for Wetherby Park. A recommendation from the Director
of Parks and Recreation is enclosed. The City Manager
will, reply after the Council. discusses the matter.
(5) Letter from Mr. Frederick V. Hendershot regarding a
drainage problem in the Ridge Road area.
Comment: The street drainage crosses Mr. Hendershot's
property which is ten feet wide. There has been some
erosion on the property. The matter has been discussed
i with the City staff. In our opinion, this is a natural
drainage way and it has existed for over 20 years. There-
fore, the staff believes that the City h,,s no liability
in this matter. Last year the City did offer to rip rap.
This offer was rejected by an adjacent property owner.
The City Manager will. respond accordingly. S.
(6) Letter from Frank .1. Longo regarding the Iowa City Kickers
Soccer Club. This letter has been referred to the City
Manager for reply.

Item No: 4 - PLANNING AND ZONING MATTERS.
a. Consider a recommendation approving the preliminary and final
Large Scale Non -Residential. Development Plan of HyVee Food
Stores, Inc. 5-7912.
Comment: The Planning and Zoning Commission at a regular
meeting held May 17, 1979'recommended (6-0) approval of the
subject development plan located on the northwest corner of
the intersection of N. Dodge Street and Old Dubuque Road sub-
ject to (1) the legal papers being in order and (2) the re-
visions requested by the Department of Transportation on the
preliminary and final plan be incorporated prior to Council
approval. This recommendation is consistent with the staff
recommendation presented in a staff report dated May 17, 1979,
which is attached to this agenda. A resolution for consider-
ation of the item will be presented at the next meeting pend-
ing resolution of the contingencies noted above.

Comment: The Planning nod Zoning Commission at a regular
meeting held May 17, 1979, recommended (6-0) approval of
amendments to the sign requirements for the M1 zone subject
to the definition of Front Wall being changed to correspond
with the definition as presented in a May 17 memorandum from
Don Schmeiser, and that line 3 in the section entitled GENERAL
REQUIREMENTS should begin "Section B.l.a

DEVELOPMENT BLOCK GRANT/SMALL, CITIES PROGRAM FOR IMPROVEMENTS IN
THE LOWER RALSTON CREEK NF.ICHBORITOOD,
Comment: An application proposal asking $2,000,000 over a three year period,
of which this year's request is $530,000, has been prepared. This
public hearing provides an opportunity for citizens to voice recom-
mendations and options on this proposal. Final Council action is
necessary during the June 5th meeting to ensure compliance with
the federally mandated June 11 deadline. Additional information
is provided with the packet.

Comment: This resolution approves an indemnification agreement with Old
I Capitol Associates in connection with the closing on Blocks 83
and 84 scheduled to take place on May 30, 1979. The City Attorney
recommends approval of this resolution.

Item No. I4 - CONSIDER RESOLUTION AUTHORIZING THE MAYOR TO SIGN THE AGREEMENT
BETWEEN THE CITY OF I014A CITY AND THE IOWA DEPARTMENT OF TRANS-
PORTATION REGARDING OWNERSHIP, OPERATION AND MAINTENANCE OF THE
STREET LIGHTING SYSTEM AT THE INTERSTATE. 80 AND DUBUQUE STREET
INTERCHANGE.
Comment: The agreement would transfer ownership of the lighting system at
the above referenced interchange from the City of Iowa City to
the Iowa Department of Transportation. It also indicates that
the Iowa DOT will be responsible for all maintenance and energy
costs of this system from July 1, 1978 on. Additionally, it also
stipulates that the Iowa DOT will be responsible for the system's
operation and may, at its choosing, extinguish portions of the
system as it finds necessary. It is recommended by Public Works
that the resolution be passed and the City enter into this agree-

Comment:
This resolution would authorize the Mayor to execute contract in
the amount of $19,293.15 to Rick Co., Inc., from Toledo, Iowa.
Only one bid was received, but it was approximately 15% below the
estimate of $22,782. Staff recommends award.

Comment:
This resolution is intended to clarify the method of computing
and refunding plan -check fees as part of the building permit pro-

The Public Works Department desires to change the name of Grant -
wood Drive to Grantwood Street from California Avenue to Hollywood
Boulevard. This street name change is necessary to eliminate
conflicts with address numbers between the north -south portion
and the east -west portion of Grantwood Drive. Existing house
numbers would remain the same; only the designation from Drive
to Street would change. This change will affect seven existing
homes and all vacant lots lying within Mount Prospect Addition,
Part III, that front on Grantwood Drive.
