This letter has been referred to the City Manager for reply. END OF CONSENT CALENDAR. Item No. 3 - PLANNING AND ZONING MATTERS. a. Consider Ordinance Amending Zoning Ordinance 2238 by Changing _ Use Regulations of Certain Property From Al to RIB Zone (area .1 % IJ C' located east of Mormon Trek Blvd. and south of City limits in the County, requested by Ty'n Cae, Inc.) (first considera- tion) Action: Comment: The City Clerk has received approval from the City Development Board for annexation of this territory. Pre- viously Council had given two considerations of an ordinance annexing this property. However the legal description on the ordinance was incorrect. A copy of the ordinance re- vised to show the correct legal description is attached to the ngenda. If Council wishes, it may give the two consider- ations and adopt the ordinance at the May 22, 1979, meeting. A public hearing on this annexation was held January 9, 1979. The legal staff advises that it is not necessary to hold another public hearing. Page 3 Item No. 4 - PUBLIC DISCUSSION. Item No. 5 - PUBLIC HEARING TO RECEIVE CITIZENS COMMENTS REGARDING THE CITY'S HOUSING ASSISTANCE. PLAN TO BE SUBMITTED AS PART OF THE CITY'S SMALL CITIES COMPREHENSIVE GRANT APPLICATION. Comment: The City is required by HUD to hold two public hearings before submitting its full Small Cities application. This public hear- ing is being held to obtain citizen comment on the City's Hous- ing Assistance Plan. A second public hearing will be held on May 29, 1979, on the full application. Comment: This resolution would npprove the plans for which you held a public hearing several weeks ago and authorize the Clerk to advertise for bids. At this time, the following schedule is being proposed: I. Authorize bids - May 22, 1979. 2. Veenstra 6 Kimm publish ad for bids nationally May 25, 1979. (30 day criteria - EPA requirement). 3. Action: Item No. 11 - IRR q Comment: Action: Item No. 12 - ciIa Comment: Action: CONSIDER RESOLUTION ESTABLISHING JUST COMPENSATION FOR ACQUISITION OF RIGHT-OF-WAY FOR THE SOUTH GILBERT STREET PROJECT. The City has received appraisals for the South Gilbert Street Project, and the IDOT staff appraiser has reviewed the appraisals. This resolution establishes just compensation in accordance with the appraisals for five of the parcels. The staff recommends adoption of the resolution. CONSIDER RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN AMENDED AGREEMENT WITH MR. BILL MIHALOPOULAS OF BEST STEAK HOUSE REGARDING CONSTRUCTION AND MAINTENANCE OF SIDEWALK VAULTS. Resolution No. 79-158 authorized an agreement with Mr. Mihalopoulos for the construction and maintenance of sidewalk vaults. This agreement is identical with the exception that the amount of in- surance coverage has been reduced from $500,000 to $300,000. /0 1 r . EXEcuTION OF ACREEMENT CLARIFYING CONTRACTUAL REMF.DIE.g WNCERNING AN URBAN RENEWAL CONTRACT BETWEEN THE CITY ANO OLD CAPITOL ASSOCIATES DATED FEBRUARY 7, 1978, Comment: This amendment to the contract between Old Capitol and the City for blocks 83 and 84 clarifies the City's remedies should Old Capitol default after taking title to the property. Comment: This supplement includes all ordinances of a general and permanent nature adopted between August 9, 1977, and December 5, 1978. The supplement is quite large, but for the most part represents material that will be substituted for already existing material in the present Code. Supplement number two beginning with ordin- ances passed subsequent to December 5, 1978, will be in prepara- tion shortly.
