Dear Council Members:
I am writing to express my views on the funding of the correction of
the drainage problems in the Bryn Mawr Heights/Penny Bryn subdivisions.
It is my understanding from Mr. Dietz that special assessments on the
property in the immediate area is being considered as the means of funding
the work required to correct the problem. Since these subdivions were
laid out by the developer and formally approved by the City of Iowa City,
the engineering mistakes that were made are a joint responsibility of the
parties involved in the planning and subsequent approval.
It is unthinkable that a group of residents who in good faith purchased
property in an approved subdivision should have an assessment against
that property to correct the mistakes of the developer and the responsible
city officials. In fact, I have been under the impression that the city
imposes taxes upon its citiaens to provide a variety of services, some of
which supposedly protect them from problems such as the one under discussion.
When this protection fails because of poor judgment on the part of a City
Engineer and his staff, it is unreasonable to propose that the affected
group suffer even more by paying for the correction of mistakes that they
had no knowledge of or responsibility for.

inadequate storm water sewage in this area as a project to be funded by
the City of Iowa City in reparation for the mistakes made by the responsible
city officials.

Dear Mr. DeRaad:
At its regular meeting of May 29, 1979, the City Council received and
placed on file your letter regarding drainage problems in the Bryn Mawr
Heights/Penny Bryn subdivisions. In response to this letter I am enclos-
ing a copy of a memorandum for your review. This brief report was
prepared by the City Engineer subsequent to a meeting held with the
residents of the area at Ernest Horn School.
At an informal session on May 21, the City Council determined not to
initiate a special assessment process in the area, directed the City
Engineer to work with individual property owners, and requested that the
City staff develop a lot and block grading ordinance to minimize the
possibility that this type of situation will occur in the future.

Dear Honorable Mayor & City Council:
Recently I obtained a small business loan from the First
National Bank to package and market a record album in the
local Iowa City area. Because of limited funding, I opted
for small posters to advertise my product looking forward
to dispensing them to individuals in the downtown area.
Upon reading the city ordinance on handbills, I discovered
that one could not dispense handbills on the street. I
feel this ordinance is too restrictive and will appreciate
your consideration in making an amendment.
I can understand litter being a problem and can guarantee
the city no litter would be found from my operation. Small
business has enough difficulty making a go of it without
further unfair restrictions placed upon them by laws and
ordinances. Your consideration in amending this ordinance
will be appreciated.

The Traffic Engineering Division has investigated your request for a
street light.

It meets the criteria of installing a light at mid -block as the block is

over 600 feet in length.
The Traffic Engineering Division will now do a postcard survey of all
residents affected by the
street light. We realize you submitted a
petition on this light; however, we have frequently found that residents
object strongly to a street light if it is going to be placed in front
- _
of their property. In addition, often times residents will sign a
petition even though they disagree with the petition.
Iowa -Illinois Gas and Electric Company does not have any easements in
this area to bring in a service line and they will be working with
property owners in the area to obtain an easement for the service line.
If there are any hitches in the process outlined above, we will notify
you of developments.

We, the undersigned, would like to see a narking G
lot installed in Pietherby Park, at the south end of
Taylor Drive; and one large enough to accommodate
all it's users. n r
It seems to us that the City Parks Dept. has
gotten the cart before the horse in the development
of Wetherby Park. The council or city certainly
wouldn't allow a business to be built without parking
thgt would handle proposed traffic, nor would the
council or city allow a sub -developer to first build
all of the houses in a sub -development, and then, 1-2
years later, decide to install the paving. Well,
this is'exactly what the City Parks Dept. has done.
They have developed a park which can be and is used
by hundreds of people every day, but yet have provided
no parking. On many occasions cars line both side of
Taylor Drive and Burns, 2 and 3 blocks each way from
the',park. This creates both an access and a safety
problem for both area residents and park users.

I an writing to you on behalf of the Iowa City Kickers, a nonprofit,
incorporated organization dedicated to providing the youth of Iowa City
with a quality soccer program. My letter has two purposes: (1) To introduce
our organization to you and to tell you something about our program, and (2)
to thank you for the services the City Parks and Recreation Department has
provided us.
Three years ago the Iowa City Kickers Soccer Club was started with an
enrollment of 20 boys. Despite our efforts to "develop slowly" we have more
than doubled our enrollment each year. Currently, we have approximately
230 girls and boys, ranging in age from 7 to 15 years on 14 soccer teams.
At our current rate of growth we expect about 500 children to be participating
in our program by 1981. We have been playing on week -ends this spring at
Wetherby Park, Willow Creel: Park and the University of Iowa Recreation Field.
This Sunday (May 27), starting at 1 PI1, our eight year old players will be hav-
ing a tournament at Willow Creel: Park. In order that you may obtain first
hand knowledge of our organization and the interest and growth of soccer in
Iowa City I invite you to attend our tournament.
The spectacular growth of soccer in Iowa City has created a need for
playing fields which the City Parks and Recreation Department has provided.
On behalf of the Iowa City Kickers I thank Mr. Dennis Showalter and his
staff for their cooperation, time, and services. Their efforts have eased
our "growing pains" and have provided the youth of our city with excellent
areas to play soccer.

