL INFORMATION Applicant: Requested action: Purpose: Location: Size: Existing land use and zoning: Surrounding land use and zoning: Comprehensive plan: Applicable regulations: 45 -day limitation period: 60 -day limitation period: SPECIAL INFORMATION Public utilities: Iowa City Development Company 2009 Ridgeway Iowa City, Iowa 52240 Approval of a final plat To develop 32 single family lots Southwest of Village Road extended southerly (see location map) Approximately 9.65 acres Undeveloped and RIB North - single family and RIB East - undeveloped and RIB South - undeveloped and RIB West - single family and RIB Area designated for a density of 2 to 8 dwelling units per acre Provisions of the subdivision code and the storm water management ordinance 6/3/79 6/18/79 Because the Lower Muscatine Road sewer has limited capacity, the applicant has proposed temporary detention of sewage during periods of substantial rainfall (infiltration) as a method of utilizing the available capacity of sewer without aggravating wet weather flow conditions. The City has agreed to test the applicant's proposal by allowing limited residential development in the Village Green area. Adequate water service is available. MICROFILMED BY JORM MICROLAB CEDAR RAPIDS•DES I90INES cw5 r) 2 '1 Public services: Sanitation service is available, as well as police and fire protection. The Robert Lucas Elementary School would serve this area. Transportation: Vehicular access is from Village Road. Physical characteristics: The topography is flat to gently sloping (0-5%). ANALYSIS The subject development is proposed within an area having wet soil conditions. The Soil Conservation Service has classified these soils as having moderate to severe limitations for development. As a method for overcoming the wet conditions, the staff recommends that no basements be allowed or, if allowed, storm systems for sump pump drainage be required. If the latter alternative is chosen, then, it is necessary that additional construction plans for the storm system be submitted and approved by the Engineering Division. In Village Green, Part 2, the applicant agreed not to construct basements and chose to control this via restrictive covenants which were approved by the City. The approved preliminary plat was of 69 single family lots to be developed on four cul-de-sacs. The final plat is of a portion of the approved preliminary and is in substantial compliance with the preliminary plat of that area. i RECOMMENDATION The staff recommends that action on the final plat be deferred. Upon revision of the legal papers in conjunction with the concerns mentioned above and revision of the plat correcting the deficiencies and discrepancies noted below, it is the staff's recommendation that the final plat be approved. DEFICIENCIES AND DISCREPANCIES 1. The legal papers are not in order and should be revised. 2. A flowage easement between lots 105 and 106, Village Green Part 2, should be provided in order to accomodate storm water flow from Village Green Part 10.