effort should be taken to ensure that this proposal is designed to blend in with

which identify some of the concerns expressed by the neighbors. The staff
recommends that the neighbors concerns be taken into consideration before the
LSNRD plan is approved.
The planned commercial (PC) zone allows only those uses (principal and
accessory) as permitted in the C1 zone. Regarding the design and height of the
entrance sign, the C1 zone does not allow a freestanding sign as proposed. In
lieu of a freestanding sign, the applicant could erect a monument sign.
The Traffic Engineer has reviewed the subject plan and has found it to be
acceptable.
The applicant is requesting that the parking and planting plans for the subject
development be approved as an "innovative parking area design plan" (see
attached letter).
RECOMMENDATION
The staff recommends that the preliminary and final large scale non-residential
development plan be deferred. Upon revision of the
lanconcerns mentioned above and correcting the deficiencies andodiscrepancthe

noted below, the staff recommends that the preliminary and final LSNRD plan be
approved.
DEFICIENCIES AND DISCREPANCIES
1. The signatures of the utility companies and the registered land surveyor
should be provided.
2. The legal papers are not in order and should be revised.
3. A note should be added to both the preliminary and the final LSNRD plan as
i to the type of screening to be provided along the north property line of
the subject development.

4. A raised median with curb drops for a sidewalk should be provided in the
entrance drive off N. Dodge Street.
5. The Fire Chief recommends that an additional fire hydrant be placed near
the front entrance of the subject stores. Further, he recommends that a
minimum water flowage of 4,000 gallons per minute to the site be provided
because the 6" water main now proposed is inadequate. The plan should be
revised to incorporate the Fire Chief's comments.
6. The building should be fully dimensioned.
7. The tree islands should be fully dimensioned.
8. The tree planting plan does not meet the requirements of the Tree
Regulations.
9. A signature block for the City Clerk's signature should be provided on the
tree planting plan.

Re: Proposed Hy -Vee Store on N. Dodge Street
On March 6, 1979, Doug Boothroy and myself met with Larry Schnittjer,
designer for Hy -Vee, and Jim Seeks and Bob Satter, residents of the
area, to discuss the design characteristics of the new Hy -Vee store. It
was indicated that the residents are very much concerned about the
signage, lighting and architectural style of the building proposed.
Larry Snittjer will obtain from -Hy -Vee Food Stores, Inc. the specifica-
tions for the above. It was also agreed that a solid fence to be
located along the north side of the property, would consist of redwood
construction and be integrated with plantings its full length. In ad-
dition, the redwood fence would be stopped approximately 100 feet short of
Old Dubuque Road and a tight planting screen would be constructed in
that 100 foot distance. Other considerations are for a landscaped area
to be provided at the southwest corner of the site and that access be
provided from the Hy -Vee property to the property to the west. Finally,
the tree islands at the corners of the building would be widened out to
provide more green area.

Doug Boothroy and I met with Steve Victor, Larry Schnittjer, Bill Ger-
hard, Jim Seeks, and Toni Frei on April 6 to review the plans for the
proposed Hy -Vee Food Store on N. Dodge Street and N. Dubuque Road. At
this meeting the group discussed the various elements of the plan in-
cluding landscaping, lighting, signage, architectural style of the
building, screening, and color schemes. Concerns expressed by the
neighbors included the following:
1. The high style of lighting (30 feet high). The neighbors felt that
the lighting might be too high and too intense for this project.
2. Color, design and height of the entrance sign. The neighbors would
like to see a lower sign (more on the scale of a monument sign) and
a color and design which reflected the design of the building.
3. The color of the building (ocher). Neighbors would rather see a
color which is less dominate and is more of an earth tone color.
4. Screening along the west side of the property. One neighbor
indicated a desire for the planting of evergreen trees along the
west side of the property to screen the use from the residential
area to the west.
5. Screening of the parking area in front. Neighbors expressed the
desire for low evergreen shrubbery at various heights to be planted
along the front property line to soften the parking area.
6. The color of the light poles (white). Neighbors expressed a
desire that the light poles be in a dark earth tone color.

Dear Mr. 5chmoisor:
On behalf of the Developer, we are respectfully requesting that the parking
rind planting plane for the above referenced project be reviewed under the
provisions of 0.10.40.11 0(7) as an "Innovative Parking Area Design".
The plans as prepared meet the requirements of the "Revised Tree Ordinance",
which has not been formally approved.
Large shade trees and large tree islands are shown within and along the
perimeter of the parking lot. Small tree islands with ornamental trees and
intermediate sized shade trees separate parking aisles from drives. Orna—
mantel trees and shrubs and intermediate sized shade trees are to be planted
along the rights of ways.
The Developers have elected to use a planting screen instead of the combina—
tion of planting screen and fence as earlier presented.
If you have any questions regarding this, please contact our office accord—
ingly.
